The law is meant to be based on common sense. A perpetrator HAS to be aware that they are breaking a law that could mean being locked up for life. There are no consequences for the making of false allegations in this jurisdiction and proving innocence is almost impossible. The impact on an innocent person falsely accused is frequently catastrophic. Loss of access to children, criminal charges, incarceration, loss of career, financial devastation, reputational destruction, social ostrasism and more. The desire to prevent sexual crimes is commendable and moral. Not having the means to prove or disprove the facts of a case, serves no-ones interests and perverts the justice system!
I'll bet it's 95% for their puuur - jury in general. Notice how it's in Family Court but not criminal court so no investigation. That's my experience at least seeing it happen whenever they don't get their way or a man breaks up with them.
The charge for a false accusation should carry the same punishment as the alleged crime.

This is exactly why we must adhere to a presumption of innocence and a beyond reasonable doubt standard to convict over the presumption of innocence. No one deserves to be convicted on mere say so without evidence.

Holy cow! That example where the person didn't say no, but instead displayed their lack of consent through body language is ridiculous. If you don't communicate your thoughts or desires clearly, you can't say the other person knew. Communication is a two-way street. For proper communication to have happened, you need to express your idea and the receiving party must indicate their understanding. If the other person simply didn't understand the body language, you can't claim they r-word you. Speak your mind! Clearly STATE your desire to stop. This a perfect example of the need for a safe-word.

The landmark case occurred a number of years ago. A Brown University student was having consensual sax. In the middle of coytus she changed her mind and expressed that to him. He quickly stopped but because he didn't _immediately_ stop he was held liable for grape and was thrown out of college among other consequences.

She ends up with a book deal, multiple million dollar Government settlement and the accused is now bankrupt with no career prospects. No conviction was made.

A perpetrator HAS to be aware that they are breaking a law that could mean being locked up for life.
If the alleged victim doesn't say "no" or indicate that they are not consenting an act that otherwise would be 100% LEGAL and which our species' continued existance depends, the alleged perpetrator has no reason to think he is breaking the law.
They would be better off criminalising sex outside marriage, and decriminalising sex within marriage. That way it would be equal.

In today's america, you can be drinking a glass coke at night in the back of your truck's tailgate in a parking lot, listening to country music and minding your own business when cops hotline it in to arrest you out of nowhere. Why? Because some lady walking past had a bad night and reported that you assaulted her despite you having met the girl, let alone even seeing her at any point that night. You're still getting taken in and processed. Ridiculous.

The definition is legally different in the UK. A penis must enter the vagina or anus to be considered r*pe, but if it's the mouth being penetrated or other body part used to penetrate, then it's classed as "sexual assault." Women cannot be prosecuted for r*pe in the UK. However, here's where it gets stupid: A young man was r*ped by an immigrant who although being male, "identified" as female, so despite the victim being sodomised by a penis, it was reported as sexual assault by a female to a male, in both the media and the legal channels--absolutely disgusting as well as absurd.
If someone changes consent halfway through the act itself, then they were essentially also complicit in setting up the crime. The entire conversation around it is simply some orchestration to avoid what should be a shared accountability for one's actions. Owning up to mistakes should not be that difficult, should it?
Be an open, clear and honest communicator that is considerate of the other party. If you're not, and if they're not, then should you really want to be intimate?
