    I'm so thankful you present things without the name calling, the fuckery, and that you explore how emotions on either side can influence perspective.
    I can't stand when commentators lean into the sensationalism and tear people down, even when I deeply dislike the people they're tearing down. It makes me feel icky. I just want to understand what's going on.
    I'm extremely grateful for how you present things and insist on civility. I've learned so much from your channel. Thank you!

    I can absolutely see a case here for IIED. He bitched about her publicly, and then he dmed her and said "good luck." What is she going to need luck for? Because to me it sounds like she's going to need luck to deal with the distressing amount of hate he is intentionally sending her way, with knowledge of how painful it can be to receive.

    It's the "I reposted your photo. Good luck." for me that makes my stomach CHURN. He knows he has 2.4 million followers. He knows as a celebrity he has a massive platform. He also knows damn well that Roice & the whole family are private citizens and that they will need "Good luck" to deal with whatever Alec's repost will bring to them. This feels like what people on Twitter a quarter his age do...

    My torts professor used to say being an A$$hole is not a tort… and I’ll leave it at that. I agree that defamation and defamation per se are the more interesting claims.

      @Maria Baja frankly, what I've learned from the lawtube community. Is that no lawyer (who does what they're paid for) is ever to expensive.
      It's ALWAYS harder and more expensive to fix a problem than prevent one.
      So, I'd encourage the channels to at least talk to some lawyers. Not all lawyers will charge you for asking the initial questions.
      Terms of service aren't really in anyone but yt's favour though. So, good luck!

    See, for me this raises a completely different question. When we're looking at the law talking about (paraphrased) "beyond all bounds of common decency" and describing acts that "any reasonable person" would find to be beyond the pale... What happens when something is really awful to do, clearly causes distress, and may even be maliciously intended to cause distress, *but it is also* something that happens all the time and is super common?

    My thoughts, I think where the sister in law may come in is that everyone knows that family members always get brought in when something is shared/reported. Once he was informed the child’s mother was getting messages he could have made it clear to his followers that she wasn’t involved but didn’t. He definitely knew what would happen once he made that post and deliberately phrased it to maximise the damage.

    I am so far on the left that I am the Republican nightmare, and even I am disgusted by what they s family went through. They have a right to support their candidate and be in D.C. hell, they had a right to protest.
    NO ONE had the right to insurrection, but by all evidence, they weren't a part of it and to say otherwise is horrible.

      Whoa, Nelly. Okay Sparkies, pretty sure at 41 I know my own politics better than ya'll and I am so far left I don't even have an actual party in the US. They stopped allowing up Socialist' to have sign up sheets quite a while back.
      That doesn't mean I don't still love my country and the right for all to have their voice, even the other side and supporting that doesn't make me a moderate by ANY means or like President Oompa Loompa any more than I did a year ago.
      No Republican should be "locked away" unless they pose an actual, viable threat (like some of the freaks who want to kill Dems for bring Dens). We're still one nation and still normal Americans, didn't change when I voted Obama and y'all voted Rimney or McCain (and may I say, while I am not fond of Romney, McCain would have been a decent choice. The last of the good Republican men, though Romney did get me to thank him twice on Twitter during Trump's term so, notvall is lost 😉).
      We need to remember that for all the idiots from both sides, the way to move forward is together.
      The future can be scary bright now. We are at a culture shift for another generation set and to many - the idea is fucking terrifying. But our ancestors survived and we will to.
      And we will be better for it.

    At 15:00 minute mark ... I have a friend who lives up a few blocks from me. She was an actress on the TV show "Dark Shadows." She recently saw that her net worth was estimated at $850,000. She said, "I sure would like to know where that money is, I could certainly use it!" I think their estimates are largely made up!

    I totally agree with you. My opinion of the lawsuit and my opinion of the people involved are two separate things. The law is supposed to be blind for a reason.

    What is it with celebrity fathers verbally abusing and degrading their own children? Do they not know how much damage it causes, or do they just not care? I didn't know this about AB until now, I'm not a fan anymore in anyway shape or form! I tried to see his shooting the gun scenario as something that may happen, or has happened, on other sets. It's been quite difficult when it comes to Alec's runaway mouth, complete ignorance and intent on interviews galore!!

      To be fair its an old saying so maybe current year we need to say a billion dollars.
      The idea is that when one has power and money they have no worries about what others might think of them. Thus if at heart they are cruel and heartless they will be such to others in life. If they are kind and compassionate then they will be so.

