'First-of-its-kind' conviction of man found in possession of illegal Glock switch

- Rochester, N.Y. (WHAM) - A first-of-its-kind conviction in New York state was announced Thursday.
Federal prosecutors announced David Rivera-Ruiz of Rochester was convicted by a jury on multiple drug and gun charges after he was reportedly found in possession of an illegal machine gun conversion device. He was convicted on five separate counts, most notably, "possession of a machine gun in furtherance of a drug crime. It is the first time a defendant has been convicted on that particular charge in the Western District of New York.
"We take these types of crimes very, very seriously," said U.S. Attorney Trini Ross, "If anyone in this community thinks it is okay to have a Glock switch, to turn a gun into a machine gun, it's not okay, and if you do that, we'll prosecute you to the fullest extent of the law."
In October 2022, authorities executed a search warrant at a home on North Clinton Avenue, where they say they found Rivera-Ruiz with a large amount of fentanyl and cocaine and had thrown a bag out of a window containing two illegal weapons with extended magazines capable of holding multiple rounds of ammunition. One of the magazines was loaded with 29 rounds. A .9mm handgun in the bag was modified with a conversion device that made the weapon fully automatic.

They try to misinterpret "well regulated" to mean law instead of its historical context related to the authors: to be proficient with firearms as a community, and to understand that responsibility. The enemies of our nation imply this right doesn't extend to the actual people but LE and Military etc. They make these implications in spite of Congress stating its not discussing the Natl Guard etc. They go as far as to their perversions of law as to call out semantics like firearm types disregarding the reality of their silly notion to think the 2nd stops at muskets. Wrong. If you have a glock switch it is possession of an unregistered machine gun under the National Firearms Act of 1934. That automatically means 10 years in prison and/or a 250,000.00 fine.

More paperwork and you need a boatload of money to buy a legal fully automatic firearm - like $20,000 for a starter firearm. That and a pretty extensive background check as well!!

If you've got the desire to own such items free of bureaucracy, buy a tabletop CNC mill & make your own stuff (remember, You've got no legal obligation to serialize any weapons you create, It's not big brothers job to know what you own & they should have no indication of what you do own until their picking up pieces of their fellow commies after the explosives you made (again, legally as you're presumably a legal citizen) did their job.

Converting a small handgun to full auto is about the most Reckless thing you can do if you are using it on the streets. Something like that would cause a lot of collateral damage from spraying bullets all over the place. Only an idiot would put something like this on a handgun with the intention of self-defense. You're going to hurt a whole lot more than your intended target.
This is not the first of its kind. They have been around for decades and have been illegal the entire time unless registered on a Form 4.
Aside from the legal questions these switches do not turn the weapon into a "machine gun". It is a machine pistol at best and not very effective in that role. For the most part, law enforcement and the military do not use full auto handguns. They are hard to control and consume huge amounts of ammo.
There are times when that option is useful.
That doesn't matter NYSRPA v Bruen protected rate of fire & accessories too.
It is 100% ok to have a switch, the only ones that makes it "not ok" is this sovereign Government.

To me a Glock switch would make it harder to actually aim and handle. A Glock with a switch is NOT a machine gun though.

Um.... well.... since the 1990s and the war on "Kitchen table gundealers" the ATF has required that SOTs have a place of business. This business must have a physical location and hours.

I finally had the chance to shoot something with a switch. Guy who legally rents such stuff. Glock 17. I carry a Glock 20 sometimes so a Glock 17 is not a problem for me.
A Switched on Glock's muzzle climb was irritating I needed to hold the item up high where slide bite was a risk, and it was a handful. I could hit things with it.
I can shoot an M14, he rents one of those too. I have decent trigger discipline.
Rather shoot an AK series or M4/M16. Much more pleasant, what the world is focusing upon today.
Where a Switch might be nice is a burst limited item with a compensator.

this is stupid, because if they actually did want to go after anyone, it would be Glock themselves, not people who have switches, because Glock makes those guns with full intention of being able to add a switch. Wait until people learn that it's way, way easier to convert an AR-15 to fully automatic than a Glock. You can convert an AR-15 to full auto with a metal coat hanger. All you gotta do is cut the top of the coat hanger off, and bend it into sort of an S shape, then put it in the fire control group pocket so that the rear takedown lug holds the bent coat hanger snug against the shelf at the rear of the fire control group pocket, and the bolt carrier group presses the front end of the bent coat hanger down on the back of the disconnector so that it drops the hammer as the bolt goes into battery. If that explanation is too complicated, just Google coat hanger machine gun.
