    Unfortunately there is no one who really ensures IEP’s or 504 plans are followed. It’s left entirely up to parents who often don’t understand their children’s rights. That’s why there is a need for advocates

      I had a 504 and never saw half the accommodations that were approved. My mom used to get pushback because she insisted I attend my OWN 504 meetings.

      Definitely. I nannied for a woman who luckily did understand her kids rights and she was on it from the start, you’d never know her son was autistic cause she even learned the therapies herself. My brother did the opposite and his kids are likely never going to be normal in any way

      No, they're not. Not that I disagree with the point you're making by neglecting this child, but from the standpoint of we have let the school system become a law unto itself. Nobody else in the gov't will buck the school system. The cops won't touch them unless it's something egregious like a teacher molesting a student. No one above their heads ever steps in to right a situation. Just look at what this school system is getting away with right now. Look at how many children have committed suicide over relentless bullying at school after begging and begging administration for help and being ignored. Not a principal or teacher has been prosecuted for their indifference and dereliction of duty. What does that tell you?

      Only prob w that is when a parent is paying for Dr's, and therapies, and taking time off work to orchestrate all the things, some don't have enough for a retainer fee. I learned our rights the hard way and they don't mess w me now. My child's advocates ask me to advocate for others after they witness our meetings and I cannot wait to be able to do so.

      Many do. Then their children end up lacking other skills. Per many reports a lot of children are doing poorly now because of the online schooling do to covid. Its a case of damned if you do damned if you dont. Plus money is an issue. Many no disabled children are not getting the education they need due to not enough funding.

      @@eileenmcdonald1599home schooling from dedicated parents is very different then the “remote schooling” during the pandemic. Typically, home schooled children excel academically when compared to their peers in public schools.

      @@daisymae3258 I know some amazing homeschoolers but yu are incorrect. It is difficult to assess whether homeschooled children excel or fall behind. If you go by reports made by the parents (aka the people who have a vested interest in saying homeschoolers excel) Yes, homeschoolers excel but if you look for more objective measures-they are hard to come by. Most homeschoolers never take anything like NAEP.
      My daughter had a classmate in high school that had been homeschooled. However, she struggled with the community college classes she enrolled in, so even though she had graduated from homeschool-She returned to high school at a public school for 1 1/2 years to fill in the gaps.
      My son went to a college where 1/2 or more of the students came from homeschooling-including his roommate. He went to a public school. What he found was that while he got some help from his roommate on things like Aristotle and Aquinas, he ws the go to for help in many of the sciences and math for a lot of guys in his dorm.
      Notably-both students got an amazing comprehensive homeschool education that was well balanced and comprehensive-In the case of my son's roommate-his mother was a pediatrician and his father a classics professor-in addition his oldest sister (10 years older and not homeschooled btw) was a public school teacher - not all homeschoolers are the same and most arent't Mds/Phds and MA ((BTW I also have a cousin she is a DMD and he's a PhD and the gaps in their education make me shudder-They while they were homeschooling, they were able to get help from a nearby relative who was ...you guessed it...a retired public school teacher)

      Parents are dropping the ball when they leave their child’s learning up to strangers. Where were the parents when their daughter was spending hours playing games and looking at videos?! I monitor the usage of my child. Most parents will drop their special needs children off and expect the school to perform magic when they can’t even perform magic.

    My daughter has chronic migraines. which require IEPs. They are brutal. And require parents to have doctorates and law degrees to get them done and to get what?
    In junior high, we asked for seating away from the window (bright light/glare), to carry water bottle, excused tardiness (one of her triggers at the time was the neurochemical fluctuations when waking up) and notes if she couldn't be in class. We also asked that she be allowed to do group projects on her own more work for her but allowed her to schedule work periods based on migraine conditions)
    It took 3 years to get THAT. Seating, water, notes, and doing more work.

      She is has had reactions to both triptans and ergots. Both are off the table. Anti depressants like amitriptyline are ineffective. Beta blockers had too many side effects. We have not tried botulism. Monoclonal antibodies are the latest classification approved migraine treatment but the insurance coverage sucks.
      Your skepticism indicates that you don't understand the spectrum of migraine symptoms or treatments. ...btw she was seen by a team at one of the best pediatric neurological departments in the country and a fabulous neurologist but migraines mandate very very individualized approaches.