    I have fibromyalgia & the brain fog is real but Emily breaks everything down in an understandable way. Since the info is all available 24/7 I can go back & remind myself of details or relearn something I’ve had erased from my brain by my illness. I’m never going to be as smart as I was before I got sick but it’s nice not to feel like an idiot when I come here

    I don't believe that the lawsuit is frivolous, but I think they will settle out of court with the plaintiffs signing a confidentiality agreement/non disclosure!

    I'm still processing how I feel about this lawsuit. What I do know is Baldwin's actions are disgusting. I won't be sad if this lawsuit does stand up in court or if he went down for the Rust shooting.

    My best argument establishing a duty in the negligence c/a is that Baldwin did not owe a duty until he created a risk of harm to Roice by reposting her Instagram post and encouraging the engagement of some of his followers. But "no duty unless create a risk of harm" is already precarious here - what is the risk? Does reposting publicly available content actually create this risk?

      This is the way I see this case in terms of public availability of initial post. Look:
      Imagine an artist posts a painting, made in red tones.
      Someone with large and loyal fan base reposts it with a comment: I knew this artist is making crimes all the time by using the bl00d of his victims for paintings like this.
      Voala. Initially public thing gains new publicity - with the context added and changed.

    I feel like this is a big stretch of a lawsuit and an H3H3 round 2. It sounds like Baldwin is big mad that he sent someone he believes to be a "Trumper" money. He shouldn't have blasted her, but he isn't responsible for other people's words. From what I heard, he called her out. He didn't directly tell his followers to go after her. As for the part about something publicly, my question is was her IG profile public or private? If it was public, then anyone could've seen it and posted it calling her out. If it was private, then that's a different story. My other question is, when was this posted and when was the lawsuit filed?

      I agree, like if you post something on the internet you have to be prepared for someone to repost it. That’s just the internet. If you don’t like it go private. Especially when you’re posting really heated topics like politics. Would people care if some comedy news show plucked her picture and did a piece about how ironic it was and people found her and hated on her? Probably not. People just hate Alec Baldwin.

The internet isn't the wild west just because laws haven't caught up and there is a rule of the platform he broke by doing that. Just cause we all know platforms don't do a good job following those rules doesn't mean that we shouldn't expect people to be held to that standard. Existing in public spaces does not make a public figure.
      But truly what Alec Baldwin did wrong here was dm her. I feel that he could have done all the same stuff he did and they would have no case if he never sent her that "just posted you, good luck". Same way I think if a comedy TV show did that in a private dm before the show then they too would open themselves up for a lawsuit. You can't imply a threat towards a person, that's what shows actual malice, thats what shows the intentional infliction of emotional distress. He didn't just post the photo he didn't like and talk about it unfavorably, he sought her out, he implied to her that he knew his audience would come after her once he posted something. When she went further and sent him the following message of how her brother deserved to die. He followed that person which could easily been seen as encouragement of the behavior. The ruder you are the more likely your fave celeb might engage with your comment or even follow you if you say he deserved it. Comedy shows do none of these things.

      I saw someone else put this very well in my opinion but celebs and influencers don't get to play it both ways. They don't get to command 14 million dollars for an advertisement or sponsorship based on their ability to influence their audience but then when things like this happen, turn around and say they have no influence over their audience.

    Unpopular opinion: I don’t think I’d be mad if a judge decided that maliciously weaponizing a large audience at another person constitutes as harassment and intentional infliction of emotional distress. Regardless of who the aggressor is and who the victim is, regardless of political/cultural context. I don’t think I’d be mad to see people face legal consequences* for getting thousands or millions of people to harass somebody because of what you said.
    *As far as what I think a fair legal consequence is? Generally I think if you can demonstrate damages to your emotional well-being (you had to go to therapy because you were suicidal, like Cardi B) reputation (being labeled as an insurrectionist who participated in trespassing on federal property like Royce) or business (tanking App Store reviews after Ethan sarcastically encouraged thousands of his fans to go rate the app and give it one star…….. or five stars), and you can demonstrate they were inflicted maliciously based on untrue information (having information that contradicts the validity of your statements, whether that’s news articles or direct statements from the victim, but you’re CHOOSING TO CONTINUE claiming otherwise), a restraining order is perfectly reasonable (you’re prohibited from speaking about or to this person, or otherwise engaging with this person, as a result of the harm caused by doing so in the past), and NOT damages to the tune of millions of dollars. I think it’s fair for a court to say KJ can’t talk about or engage with Tati. Or that Ethan can’t talk about or engage with Ryan Kavanaugh. Or that Tasha K can’t talk about or engage with Cardi B, or that Alec Baldwin can’t talk about or engage with Royce. Don’t tag them in anything, don’t reply to their posts, don’t send them direct messages, don’t make posts or videos or comments or blogs or websites referencing their name or likeness. Don’t answer questions about them in comments on your social media, on TikTok or Instagram or Reddit or UA-cam, or in interviews, regardless of it being a small podcast or Joe Rogan, or Fox News or Hot Ones or MTV/TRL. If they choose to violate that restraining order? Then we can talk about monetary damages for violating a court order.

