I was involved in an accident where I was completely at fault. I was pulling out of a parking lot and only looked right and not left and right due to overconfidence. I ended hitting a box truck where thankfully nobody was injured. But the financial impact and the emotional trauma from my carelessness will haunt me forever. It’s tough recovering from the whole situation because I feel like a horrible person now. I’m 22 years old now and I really don’t know what will happen in the next 50 years or so.
I was at Same scenenario like you.. because I daily take my car out side from curbside, where on that my car was in between two cars, where I was trying pull my car outside carefully so that it would not hit the car infront, unfortunately my car got hit by Another Toyota Tocoma pickup 🛻 truck and this happened as on 09/22/2022. I was with Geico insurance where my monthly insurance raised from $128 to $301. Now I moved to progressive, now I’m paying $126/month on average, which excludes Rental reimbursement feature.. Trust me if you had accident forgiveness feature, trust me you would have got saved. again not all insurances companies offer that “Accident Forgiveness” feature. It depends from state to state again. I think “Nationwide” provides that accident forgiveness feature..

I got into my first accident today. I was turning left on a green light when there was a gaping traffic, when a truck came and smashed my taillight. I believe the other party was speeding but said nothing when talking to the cops. I overhead some witness talking to the cops saying they thought "she was going a bit fast". I was curious if I had and chance to get out of a failure to yield on a left turn ticket in that situation. Thank you for you're time in making these videos. Hi, so you were making a left and the other car was going straight and hit you in the rear end of your car? But it was not a rear end accident right? It's a toss up to me. Sounds like you were pretty far through the intersection and if the other party was speeding you may have a shot at avoiding 100% of fault for the accident at least. Hi there! Just got into my very first car accident today. I’m a 25 unmarried male, and I own a 09 Honda Civic. I was driving in Hollywood and a driver 2 cars ahead of me swerved out in front of the person in front of me, she slammed on her brakes, and unfortunately I ended up rear-ending her. We filed a claim with our insurances, no police report was filed because damage wasn’t substantial-her bumper will need to be replaced and the front of my car has a small dent. I guess my questions would be 1. How badly will this affect my insurance if I’m named the at-fault party? 2. How long will this accident last on my record in the state of California?

Insurance for me didn't go up that much--only about $5 more a month. Insurance thankfully covered the whole thing for the person I hit, but not for me. Still have the battle scar to show for this! LOL
Something that I wish I could've done in the moment was to file a police report. No matter what. If there's any piece of advice I can give you is to never openly admit to the fault of it especially if someone else caused the accident. Honestly, the person who swerved out in front of the other driver and I could've been blamed, and part of me wished I fought harder, BUT what's done is done. Just know that this happens to the best of us and that you're not alone.
I caused an accident on the highway due to passing out from a medical condition I didn’t know I had. It’s called Syncope and my blood pressure suddenly dropped outta no where which caused me to pass out. I have no memory of the accident and I’m insanely lucky to be alive. Thankfully I was the only one hurt. I’m now working with my doctors to make sure this never happens again. Prior to this I was a perfect driver. It’s tough cause there was nothing I did to cause this, my life style isn’t crazy… but I was still at fault.
just gotten my license four days ago (I’m 16 years old), and like many new drivers, I told myself, That won’t happen to me. But I promise you-be careful, because it absolutely can happen, even if you think you’re driving correctly. I was merging onto the highway, which required me to make a left turn. The light was green, so I proceeded-only to realize too late that an entire lane of oncoming traffic was headed straight toward me. Fortunately, only one car hit me, and no one was injured. However, the accident was my fault. Next to the traffic light, there was a sign that read “Yield on Green”-a sign I completely overlooked in the moment. As soon as I read it after the crash, I knew I was 100% in the wrong. Now, just a few hours later, I still don’t know what the full consequences of this accident will be. But one thing is certain-every crash teaches you something. Road signs aren’t just there for decoration; they exist to guide and protect us. Ignoring them, even unintentionally, can lead to serious consequences. I’m not proud of my mistake today, but I hope others can learn from it. I was incredibly lucky that the other car hit me at only 6-13 mph and that no one was hurt. The situation could have been much worse. If you’re a new driver, please take every sign, rule, and precaution seriously. Stay alert, stay safe, and don’t assume accidents only happen to “other people because I was thinking the same thing just a few days ago.

I was involved in an auto accident where the officer and insurance declared me at fault. Doing DoorDash with my two kids and girlfriend in the car when we went through an intersection and was t-boned ended up flipping our car over on our roof. The officer submitted a DMV re-examination and not it’s putting my driving privlegde at risk. All this ordinal has been overwhelming on my emotions giving i deal with depression to begin with. My father-in-law is letting me use one of the cars he has but i just feel like I don’t deserve it anymore. I’ve been really beating myself up over this. Hello, so two years ago i was at fault of an accident in California, the settlement for property damage was token care of and now (two years later) im being demanded 15k for bodily injuries. State farm says i have coverage for 25k property damage and 15k for each persons injuries. I no longer have this vehicle insured with them so would state farm cover this in case the suit goes trough?

Thanks for the informative Video..... i was involved in an accident few weeks back in a multistory parking lot in San Diego, CA . i was taking a right in a T intersection and got hit by a car going straight..... i am a good driver with no prior accidents and i always look carefully before merging into a lane..... this time also i saw no car in the straight lane and make a right and this car came out of no where and hit my car...... i believe the other driver was over speeding in that parking lot.......After the accident, the other driver accepted his fault and said sorry..... Hello Im glad to come across this video. I live in California and wanted to see if I can do anything as he did a malicious act. I was in an accident that was reported as my fault. I was traveling west bound on Fruitland ave. I was driving behind a AAA tow truck. We came up to a red light and proceeded to go when the light turned green. After a while I tried to pass the tow truck on the left side crossing a double yellow. As I did this the tow truck sped as I tried to get back into the right lane the tow truck driver purposley hit me on the back right side of the car causing me to spin and hit the side walk. The tow truck lost control because of his speed and hit a light pole. I wanted to see if I had some kind of case considering he did this with malice and hit my car .
My dad was in an incident a month ago. He was driving on a straight lane and then he stopped to see if it was clear to continue around the roundabout. The car he was to give way to was a good distance away. So he decided to carry on driving. However, once he started driving that same car came out of nowhere and crushed the side of his Jeep, leading to the left side of his door handles being broken and a large dent left in the center. Thank God my dad and the other driver wasn't physically injured. The driver was a woman who seemed like she was unstable and her personality was really horrible. I believe she was speeding since her vehicle wasn't near the intersection of the roundabout. This week my father got a bill in the mail from her insurance company demanding that he pay 10,000 for the damages of her car. It's got all the photos and all. My dad doesn't understand what's going on because she was the one who hit his car and he had to fix the damages she made. My dad didn't even touch her car. On that day of the incident, the police came and she told them that my dad didn't give way to her so he was accountable. My dad doesn't have insurance or the money to pay for her car. I'm scared and really sad for him. We don't know what to do. I believe it was a false claim against him. But me and my dad have didn't take photos because we didn't know it would be that serious 😭😭😭 Please God help us 🙏🙏🙏🙏🙏
@@LawFull really? They won't take my dad to court? There's no evidence that we did those damages to her car. There's no evidence on both sides...so are we still accountable? A friend told me that the police can't get involve because it's an insurance claim. And that we can sue her for dishonesty but then again we have no proof.

Great video. Thank you so much. I have a Question, do you recommend getting a defense attorney if found at fault? No major offenses was made, i just failed to yield towards on coming traffic and accidentally caused someone to hit me. I reported the claim to my insurance and they said that we would be considered at least 90% at fault. The other guy did request an ambulance ride to the hospital so I imagine he's going to come after my insurance which is only going to cover upto 60k in damages and legal fees. Hi, well, your ins co should assign you counsel to represent you. I would ask that attorney that question. I can only speak from our experience, and that is, there has never been much reason to go after someone personally for damages because people don't usually have the assets to pay for the damages. I would not say anything further about this online. Talk to your ins co, talk to the attorney assigned to your case (if there is one) and then you'll be in a better place to make a decision.

