      my question as always how do they get a warrant how do they get permission what do they need to do or take and send to a judge to get a warrant to try come in cause its one thing to be stood outside no curtains and witness some idiot watching the mitchels on eastenders i assume they are still there but what if they just lie to get in

      What if your TV, has pre loaded station's. I do not watch TV, i only use it for my Xbox. How can i prove i do not watch tv? i have no Aerial cable attached, only cable for internet.

    As a pensioner now, I had to find ways to cut costs - getting rid of the television and the licence cost was the best thing I did. My pc gives me access to everything I need.

      I will become a Pensioner next January and I stopped paying for aTv Licence 6 years ago . In that time I have had 38 Letters from Capita and two doorstep visits where I just shut the door on them , they can get knotted !

      Snap, you can do without BBC very easily. I get a “warning” letter every so often that they might decide to visit me, which is no problem. Thanks to this UTube channel and others, I won’t get into any conversation with them and they will not be invited to enter my property.

      @@Rogerdowler That's not true as you wrote it. You don't need a TV licence for radio at all. You only need a TV licence for youtube if you're watching "live TV", they give the example as Sky News live, and you only need a TV licence for Netflix if you're watching live TV on it.

      ​@@CarolWoosey-ck2rgMen are far far more difficult to coerce, if a man knocked at my door and suggested I had to let him in, I would laugh in his face and wind him up, a lot of women when someone with a suit and a clipboard and a silly badge turns up at their door claiming to have some sort of authority, women are far more likely to 'recognise' that authority and let them in. The reality is a lot of the time in this world, people try to pretend they have authority over you when they have none.

    TV licensing thugs (3 of them) turned up to my old place - one of them forced his way past me and I had to resort to physical force to prevent entry and protect my self from harm. The police threatened to charge me with assault if I didn't let the matter drop.
    This is why for the last 10 years I have denied right of access to my property to these scum, and its also one reason I have zero respect for the police.
    The LAW does not matter when it is ignored or selectively enforced!
    The LAW is not there to protect ordinary people as it should be - it is a mechanism of power, only usable by those with sufficient money.

      Shouldn't have let the matter drop. Should have added that the police tried to dissuade you from not reporting it by threatening to charge you. Ie. they used a threat to try and make you do what they wanted you to do.

      @@ianwebb6182 yeh. I did let it drop out of frustration of not having a solution - but it forced me to learn the law my self. if it hapened again I would fight it. I now have legal insurance throgh my house insurance - at the time I simply did not have money to fight it - and I was too busy looking after my father with terminal cancer.
      I lacked the weapons to fight then.. now I do not, so atleast I did take action of a sort.

      @@davidioanhedges if by not paying for TV in the US, you mean along the lines of jacking cable or satellite illegally, that's because it's an entirely different crime, keep your American ego in check sir..
      Of course you'd get arrested for Telecommunications Service Theft, but that's a different crime. People who don't pay the BBC License Fee aren't illegally acquiring TV access, they're just not allowed to use it.

    I'm 40. Not once in my adult life have I owned a TV. I don't watch iPlayer. I don't even watch BBC stuff on youtube. TV Licensing still send me harassing and threatening letters and send men to my door. I refuse access on principle, now - in the past I tried letting them in and just showing them I wasn't breaking the law and it was at most like 6 months before the threats started up again, so there's clearly no point.
    It makes me incredibly angry to hear how high the conviction rate is for TV license non-payment, because of what that communicates about how our legal system prioritises prosecution of crimes. Compare that to the conviction rate for any other crime, for violent crimes, for crimes that involve actual harm to real people. It frankly makes a laughing stock of our legal system.

      I think the BBC should transition to a subscription-based model, similar to Sky or Netflix. This would allow the licence fee to be eliminated, giving residents peace of mind without the worry of harassment or bullying.

    My wife was so pi55ed at the quality of the Olympics coverage , on the BBC, that she cancelled her direct debit today ! Hoorah...been a sore point with me for four years. I never watch the BBC...and not even any other channels. I just watch yt and streaming services.

    I haven’t paid my TV licence since 2021. I’ve called them very politely in my best British voice that I don’t need the TV licence. I was very polite and so were they. You will receive a letter saying that you do not need a TV licence, but they will get back to you, in 2 to 3 years time passed and I had to call them again very politely that I did not need a TV licence the lady was very lovely on the phone rinse and repeat Thank you very much black belt barrister for your videos. I would be lost without you. They mean a lot to everyone.

