I'm finding these videos and other similar ones the best way to prepare for being-cross examined. Understanding the strategies being used, how manipulation is applied to maneuver a witness to a specific goal is priceless. The actual witness preparation does not provide the understanding of technique, and how that technique and control can be broken very easily by telling the truth and at the same time, not allowing oneself to be manipulated to benefit the other person's story which may or may not be the truth at all.
I think all witnesses should be directed to watching these types of videos. Understanding how strategies work, what is the process and the steps that create the strategy to shred a witness, even one that is telling the truth as sworn to do, is the first step in not allowing the cross-examiner to start off in control.

Stephanie, do not be so naive. If a witness watches this video, it will not help him / her. I invite you to have yourself cross-examined in the witness stand; you will find that human nature will not allow you to achieve the result which you think you are capable of achieving.
Witness coaching is not permitted; this is perhaps the most crucial of points here. I can tell that there is a sense of lay person in you.

Thanks Professor Rose. Good lecture on how to present a good cross. I am in a different jurisdiction to you but your rules apply here. I appreciate you publishing it. I will be better because of the knowledge you impart.

More examples please. Abstract concept is great, but examples are critical at making the understanding go in and stick

Ahh, how that first part of "asking the witness a question" bring back memories. You are not asking a question you are telling a story. Any good AUSA worth his salt would object. "Your honor is there a question there somewhere or is he testifying? Now this is not going anywhere but it will break the defense attorney's rhythm and wake the jury up. What I liked to do is wait until the defense attorney has gone through his speech and the ask for the question again. No, you are not in control. The truth is in control. Your conclusion is correct "if" and if is the biggest word in the English dictionary is correct, the witness heard "bang" and then looked up, he saw nothing. It was already over. Reminds me of the story that you never ask a question you don't already know the answer to. Once upon a time asked a witness if he actually saw the defendant bite off the victim's ear. The witness said no. The attorney asked, then how did you know he did it. Witness says on accounta I seen him spit it out. Sorry for rambling. I have only seen a few minutes of your post. I have been cross examined by arguably one of the best defense attorneys in the State of Texas. I will critique you according to him at the end of your video.

I enjoyed it very much. It appears to me to be a "losers" strategy. What I mean by that is you know your client is guilty and you are providing the fiduciary zealot defense of your client.

@@jacksontrollinger876 Are you a L1? Is this why I served in the military and went on to a very successful career in Law enforcement. So you only have to listen to what you want to hear? Free speech is free for all. I helped pay for it. Grow up. You are going to have to one day. So why not today?