I was stopped at a stop sign on a side street. I was planning to make a left hand turn onto the Main Street. The traffic light at the end of the street was RED. traffic coming from my left stopped to keep the lane clear. They were stopped behind the beginning of side street, with the rest of the traffic stopped on the other side(Traffic was backed up because of the red light). I saw that there was no more traffic coming from the right side of the main street so I proceeded SLOWLY to make my left hand turn passing the STOPPED TRAFFIC. As soon as I passed the stopped traffic I was hit by a car going atleast 35-40 mph WHICH I COULD NOT SEE BEHIND THE STOPPED TRAFFIC, which was headed to the red light, mind you it was RAINING. From my point of view, it looked like the car went around the stopped traffic, to try and pass them If I could add, I wouldn’t blame either one of us. I feel like there should not be a stop sign on that street! I think a STOPLIGHT would be better in that area. With traffic lined up, it was hard for me to see the other lane of traffic. There is no reason for traffic to be lined up behind an intersection for a STOP SIGN! there needs to be a stoplight there on both sides of the street. It is too dangerous
The police officer that arrived on scene after the accident gave me a ticket for Failure to yield, and said that I was at fault. I also just got off the phone with a lawyer who said the exact same. I am fully covered with Safe Auto. My car was announced as a Total Loss yesterday from the Appraiser who inspected my vehicle.

Morning - what is your ins adjuster saying I'm curious to know.... You caused an accident and your ins policy is not enough to cover the victim's damages? When I was faced with this situation, my client would normally turn to their own ins policy for coverage if there was any first. And we'd make the defendant sign a document confirming that they didn't have any assets that could be used to compensate the victim - that kind of thing.
Yesterday I was in my 1st accident and I believe I’m the one at fault. I was exiting my neighborhood hood trying to turn left and it’s a pretty busy street. I looked left first to check for cars and they were a far distance away from me so I looked to the right and no cars so I felt clear to go and let off the gas. All of a sudden a car slammed into me from the left. I feel I’m to blame because I didn’t check left before going when I should’ve. I’m only 18 though and I’m worried they’ll try to sue me for damages. They seemed ok to me though because not even a minute that I got out of my car, the other driver (he was elderly) started taking pictures of my car and that’s that he kept driving a little after hitting my car. The speed limit is 40 there but the way the impact was and how far he had to keep driving to slow down, do you think they were speeding and would that help my case? I am willing to say it’s my fault but if they were speeding could they also be at fault too?

That was very good and informative. I had a teacher who was at fault in a car accident but the person he hit didn’t bother to exchange insurance. The person he hit just decided to leave the scene. A few years later she somehow got his insurance and now he’s being sued. Do you think the victim should be charged with hit and run even though she wasn’t at fault?

Hi i was involved in a car accident, we were both in the same lane, at a distance i saw her,and then i decided i was gonna switch lanes and turned on my right blinker, i look at the rear view n shes still there n didn't have her blinker and she was still behind me. If a person is at fault 70% and the car insurance personal liability is 100,000 but the injuries of the other person received were severe which means it goes beyond that amount ...how can one protect oneself from being suit for assets like a house?

I hate my situation I got hit in my ball and mount that doesn't leave much damage to your car. Now I have a umbilical cord hernia torn ligament in my shoulder and a damaged disk in my neck. And headaches all the time and my doctors seem to dought my story. I tried not to say I was in a automobile accident.
I just had an accident back in February and caused serious injury to the other party. I filed a claim and everything seems to be going fine so far. The problem is, I know for a fact my insurance policy isn't going to cover the costs that their demand letter is asking for. It probably won't even cover the settlement amount. My dad didn't have umbrella insurance and I just recently declared my assets to my insurance attorney. So, I own 33% of a house that I cosigned with my brother and I was told that is gonna be at risk and absolute worst case, they will make me sell the house and take the portion I own. Reaching out to other attorneys right now for consultation because my insurance supposedly won't help me after the case settles. I am still waiting for more information, but it's got me seriously worried.

The driver who caused my accident didn’t handover their details and they got away with it because the police couldn’t identify them and they done a lot wrong at the time of the accident.
@@Alwaysbigger44 I agree that’s not good, in hindsight that driver attempted to extort me blaming me for the accident when their vehicle walked away with a scratch and mine ended up being written off along with me not having access to a vehicle for a few years, eventually things got settled via insurance but I think I could have got more.

Goto court for what? You got a ticket? If so thats a question for a traffic ticket attorney. I do injury stuff. But definitely you can find someone local to help you out

Hello. I just got into my first car accident. I accidentally rear ended someone and there were very minor damages to his car (slight crack on the bumper) and almost no damage to my car. I was able to give them the insurance on the car but unfortunately I was not able to get their information nor did I take pictures. Everyone in the car seemed to be perfectly fine after the accident but I'm worried they may try to milk it for more. The car I was driving was under my mom's name and she is the primary insurance holder although I'm also listed on the insurance. My mom is terrified that this may turn out with us losing our home. @@LawFull Hello again. I was just told by my insurance that because I was driving for postmates during the accident, there might be a chance my moms insurance (AAA) will not cover damages. By the way, there were three passengers and they hired an attorney and also went to the hospital for "injuries" after telling me they were perfectly fine after the accident, which is what I expected they would do. On a scale of 1-10, how bad of a situation are we in because we are both stressed out and terrified of what we may lose.

Hi, well I am not a criminal attorney so this is a bit outside my area of knowledge. However, I have had lots of injury cases and the defendant who caused the accident often receives a citation. But I dont think they have ever served jail time for a simple failure to yield ticket. Perhaps if there is an aggravating circumstance like DUI but my guess is you will have to pay a fine

Normally, if I had been the attorney on the other side, unless you had a lot of personal assets to go after, we would have just settled for the ins policy limits and that would be it. Unless there is some state law that I'm not aware of. I would recommend consulting with a local attorney regarding this matter....
Hi, I was in a car accident in 2017. I was driving on the freeway when an suv quickly switched lanes in front of me. I wasn’t able to see that the truck in front of it was stopped. When I did realize the truck was stopped I tried to move lanes also, but couldn’t. I ended up rear ending the truck. The driver of the truck also saw the suv switch lanes very fast and that I didn’t have time to avoid hitting them.(the police officer wrote that in the accident report). My car was totaled and there was damage to the other vehicle. Unfortunately my insurance was 3 days expired. I just got served a summons this past Saturday from a law firm on behalf of the other drivers insurance for $18,000. I don’t think I should pay that much since I don’t think the accident was 100% my fault. I tried to avoid it, but was unable to. What should I do?
Hi, first I'd check if they filed the lawsuit within your state's statute of limitations. Is this for property damage or injuries too? If PD only the statute is likely longer than an injury claim. Then get back to me.

Hello; I was at fault for an accident and I’m an excluded driver; the other driver is going to file a claim and I plan on doing so as well; she didn’t require medical assistance immediately and said she was fine. There were no witnesses; I do believe that she is at fault too however because the line for the turn on the highway was moving and she was not and by the time I realized that she wasn’t moving I hit my brakes and there was loose gravel on the highway; my car slid and bumped her vehicle. There are no serious injuries or even serious car damages. The worst part of the accident is part of her fender came undone but she had also let me know that while in Florida with her husband that she was involved in another accident where she wasn’t at fault but didn’t report.
thats bad luck there buddy. even when people just sit on the road because they are texting or whatever its still your fault if you hit a non-moving car. I had something like this too but she suddenly stopped and I didn't have time to stop and apparently I am at fault too.

I have my 21 years old son in my policy and he recently was involved in an accident with a motorcycle and the police report deemed my son at fault for “side swiping” the other party while changing lanes. He’s a student with just a part time job and this was his first accident. We are in the state of CA and I have a few questions: 1. My personal injury protection was unfortunately low - $50K/person/$100K per accident (I have since increased it for future accidents). What should we be concerned about? They did have to call an ambulance to take him to the hospital but he was conscious (and I pray that he makes a full recovery from this unfortunate event). 2. Am I liable for anything given that he’s on my policy and even though he was found at fault. 3. Should we look into speaking and potentially retaining a lawyer in this case?

However, I can say that in regards to hiring an attorney, your ins co would normally hire an attorney to rep you and your son if it came to that. I was at fault in a car accident about a month ago and Im lucky that since I rear ended a city bus and no one was on the bus, there were no damages 2 the bus and the driver was fine so I didn’t have 2 worry about getting sued. My insurance was really good. My car was totaled and they gave us money 2 compensate 4 the car as well as paying the towing fee and my medical expenses. Unfortunately my insurance did go up but I’m not sure how much yet 😬
Can you provide us with an update, I just got into an at fault accident on July 10, 2023 and the car has been totaled. I know our insurance will go up. I am at a total fault, this is sad.

