Flying Drones Over People and Vehicles FAA Ruling... is it Legal? the Interview
Вставка
- Опубліковано 6 сер 2024
- Is Flying Drones Over People and Over Vehicles allowed for all Recreational and 107 pilots, according to the FAA? NO. I interviewed the FAA to get answers on Who CAN and HOW. BVLOS, Remote ID and Night flying is discussed as well and even a little history and some passionate pleas from the FAA. I learned a lot in this discussion and I'm sure you will as well.
*** As always I'll continue to share the nuances as I find them but PLEASE LEAVE ME YOUR COMMENTS as well, I learn a lot from you too! Good Flying!

Hearing directly from a FAA representative is very informative. Instead of hearing someones interpretation of the rules or their feelings of what the FAA is doing, hearing it directly takes the quessing out. It allows the FAA to get out accurate information to the people. It's a win for the FAA and for the ones the rules will apply to. Great job with this one.
Thanks for the kind words, glad it is useful to you! Good Flying! 😎
It's definitely great to see... I still have mixed feelings about the rules and rules to come. Now. if I'm sitting on the front porch I'm not supposed to fly the field in my back yard but with remote ID I could fly around the block. The problem with that is if I go to a Park everyone will know who I am and where I'm at.
Everything is changing and all we can do is make our voice heard about loosing our freedom and the right to fly anywhere from a safe height over a few people in passing is OK and use a strobe lights to fly at night and just use common sense and do the best you can to comply with the regulations and have your number from the FAA on the drone I ordered a sticker with my number and phone number on it for around 10 bucks
Super cool FAA rep...
@@YorkyPoo_UAV Just fly bro, I'm sure your smart enough to do it safely. Getting a ticket from the FAA would be like winning the California lottery
I own and operate a commercial drone company and have been in business for several years. I do my best to keep up with the changing FAA rules. Nice job with your video. It's always nice to hear directly from the FAA.
Thanks for watching and taking the time to let me know!
Keith this video was a huge help! Thanks for taking the time putting this together I sat through the entire video taking notes.
Give this man a raise, FAA. He just single handedly gave a large organization a real face as a real person and made me feel very comfortable about your intentions.
Also I can confirm: I’ve reached out to the FAA when planning a flight here in LA and they were incredibly fast and helpful in their responses.
Thanks for chiming in, appreciate it! I as well did feel a bit more at ease hearing what I think were authentic responses and reasoning from the FAA via Kevin. I really did enjoy the discussion and plan on more in the future... Good Flying!
@@AlienDrones thanks man, please keep ‘em coming
Love this style of video. It's great to hear and see FAA representation to assist us with our concerns and questions.
Meh, looks like he is already getting between $130,000 & $200,000 a year plus benefits 💰💰💰
Keep up the great work, Keith! I find these FAA interviews VERY helpful and insightful! Thanks!
Thanks Keith for putting this together. It was one of the best most informative videos on the tube I’ve seen. The FAA rep is good at his job. Great questions and clear concise answers, not interpretations. Yes please do more of these, no one else is and for newbies like me the information is welcome.
Thanks again and great job!
Thank you! 🙏 Good Flying!
@@AlienDrones Hi Keith, I have a question. How does the FAA view theatrical performances with drones? The ones where they fly at night and create 3D art. The way I read the law the pilot must operate only one drone at a time. How is it that they can have hundreds of drones in the air driven by computer and only one pilot? It defeats the whole purpose of optical line of sight because you cannot be looking at 100 different drones simultaneously.
@@ke4uyp Thanks for the question! Indeed, this needs special FAA waivers approved for this type of operation. I imagine having a good lobbyist in your corner during the process doesn't hurt either... 😎
Flexibility means the FAA can interpret as THEY want
Sounds like they work for the government 🤷♂️
This is why complying with them gives them dangerous credibility. The only answer should be two middle fingers held high, or you'll lose everything. Non fudds have been pointing this out for decades.
Glad I found your channel, these questions are very important and I am a cinematographer that tries to always get proper permits etc.... very helpful - just got my mini 2 a short while ago and found your video very helpful ...so thank you! - subbed-
Thank you for watching and the sub, appreciated! 🙏 Glad it is useful to you, good flying!
Great interview! Very informative! I'll have to check out your previous video on the Night Flying.
Great vid man it was a super smooth interview. All the right questions answered by someone with the knowledge to do so accurately. Very informative and interesting to watch which I don't believe is such a simple task especially a remote interview. Just subbed and gonna scope out the rest your content. Thanks for the vid
Thanks for the feedback and the kind words! Indeed, it was a lot of work to set up an interview with a government employee that would allow posting online, and I was pretty nervous about a live interview. 😰 Kevin did make it easier as he is a knowledgeable guy, but I'm glad to hear the questions were on point as those were all mine... 👍 Thanks for the sub, and good flying!