      Did you also, in your best British voice, politely call Amazon to tell them you didn't require Prime, or Netflix or Hulu, or the sponsor of the video NordVPN, or any of the other literally hundreds or thousands of other various subscription services for all sorts of things that exist to tell them you would not be requiring their services? Did any of them have the gall to send hired thugs to your house to demand entry so you can prove you are not using that service?
      I've had a visit in the last few months. I opened an upstairs window to talk to them briefly, told them what I think of the BBC and they still snooped around my property, peering through windows and generally invading my privacy for an uncomfortable amount of time before I threatened them with trespass charges and they eventually left. ANY other organisation doing this would be all over the front pages embroiled in scandal for it (rather than the various other kinds of "misbehaviour" their employees hit the front pages for...)

      I do not have a driving licence either and no one hassles me about it.

      A TVL officer can visit and enter with a warrant alone in law. Sect 366 (2a)
      I think however CAPITA policy is that they attend with police as they are not trained to go hands on if there is resistance at the door. Also, the police are there if the occupier needs arresting for obstruction.

      @@BlackBeltBarrister I've heard of cases where the defendant was waiting to enter the court, for the trial, when someone from BBC/TVL has approach them, and asked them to step into a room, so they can "have a word".
      When the defendant refused, they were then informed that the case had been withdrawn.
      Presumably, if they had gone into the room,, they'd have been pressured to change their plea to guilty.

      So you'd get charged for assault or worse, instead of just refusing them entry, which you're perfectly entitled to do and they know this, its just typical underhanded tactics to scare the uninformed or those who aren't used questioning authority.
      Of course if they barge past you or gain entry to your property without permission they open themselves up to all sorts of charges and possibly private prosecutions if you get good legal advice.

    I met a TV licencing office on holiday. What a load of rubbish he tried to tell me when I informed him I didn't have one and didn't need one. He advised me to get one just to be on the safe side. He even tried to tell me if he was outside my property he could tell if a TV was being used even though I lived in a flat on the 3rd floor. He claimed he was like a walking detector van but couldn't explain where this bogus equipment was on his person. He did say they almost make their own hours and he would go out on Sundays when people least expect him so he could meet targets for monetary gain. He'd gain entry into student accommodation, sometimes on other pretexts because most didn't know they required a licence and it was easy pickings there. His lies and manipulations were astounding, I could see how once he'd gained entry some people would believe his lies.

    TV Licencing operates on the basis that they require proof that a criminal offence has not been committed. In order for there to be any criminal conviction, proof is required beyond all reasonable doubt that an offence has been committed.
    Why have TV Licencing been allowed to turn the law on its head and work on the the basis of guilty until proven to be innocent?

      Because that's the way the statute is written. As the BBB mentioned (but kind of skipped over), the relevant statute makes mere possession of TV equipment that is capable of receiving live TV (i.e., it's been installed, wired up and tuned in that way) require a licence. So, if they see an aerial on your roof and can see a TV displaying a picture through your windows, that's all the evidence they need to make the accusation.
      Now, I have milk in my fridge but that doesn't mean I have a cow in my garden: an aerial on the roof and a visible display on the TV doesn't, obviously, mean you are necessarily watching live TV... but it's persuasive of that possibility. And they prosecute on the basis of "reasonable grounds to believe".

I do not want a world in which I don't watch live TV yet still have to fund a state-owned TV broadcaster, with no possibility of legal opt-out. Long may the current TV licence regime continue, therefore!
      I also have less cynicism than you about the British public: most of them (22 million plus) _do_ pay the TV tax. Because most people want to stay on the right side of the law, probably, and think paying for something they consume sounds reasonable.

    In the UK, TV Licensing agents are not allowed to enter your home without your explicit permission, except in cases where they possess a valid warrant. Securing such a warrant involves a legal process where the TV Licensing authority must first gather and present compelling evidence to a magistrate or district judge. This evidence must sufficiently demonstrate that there is a reasonable belief that a TV license offense is occurring at the property in question.
    To be granted a warrant, the TV Licensing authority needs to show that there is probable cause for their suspicion. Essentially, they must convince the judge or magistrate that there are valid reasons to believe you are watching live television or using BBC iPlayer without holding a proper TV license.     I have had two interactions. One was when the inspector rang the door bell and when I opened the door he calmed to be selling washing machines. When I denied entry he said I can hear you have a TV. I closed the door and a few weeks later got a summons or postal....... I turned up at court in person, the inspector did not. The judge heard my side of the situation, showed anger that the inspector was not there and dismissed the case. The second time in a different home with a inspector on my door step that could not believe I did not have a TV and was very argumentative. I did not have the emotional strength to put up with him returning so I gave in and said "I will take you round my home under the understanding you do not search or touch anything" After he was surprised "you really don't have a TV.........." but not apologetic. However I did complain and ironically got the offer of a free TV licence, I turned that down.

