- The MK party spokesperson Nhlamulo Ndhlela says the argument they will
present to the Constitutional Court is that the absence of 58 of its
party MPs from Parliament's first sitting, means the house won't reach
the 350-member threshhold to elect a president, speaker and deputy
speaker.
Ndhlela says the party will soon submit their evidence to support the
contention that the elections were not free and fair.

The issue is not the number of votes misallocated or missing and whether or not it is immaterial to the outcome of the elections or not. We as South African citizens have fought long and hard for the right to vote. If my right to vote is infringed upon, or my ballot is discarded before or after I cast my vote, that would constitute a denial of my constitutional right which is a crime. I fail to understand how the IEC and South Africans, especially the media, can be so dismissive of claims from a multitude of parties of Vote-rigging. This reminds me of that famous saying of Joseph Stalin: “Those who vote decide nothing. Those who count the vote decide everything.”

Then, the allegations that the people that must go to parliament are family members and allies of the MK president. According to Constitution of South Africa,for Parliament to sit, it must have one third members which is 133 members. So even ANC with 159 members can legally proceed with sitting even if all parties boycott

Hey Sir. That is not true. The first sitting of the National Assembly must consists of no fewer than 350 and no more than 400 women and men elected as members in terms of an electoral system. The keyword here is FIRST and and the 2nd keywords is -- NO FEWER than 350. You can read this in the Constitution-- section 46(1). What you said, may only occur after the National Assembly has been established( created with no less than 350 members). You are referencing section 53(1)(b) of the Constitution, which only become valid done after the National Assembly has been constituted(created) period.

Not that I'm defending president Zuma, but the constitutional court had never sentenced anyone as a court of first and last instance before. His case has no authorities that can be quoted in this country therefore his suspicion of a possible error of judgement was justifiable.