Yesterday I got in an accident in a company owned vehicle, it was determined my fault and I was ticketed with failure to yield at a stop sign. I did yield and look both ways but the intersection is an extremely busy intersection and famously hard to turn into; many wrecks have happened there before. The oncoming road also has a curve so it’s very hard to see cars coming. Also, the other driver was cited for driving without a license and because his brakes were somehow damaged (I forgot exactly why) but do you think this would be a strong enough case to maybe fight the ticket given?

I'm the atfault driver I rear-ended a driver totalling both vehicles. My Insurance company is telling me preliminary accounts they are telling me my full coverage insurance may not cover all allegations of injuries on the party I hit any my response for any overage. Good morning. Not sure why they would use it to deny the claim. As far as how much info you have to provide. I would consult with the attorney on that. Hard for me to know. However, I can tell you that when we've done a financial affidavit, we never asked that much info just enough to verify that the defendant didn't have a lot of extra assets we could go after.....

If you were turning left and it was a t bone accident, its tough to argue they were at fault. Turn it over to your insurance company and let them run with it. Thats why you got it.

Hello Dr, I got into a car accident few days ago. I was double parked to answer a phone call. I check the mirror to see if someone was coming and didn’t see nothing . Once I tried to merge on to the lane this black Lexus came and hit my car from the side causing him to crash into me and another vehicle. I say he was going over the speed limit because if he was going at a regular speed , he would of had time to brake or just hit my car. I was at fault for a accident that happened a month ago, i was on the way to work and it’s a hour drive so I was feeling drowsy l. The accident happened at a intersection light, there was a suv in front of me and I remember putting my foot on the break slowing down but I never fully stopped and rear ended the suv. I had put my head up and closed my eyes just before this happed and after the hit we pulled over at a gas station. No one was hurt and no police were called. We exchanged information. Insurance.. etc, my front bumper and hood were damaged and their rear bumper was damaged. I get phone calls from the persons insurance about making a claim and I haven’t answered to them because I am not sure how I should go about the situation.
Hi, if you don't answer them you'll probably get sued. If it were me - just if it were me - I'd answer them and say you filed a claim with your insurance and you were not covered. They will then go after their own insurance under the uninsured motorist coverage - hopefully they have it. But this is just generally speaking. Last November on highway when I changed the lane to pass this white car, this dark car came from nowhere with the speed of 100 mph and tried to pass me, and if I didn’t move over, the dark car would have rear-ended my car and caused a ‘life and death’ terrible accident. So to avoid that, I had to move over a little bit to the right so the dark car could pass me without hitting me, and my car touched the white car on my right when I moved over. No damage to both cars. No injuries. The state trooper gave me a written warning (not a citation) right then and told me to give the info to insurance agency and company. The accident summary states that Operator #2 (which is me) was found at fault and issued a written warning. Yesterday I received Surchage notice. I thought a written warning doesn’t affect the rates. How is that possible? Any help would be appreciated. Thank you.

Hi, if you rear ended the vehicle 1. That driver will likely file with your insurance company 2. Your policy likely says something to the effect of if you are involved in an accident you are obligated to report. Some do and some dont. If you do not, it could threaten your coverage. You would have to check your policy.

I pulled into an intersection from a side street, and there were large bushes blocking my view, as I crossed, a man going (very fast, approx. 50 in a 25) collided with my car and went to the hospital and ended up blaming me. Even though he had the right of way, going 25 over approximately in a 25 seems excessive and dangerous. Is there any way I can say he was at fault in court, even though the police don't agree with me?
Morning - sure, you can try and fight it - what is your ins co saying? Depends on what your state law says - but very generally speaking - you can at least try and argue either to your ins co or in court that the other side was comparatively negligent for the accident. Look up your state law however to see what it says. I would also consult with a local attorney about this issue (again because this is really a local issue and I can't provide feedback on it specifically).

My bf rear-ended a woman who then rear-ended another woman in a bottleneck on the freeway in CA (I was not in the car so I did not witness this happen, but he was not drinking or anything; he was driving a standard and did not hit the break in time). The car he was driving was financed and he only had it for 5 months. Luckily he had gap insurance from VW so he did not owe the rest of what was due on his car. It was a total loss. The woman in front of him was also a total loss, no injuries. I saw her car in the tow yard, it was a mid-2000s Camry. Apparently the woman in front of this woman was transported to the hospital (I didn't see her car following the accident and don't know what she was driving). Anyway, it seems like Geico (bf's insurance) covered her ambulance and that portion is resolved. Now, for the cars, one of the women has AAA and the other has Mercury. These insurers have sent letters directly to my bf requesting the money for the cars (AAA wants approx. $12,000 and Mercury wants about $6,000). Their letters CLAIM they have already been in contact with Geico and that Geico will not pay more based on coverage. However, I am finding this hard to believe because we live in California, and for some reason I just have it in my mind that you are required to have high collision/liability due to the area we live in (I also have Geico for my 10 year old car and I pay over $100 a month just for it to sit in my garage -- I hardly drive anywhere but Geico doesn't care - based on my zip code and age I am "higher risk"). I'm trying not to meddle in his situation because it is stressful. I do know that he forwarded the documents he's been receiving from the other insurances to Geico, and Geico says they are in negotiations. Is it possible that my bf will have to personally pay these women/insurers the requested $18,000? He has not purchased another car following this accident and thankfully does not need one. Are there other options such as declaring bankruptcy? I am stressed about what is to come.
Hello, I would not worry about this at this point. Let the insurance company handle it. Is it possible that there is excess property damage that needs to be reimbursed? It's possible, but you don't have to just pay it Upfront. For them to really recover on that they have to file a lawsuit against your boyfriend and go to trial and win and then recover the damages. So that's a long ways off. Let your insurance company handle this right now.

But there are ways to confirm that the person doesn't have any personal assets etc. That's why i suggest you consult with a local attorney...
I was at fault in an accident august 1st 2020 and my insurance company called me today august 2nd 2023. And said that the statue of limitations has expired. But they could have filed a lawsuit. But they haven't received anything and neither have I
I wish there was more on this. I was at fault, I backed into a person leaving a driveway. The damage was minimal. Under 2,500.00 the officer said it didn't need to be reported to the DMV. I was working for a commercial company using my vehicle. My insurance company would not cover me. I agreed to pay the person and even get them a rental car. They agreed to except payment. I did this once before for a trucker who hit me and it worked out great for both of us. But in this recent situation, she has notified her insurance company. They apparently are not saying there is damage because they want me to pay. But their insurance company is calling me about a claim. I don't know what to do.
Hello, in need of help. My boyfriend was driving my car and wrecked it. He was at fault. I immediately filed the claim the next day and did everything my adjuster asked me. I gave a recorded statement, gave the police report, he as well gave a recorded statement. I was told that they may not cover my damages because he wasn’t listed as a driver on my insurance. I’m the only one who drives my car so I never thought to do such a thing. He only drove it that one time. They are currently in the process of inspecting my vehicle. I also found out that the law in TN states that a person does not have to be listed on your insurance company if they do not live in your household. I live alone. So technically speaking it’s not required to list him. I have comprehensive collision and collision coverage. Please help with legal advice.
Hi, don't just take their word for it. Ask for a certified copy of your insruance policy and tell them to show you where it says that he is not covered. If they continue with this tactic, you may have to demand arbitration. You can find out how to do that in your insurance policy....

Hello, I recently backed into a newer Toyota Rav 4 In my church parking lot (I have 2012 Ford Focus) and the victim has small damages to her back end of the car. I didn’t see her prior to backing in and I cannot confirm if she quickly pulled into the spot after me while looking into my other mirrors. I Fainted while driving, hit a tree at the side of the road while trying to get off the road realizing I was about to faint. Police came, they called ambulance, asked me questions like when was the last time I ate something, I replied the night before. The ambulance guys recommended I go to the hospital but I don't have health card. I'm a temporary resident on work permit. However, I had been doing Uber and doordash till June 3 and at that time I was with another insurance company and I didn't let the previous insurance know about Uber doordash because I thought it was not needed. And I didn't do Uber doordash after June and was with this present insurance company from July . But they asked me if previous insurance company was aware about Uber doordash and I said no . Will it affect the coverage now ? Does doing Uber doordash with previous insurance companies affect the coverage of this new one where I wasn't doing Uber doordash with this new insurance coverage?