    I stopped watching any TV at the end of 2022, binned the TV set, cancelled the licence and that’s where I am today - legally not paying for something I don’t use or need. It’s a liberating feeling. The incessant letters from TV Licensing are an irritant but also amuse me with their talk of all their investigations.

    I lost any interest in TV - BBC or any other - about 25 - 30 years ago. When I started getting private contractors showing at my door pretending to have Gestapo level authority, I never let them in. The first few time I was nice and polite with them. Until I got fed up, especially when one tried to just walk past me. Tried. Now, I call them distraction burglars using fake IDs, take a short video of them and give them 15 seconds to go away before I call the police.

    Another point to remember. Is a licence holder can watch live tv anywhere. So if your neighbour is mate is sat in your house watching live tv. They are perfectly entitled too.

JUST ask who they are, and then say "No thanks" and SHUT THE DOOR!
    ALSO... BE AWARE of WHERE YOUR TV IS PLACED WITH REGARDS TO EXTERNAL WINDOWS!!! I had a neighbour who got pulled into court because - He got a visit by a coupla goons, he said "Nope, don't need one!" and closed the door..., BUT, he was watching a DVD film on his TV and they COULD SEE IT playing on his big screen TV... So they PRESUMED he was watching 'Live' TV, or, more likely MADE OUT that he was... It took a while, but he managed to win the case! The BBC/Capita goons ARE SNEAKY BASTIDS!!! 🤬🤬🤬

    We had endless hassle with me TV licence exempt late mother in law's licence account. We were selling the house and it was empty and had no TV but they took some convincing! When the refund cheque came it bore the word 'Capita'. Says it all. TV licencing is a profit making business.

    I have a TV licence enforcement officer make a pass at me and claimed he could get me off from prosecution if we went on a date. I'd already proved I was exempt. I reported him and now refuse them access whenever they show up. It honestly made my skin crawl that I was subjected to that. He'd given me his number so when I complained they had proof to give to his boss when he came to speak to me. I think he was sacked thankfully.

      Good question: A number of utilities try to "pass off" that they have a warrant authorised by the court that on examination turns out to be nothing of the sort. Generally a court document will have the name of the court its address & phone number and it should describe that at a hearing on such and such a date it was ordered by a judge (named) that they could do {whatever the court ordered}. If you were shown such a document it should have your name as the defendant & address of your property and case number. If you suspect that they are trying to "pass off" a document that is not valid you can always ask to see the document and then tell them that you want to verify its legitimacy with the court. However that could take hours to get through and even longer to confirm. If they are accompanied by an officer of the law you can get them to help you verify whether it is a legitimate document or not. But I suspect that a police officer will say that they are not authorised to give legal advice in which case they will have to give you time to check it out yourself and come back another day. Their single greatest weapon is fear & intimidation and bluff. Of their three greatest weapons are fear, intimidation bluff and bluster. You get the rest. Lol

      They should be wearing a lanyard to identify who they are. If they don't identify themselves straight away, you should ask who they are. Don't engage in any more conversation or answer any questions. Politely shut the door while saying 'No thank you.'

    I don't have a TV licence, but I do have a TV. The TV isn't connected to anything that receives a live broadcasting TV signal, but is used as a monitor for the computer so I can watch UA-cam, ITVX (catch-up only), Prime, and Netflix.
    You don't need a TV licence to own a TV set so long as you use it to watch streamlined (not live broadcaast) programs, excluding the BBC iPlayer. You only need a licence if you are using a TV set to watch a live broadcast.

    I am quite surprised at the conviction rate….. As a former police officer, I applied for warrants under various pieces of legislation multiple times per week.. the amount of effort to justify each search warrant, would suggest to me, that it would be almost impossible for tv licensing to obtain warrants to cover all these cases…. Secondly, if it went to trial, I am pretty sure the magistrate, or equivalent, would intervene, if defence didn’t raise it, to ascertain if there was a warrant in place… then if there was any suggestion tv licensing had misled or tricked the occupant into gaining entry without a warrant in place, then any subsequent evidence found would be unlawfully obtained…

      Apparently very few warrants are actually applied for. Most convictions are based on something said by the defendant. Some people just don't know when to keep their mouths shut. Or how to shut their door without saying anything.
      Even buying a licence from the Capita door to door salesmen can land you in trouble, it can be assumed that until you bought it you had been watching TV without a licence. Buying the licence DOES NOT give you immunity from prosecution for something done before the purchase.