Keith, a really good interview, style and content-educational and informative! (You should do more!). The FAA representation was excellent...Kevin certainly will have eased the angst in a lot of people...he was a great spokesman! Hope you can get him again for other related subjects! ... Well done!... Onggia
Thank you for the kind words! It was a lot of preparation and turned out much longer than I hoped, but agreed, Kevin did put a pleasant face to the FAA and their goals... I'm working on future interviews that I hope we can agree on soon... Good flying!
Hi Keith,
I’m a new subscriber. Loved the information and the presentation. Very clear and helpful for a fairly complex topic. Looking forward to checking out your other videos.
Thanks,
Paul
Awesome, thank you!
Excellent! I am completely new to the world of drones. Great questions, clear responses. I know you can’t control the mic on the guest speaker’s end but I was able to catch 99% of what was said. Please keep us updated as it’s easier on this platform for me to drive and listen to the info without having to look at the screen. It was like a podcast!
Glad it worked for you! I'm sure I'll have Kevin back in the future, stay tuned!
Thanks for doing this and nice he took the time to do this. He seems cool and very knowledgeable about all the information. I definitely had the fly over people explained in a way I can understand. That was fun to listen to. BVLOS will he another cool thing to have and see how that develops. I always enjoy these informative videos and some if the reading isn’t there easy to understand and too long to read. Thanks 👍🏻
My pleasure, thanks for the kind words! Kevin is great to talk to for sure, looking forward to next time!
This was a super helpful and informative video. Great questions asked by you and clear situational answers by Kevin. Thanks for this video!
Glad it was helpful!
This was a great interview. Got a lot of good information out of it. Along with your other content, please keep doing these interviews with the FAA.
Thank you! Will do!
When I saw that the video was 40 minutes I just knew I wasn't going to watch the entire video in one sitting. It was so interesting that I ended up watching the entire video from beginning to end. I didn't realize 40 minutes had passed. Great video! I just purchased my first drone and I needed this video to help me as I move forward.
Glad it was helpful to you! Good Flying! 🤙
Thanks, it was a great interview. Kevin is really a great guy and well spoken as you are too. I would enjoy more like that as well as your other content. Quick mention to your intro, I laugh every time I see that drone land in the water behind you. Take Care.
Thank you for the kind words, appreciated! This was my first "live" video interview with the FAA and I feel I could have done better but I have to start somewhere (and it could have gone worse too!). Appreciate the comments about the intro, I considered losing the intro but I get so many comments on it that people enjoy it so I'll leave it in for now... If everyone knew the whole story behind the creation of that... 😂 quite a lot of work and mishaps... Makes me laugh thinking about it... 😎
I agree… I enjoyed this content like this AND the intro is awesome… please keep it. Thanks for sharing.
@@AlienDrones okay now I really want to know... what drone did you sacrifice for the water plop shot?
WOW... That was some great information. Thank you for keeping us informed with video's like this one.
Excellent interview with a lot of good information. The only thing that surprised me was that in the discussion of Category 1 drones, there was no mention/reminder that we're talking about takeoff weight. Prop guards are going to put pretty much every popular high quality mini drone well over the 250 g limit. Manufacturers are going to have to produce special edition batteries like the ones sold with the DJI Mini 2 in Japan, in order for their drones to meet the 250 g limit at the same time as they meet the no exposed rotating parts requirement.
Alpha a85 has dji fpv and prop guards sub250.
I appreciate the spectacle of this comment. BUT it is widely known the Mini 2(opposed to the mini one weighing in at nearly exactly 249g) the Mini 2 weighs something in the 230-237g range. I don't think adding the prop protectors would put you over 250 :)
@@MrGuntherJohn Watch the Pilot Institute's video on the topic. Prop guards put you WAY over 250 g.
Who is weighing your drone? F the FAA
@@TheInsultInvestor It would seem like DJI might know the weight of their own drones. Mini 2 = 242 G.
www.dji.com/mini-2/faq#:~:text=What%20is%20the%20weight%20of,microSD%20card)%20is%20242%20grams.
Such a great interview thanks to you and the FAA for clearing up the New rules and regulations much easier to understand. I do have one piece of advice about producing the interview. The background music is totally unnecessary I want to be able to hear you and the FAA speak it’s almost bothersome but thank you so much for the interview I appreciate your time to do it.
Glad you enjoyed it!
Thank you for hosting this. I came away with a more positive feeling about what originally seemed like regulations designed to crush the dreams of all but the largest of drone operation companies. A kinder/gentler FAA😄
Thanks for the kind words! Good Flying!
Screw these over-reaching clowns.
Awesome video. I appreciate you getting this done for us. I just passed my test today and was very curious about these details.
Glad it was helpful!
Amongst all the channels here you certainly are a jewel Keith. Thank you for all the effort and you have a new subscriber and a fan!