I've heard that the new provider can drop the coverage after the claim. Especially if the at fault driver didn't report the accident.

I also wanted to ask, I was told that we would need an "at fault" lawyer to represent the accused and also maybe a bankruptcy lawyer to file a bankruptcy claim (although he's already essentially bankrupt). Is there a way to get an attorney to represent you if you have no money? I know in a criminal case you are entitled to a public defender but in a civil case, how would you go about getting a defense attorney with no money? Also, can we just call the other person's insurance company and tell them there is no car insurance? And do wrongful death cases need to be a full on courtroom case where there are witnesses and people giving testimony?

Bankruptcy I don't know a single thing about to be honest and I don't want to give you bad information. I would google 'bankruptcy lawyer near me' and ask a local attorney about it. Or research free legal aid in your area. I know here in IL we have a legal aid society. You may have one too. As far as whether you can call the other ins co and tell them you don't have ins. . . I don't know why you couldn't do that. Finally, I have no idea what your local rules are regarding any kind of personal injury trials but very generally speaking, a personal injury case will usually involve a jury and testimony etc etc.
Just got in a really bad accident today. Supposedly a blue car maybe 5 cars ahead in a 2 lane highway had mechanical failures and bounced back and forth twice from the barrier to the guard rail. I was in the fast lane and even with enough distance the roads were wet and my heavy truck just slid right into the back of the car in front of me. I don’t know if I at fault or partially or maybe it’s on the blue car. I was the last one in the line for lane so no one hit me from behind. But I’m the least bit happy since I just bought the truck and haven’t even paid my first payment on it yet. I’m replaying it in my head but there was no way to avoid hitting the car in front of me. I just wish I left the house 5 minutes late or earlier to avoid the whole situation
Really sorry you're dealing with this. But my guess, and it's just a guess, is that you're probably going to be found to be at least partly at fault for the accident. What is the ins co saying?

I was hit twice and I contacted the police. One on the rear right then after rear ended. The other driver took off after exchanging info. The police arrived and I gave my statement. I’d contacted my insurance they told me to contact the other driver’s insurance since he had hit me. Shortly after I’d hired an attorney. The police report came back saying that I was at fault. Now my attorney doesn’t want to pursue it. I’m just baffled as to why. Any advice??
Hi, you were rear ended? Odd to be placed at fault unless you cut someone off and then got hit. If you have collision coverage your insurance company should cover it.
LawFull what had happened was I signaled and checked my side mirror and through my windows, as usual, to get into the right lane. The other driver was about two car lengths behind on the lane in getting into. As I proceeded, I hear an engine revving and seconds later I was hit on my right rear quarter panel. The guy definitely raced to not let me over. Cause there is no way he could’ve caught up to me doing speed limit. After the initial hit I’d proceeded to pull over to get out of the way of other vehicles. And seconds after he plowed into the rear of my car.
LawFull I did suffer injuries. Still in pain. When the officer arrived I gave a statement. I’d told him the other other seemed drunk because he was acting funny and slurring his words. He then asked to see a picture of the other driver. Soon after the police started making excuses for him. Then I get the police report and the officer said that I was at fault. And on the report he determined that the other driver wasn’t intoxicated by contacting via phone. It doesn’t say the timeframe after the accident that he was contacted. Seems fishy to me. As if the officer knows the other driver. Now, since officer reported such, the attorney is insisting that I don’t pursue it and had me stop seeing the chiropractor. The accident happened on June 26, 2019.
hi, i had my first accident last week. i was placed at fault since i was turning left out of a plaza and couldnt see oncoming traffic. there was a person in the turn lane and we collided. i have insurance, but since i was doing uber eats at the time theyre telling me my insurance wont cover anything due to material misrepresentation. do you have tips? im working on trying to get in contact with a defense lawyer but i dont really know what im doing :( there were no bodily injuries and airbags werent even deployed.
Hi - don't just take their word for it - make them show you where in your policy their denial is based upon. And look into appealing any decision against you. Just don't delay.

Hi, I'm not entirely sure what you're asking. Video is evidence and can help prove who was at fault for the accident. The police and the court will look at it (at least theoretically) and it can help make a determination regarding fault.
If the ask for 40 thousand and your coverage is 40 thousand and the insurance is willing to pay that, does that mean they can’t come back and sue you personally for more, even if you have a good job where they could garnish your wages? Thanks.
Morning - not entirely sure I understand. But very generally speaking, if the victim settles with the ins co, that means they are settling with you too. And as such, there wouldn't be any remaining liability on your part. Though I would consult with a local attorney to confirm what the rules are in your jurisdiction.
I was in a car accident the other day and i was driving on my way to school and there was traffic. When the traffic cleared up the lady in front of me started to accelerate and I did as well but she then slammed on her brakes and came to a dead stop because there were more cars in front of her . I then slammed on my brakes but still hit her and then I got hit in the back aswell. My car was totaled but her bumper was the only thing damaged. The ambulance came and checked her out but she was fine . I asked her if she was ok and she said yes but her head hurt a little. She is now filing for a lawsuit against me and my insurance only covers $10,000. I do believe she was distracted because of she braked so sudden. Is there anything I can do to defend myself ??? You just need to turn it over to your insurance company and let them handle it. Nothing more you can do to be honest. If the first event that happened was you rear ending her, you're likely going to be found at fault unfortunately. This is the very reason you have insurance. Accidents happen...
My case is complicated. I was driving a rental car from Enterprise. I have a damage waiver on the car, but its not technically insurance. It just means enterprise could fix their car. The cop at the scene said I was at fault, but I'll dispute that. I was merging left into a lane from a parked position. I was about a third to half way into the lane when another car struck me. Their car flipped onto its side. My car had minor (dent) damage near the door hinge on the front driver side door. Her car flipped, had damage to front of the vehicle, and her front right light came loose. The right side of her car was the side that wasn't touching the ground in its flipped position. This means she hit me with the front of her car and should have had enough time to see me as i was already pretty far into the lane. Keep in mind that there was no damage to the front of my car so I did not hit her with the front of my vehicle. The fact that she hit the side door means that she should have seen me in the lane. The speed limit was about 25 miles per hour and I was pulling out into the lane at a slow enough speed but not too slow. Maybe 5-10 miles per hour from start. I did check mirrors and thought I was clear but before I knew it I was hit as i looked forward.. Her husband arrived on the scene and said " she must have been speeding" even though I can't prove that. And she even mentioned jerking her wheel in panic from the initial collision. As such, its not so cut and dry who was at fault though I know the courts generally side with the non-merging vehicle. Anyways, I'm dirt poor and have no assets. I don't have personal insurance, although I do have a car. My car has been broken down for a while, which was why I was using the enterprise car. My car is also a piece of junk and probably wouldn't even sell for 500 bucks at this point. I'm too poor to justify paying for car insurance at this time when I can't even drive my car. I am also self employed. What are the odds that I get sued even though I don't have insurance, a garnishable job, or any assets? And do I have a case in contesting any at fault verdict even though the cop said that I was?
Morning - well, if I was the personal injury attorney representing the other party, I would think there was little chance of recovering against you personally and as such, would go after their client's UM coverage only... Not much point in going after someone with zero assets.

I caused an accident, I was merging into a lane person in front of me started breaking and I didn’t notice so I rear ended them. Hi I'm not sure I understand the fact pattern. However, very generally speaking, you would not sue the ins co. You would file a claim with them to get compensated for your damages. If after going through that process, you couldn't obtain compensation, at that point you would then, again very generally speaking, file a lawsuit against the driver of the other vehicle and/or the company he/she was driving for. I was being irresponsible and crashed into a building on a deep turn in Monroe Louisiana. Car is totaled and the front of the building is messed up, what can I expect goin forward. How bad did i mess up.
I was involved in an accident where I was completely at fault. I was pulling out of a parking lot and only looked right and not left and right due to overconfidence. I ended hitting a box truck where thankfully nobody was injured. But the financial impact and the emotional trauma from my carelessness will haunt me forever. It’s tough recovering from the whole situation because I feel like a horrible person now. I’m 22 years old now and I really don’t know what will happen in the next 50 years or so.