      You are spot on... As Danial Has pointed out in numerous Videos, The TVL is handled by a "Single Justice System" - If you dont attend court, You are convicted in your absence! Which is another reason the conviction rate is so high... As for Women being disproportionately targeted.. Yeah, They are often, even now the "Mothers" at home looking after the children... And they end to want to speak to an adult after having no one but teh kids to talk to all day, So they are more likely to speak to a TV License officer and unfortunately "Condemn themselves"
      The vast majority of convictions come from Admission... Or just being foolish enough to speak to a TV License officer, As they used to be paid on Commission - So they woudl make up every LIE you could think of to convince you that you MUST have a TV License, Even if Legally you di not need one...
      I have not seen a TV License Officer in over a Decade now, The last one I did see back when I was a Single man, Tried to convince me that I MUST HAVE a TV License as I watched DVD's and used a TV set to play my "Microcomputer" (I was in my first home away form my parents, and bought myself a second hand Acorn Electron!) - Thankfully, I did not fall for his guff... And I was also on my way to work so he could not keep me there to speak to him...
      ... And that was the last I ever saw of one of them! I guess it helped with me Living in a Tower Block as well! They had to get through Security first and often Security woudl not let them in! PERIOD!

      FYI A FOI request revealed that in the financial year 2014-15, TV Licensing applied for 256 warrants to serve in the UK. 167 warrants were granted by the courts of which 115 were executed.

      @@aNiTF3 I'm not condoning anything illegal, merey pointing out the facts. I also read somewhere that 100% of conviction are made on the basis of a conviction. Given that the offence is against a particular individual and it has to be proved beyond reasonable doubt that that particular individual watched broadcast TV or iPlayer, it is hard to see how it could be otherwise. Is a BBC agent with a warrant really going to catch a particular individual in the act of watching when they turn up with warrant? I think it very unlikely.

    I have legally not paid the TV license for over 15 years. My fear is that the government, especially of the Labour flavour will replace it with a mechanism that you are unable to avoid even if you do not consume their product eg added to council tax or some other mandatory tax.

    The fact they say you must declare no licence required every 2 years is a joke. That needs to be removed. I cancelled Prime a little while back because of the price increase and the addition of adverts as well. I am not required to cancel that every year or every 2 years. It's cancelled and forgotten about until I decide its worth paying for again.

    We bought a cottage in Wales so that we could have holidays. The nature of our business made it impossible to book holidays, and so we wanted a place we could pack up and go to at the drop of a hat. We wanted it to be a place we could completely unwind and did not want a TV. TV licencing started hounding me about not having a licence and would not accept that we didn't want a TV. They were very threatening, aggressive and rude. They said they would break into the house while we weren't there, and the house would be left open when they left. They said that they would take me to court and prosecute me if they found anything related to TV equipment there, such as aerial wires, TV cabling, etc (which there was from the previous owner - and a Sky dish that wasn't in use). I found the whole ordeal so distressing that we bought a TV and have been paying the licence fee on that house for about 15 years now, and the TV doesn't get watched. I don't even watch TV at home anymore (I still pay for a licence, though) because there is more interesting stuff on UA-cam than on the BBC.

    I unsubscribed my email from the BBC asking me if I watched TV to pay for a licence.
    A very quickly had sent to me in the post a letter that I could expect a visit from them to determin if I have been watching TV.
    I don't watch TV because there is nothing on what I like so they can whistle until the cows come home.

    I can remember the days when I paid 7/6 a year for a Radio licence. The licence said explicitly that I must be willing to let them inspect my receiving apparatus. TV has always been different.

      I am an amateur radio ham and am licenced by Ofcom (the same body that regulates the BBC). They have a clause in that licence that says I must let Ofcom in to inspect my transmitting apparatus (if there has been a complaint about interference and there is reasonable cause to suspect that I am the cause). Recently they amended their regulations and said that amateur radio hams do NOT need a TV licence if they do NOT watch live TV. However amateur radio hams can transmit & receive TV signals but on a different frequency to that used by the terrestrial services. Its a strange world.