Wow! Great knowledgeable and well-spoken speaker. So informative with a confident FAA speaker who was pleasant to listen to with fast paced information with no stumbling or repeating.
Thank you for the kind words, appreciated!
Just became a subscriber. This was a very informative discussion. Certainly appreciate your efforts. Thank you
Thanks and welcome!
Thank you Keith for your daily uploads. I learned a lot as well
Cool indeed, glad it was useful!
BVLOS - you got your DJI guys flying a couple miles out in busy places - and you got guys like me FPVing around trees and outbuildings - never more than a couple hundred meters out, on our own properties out in the sticks - nobody around. But the FAA puts it all together, into one stupid bundle of criminalized RC activity.
Very interesting to hear this, thank you so much for sharing.

We need this kind of information given to drone pilots here in Canada.
Thanx for the info. Im on my way to getting my part 107. Hopefully here soon. Good Flyin.
My pleasure... Good for you! You're going to take the test? If so, let us know how it goes. Good Luck!
Good interview. You compiled good questions during preparation. I actually took notes 😄
Glad it was helpful! Thanks for watching!👍
Great info/video!! Thanks to you, Kevin and the FAA for putting this info on line!!
Our pleasure! Thanks for taking the time to comment!
Very well done. I look forward to similar interviews from the FAA and possibly industry groups. It'll save me a lot of time pouring through regs.
Thanks! Good Flying!
I liked the video because you get to hear from the FAA instead of just some paper being pushed out by the FAA with no explanation. Thanks for setting that up and I look forward to more conversations like this.
Thanks! 👍
Great interview. It makes me feel much better about the FAA when you have someone like this who speaks normally and doesn't do the bureaucratic speak that we are some accustomed to from the government.
Thanks! I'm sure Kevin appreciates it!
Watched the whole video. I thought this was great info and loved hearing all this directly from someone at the FAA who really seemed engaged and knowledgeable. Thank you!
Glad you enjoyed it, thanks for taking the time to comment!
Always best to hear from the horses mouth. Thanks for facilitating this piece. As a recreational drone pilot I have learned a lot about the FAA and how I fit in to the overall regulatory environment. Well done.
Thanks for the kind words, glad it is helpful to you!
This guy seemed to know what he was talking about and knows alot about the drone community so I have a little more faith in the FAA now. They should have only people like him out talking to the public. It sounds as if he owns a drone or two. Anyway, Great Interview. Its good when ya can get some actual and useable info out of the FAA so thanks
Thank you for the kind words! Indeed, Kevin knows his stuff and does a good job articulating a lot of technical information. He must be pretty smart with a title that's 30 words long and all, lol... 😎
@@oemglobal3535 The actual usable info is that they are trying to maintain a high safety record while expanding the flight load of the national airspace to include the use of all levels of drones (UAS).
@@oemglobal3535 Of course, nothing personal, after all we don't know each other and it's just a discussion over point of view, always a fleeting proposition at best. From what I've seen of hang gliding (Torrey Pines) and ultralights I'm not concerned about them at all like I would be about drones flying BVLOS. Ultra lights are few and far between in the urban and suburban environment while drones flying BVLOS have the potential to be far more present in these areas and the injuries that could occur would be to non participating bystanders rather than pilots and passengers (pilot/passenger deaths and injuries dominate rather than bystander deaths and injuries).
My point in my earlier comment was that it appears that the overall long range theme of the FAA program regarding drones is to develop a regulatory basis that will allow safe BVLOS while maintaining a backward compatibility with "recreational" use using an appropriate "common sense" level of "self certified" pilot responsibility that one should always expect to see in any case.
As far as your Gotcha moment, I see it more as a caveat moment to remain alert to. Exception 44809 is certainly a work in progress to be hammered out in more detail and hopefully not by the courts alone and as the last resort.
It is strange that ultralights are as lightly regulated as you point out. I'm curious to know how that came about.
@@oemglobal3535 this is a very good point. Perhaps the ultralight market is deemed small and exclusive enough that they are less concerned about occasional fatalities? It's hard to fathom the reasoning.
@@ChrisTietjen_00 yeah, manned aircraft certainly do have a built-in deterrent to reckless operation, and as I indicated elsewhere, ultralights are rarer than drones. So your points are well taken here. At the same time, while this rep's presentation comes off as effective UAV-friendly PR, I'm cynical and skeptical of the stated rationale for some of the rule-making, particularly remote ID requirements (as I also stated elsewhere).
Great video, answers/makes clear many of my questions. Thanks
My Pleasure! Thanks for taking the time to comment and let me know!
Just found your channel and I really like it. Subbed. Thanks for your work.
Awesome, thank you! Good Flying!
Some people are good with reading text docs and others get and retain with real time visual and hearing. I like both. I comprehend better! Keep having guests please and thank you.
There's so much info on this video with a lot nuances that sometimes it was hard to follow which rule and in which instance the rule applies Kevin was talking about. I think a written summary (or maybe another video) would be very helpful.
I would like to see more discussions like this. It's very helpful. :)
Also, aimed at the FAA, I would like there to be some consideration in regards to the accessibility of using drones for personal purposes, in a not-for-profit situation.
I see no reason that a person should technically need a Part 107 remote pilot certificate if they decided to, for instance, take a photo using their DJI Mini of their yard to help determine where to plant a tree, garden, etc.; However, right now, it kind of feels like that is the case, given the rules as written right now.
Funny thing is I was using my mini to inspect my own roof which is much safer than me climbing on the roof. The rules seem to say I need a 107 part B which makes no sense. If I see missing shingles or flashing I would then climb onto the roof to inspect and repair as needed. The drone is much safer way for just a simple inspection.
@@worldofzap I guess the FAA would say that you not risking your butt unnecessarily is "payment". XD
How the fuck would anyone know that you're inspecting shingles anyway and not just flying over your house? I doubt if you announced it on loudspeakers where your entire neighborhood heard it you would ever hear anything about it back in a billion years.
@@e5m956 I'm not saying they'd know.
I'm just saying that honestly, the way the rules are written is silly / not ideal, and also (as you point out) not really enforceable.
I'm saying the regulations should be reevaluated and redone, IMHO, to be less ridiculous.
Make a mistake and get a $10000 fine plus potential legal fees.
Super informative. Great video Keith.
Excellent presentation. Definitely have Subscribed to your Channel. Thnx for your diligence.
Awesome, thank you!
loved FAA interview. I haven't as yet heard an explanation as to why FAA cares if you make money from drone pictures/videos. And yes I am very new to drone flying, I have viewed many videos explaining a lot of the rules of the FAA and part 107. Reading part 107 was directed at all the legal definitions that were overwhelming. Hope you do more FAA interviews that helped reduce a lot of my concerns. Thanks a lot.
Thanks for sharing!
THANK you for asking this. I would LOVE for somebody (not I, since I am lazy) to go through thousands of UFO videos caught on tape and analyze: if that were a drone, would it be legal in that area at that time according to the FAA.
Great interview and thanks for contacting the FAA on our behalf. Definitely continue to do these interviews as they are more helpful than trying to interpret a FAA legal document.
Thank you! Will do!