    My mind went to the Marine that died and the irony of it all. Anyone that serves our country does so to protect us and our liberties. He made the ultimate sacrifice. I understand the feelings of this case but I think Alec has a loophole. Yes, what he did was extremely out of line but was it illegal? He didn’t state that everyone should harass her but I do believe just his post and the comments he left were his nonverbal way for people to dogpile and bring awareness. Imo, I think he is quick to anger, impulsive and has difficulty taking accountability. Wonder how long it’ll be until he gives a televised interview. Great podcast Emily! This is certainly an interesting case! 💜⚖️

    I think the articulation of facts in the lawsuit is messy. That being said, the damage to Baldwin is still irreversible by highlighting the a hole he is. His fame is vicious and so below any standard of civility. Ugh

    Regardless of the political leanings of the people involved (I'm not American but I do lean pretty strongly to the left), I can't ignore the inherent power dynamic between multimillionaire celebrity and a private individual. I disagree with Roice's *opinions*, but, per her fbi interview, her conduct was not criminal. I disagree with Baldwin's *actions*. He threw his toys out the pram (stroller) when he found out he accidentally donated money to someone whose family wouldn't vote the same way he did and, instead of just taking the L like an adult, he had a public tantrum. He either should have known better than to include her insta handle or he did it deliberately...sounds like reckless or intentional infliction of emotional distress to me. I don't think the sister + sister-in-law being his targets is going to fly though.

      One thing that plenty of the MSM and others don't like to admit is that there were a lot of rather left leaning individuals there on January 6th as well, and in fact may have been involved in some of the entries into the capital. They want everybody to believe the entire crowd and all of the bad behavior was bad actors on the far right. This is the narrative they've been running rabid with since it happened. The truth is far more messy.
      On top of that the truth of the matter is that Alec, You, and anybody else can only make an only somewhat conclusion of the Political leanings of anybody in the family. That of the sister in law. Nobody else in the family as shown in the lawsuit from what Emily showed shows any kind of leanings at all, and families do not just automatically share political affiliations, which has only become more obvious in the polarizing environment of the last several years.
      Yes he should have gracefully taken the L, but at the same time. He's also jumped to a great deal of conclusions. Mostly derived from a hard line political stance combined with very biased and peacemeal information.

    In Norway we are legally required to stop and help if someone has had an accident on the road. If it gets known that you drove past without stopping, you can even go to prison.
    This rule also includes animals, but I don't think anyone would "care" enough to prosecute that as hard. With animals you can take them to a veterinarian and give them treatment or have them put down and the government will pay (wild/stray animals)

    Hey Emily! I just wanted to say thank you for talking about your ADHD, I saw a lot of similarities in myself when you talked about time blindness and hyper focus; because of you I talked to my psychologist about it, it's been almost a whole month but I got the diagnosis yesterday. I can see things now in hindsight that happened in my childhood as being caused or in part by having untreated ADHD. This was the final piece of the puzzle for me, so really- thank you.

    There were PLENTY of people who were at there Jan 6th who were NOT involved in the violence. The percentage of those there who engaged in unlawful acts were a small, loud MINORITY. When things turned violent, most left. Being present when others start violence does not an insurrectionist make.

      ^^^^THIS! I have an acquaintance that went to the Jan 6 protest. When things started to get violent and people breaching the Capital, he was like “Oh, hell no! I’m having no part of this!” He and his friend were already in the back of the assembled crowd and so he and the friend made a hasty retreat. He definitely wanted no part of the violence and was really upset that the Capital was breached and appalled at what happened inside and the deaths that occurred.

    I met Alec Baldwin, at a church I was going to at the time, when I was 12 and he was a condescending ass hole who talked down to me and my friends and said we were going to hell. He assumed we wanted an autograph took my Bible from my hands and signed the title page....

