Airspace above private property is considered an easement via faa regulation. Passing through is not illegal. Agreed. I just had a neighbor walk up and give me beef about the drone. I never went over their home, have the data to show, and I was at 250 feet. Walking into my garage out of the blue was more invasive..

All that you said, is absolutely incorrect. There are classes of airspace. Class A which is 17,999 feet MSL, then Class B, Class C which are around the busier airports, Class D and Class E. Most airspace is under Class E, which in most cases doesn't begin until 700 feet. All other airspace is class G, which is uncontrolled airspace. Drones are allowed to freely fly in class G airspace up to 400 feet AGL. The shooting down of a drone is 100% illegal, and yes criminal charges can be brought on a person. They can face stiff fines and yes, even jail time. So what you're saying is 100% not true at all. Now with that said, Drone Pilots are expected to fly responsibly, safely, and follow the laws. You can NOT shoot down a drone, period. I don't care how you try to color it, you simply can NOT. Drone pilots CAN fly over houses; however, they should never ever hover especially at low altitude. No one has any domain of airspace, other than the FAA. Period. Also remember this, any state law does not trump federal law.

It's different when you have a drone come to your and your neighbors house multiple times a day and when they see you outside they hover closer . I have cameras on my property showing how even tho the drone does move around ect it also like getting close where its atleast 25 feet in the air when seeing us outside

A lot of drone people are completely ignorant of the law and air rights. In the 1946 Supreme Court case - United States vs Causby 328 US 256, established that the property owners have domain of the airspace at least 87 feet over their property with possible implied control up to 500 but is has not been defined by either the Supreme court or Congress. The case also implies that the FAA controls airspace from 500 feet up (minimum safe altitude of flight), but may change very soon, and then be challenged.
Flying over private property without the owners consent can be construed as trespass and or violate nuisance laws in many jurisdictions. In a Kentucky federal court hearing, the judge dismissed charges against William Merideth, who had shot down a drone operated by David Boggs over his property, saying it was an invasion of privacy, that he was within his right.
David Boggs then sued Merideth for loss of property ($ 1500.00). Bogg's attorney tried to make his case by saying that Boggs was operating his drone in US owned airspace (FAA controlled airspace) rather than Merideth's property, hence, he did not violate Merideth's privacy. He failed to prove that the airspace was in fact owned by the United States and eventually lost the case. He appealed and lost.
My take is that Boggs is not exactly the brightest person in Kentucky. The writing was pretty much on the wall at that first hearing, yet he hires a lawyer which is going to cost at the very least a grand or two per day (a lawyer spending a full day in court is expensive), and they are going to try and go against a notable supreme court case (US vs Causby). That loss wasn't enough for Boggs, so he had his lawyer appeal it. All for a $1500 toy, what a chump.

All that you said, is absolutely incorrect. There are classes of airspace. Class A which is 17,999 feet MSL, then Class B, Class C which are around the busier airports, Class D and Class E. Most airspace is under Class E, which in most cases doesn't begin until 700 feet. All other airspace is class G, which is uncontrolled airspace. Drones are allowed to freely fly in class G airspace up to 400 feet AGL. The shooting down of a drone is 100% illegal, and yes criminal charges can be brought on a person. They can face stiff fines and yes, even jail time. So what you're saying is 100% not true at all. Now with that said, Drone Pilots are expected to fly responsibly, safely, and follow the laws. You can NOT shoot down a drone, period. I don't care how you try to color it, you simply can NOT. Drone pilots CAN fly over houses; however, they should never ever hover especially at low altitude. No one has any domain of airspace, other than the FAA. Period. Also remember this, any state law does not trump federal law.

Justin I know what you're saying, im learning to fly a droan, they aren't as easy to control as you might think I have had a few cheap ones fly off on their own and been " squashed" in the middle of the highway... its like ouch! Then damn. I attempt to keep mine on my 10 acres but I do have a lot of trees. I understand that you probably like your privacy, but there are a lot more of us learning, and not wanting to harm or get anyone's feathers ruffeled, we just like to fly our toys and have fun. I love aerial photography that's why I fly. If you would try it once, you will understand what I'm talking about, but then maybe you don't care about aerial photography.... Happy thanksgiving

Flying by or even over my property is one thing, I don't think anyone would care, but hover above and film, that's a new issue, those need to be taken down. You can't climb my fence and film my yard, me, my children etc. I wouldn't hesitate, it would come down.

First the individual with the certificate will be mindful and respectful of you as a property owner. I have no problems, it's call informing and requesting. Oh the flip side..drones are classified as unmanned aircraft, and an individual can get into serious consequences on destroying a platform zipping across the air at non harassing altitude.