I was happy to hear that the FAA is beginning to move toward BVLOS. Hopefully, recreational sub-250 gram fliers will benefit as well.
@@Quickcat21MK Cite the rule, please.
@@Quickcat21MK yeah, we really need to see the rule or how it is interpreted. It would be great news if following all other rules that you can go BVLOS and up to 3 miles. Would be nice if true.
@@StrideWarrior nuts wont suck themselves.
I think its more of a risk flying the sub planes BVLOS because if you live in a state where theres constant wind gust that blow jungle gyms a mile away it could get messy with these little toy drones??
@@spiritualwarriorhealer6154 theres no fucking risk.
You going to support the desecration of a branch of the hobby just because you dont fly fixed wing???
Idiocy.
Whats next you going to ban birds?
Because bird strikes have actually taken down planes.

real educational head shack not everyone thinks of this one, great content thanks health and safety first with everything we do from swimming to driving thanks again
Indeed, thanks! 🤪
It feels like the FAA has used BVLOS as the carrot for trying to induce acceptance for RemoteID. The reality is the BVLOS will require MUCH MUCH MUCH more than just RemoteID for a UAV to qualify for BVLOS. So I consider some of the past FAA communications to have been a bit sloppy at best if not disingenuous in directly linking RemoteId to BVLOS in an effort to "sell" RemoteId to the non-commercial UAV participants (i.e., RemoteID = BVLOS).
Kudos to this FAA rep for at least acknowledging that RemoteID is simply a small building block towards a UTM system (which I believe is likely many years off) which ultimately will create framework for BVLOS for certain classes of drones (e.g., likely only commercial drones not consumer drones because of the fees and additional equipment required). This is why I have a problem with the FAA using BVLOS as the carrot for acceptance of RemoteID...As consumers we will pay the RemoteID "tax" and the Commercial UAVs will reap the benefits. Also I find some of the the Privacy implications of the current RemoteID standard to be totally unacceptable (e.g., broadcasting the exact location of the pilot AND making that information available to JohnQ public via a simple app on a smart phone).
Great video for beginners and experience pilots. Thank you.