      @@lindag4544It’s clear from your unsympathetic response, you or a family member you love has not experienced debilitating migraines that are not able to be helped much by medication. Not every medication works for everyone! Gaslighting people about their medical diagnosis isn’t very kind, especially when you clearly lack knowledge about how many suffer from this without proper medications that work despite the fact they may have tried everything their neurologist has in their arsenal. I rarely respond to rude comments anywhere, but the momma in me just couldn’t help it. This momma shared an experience that was valid for her and her child and you, without knowing any actual facts basically accused her of lying. I’m genuinely curious as to why that’s your default reaction?

    They have ten days from the IEP meeting request to make it happen or face a huge fine. I am in Alabama and I have requested three IEP meetings that were ignored and I fully intend to sue. These schools get at least 15,000 dollars a year extra per child with an IEP.

      Suing in court is expensive. A lot of the time, the courts first require you to go through the review process...IDEA is a federal law....administered by the Dept of Education. Trump plans to get rid of the Dept of Education...
      In other words, the courts refuse it and the investigators will be gone

      If they don’t reply, the next step is to contact the Special Education office of the state education agency. The parents have to be given a Parents Rights book at every IEP meeting that outlines steps to take and who to contact when you disagree with what the school is doing. The contents of this booklet are specified by federal law. Most districts don’t want to deal with the state agency.

    Yep, the district is doing things against the law by not having meeting. Parents have a right for an advocate to be there. It's against the law not allowing an advocate to be there by the school.

    Take your child out of there fast. Schools like that should be shut down. It’s not a School, it’s a daycare for special needs kids. Your kid will be so far behind due to them if she stays. Like they said they make her watch videos not teach. Trust me I have been there as a child. And until this day it still makes me mad. I wasn’t slow I just needed a little bit of help. I finally got the right kind of help when I left that School!

    I find it interesting that the school is not answering the questions presented but rather just giving "prepackaged" answers that are at best generalizations. If you have nothing to hide, you typically are direct and more than willing to answer the questions clearly. They are not which immediately makes me think that they are hiding something.

    This is the sort of situation where a parent and an instructor need to be in close, regular contact. Waiting till the school year is mostly over to schedule a meeting and then canceling the meeting on short notice is NOT in the best interests of the child.

    The parents brought an advocate without telling the school. The principal called Special Education Department at the district headquarters. Standard procedure. I have no doubt the principal was told to cancel the meeting.

      Not standard procedure. It's a delay tactic by the school, especially in light of the Demostrated Academic Regression. The Child is not receiving services as mandated by law. You do not have to announce the inclusion of an advocate.

      If you bring an attorney, you have to notify the district in advance. (You don’t if it’s just an advocate). If the attorney is present-even on the phone, the district will have their attorney present as well. If you record the IEP meeting, the district will also record the meeting. I’ve been in meetings with advocates, attorneys, and recorders. They can be positive and collaborative or adversarial.

    This was happening with my daughter who has Down Syndrome, not only was she regressing but she was also getting bullied. I tried talking to them and working with them to see no change. So I took my daughter out of the district and began homeschooling her. She is now thriving. She has friends who are also homeschooled and understand kindness. Unfortunately, schools do not have the ability to actually help our children anymore because there is way to much bureaucracy within our schools. Its not just special needs students, its all students who suffer. But honestly it was the best thing ever for us. I'm happy to be able to spend quality time with my daughter every day, watch her learn and grow.

    We have been also having "moments" of uncertainty for our autistic son's school. He is 8 years old. The entire second grade will go on a field trip and his class is not allowed to attend. His class was never part of any elementary school Christmas chorus or spring sing a longs. They don't allow them to eat in the cafeteria with the other children either. Something is definitely not right. I don't know what to do. I can't move and I am disabled and cannot afford homeschooling. He is a good boy that just wants to do normal kid things. It breaks my heart.

    I worked in special education for many years as a case manager with a private organization. We provided wraparound supports to families of kids with developmental disabilities. I was frequently asked by families and county staff to attend IEP meetings to advocate for families and help them understand their rights, and explain what services the child needed to be sufficiently reported at school. I could not have ever imagined advocates would be denied access to these meetings when parents wanted them present. I was often able to help parents understand what they could request and help the school staff better understand each family's situation. Advocates at these meetings are critical for getting the right services into a child's IEP. Good for this family for speaking up; they will help others in this situation.