I was at Same scenenario like you.. because I daily take my car out side from curbside, where on that my car was in between two cars, where I was trying pull my car outside carefully so that it would not hit the car infront, unfortunately my car got hit by Another Toyota Tocoma pickup 🛻 truck and this happened as on 09/22/2022. I was with Geico insurance where my monthly insurance raised from $128 to $301. Now I moved to progressive, now I’m paying $126/month on average, which excludes Rental reimbursement feature.. Trust me if you had accident forgiveness feature, trust me you would have got saved. again not all insurances companies offer that “Accident Forgiveness” feature. It depends from state to state again. I think “Nationwide” provides that accident forgiveness feature..

I got into my first accident today. I was turning left on a green light when there was a gaping traffic, when a truck came and smashed my taillight. I believe the other party was speeding but said nothing when talking to the cops. I overhead some witness talking to the cops saying they thought "she was going a bit fast". Hi, so you were making a left and the other car was going straight and hit you in the rear end of your car? But it was not a rear end accident right? It's a toss up to me. Sounds like you were pretty far through the intersection and if the other party was speeding you may have a shot at avoiding 100% of fault for the accident at least. Hi there! Just got into my very first car accident today. I’m a 25 unmarried male, and I own a 09 Honda Civic. I was driving in Hollywood and a driver 2 cars ahead of me swerved out in front of the person in front of me, she slammed on her brakes, and unfortunately I ended up rear-ending her. We filed a claim with our insurances, no police report was filed because damage wasn’t substantial-her bumper will need to be replaced and the front of my car has a small dent. Insurance for me didn't go up that much--only about $5 more a month. Insurance thankfully covered the whole thing for the person I hit, but not for me. Still have the battle scar to show for this! LOL
Something that I wish I could've done in the moment was to file a police report. No matter what. If there's any piece of advice I can give you is to never openly admit to the fault of it especially if someone else caused the accident. Honestly, the person who swerved out in front of the other driver and I could've been blamed, and part of me wished I fought harder, BUT what's done is done. Just know that this happens to the best of us and that you're not alone.

I caused an accident on the highway due to passing out from a medical condition I didn’t know I had. It’s called Syncope and my blood pressure suddenly dropped outta no where which caused me to pass out. I have no memory of the accident and I’m insanely lucky to be alive. Thankfully I was the only one hurt. I’m now working with my doctors to make sure this never happens again.
Prior to this I was a perfect driver. It’s tough cause there was nothing I did to cause this, my life style isn’t crazy… but I was still at fault.

just gotten my license four days ago (I’m 16 years old), and like many new drivers, I told myself, That won’t happen to me. But I promise you-be careful, because it absolutely can happen, even if you think you’re driving correctly.
I was merging onto the highway, which required me to make a left turn. The light was green, so I proceeded-only to realize too late that an entire lane of oncoming traffic was headed straight toward me. Fortunately, only one car hit me, and no one was injured. However, the accident was my fault. Next to the traffic light, there was a sign that read “Yield on Green”-a sign I completely overlooked in the moment. As soon as I read it after the crash, I knew I was 100% in the wrong.
Now, just a few hours later, I still don’t know what the full consequences of this accident will be. But one thing is certain-every crash teaches you something. Road signs aren’t just there for decoration; they exist to guide and protect us. Ignoring them, even unintentionally, can lead to serious consequences.
I’m not proud of my mistake today, but I hope others can learn from it. I was incredibly lucky that the other car hit me at only 6-13 mph and that no one was hurt. The situation could have been much worse. If you’re a new driver, please take every sign, rule, and precaution seriously. Stay alert, stay safe, and don’t assume accidents only happen to “other people because I was thinking the same thing just a few days ago.

I was involved in an auto accident where the officer and insurance declared me at fault. Doing DoorDash with my two kids and girlfriend in the car when we went through an intersection and was t-boned ended up flipping our car over on our roof. The officer submitted a DMV re-examination and not it’s putting my driving privlegde at risk. All this ordinal has been overwhelming on my emotions giving i deal with depression to begin with. My father-in-law is letting me use one of the cars he has but i just feel like I don’t deserve it anymore. I’ve been really beating myself up over this. Hello, so two years ago i was at fault of an accident in California, the settlement for property damage was token care of and now (two years later) im being demanded 15k for bodily injuries. State farm says i have coverage for 25k property damage and 15k for each persons injuries. I no longer have this vehicle insured with them so would state farm cover this in case the suit goes trough?

Thanks for the informative Video..... i was involved in an accident few weeks back in a multistory parking lot in San Diego, CA . i was taking a right in a T intersection and got hit by a car going straight..... i am a good driver with no prior accidents and i always look carefully before merging into a lane..... this time also i saw no car in the straight lane and make a right and this car came out of no where and hit my car...... i believe the other driver was over speeding in that parking lot.......After the accident, the other driver accepted his fault and said sorry..... He even said that he was in a hurry to work and did overspeed...... at that time no one was injured and the other driver was 18 years of age who just got his provisional driving license...... now after 2 weeks my insurance company called me and telling me that the other driver is putting the responsibility to me and my Insurance company (GEICO) can not prove that the other guy was over speeding and they are saying the other driver had the right of way in that parking lot... they are saying at this point "i am at fault"

I was in an accident that was reported as my fault. I was traveling west bound on Fruitland ave. I was driving behind a AAA tow truck. We came up to a red light and proceeded to go when the light turned green. After a while I tried to pass the tow truck on the left side crossing a double yellow. As I did this the tow truck sped as I tried to get back into the right lane the tow truck driver purposley hit me on the back right side of the car causing me to spin and hit the side walk. The tow truck lost control because of his speed and hit a light pole. I wanted to see if I had some kind of case considering he did this with malice and hit my car .

My dad was in an incident a month ago. He was driving on a straight lane and then he stopped to see if it was clear to continue around the roundabout. The car he was to give way to was a good distance away. So he decided to carry on driving. However, once he started driving that same car came out of nowhere and crushed the side of his Jeep, leading to the left side of his door handles being broken and a large dent left in the center.
Thank God my dad and the other driver wasn't physically injured.
The driver was a woman who seemed like she was unstable and her personality was really horrible. I believe she was speeding since her vehicle wasn't near the intersection of the roundabout.
This week my father got a bill in the mail from her insurance company demanding that he pay 10,000 for the damages of her car. It's got all the photos and all. My dad doesn't understand what's going on because she was the one who hit his car and he had to fix the damages she made. My dad didn't even touch her car.
On that day of the incident, the police came and she told them that my dad didn't give way to her so he was accountable.
My dad doesn't have insurance or the money to pay for her car. I'm scared and really sad for him. We don't know what to do.
I believe it was a false claim against him. But me and my dad have didn't take photos because we didn't know it would be that serious 😭😭😭

A friend told me that the police can't get involve because it's an insurance claim. And that we can sue her for dishonesty but then again we have no proof.

Great video. Thank you so much. I have a Question, do you recommend getting a defense attorney if found at fault? No major offenses was made, i just failed to yield towards on coming traffic and accidentally caused someone to hit me. I reported the claim to my insurance and they said that we would be considered at least 90% at fault. The other guy did request an ambulance ride to the hospital so I imagine he's going to come after my insurance which is only going to cover upto 60k in damages and legal fees. Whats my next move here? should i lawyer up? This is my first accident after almost 20 years of driving.
Hi, well, your ins co should assign you counsel to represent you. I would ask that attorney that question. I can only speak from our experience, and that is, there has never been much reason to go after someone personally for damages because people don't usually have the assets to pay for the damages. I would not say anything further about this online. Talk to your ins co, talk to the attorney assigned to your case (if there is one) and then you'll be in a better place to make a decision.

I was stopped at a stop sign on a side street. I was planning to make a left hand turn onto the Main Street. The traffic light at the end of the street was RED. traffic coming from my left stopped to keep the lane clear. They were stopped behind the beginning of side street, with the rest of the traffic stopped on the other side(Traffic was backed up because of the red light). I saw that there was no more traffic coming from the right side of the main street so I proceeded SLOWLY to make my left hand turn passing the STOPPED TRAFFIC. As soon as I passed the stopped traffic I was hit by a car going atleast 35-40 mph WHICH I COULD NOT SEE BEHIND THE STOPPED TRAFFIC, which was headed to the red light, mind you it was RAINING. If I could add, I wouldn’t blame either one of us. I feel like there should not be a stop sign on that street! I think a STOPLIGHT would be better in that area.
With traffic lined up, it was hard for me to see the other lane of traffic. There is no reason for traffic to be lined up behind an intersection for a STOP SIGN! there needs to be a stoplight there on both sides of the street. It is too dangerous
The police officer that arrived on scene after the accident gave me a ticket for Failure to yield, and said that I was at fault. I also just got off the phone with a lawyer who said the exact same. I am fully covered with Safe Auto. My car was announced as a Total Loss yesterday from the Appraiser who inspected my vehicle.

