Thank you so much for this video! I almost send our case to NVC even though my daughter’s income requirements were’t met. It’s so frustrating to wait for so many years, but I agree it’s worth to be more prepared. She is in the States and I am in Canada - we're not seeing anything about income requirements in the initial I-130 application, when does that come into play? Is that after the Petition for an Alien Relative gets approved?
That's why I'm not rushing to mail all the applications too quickly even though I already have my marriage certificate. I thought I had to submit documents before my wife's J1 visa expires but I learned that I can still submit everything if she overstays her visa. So now I'm building a strong portfolio of bona fide marriage evidence to support my petition and feel that will take a few months having to show both of our matching names and address on license/passports, converting banks to joint accounts, and our domestic traveling with family/friends to have as more solid proof.

The Evidence of Financial Report requirements differ from INSIDE the US (Adjustment of Status) vs NVC to foreign Consulate. Yes, if Inside US they only care about last couple yrs tax returns (and will usually avg them.) If a Native country consulate however, the tend to care more about current Income (but you still need to provide tax returns. TIP: BE SURE to check the CURRENT YEAR 125% Poverty Level and BE SURE to be a min of 135%. If too close to 125%, they will assume you manipulated the numbers.

If you don't file taxes you need to get a sponsor somebody that makes money that is willing to say that if your mother ever ask for financial aid from the government they will be the ones providing it for her not the government.

I overstayed my J1 visa. I got the J1 waiver from the DOS. I heard I can file for green card now. But, should I provide the USCIS of the reason why I overstayed? With what? Evidence?

I'm really stressed now! My wife and I just responded to an RFE regarding i864. I never submitted my W2s to support my 2022 return, so we figured the rfe was for this. I've submitted 6 months worth of paystubs making my current pay rate which is well above requirements but all my returns for 3 years was part time work during college... will this be rejected?

Do I need to submit evidences for support if I am already living working in United States and have earned credit equivalent to 40 quarters of Social Security payments? You need a co-sponsor for that, which means another US citizen or PR. You will then file the "Affidavit of Support" form.
Hi Kseniya if someone waits 6 months to submit evidence and pay fees after receiving the nvc welcome letter, would that be too long to wait?
Your case will be closed if you don’t log in to the portal and are inactive for a year.

I got married a month ago with a USA citizen, we have been together for 5years, I have J1 student visa and we just send online the I130. however, we are getting all the documents to support form I485, but its going to take a couple of months, so can I stop going to the school and overstay whiteout affecting my case in a bad way??
Visa overstay is forgiven for immediate relatives of US citizens. But each case is different. For example, consider the 90-day rule.

We're going through the consulate in England for my wifes case. We were told we can do the i-864 right after submitting the i-130 which we did. Can you please answer if this is okay? I saw it in a video where someone was claiming he and many others have done that with success. Does anyone know about this??

No. They can’t be your joint sponsors or household members because they cannot consent to it. Also SSI doesn’t count as income

When filing your i-485 form you also file your affidavit of support and other required forms. Then you mail everything together to USCIS.
So if my spouse entered legally and her tourist visa will expire before I apply, will I need to send an additional form?

I did all my application with my maiden name, I am about to go to my biometrics today. Does anybody know if I can go in there and give my new name (my husbands) of did I have to do that since the beginning. I havent been able to change it yet because I don't have a valid ID. I want to know if it's possible to change it today in my biometrics so I can get my EAD and green card with my new name? because I know they will send a new SSN. which I already have one with my maiden name but it doesnt have authorization to work.

Hello, I sent my I-130 online two months ago and I was taking my time to fill the i-485 and collect all the evidence, but a coworker told me that I should have sent everything together and my case will probably be denied later on. I’m freaking out! And rushing to finish my I-485. So is it ok to send I-485 months after I-130?
You can send I-485 at any time with I-130 receipt

Is it possible to use the Petition I-130 for Parent? The goal is for Mom and my daughter to travel freely on occation for visits with me. Denied on the tourist Visa because we have a child, they wouldnt even hear it. Thanks

@@okita273 it appears to be fine. I resubmitted before I get the rejection notice, so I did not have the green sheet by that time. It might have helped that I resubmitted within 1 day of my initial application!

There’s a difference between a 2 year and a 10 year green card.
One question: if sponsor made $10k AGI in 2019, $30k AGI 2020 and $$40k AGI in 2021, is it enough to fulfill requirements? (Even though 2019 AIG wasn't above poverty line)?
You only NEED to upload the MOST RECENT 1 year tax information. If you make enough last year, then you're fine.