    I'm a special educator, I've also worked as an Educational Advocate for a disability support agency that works with families of kids who have the same disability I do.
    If you're bringing an advocate let the school know ahead of time. While the rules are different between a lawyer and an advocate, it's still good practice to let them know. In my state the law is that if you're bringing a lawyer or recording the meeting you are required to let the IEP team know so they have an opportunity to do the same. It's not illegal, you just need to be transparent.
    I've gone into too many schools where things got acrimonious because people didn’t communicate. Honesty I don't know the full story here, but it sounds like the advocate came in and added fuel to the fire instead of helping make the situation worse. If this was their first encounter with the school they royally messed up. If this is after a string of problems then the school was way out of line.

    TN SUCKS!! I had to fight for 5 years (kindergarten through 5th grade) to get an IEP for my daughter (diagnosed officially w autism and adhd) but bc she's "high functioning" they ignored every request I made to communicate. The principal was a total jerk after my kid got molested by another student and I DEMANDED a meeting. She refused to accept her diagnosis bc she "didn't see it". Even though she isn't a Dr. My kid needed 2 independent diagnosis before finally giving us a meeting. Principal cried in the hall apologizing but by then, in 5th grade it was too late. They destroyed my child spirit. Kids bullied her and worse, the teachers (bc the principal just told them she was annoying). I expect that from kids, but the adults?!? Come on! The moment I got an advocate, it got the wheels moving. They only cared about covering their butts and their lies. I'm so sorry this family went through that. I am going to be am advocate one day so other families don't go through what me and my daughter went through. I hate my child's elementary school (except a few angel teachers that helped put her confidence back together in 5th grade). My experience was in Blount County TN

      I had high functioning grandson in Minnesota ..who was in special Ed study room until the last 6 months of high school. He ended up loosing his temper because he no longer felt safe because he was bullied.He had to leave 6 weeks before graduation. Luckily the system came through because he was high functioning he had already basically completed all his school work, the district had him sit in class in a separate school for problem kids…another type of experiment. He is employed for the last 5 years works quietly behind the scenes stocking.

    Firstly it’s absolutely ridiculous that it took until May to schedule the IEP meeting. Each school is supposed to have IEP teams in place and so it should never take that long to put a meeting on the calendar when a parent request one particularly in the case of a child that already has an existing documented condition, IEP in place, and when the parent believe that her goals and needs are not being met. Secondly, that conversation that was recorded sounded like the person had no idea what power they had a what they should be doing. If they’re going to cancel the meeting last minute they certainly should’ve had a better reason then I don’t know and I’m not sure.

    I was on the school board in my town and also on the Special Education Parent Advisory Council. The school district cannot and should not discuss any student or employee publicly. For the student, it is a violation of FERPA. For employees, it is a subject that may result in legal action, and these matters are kept private so to not impact the legal matters.

    Having worked in SPED the law provides for advocates participating in all official meetings... These district officials have access to attorneys but the family can't have an advocate...

    If the school district doesn't want to comply with Federal standards then it doesn't need its federal funds or its accredidation. I am sure once the Feds step in and start talking about pulling funds then a lot of people will be fired and replaced with those who will do the jobs. I hope they sue and win.

    Everyone involved needs an advocate; The child, parents & including the principal who was blindsided. Both sides need full support staff so everything is followed legally.

    From my experience, the IEP is almost useless for actually ensuring that activities take place in the classroom. Beyond that, they are good for things like special accommodations in environment or transportation. Another issue is that very few teachers get any useful training that specializes in autism and other neuro non-typical behaviors. The lessons are often not appropriately geared to the needs of the student. In some ways they are, but my experience is that emotional impairments (which are very often a significant factor) are not given much consideration. This results in a child that is stressed and begins "acting out". The teachers are more stuck on getting compliance and results from the child rather than helping the child where they are at mentally. Unfortunately, I would have to say that I've seen this type of behavior from the older teachers who are tenured and supported by the unions and administration. Younger teachers, who are often better suited, are pushed aside or kept silent.

    If these schools followed the IEP guidelines, as they are required by law to do, with as much energy as they use rejecting the IEP guidelines, there would be no problem.
    Every teacher is given the guidelines for every special needs student they have. But so many of them are “Hell Bent”on not following the guidelines. My wife and I have seen this with our son.

    An advocate is there because not all parents know their rights and not all schools know the law. Advocates can help you understand your rights and your children's rights, and help obtain the special education services your child needs and help facilitate disputes with the district. They aren't lawyers, but they certainly can tell you when it is likely time to get one.