What if the bodily injury coverage is less than injuries sustained
Is getting a lawyer defending the one at fault a good idea and what might the lawyer be able to do in that situation defending at fault defendant ?
Morning - what is your ins adjuster saying I'm curious to know.... You caused an accident and your ins policy is not enough to cover the victim's damages? When I was faced with this situation, my client would normally turn to their own ins policy for coverage if there was any first. And we'd make the defendant sign a document confirming that they didn't have any assets that could be used to compensate the victim - that kind of thing.
Yesterday I was in my 1st accident and I believe I’m the one at fault. I was exiting my neighborhood hood trying to turn left and it’s a pretty busy street. I looked left first to check for cars and they were a far distance away from me so I looked to the right and no cars so I felt clear to go and let off the gas. All of a sudden a car slammed into me from the left. I feel I’m to blame because I didn’t check left before going when I should’ve. I’m only 18 though and I’m worried they’ll try to sue me for damages. They seemed ok to me though because not even a minute that I got out of my car, the other driver (he was elderly) started taking pictures of my car and that’s that he kept driving a little after hitting my car. The speed limit is 40 there but the way the impact was and how far he had to keep driving to slow down, do you think they were speeding and would that help my case? I am willing to say it’s my fault but if they were speeding could they also be at fault too?
Hello, first I wouldnt say anything more online about this. The short answer is if they were speeding there might be comparative negligence on the part of that driver. Sorry you are going through this.

People often think they have full coverage but then find out that they actually don't. What's happened since you posted this. Did you file a claim with your ins co and what did they say?

That was very good and informative. I had a teacher who was at fault in a car accident but the person he hit didn’t bother to exchange insurance. The person he hit just decided to leave the scene. A few years later she somehow got his insurance and now he’s being sued. Do you think the victim should be charged with hit and run even though she wasn’t at fault?

If a person is at fault 70% and the car insurance personal liability is 100,000 but the injuries of the other person received were severe which means it goes beyond that amount ...how can one protect oneself from being suit for assets like a house?

I hate my situation I got hit in my ball and mount that doesn't leave much damage to your car. Now I have a umbilical cord hernia torn ligament in my shoulder and a damaged disk in my neck. I just had an accident back in February and caused serious injury to the other party. I filed a claim and everything seems to be going fine so far. The problem is, I know for a fact my insurance policy isn't going to cover the costs that their demand letter is asking for. It probably won't even cover the settlement amount. My dad didn't have umbrella insurance and I just recently declared my assets to my insurance attorney. So, I own 33% of a house that I cosigned with my brother and I was told that is gonna be at risk and absolute worst case, they will make me sell the house and take the portion I own. Reaching out to other attorneys right now for consultation because my insurance supposedly won't help me after the case settles. I am still waiting for more information, but it's got me seriously worried.

Not much. They can go after you personally but usually if there is no insurance the person doesnt have the assets to pay for the damage or injuries anyways...

The driver who caused my accident didn’t handover their details and they got away with it because the police couldn’t identify them and they done a lot wrong at the time of the accident.

No one is injured, fortunately, but I am very anxious and guilty because of my parent’s having to pay a lot for insurance going up. Hello, I was at fault for an accident 6 months ago where I was taking a left turn on green both ways and unfortunately crashed into the person while making my way to the other side. I did file a claim with my insurance company immediately after the accident and ended up with total loss for my vehicle. Goto court for what? You got a ticket? If so thats a question for a traffic ticket attorney. I do injury stuff. But definitely you can find someone local to help you out

Hello. I just got into my first car accident. I accidentally rear ended someone and there were very minor damages to his car (slight crack on the bumper) and almost no damage to my car. I was able to give them the insurance on the car but unfortunately I was not able to get their information nor did I take pictures. Everyone in the car seemed to be perfectly fine after the accident but I'm worried they may try to milk it for more. The car I was driving was under my mom's name and she is the primary insurance holder although I'm also listed on the insurance. My mom is terrified that this may turn out with us losing our home. Is this really a possibility and what steps should we take to avoid this?
Hi, tell your mom not to worry. Just turn this over to your insurance company and let them run with it. That's why you've had insurance this whole time. There should be nothing to worry about.
@@LawFull Hello again. I was just told by my insurance that because I was driving for postmates during the accident, there might be a chance my moms insurance (AAA) will not cover damages. By the way, there were three passengers and they hired an attorney and also went to the hospital for "injuries" after telling me they were perfectly fine after the accident, which is what I expected they would do. Hi, well I am not a criminal attorney so this is a bit outside my area of knowledge. However, I have had lots of injury cases and the defendant who caused the accident often receives a citation. But I dont think they have ever served jail time for a simple failure to yield ticket. Perhaps if there is an aggravating circumstance like DUI but my guess is you will have to pay a fine

I involved in a car accident in July. The police report said I was in fault. And my insurance told me that there are significant injuries to the other driver which exceeds our policy limits. I was trying to turn left at the intersection. It was green light and I stopped and slightly pulled into the intersection and stopped to yield to the oncoming traffic. And then most vehicles is passed through the intersection . one black truck and one white car were 100-150feet away from the intersection. And the white car was maybe 20-30feet behind the black truck.I was waiting till they passed too. But the light turned yellow, I saw both cars are slowing down. Then the black truck speed up suddenly to run the yellow light. Then the light turns red . After I saw the black truck run the yellow light and then light turns red , and the white car is not into the intersection and I saw the white car is slowing down so I started to turn .then the white car speed up suddenly and hit my car.

Hi, I was in a car accident in 2017. I was driving on the freeway when an suv quickly switched lanes in front of me. I wasn’t able to see that the truck in front of it was stopped. When I did realize the truck was stopped I tried to move lanes also, but couldn’t. I ended up rear ending the truck. The driver of the truck also saw the suv switch lanes very fast and that I didn’t have time to avoid hitting them.(the police officer wrote that in the accident report). My car was totaled and there was damage to the other vehicle. Unfortunately my insurance was 3 days expired. I just got served a summons this past Saturday from a law firm on behalf of the other drivers insurance for $18,000. I don’t think I should pay that much since I don’t think the accident was 100% my fault. I tried to avoid it, but was unable to. What should I do?
Hi, first I'd check if they filed the lawsuit within your state's statute of limitations. Is this for property damage or injuries too? If PD only the statute is likely longer than an injury claim. Then get back to me.

Hello; I was at fault for an accident and I’m an excluded driver; the other driver is going to file a claim and I plan on doing so as well; she didn’t require medical assistance immediately and said she was fine. There were no witnesses; I do believe that she is at fault too however because the line for the turn on the highway was moving and she was not and by the time I realized that she wasn’t moving I hit my brakes and there was loose gravel on the highway; my car slid and bumped her vehicle. There are no serious injuries or even serious car damages. The worst part of the accident is part of her fender came undone but she had also let me know that while in Florida with her husband that she was involved in another accident where she wasn’t at fault but didn’t report.
thats bad luck there buddy. even when people just sit on the road because they are texting or whatever its still your fault if you hit a non-moving car. I had something like this too but she suddenly stopped and I didn't have time to stop and apparently I am at fault too.

I have my 21 years old son in my policy and he recently was involved in an accident with a motorcycle and the police report deemed my son at fault for “side swiping” the other party while changing lanes. He’s a student with just a part time job and this was his first accident. We are in the state of CA and I have a few questions:
1. My personal injury protection was unfortunately low - $50K/person/$100K per accident (I have since increased it for future accidents). What should we be concerned about? They did have to call an ambulance to take him to the hospital but he was conscious (and I pray that he makes a full recovery from this unfortunate event).
2. Am I liable for anything given that he’s on my policy and even though he was found at fault.
3. Should we look into speaking and potentially retaining a lawyer in this case?