    I remember when I first started university 20 years ago, TV Licensing would send out blanket letters to the halls of residence rooms. They contained details on how we weren't covered by the TV license at our parents, nor were we covered by the license that covered the communal TV room. As well as containing all the threats of (what was then) a £1000 fine and all the rest.
    I didn't take a TV to uni with me and so I gave the letter a stiff ignoring. A couple of months later a slightly more threatening letter came saying that "I must pay for a TV license", with small print saying "if you watch or record live TV". I continued to ignore them and they became ever more threatening and had more red on them each time.
    When I was travelling back to uni after Christmas I was bored on the train. I decided to send them an email telling them to stop sending me threatening letters. I told them I did not have a TV and therefore I did not need a license. I then went on to say that there is no requirement for me to contact the police to prove to them I'm not committing crimes, so why should I have to prove to them I don't have a TV. I finished up by saying that any further threatening letters sent to me will be forwarded to a solicitor and dealt with accordingly.
    They then stopped sending me letters after that.
    As for how they "detect" people using TVs, I have heard many a rumour that it is as simple as walking by and or waiting outside your house and listening for live TV. E.g. they hear the Eastenders theme coming at whatever time it's starting or finishing and then knock and say they've detected your TV. Technically they're not lying, but I'm pretty sure they don't have a special van, like something out of a 60's spy film with a detector dish on it. As much as they would like you to think otherwise.

    I just got to 4:10 in the video... I am going to hazard a guess that TV Licensing are going to try and leverage something that Bailiffs can do... If your door is Unlocked, certainly if it is open during this HOT, HOT WEATHER we are having right now... A Bailiff can just WALK RIGHT IN!
    Now, TV Licensing should NOT be trying your door to see if it is unlocked... THEY ARE NOT BALIFFS - They are Salesmen! But if a Door is Open, YES - THEY CAN... Your door being open constitutes an "Open Invitation" for want of a better word...
    As for your question that you ended with - Do I think it is a fair fee to pay? Not anymore... Times have changed, When there were only 2 or 3 channel's, It made sense... When the old Analogue System was used for Broadcast, it made sense... Not only was the TV License funding the BBC it was also maintaining the infrastructure to broadcast!
    With teh advent of Satellite and Cable Broadcasting, Not only were we receiving more channels, We were paying for them SEPERATELY! These companies - The two largest of which still operate today - SKY and VIRGIN - Provided their own Broadcast Systems... They were NOT using the National Infrastructure.
    Now in 2024, With Digital Broadcasting, EVEN FEWER Broadcaster's are using the National Infrastructure! And yet the BBC still hold's a Monopoly! Were it not for the Royal Charter... The BBC like so many other companies that old a Defacto Monopoly woudl have been dragged before The Government and FORCED to play fair!
    The only reason we still have to deal with the TV License is that Royal Charter... If it is not renewed in 2027... The BBC will no longer be protected! Sadly, It looks like Kier Starmar will aim to "Renew" the Royal Charter - Or failing that will impose a Media tax...
    In my view, The BBC should become a Subscription Service - They dont want to as they are currently GARUANTEED BY THE ROYAL CHARTER £5 BILLION A YEAR ENFORCABLE BY LAW! (And yes, That is £5 BILLION... And yet somehow the BBC says it is unable to make ends meet and is in debt! There are literal Countries' that not only survive but THRIVE on £5 BILLION a Year...)

      Except for France Televisions, which is the national TV network funded by the treasury; or ARD, the German national broadcaster funded by a mandatory licence fee; or Television Espanol, which is funded by the Spanish treasury subsidy; or RAI, the Italian national broadcaster, which gets it's funding from advertising and a mandatory licence . . .

      @@EvilGav I think they're referencing the BBC in operating an elective subscription service overseas, while compelling people in the U.K. to only access their content through the mandatory purchase ( in threat of forfeiture of goods ) of an annual license.

      Don't think they can demand a licence fee from any other country other than the UK, if that's what you mean. I've said this for a while now though, I'd like to know exactly how much revenue the British government makes every year from TV licencing. They must make something substantial because they are extremely supportive of it.

    Good video. You should lay out exactly what people can do and watch without a TV licence. There's some deceit going on and if they are struggling for money then the coercion/entrapment will get worse...
    I don't have a TV licence and don't watch any live TV. Interestingly enough the iPlayer will tell me when I last logged in. Which was at my mother's who has a TV so she could watch Strictly but that was years ago and I was living there. Another interesting thing is UA-cam does stream some things live. What's the rule there, they're not on mainstream TV? As a rule I avoid everything live but it would be interesting to know and I could give examples.

      That's because you live in a posh area, like me, where people who watch live TV just pay. It's more worthwhile for capita to focus on poor areas of the uk where there are more people watching live TV without a licence and where they are less likely to know their rights/stick up for themselves