    Transfer out of this district find a school that will take your daughter with open arms and it will change everything for her. The original school would have to pay it is called cross services. I have known parents that had to sue to get what is best for their children. Best of luck for your little angel🥰

    That school is screwy. Why was there a hitch about having an IEP meeting just because the parents brought an advocate? I’m very pro educator but when they are wrong, they are wrong. I had an issue like that with my son and it did not improve until we changed school districts. Sometimes the administration just isn’t any good. It goes all the way to the top with the superintendent.

    No, the principal didn’t have any discretion to refuse to meet, none that’s legal anyway. The statute isn’t permissive in that regard. I was around when IDEA was implemented. But hey, what do I know after 30 years practicing law?🤦🏾‍♀️🙄

    Reschedule the meeting - the school can ask someone from central office to attend ,

    Most sped teachers are really wonderful people, as are the majority of educators. However, being a great person and a great educator are not necessarily related. Colleges and school districts do NOT do a very good job in helping our educators become effective, professional teachers. I say this after a 40+ year career in public education across multiple states and districts.

    This happens far more than you think. Schools do not have qualified staff to coordinate, implement, and oversee these programs. Corners are cut to save money, which in turn makes the administration of the schools look good, and justify bonuses on top of their overinflated salaries. It mostly happens in smaller school districts where money is tight, and the "good ole boy" network prevails between the local school board and administration. In bigger urban districts this happens, but nowhere near as often because there is more scrutiny, and thus more lawyers ready to step in and make sure the policies are in fact followed, and the children receive the help they need. These programs are well funded, but the school boards and administrators find loopholes in the laws in order to pay certain "friends" more money. It is indeed sad that in order to get the help this young girl needs, and for which funds are provided, her mother will have to go to court. Otherwise the schools will stall and delay every way they can when releasing the records for this case. If they have done nothing wrong, why are they afraid to let everybody see they are telling the truth. It will drag on for years, and those responsible will have retired, or moved on to other positions in other schools, and they will never be held accountable.

    School admin is used to dealing with children where their athouritie is Godlike and all powerful. A single no or the act of questioning them can bring on anything from tremors to full on fits. This seems to be one of those full on fits.

    My sons OT PT offered to go with me.
    Its part of her job.
    I dont know how many times they canceled. Rescheduled or I showed up & they couldnt come up with the required people.

    I had a similar situation 17 years ago. I was taken out of the school system ). Minus chrome book. It is not surprising what happened to this 11 year old girl I can't stand special ed. She does need to be taken out of the school system.

    This is common behavior by educators and administrators throughout special needs educational actors. They violate federal law as needed, knowing there are to my count only 2 court cases that met an end in judicial decisions for the children and against schools. Now the legal route takes bt 5 to 10 yrs on average because of the protections bone deep in the institutions.
    Do your due diligence journalists I should not have to out do you in research.

    Oh and should you have to sue, since your daughter has down syndrome, it would also (your law suit) or should include a possible violation of the ADAA. I don't know for sure - but ask the attorney should yo go that route.

    Defund public schools. The problem is that the schools act like they're doing you a favor to use YOUR money, to educate YOUR child. This is because they get the tax money whether they do the job or not. When parents hold the purse-strings, and determine their own child's education, this improves. Reduce the tax burden, so families have more disposable income, and can make choices about their kids' education.

      @@answerman9933 Let citizens keep their OWN money, and make their own choices. The idea that the government should fund things - of their choosing - is the problem. (To be clear - I'm not in favor of the poor being left without education. I just think it should require qualifying, more like food stamps, rather than being forced upon every citizen regardless of need or ability to pay)

Instead of advocating for less funding to an already cash strapped system, how about increasing funding and services? When you cut funding, the above is the result.     As a teacher, when I hear a parent telling me that their child is using their Chromebook innappropriately, I really wish they'd come to the conversation with solutions. I can teach the students or I can sit there and monitor their Chromebook usage. I can't do both. There are all kinds of software that the schools can spend a lot of money on, but the kids find ways around every obstacle that is placed in front of them.
    Scheduling IEPs does take time. They have tests they run, interviews, and then they have to get a number of individuals' schedules all aligned so that the key participants are available. Canceling the IEP, therefore, would be infuriating for all involved.

    The SpedEd Dept and HR are king!
    The SpedEd Dept in its entirety are only ones who implement stuff and E/A are the ones doing most of the work with students! (Unless some minor minor time with physical/speech “therapy”!!!