However, I can say that in regards to hiring an attorney, your ins co would normally hire an attorney to rep you and your son if it came to that. I was at fault in a car accident about a month ago and Im lucky that since I rear ended a city bus and no one was on the bus, there were no damages 2 the bus and the driver was fine so I didn’t have 2 worry about getting sued. My insurance was really good. My car was totaled and they gave us money 2 compensate 4 the car as well as paying the towing fee and my medical expenses. Unfortunately my insurance did go up but I’m not sure how much yet 😬

Yesterday I got in an accident in a company owned vehicle, it was determined my fault and I was ticketed with failure to yield at a stop sign. I did yield and look both ways but the intersection is an extremely busy intersection and famously hard to turn into; many wrecks have happened there before. The oncoming road also has a curve so it’s very hard to see cars coming. Also, the other driver was cited for driving without a license and because his brakes were somehow damaged (I forgot exactly why) but do you think this would be a strong enough case to maybe fight the ticket given?
Its hard to say - but you could at least argue that the other driver was at least partially at fault maybe even more than 51% at fault.
i had almost the exact thing happen to me two days ago and the guy who hit me from the side was speeding and didn’t try to slow down because he was under the influence but i’m still the one at fault and got the ticket because i pulled out right after i looked and no one was coming but i’m not sure what i should do either

I'm the atfault driver I rear-ended a driver totalling both vehicles. My Insurance company is telling me preliminary accounts they are telling me my full coverage insurance may not cover all allegations of injuries on the party I hit any my response for any overage. I was at fault and had full coverage but the injured party has an attorney and is seeking medical damages that exceed. Their attorney is now asking my insurance company for a financial affidavit. My insurance company set up a consultation with an attorney they have retained. Is my insurance company going to use this opportunity to deny my claim? Good morning. Not sure why they would use it to deny the claim. As far as how much info you have to provide. I would consult with the attorney on that. Hard for me to know. However, I can tell you that when we've done a financial affidavit, we never asked that much info just enough to verify that the defendant didn't have a lot of extra assets we could go after.....

Hi, was in an accident turning left. I was flipped and my car is totalled. Their car is also totalled and I do believe they refused medical treatment on site. This person is now claiming to have injury, what should I expect? I am covered but not sure what to expect. If you were turning left and it was a t bone accident, its tough to argue they were at fault. Turn it over to your insurance company and let them run with it. Thats why you got it.

Hello Dr, I got into a car accident few days ago. I was double parked to answer a phone call. I check the mirror to see if someone was coming and didn’t see nothing . Once I tried to merge on to the lane this black Lexus came and hit my car from the side causing him to crash into me and another vehicle. I say he was going over the speed limit because if he was going at a regular speed , he would of had time to brake or just hit my car. Not impacting me and hitting another car that was on the other side of the lane. Keep in mind I only have a permit but I’m 19. My dads car has insurance and everything is up to date. Hello, I was not at fault of my accident on June 24th this year I had my Vehicle for less than 30 days fresh off the lot. Due to me having 0 credit I put a $4000 down payment to take the car off the lot, I made my first car payment 1 week after the crash I didnt have rental coverage so I ended up losing my job an im negative currently. What should I do? her insurance didnt have enough coverage to pay for my car so I ended up going through my insurance but it was a total loss... So I lost my car basically $4000 an my job. Hi, did your loan get paid off? Sorry to hear this. Not a lot you can do Im sorry to say. Did you suffer any injuries? If so you can recover for your meds and pain and suffering. You can also argue lost your job because of the defendant's negligence and can try and recover lost wages. Barry

I was at fault for a accident that happened a month ago, i was on the way to work and it’s a hour drive so I was feeling drowsy l. The accident happened at a intersection light, there was a suv in front of me and I remember putting my foot on the break slowing down but I never fully stopped and rear ended the suv. I had put my head up and closed my eyes just before this happed and after the hit we pulled over at a gas station. No one was hurt and no police were called. We exchanged information. Insurance.. etc, my front bumper and hood were damaged and their rear bumper was damaged. The following day my uncle calls saying that my insurance bailed on me and that I had to go look for a new insurance company because I wasn’t a listed driver on the policy. I get phone calls from the persons insurance about making a claim and I haven’t answered to them because I am not sure how I should go about the situation.
Hi, if you don't answer them you'll probably get sued. If it were me - just if it were me - I'd answer them and say you filed a claim with your insurance and you were not covered. They will then go after their own insurance under the uninsured motorist coverage - hopefully they have it. But this is just generally speaking. I also would not say anything more online about this accident.....
I was an uninsured motorist it was a minor bumper accident I was the one at fault. this accident happened back in June and I'm now receiving a notice from farmer insurance to pay for $2160.38 I guess that was the damages. Last November on highway when I changed the lane to pass this white car, this dark car came from nowhere with the speed of 100 mph and tried to pass me, and if I didn’t move over, the dark car would have rear-ended my car and caused a ‘life and death’ terrible accident. So to avoid that, I had to move over a little bit to the right so the dark car could pass me without hitting me, and my car touched the white car on my right when I moved over. No damage to both cars. No injuries. The state trooper gave me a written warning (not a citation) right then and told me to give the info to insurance agency and company. The accident summary states that Operator #2 (which is me) was found at fault and issued a written warning. Yesterday I received Surchage notice. I thought a written warning doesn’t affect the rates. How is that possible? Any help would be appreciated. Thank you.

Hi. I was driving and all of a sudden, a boy of 13 years old bumped into my car while trying to cross the street with his scooter. Hi, if you rear ended the vehicle 1. That driver will likely file with your insurance company 2. Your policy likely says something to the effect of if you are involved in an accident you are obligated to report. Some do and some dont. If you do not, it could threaten your coverage. You would have to check your policy.

I pulled into an intersection from a side street, and there were large bushes blocking my view, as I crossed, a man going (very fast, approx. 50 in a 25) collided with my car and went to the hospital and ended up blaming me.

Morning - sure, you can try and fight it - what is your ins co saying? Depends on what your state law says - but very generally speaking - you can at least try and argue either to your ins co or in court that the other side was comparatively negligent for the accident. Look up your state law however to see what it says. I would also consult with a local attorney about this issue (again because this is really a local issue and I can't provide feedback on it specifically).

My bf rear-ended a woman who then rear-ended another woman in a bottleneck on the freeway in CA (I was not in the car so I did not witness this happen, but he was not drinking or anything; he was driving a standard and did not hit the break in time). The car he was driving was financed and he only had it for 5 months. Luckily he had gap insurance from VW so he did not owe the rest of what was due on his car. It was a total loss.
The woman in front of him was also a total loss, no injuries. I saw her car in the tow yard, it was a mid-2000s Camry.
Apparently the woman in front of this woman was transported to the hospital (I didn't see her car following the accident and don't know what she was driving). Anyway, it seems like Geico (bf's insurance) covered her ambulance and that portion is resolved.
Now, for the cars, one of the women has AAA and the other has Mercury. These insurers have sent letters directly to my bf requesting the money for the cars (AAA wants approx. $12,000 and Mercury wants about $6,000). Their letters CLAIM they have already been in contact with Geico and that Geico will not pay more based on coverage. However, I am finding this hard to believe because we live in California, and for some reason I just have it in my mind that you are required to have high collision/liability due to the area we live in (I also have Geico for my 10 year old car and I pay over $100 a month just for it to sit in my garage -- I hardly drive anywhere but Geico doesn't care - based on my zip code and age I am "higher risk").
I'm trying not to meddle in his situation because it is stressful. I do know that he forwarded the documents he's been receiving from the other insurances to Geico, and Geico says they are in negotiations.
Is it possible that my bf will have to personally pay these women/insurers the requested $18,000? He has not purchased another car following this accident and thankfully does not need one. Are there other options such as declaring bankruptcy? I am stressed about what is to come.
Hello, I would not worry about this at this point. Let the insurance company handle it. Is it possible that there is excess property damage that needs to be reimbursed? It's possible, but you don't have to just pay it Upfront. For them to really recover on that they have to file a lawsuit against your boyfriend and go to trial and win and then recover the damages. So that's a long ways off. Let your insurance company handle this right now.

Hi - have you consulted with a local attorney yet about this by chance? May be local rules that I'm not aware of. Very generally speaking, if insurance is limited, not much you can do. But there are ways to confirm that the person doesn't have any personal assets etc. That's why i suggest you consult with a local attorney...

I wish there was more on this. I was at fault, I backed into a person leaving a driveway. The damage was minimal. Under 2,500.00 the officer said it didn't need to be reported to the DMV. I was working for a commercial company using my vehicle. My insurance company would not cover me. I agreed to pay the person and even get them a rental car. They agreed to except payment. I did this once before for a trucker who hit me and it worked out great for both of us. But in this recent situation, she has notified her insurance company. They apparently are not saying there is damage because they want me to pay. But their insurance company is calling me about a claim. I don't know what to do.

