The most fundamental flaw in Chandrachud's argument is his flawed understanding of A-14 which is such an important article of Indian constitution. A-14 allows for reasonable classification, without this we would not have had different laws for Juvenile crime, many laws catering to SC&ST, etc. I am seriously concered if this man goes on to become a SC judge (maybe CJI) with such flawed understanding of Indian Constitution. India needs a 'well balanced' judicial appointments reform. A-14 provides for unequal treatment of unequals (under Equal Protection of Law), state is empowered to reasonably clasify people and thereby apply law differential among these group. And here the classification is on basis of "Religious" persecution. His arguments hold no water, all can be legally and constitutionally countered. The most fundamental flaw in Chandrachud's argument is his flawed understanding of A-14 which is such an important article of Indian constitution.
A-14 allows for reasonable classification, without this we would not have had different laws for Juvenile crime, many laws catering to SC&ST, etc.
I am seriously concered if this man goes on to become a SC judge (maybe CJI) with such flawed understanding of Indian Constitution. India needs a 'well balanced' judicial appointments reform.
A-14 provides for unequal treatment of unequals (under Equal Protection of Law), state is empowered to reasonably clasify people and thereby apply law differential among these group. And here the classification is on basis of "Religious" persecution.
His arguments hold no water, all can be legally and constitutionally countered.