      I can totally see him doing that! I think he’s an ass in many ways and always has been. I think early on in his career, he wasn’t as vocal in his assholery. Once he became an A list actor, he just became more brazen and vocal in his assholery.

    Also how about the emotional distress of seeing all the awful things said about her recently deceased hero of a husband and the father of her daughter. She's already grieving and she has to read stuff about how he died for nothing and he got what he deserved and so much worse... it's a disgrace to his memory that Alec Baldwin set into motion.

    37:36 He most definitely knows better. At 30:22 he states he said, "I reposted your photo. Good luck" You do not tell someone "Good luck" when there are no challenges/problems ahead. He knew EXACTLY what he was doing and exactly what would happen. He knew posting her photo would bring her challenges/problems. He himself had a problem with her!

    I’d be curious to see if she had any negative comments prior to AB posting considering the events of 1/6/21 on its own is going to trigger a response for others. If there were other negative comments, could it be argued that the post was controversial enough that by posting it on a public account, she opened herself up to nasty messages?
    All this to say that while I think what AB did was idiotic, a lot of this suit is a stretch based on what you explained of the law. RM should be the only plaintiff for sure. I’m curious if her account being public will play into any part of this.
    Also, I don’t know that AB ever said he wouldn’t have donated the money if he had known. I think it was more that was bothered that someone who lost a family member in service could also participate in 1/6.

    I completely agree that there is really only one proper plaintiff. I think false light is fair because he knew she was not considered an insurrectionist by the government. Whether this was highly offensive to the average person, I don’t know, I think it is common to see mean hyperbole on social media. Defamation - I think these facts are good for defamation per se. I agree as well that negligence fails with duty.
    IIED - this is one of the best cases I’ve seen but, again, this crap is so common on social media. Is it outrageous? They are well placed for this in Wyoming. Do you really think he’ll go to court over this? I think he will settle, unfortunately.

    Not only the fact that he’s had previous experience of being a media target… I feel like that last ‘I retweeted you to my followers - good luck’ showed his intent to cause distress to at least the sister that started the gofundme. That tweet reminds me of Tasha K’s video, where she said ‘yeah - I know I’m sharing lies. I know I’m making up lies’ I’m not an attorney, but as a layperson that’s what it looks like to me.

    The best takeaway I got from this is your statement 'making a dick move is not illegal'. Thank goddess for that, or we'd all be criminas at some point or other! It encapsulates the whole discussion we are (hopefully civilly!) having about Social Media at the moment. I do have an issue with trying to equate Baldwin's statements to TFG's. There is a difference between what a POTUS says and what is said by a guy who just played a POTUS on TV. I think you were saying that when you talked about the 'duty of care' for private citizens? Not gonna lie, I got a bit confused by it all; but I really appreciate your covering it; it is a very important discussion.

    As a well known Hollywood star Baldwin is an influencer, like it or not, asked for it or not. That's what all the glossy magazines with the pictures and stories of stars looking and doing good is all about. They influence people and are used to do so. HIs following on twitter are probably a large majority of people who hold his political leanings, hatred of Trump and all those that supported Trump. When he told the lady that he was going to put her picture up he knew that could harm her, that's why he said sarcastically "good luck". He knew by that statement that she was going to be inundated with hate and threats. His followers responded to his call to action. His deliberate call to action. So that's why I think he does have a duty of care.

    Political leanings have no business in court. Right is right wrong is wrong. Both are wrong here. However I have questions about the go fund me for the wife and kids. He was active duty at the time of his death. The military covers funeral services for active duty as well as provides life insurance. I know this because my so. In law is active duty. Life insurance was a requirement when he enlisted. The choices are not chump change. Why even do the go fund me. I understand Baldwins feelings about if all but that doesn’t mean he was right in what he did. He definitely shouldn’t have so what he did. There’s no excuse for sending a mob after anyone. But political beliefs have no business in a court room.

      Life insurance can take ages to pay out it took 3 months for the funeral part of my dads life insurance to pay out and the rest of it is still waiting to be paid 7 months later I can assume the military works a lot faster but it wouldn’t surprise me if there’s a period where there’s some financial difficulties especially if it was a single income family

      The military is slow as molasses to act on anything and insurance payouts are probably no different. Also, even with the insurance the cost of buying a house, raising a child, getting the child through college will outstrip that. Most military wives don't work because they CAN'T, given the moves the military puts them through. She's probably loosing base housing and may need job training...