Hello, in need of help. My boyfriend was driving my car and wrecked it. He was at fault. I immediately filed the claim the next day and did everything my adjuster asked me. I gave a recorded statement, gave the police report, he as well gave a recorded statement. I was told that they may not cover my damages because he wasn’t listed as a driver on my insurance. I’m the only one who drives my car so I never thought to do such a thing. He only drove it that one time. They are currently in the process of inspecting my vehicle. I also found out that the law in TN states that a person does not have to be listed on your insurance company if they do not live in your household. I live alone. So technically speaking it’s not required to list him. I have comprehensive collision and collision coverage. Please help with legal advice.

Hi, don't just take their word for it. Ask for a certified copy of your insruance policy and tell them to show you where it says that he is not covered. If they continue with this tactic, you may have to demand arbitration. You can find out how to do that in your insurance policy....

Hello, I recently backed into a newer Toyota Rav 4 In my church parking lot (I have 2012 Ford Focus) and the victim has small damages to her back end of the car. I didn’t see her prior to backing in and I cannot confirm if she quickly pulled into the spot after me while looking into my other mirrors. I Fainted while driving, hit a tree at the side of the road while trying to get off the road realizing I was about to faint. Police came, they called ambulance, asked me questions like when was the last time I ate something, I replied the night before.

I also wanted to ask, I was told that we would need an "at fault" lawyer to represent the accused and also maybe a bankruptcy lawyer to file a bankruptcy claim (although he's already essentially bankrupt). Is there a way to get an attorney to represent you if you have no money? I know in a criminal case you are entitled to a public defender but in a civil case, how would you go about getting a defense attorney with no money? Also, can we just call the other person's insurance company and tell them there is no car insurance? And do wrongful death cases need to be a full on courtroom case where there are witnesses and people giving testimony?

Bankruptcy I don't know a single thing about to be honest and I don't want to give you bad information. I would google 'bankruptcy lawyer near me' and ask a local attorney about it. Or research free legal aid in your area. I know here in IL we have a legal aid society. You may have one too. As far as whether you can call the other ins co and tell them you don't have ins. . . I don't know why you couldn't do that. Finally, I have no idea what your local rules are regarding any kind of personal injury trials but very generally speaking, a personal injury case will usually involve a jury and testimony etc etc.

Just got in a really bad accident today. Supposedly a blue car maybe 5 cars ahead in a 2 lane highway had mechanical failures and bounced back and forth twice from the barrier to the guard rail. I was in the fast lane and even with enough distance the roads were wet and my heavy truck just slid right into the back of the car in front of me. I don’t know if I at fault or partially or maybe it’s on the blue car. I was the last one in the line for lane so no one hit me from behind. But I’m the least bit happy since I just bought the truck and haven’t even paid my first payment on it yet. I’m replaying it in my head but there was no way to avoid hitting the car in front of me. I just wish I left the house 5 minutes late or earlier to avoid the whole situation

I was hit twice and I contacted the police. One on the rear right then after rear ended. The other driver took off after exchanging info. The police arrived and I gave my statement. I’d contacted my insurance they told me to contact the other driver’s insurance since he had hit me. Shortly after I’d hired an attorney. The police report came back saying that I was at fault. LawFull what had happened was I signaled and checked my side mirror and through my windows, as usual, to get into the right lane. The other driver was about two car lengths behind on the lane in getting into. As I proceeded, I hear an engine revving and seconds later I was hit on my right rear quarter panel. The guy definitely raced to not let me over. Cause there is no way he could’ve caught up to me doing speed limit. After the initial hit I’d proceeded to pull over to get out of the way of other vehicles. And seconds after he plowed into the rear of my car.

LawFull I did suffer injuries. Still in pain. When the officer arrived I gave a statement. I’d told him the other other seemed drunk because he was acting funny and slurring his words. He then asked to see a picture of the other driver. Soon after the police started making excuses for him. Then I get the police report and the officer said that I was at fault. And on the report he determined that the other driver wasn’t intoxicated by contacting via phone. It doesn’t say the timeframe after the accident that he was contacted. Seems fishy to me. As if the officer knows the other driver. Now, since officer reported such, the attorney is insisting that I don’t pursue it and had me stop seeing the chiropractor. The accident happened on June 26, 2019.

hi, i had my first accident last week. i was placed at fault since i was turning left out of a plaza and couldnt see oncoming traffic. there was a person in the turn lane and we collided. i have insurance, but since i was doing uber eats at the time theyre telling me my insurance wont cover anything due to material misrepresentation. do you have tips? im working on trying to get in contact with a defense lawyer but i dont really know what im doing :( there were no bodily injuries and airbags werent even deployed.

Hi, I'm not entirely sure what you're asking. Video is evidence and can help prove who was at fault for the accident. The police and the court will look at it (at least theoretically) and it can help make a determination regarding fault.
If the ask for 40 thousand and your coverage is 40 thousand and the insurance is willing to pay that, does that mean they can’t come back and sue you personally for more, even if you have a good job where they could garnish your wages?

And as such, there wouldn't be any remaining liability on your part. Though I would consult with a local attorney to confirm what the rules are in your jurisdiction.
I was in a car accident the other day and i was driving on my way to school and there was traffic. When the traffic cleared up the lady in front of me started to accelerate and I did as well but she then slammed on her brakes and came to a dead stop because there were more cars in front of her . I then slammed on my brakes but still hit her and then I got hit in the back aswell. My car was totaled but her bumper was the only thing damaged. You just need to turn it over to your insurance company and let them handle it. Nothing more you can do to be honest. If the first event that happened was you rear ending her, you're likely going to be found at fault unfortunately. This is the very reason you have insurance. Accidents happen...

My case is complicated. I was driving a rental car from Enterprise. I have a damage waiver on the car, but its not technically insurance. It just means enterprise could fix their car. The cop at the scene said I was at fault, but I'll dispute that. I was merging left into a lane from a parked position. I was about a third to half way into the lane when another car struck me. Their car flipped onto its side. My car had minor (dent) damage near the door hinge on the front driver side door. Her car flipped, had damage to front of the vehicle, and her front right light came loose. The right side of her car was the side that wasn't touching the ground in its flipped position. This means she hit me with the front of her car and should have had enough time to see me as i was already pretty far into the lane. Keep in mind that there was no damage to the front of my car so I did not hit her with the front of my vehicle. The fact that she hit the side door means that she should have seen me in the lane. The speed limit was about 25 miles per hour and I was pulling out into the lane at a slow enough speed but not too slow. Maybe 5-10 miles per hour from start. I did check mirrors and thought I was clear but before I knew it I was hit as i looked forward.. Her husband arrived on the scene and said " she must have been speeding" even though I can't prove that. And she even mentioned jerking her wheel in panic from the initial collision. As such, its not so cut and dry who was at fault though I know the courts generally side with the non-merging vehicle. Anyways, I'm dirt poor and have no assets. I don't have personal insurance, although I do have a car. My car has been broken down for a while, which was why I was using the enterprise car. My car is also a piece of junk and probably wouldn't even sell for 500 bucks at this point. I'm too poor to justify paying for car insurance at this time when I can't even drive my car. I am also self employed. What are the odds that I get sued even though I don't have insurance, a garnishable job, or any assets? And do I have a case in contesting any at fault verdict even though the cop said that I was?
Morning - well, if I was the personal injury attorney representing the other party, I would think there was little chance of recovering against you personally and as such, would go after their client's UM coverage only... Not much point in going after someone with zero assets.
What if i wasn’t in the insurance policy and in somewhat the one I hit was “injured” what should I do or say at court?

I caused an accident, I was merging into a lane person in front of me started breaking and I didn’t notice so I rear ended them. It was my fault, the cops came but the lady didn’t receive my information or my insurance information. She just left, the cops however gave me a sheet where I need to hand it in to the DMV to report it. I don’t know what to expect after.

Hi I'm not sure I understand the fact pattern. However, very generally speaking, you would not sue the ins co. You would file a claim with them to get compensated for your damages. If after going through that process, you couldn't obtain compensation, at that point you would then, again very generally speaking, file a lawsuit against the driver of the other vehicle and/or the company he/she was driving for. What's happened since you posted this comment?
I was being irresponsible and crashed into a building on a deep turn in Monroe Louisiana. Car is totaled and the front of the building is messed up, what can I expect goin forward. How bad did i mess up.
