    Gerry Spence is a mind-boggling brilliance. As we were born to walk, he was raised to make the winning case. When a dispute has been the forbidden fruit of your youth, the winning argument should begin with a mindset that permits you to argue freely. When the argument comes from your own authority, it will not only be the winning argument, but it will also be distinctive among the others. Demanding the winning argument, on the other hand, involves the use of refined strategies. Spence is equipped with such tools to produce positive outcomes.

    "I was rejected from the legal fraternity when I failed the bar. I ran for Congress & lost. I then tried to get a job as a law professor, "nope!" When I wanted to become a judge yet it didn't happen". Gerry Spence (his wisdom & prowess came from losing away from the courtroom).

      did you become a lawyer now? I'm 50 I plan to study law but I don't know if my brain still functioning....lol....I would like to be a lawyer because like GERRY SPENCE I have the same passion...So funny it's been my dream since I was in grade school...

    Painting word pictures is the key. Any lawyer who's never lost a case hasn't tried enough cases. Wisdom is our consolation prize for losing. We don't learn a damn thing from victory.

      One of the greatest famous trial attorneys. But he's not much of a legal mind actually. So you're not going to see him making clever legal arguments in motions or appeals etc. But that's fine. Not his specialty. But what he does is a very small part of being a lawyer.

    Spence was so intelligent and so deeply philosophical. The issue is not lawyering but 'caring.' Sincerity is the main point. Personally I think he took his compassion too far in expatiating all wrong by force of circumstances. Perhaps this is the way he reconciled defending the guilty, I have no idea - but I respect him for being a brilliant lawyer.

    The comments here are evidence to me of how an eloquent and persuasive speaker can captivate and manipulate an audience to believe almost anything. The fundamental argument is that the rapist had the "cards stacked against him", therefore, one must pity the defendant and excuse him/her of their transgressions or at least show leniency. A great tactic for a defense attorney to be certain, but still amazing to me how ready an audience is to call that line of rationale "genius".

    Gerry did lose a mock criminal trial, however, vs. Vince Bugliosi, who was the prosecutor of Oswald. Gerry defended Oswald, who was convicted.

      +Dexter Haven There is not any way he could have won. h sonly had about four months to prepare and the JFK case is much too complex to learn in that period of time.

      Spence lost his potency during the mock trial opening when the judge broke his balls. Spence obviously had never been scolded to the degree. A a result, he lost his footing & never got it back (go back & watch).

      He’s awesome, but he also takes the victims family under his wings and during the trial they are the most important people to him and his staff in America. He talks in court just like he is talking here...personalizes each case.

    He lost me on his opening speech on Nature vs. Nuture. His argument could be used to defend Hitler, Stalin, Bundy and Jack the Ripper. Understanding is important but defending is a different issue. Whilst clearly a brilliant man he has never experienced violence or the fear of. His stance comes from enormous privilege

      +Mark G I think that award was lowered on appeal, plus it was a civil trial, without life on the line, like Racehorse Haynes when he got T. Cullen Davis off twice - for murder and then for conspiracy to commit murder.
      Davis was so guilty each time that the DA considered each one a slam dunk, then lost each case to Haynes, a magician.

      Speak to a jury as they are asked as those on trial. What they witness to a challenge is lives to a judgement in those not perfect or abused.     Can you imagine Spence defending Hitler. Here’s what he would say…….
    When you get a little puppy and put that cute little puppy in a cage and deprive that puppy of food and water, then you hit the puppy with a stick, what do you expect? Now Ladies and Gentleman of the jury, take a good look at my client…. Here’s a poor kid who was beat up by his father every day with a wooden stick… you know the rest of the story. This guy got Imelda Marcos off, with the poor little puppy routine. But he says I have to believe in my client. Marcos looted the country of the Philippines and had many innocent people murdered. But she paid Spence millions to defend her. I’m curious, would he defend a murderer who doesn’t have big money to be able retain a top defense attorney? Absolutely not! It’s funny how the more hundred dollar bills you keep putting on his desk, the more believable you become to him!

      Imelda Marcos did not pay one penny for her defense. Doris Duke paid the legal fees. Get your facts straight before you make your comments