      @@texaskatydid1081 I am a military spouse so I can speak to this period you receive a $100k within 24 hours of the confirmed death. That is direct deposited into the bank account. Within 30 days, the remaining amount of the death benefits as well as the life insurance are paid out. These total to $550000 within 30 days. In addition, the spouse also receives 6 months of income and allowances. I believe this would total about $30k in additional money for a Lance Corporal (lcpl). Once all of that has been Paid, it is also important to remember the additional benefits provided to widows and children. You must consider that they both now receive a lifetime of monthly income as well as healthcare, education benefits, tax breaks, and additional benefits dependent upon the state as well as the veterans association in the United States. Military families have to plan for the death of their spouse. I am in the midst of my husband's 12th deployment and had to get all those ducks in a row before he was able to leave. We plan for our spouses to die. We also are aware of the financial impact that death may have for us and our children. This woman did not need additional funds. I am so glad that she received the generosity of others but I am appalled that her in laws would solicit those from people they so clearly despise in her name.

    i can see the argument, that *morally* the right thing for Baldwin to do would be to say "it's never appropriate to send someone threats of harm when you disagree with their actions, and i would hate to see people who support me behaving in such a way" but I'm with you Emily. I don't see how that is a duty of his.
    There is kind of an expectation for someone with a large media following to do that, because generally people on the internet who don't want to encourage that sort of behavior do their best to encourage their followers to behave politely. but i don't know that i believe Baldwin feels that way

      What if they proved they attended a rally and wound up staying with police officers for safety when it turned violent? There is NOTHING wrong with protesting. It was the a-holes that went in the building and rioted. Would it be ok if I said ALL those who protested the death of George Floyd are guilty of murdering the 30 people that died during those riots? No, it wouldn't. It's not ok to lump one person exercising their rights in with the few who are criminals.

      Alana, attending a protest is one's right Alec conflated her right to protest with being an insurrectionist. Ellie is thinking on her feet and I don't think she said anything to warrant your last statement. Everyone is on a spectrum of political beliefs. She listened to yours and answered. There is no reason to say "this is why I don't like _______" . We need to understand each other and not move further away from each other.

    IMO, Baldwin used his power as a “Blue Check” celebrity with millions of followers to impliedly direct the scorn and vituperation of those followers at the Plaintiff. It was Defendant Baldwin’s obvious intention to do so. He was the falconer taking the hood off of his hunting bird’s eyes, throwing his arm forward, and signaling the predator to attack the illuminated prey.
    ETA: Wonderful monologue, ma’am. I’d love to be able to explore some of these philosophical/political points with you; I love philosophy, too!

    I believe celebrities and Influences cannot have it only one way . They post on social media to follow them buy this product ect influencing followers so there should also be the acknowledgement that everything they say influences .even negative things that can influence followers to do wrong....does that make Sense?

    Roice McCollum was on many a conservative news program and conservative channels at the time. She talked openly about both her attendance at the Capitol January 6th, in the context of her disappointment with the withdrawal and Biden policy, and her fund following the death of her brother in these. I think it's a harder argument to make on the face, but does that count if she's a public figure in the sense that each party would be interfacing with different media outlets and the overlap was minimal?

    Hello, I'm from Alabama and have two protection orders against different family members. One has texted me acknowledging that she's not supposed to do so, but the authority can't issue a warrant bc it's a text. How is Facebook/Instagram/social media any different? How can they use screenshots? I was told it didn't prove anything.

I just feel defeated bc these people are not supposed to contact me but there are loopholes. I am finding it interesting that these screenshots are being used in this Baldwin suit.       Yes, that’s true. However, she’s not a movie star, doesn’t have millions of viewers, and isn’t as influential as Baldwin is. He knew exactly what he was unleashing on her with the “Good luck” comment. At most, she probably would have had a few hundred of people trolling her for being at the Capital on January 6. By Baldwin reposting her post, then she had 10’s of thousands of people trolling her. What he did was flat out wrong.

    I think it's important to consider what an insurrectionist is. How far does the term extend, and to whom is caught up in it. Just because someone isn't prosecuted by the FBI/AUSA doesn't mean they weren't complicit in the actions of the day, and in the actions of others. There could be an easy argument to be made that those who were present, but cannot be proved to have commited crimes/entered the Capitol Building directly, could be considered involved in the incitement of others to do such acts on the day by their mere presence up until certain points/vocal encouragement.
    The term 'insurrectionist' is used colloquially here, and there isn't a direct definition given. So for Baldwin to say she is an insurrectionist really depends on the interpretation of the word. And colloquially, it could be applied to anyone at the Capitol today, therefore it is not a false statement.