I suggest chopping this video into a bunch of "shorts" pertaining to single questions. I mean I watched the whole video start to finish, and that was a lot to unpack. It might be easier on others, idk just a thought. Thank you for your hard work!
Interesting thought for sure... There's a lot of information. I hoped the bookmarks would help and keep it all in one place, but I do like the shorts thought as well, I'll have to think about that...
Great interview and very nice work, Keep it up.
Thanks, will do!
The Mini-2 with Prop Guards does NOT qualify as Category 1 because the Prop-Guard puts the weight of the drone "and anything attached" over the limit of 0.55 Lbs. If you manage to acquire a Japanese battery, (Good Luck!), which is lighter than the US model, the drone including guard stays under 0.55 Lbs., thereby qualifying as a Cat-1.
Great interview, gave me a better understanding of their motivation behind remote id.
Glad it was helpful!
This feels just like the ATF "letters" clarifying the rules.
Or osha letter of interpretation:)
Exactly what i have been saying. Tyranny is tyranny. They have been doing this with guns forever. Compliance will ensure total loss of freedom.
@@krotchlickmeugh627 Pretty much right. I understand grandma and grandpa are tax payer, they don't like those pesky kids nosing around flying around their house. They have to have someone to call and complain to, since they are dearest tax payers that's their right and they should have someone to call, so I understand the non drone friendly side of the population who has to be quelled, and at the same time in the end well pleased. Everyone on the other side is Us, trying to think we can exercise good common sense, use a strobe at night, starboard and port indicators (sea terminology I know 😆). Stay well away from people and their property (120 meters up should do the trick) don't hover over anyone or anything that could cost life, limb or damage to personal property, of course.
When I don't want to or need to worry about using my drone for$ I shouldn't have to worry about coming up with$160.00 for a part 107 in compliance, as I really don't need it as a recreational flyer... But then after this, well sounds like everyone needs it or there's a good chance at some point day, night or wherever, you are going to probably have done something wrong in the eye's of the FAA. Common sense is great and I'd love to think I can count on it, but it be damned depending on who see's you and go ahead and report you. It's just all too much, it's boiling down to goVt over reach and communist Marxist control. Make a mistake (that didn't harm anyone or anything) and it just doesn't matter because it's your butt and pocketbook getting the rewards of this system we set up by the people for the people, it's not working anymore. Too much red tape bs when rc helicopter and other crafts have far more damage to inflict potentially, yet don't have any of the scrutiny laid upon the drone community. I would say look at the monster we've created, ..but I don't take any credit for anything to do with this monster they've created which is better said, a plain cluster fk.
At least there is a provision now for the hobby pilot. But that flying beyond line of sight is going to cause issues😳
Indeed! Keep in mind that this rule only applies to 107 flights... 🤙
Thanks for sharing very interesting 👍

I liked the information that came from Mike of the FAA and like to learn more information about the rules of the FAA concerning drones flying. I want to get my FAA certificate early 2023. Thank you. Robert

Best video...Thank you. Yes more video that explains different aspects. Its nice to hear from FAA, versus a guy in a drone group. Thank you.
Thank you for the kind words! Good Flying!
That dotted a lot of I’s and crossed a lot of T’s for me. Great vid!

Excellent discussion!,,,thanks so much for sharing
My pleasure, thanks for watching!
What an OUTSTANDING PIO. Clear, concise and relevant answers! to great questions! Could you imagine if *other* .gov agencies employed PIO's like this....
Indeed, he is knowledgable and personable for sure. Took quite a while to set this up with Kevin so I'm glad you liked it... Good Flying!
Thank you, Keith. 👍
Great no nonsense interview. Have dealt with FAA all of my career as airline pilot and have found that like any organization, there are good and bad experiences. They are people also and if approached that way instead of the "Big Brother" assumption, you will fare well!
For Manned Aircraft they made sense. They have fucked up repeativly the drones and had the courst tell them such more than onces including the current suit over Remote ID. NO that are not good for drones NOT AT All. Only thing they are woried about is Comerical and HUGE operations not hobbiest and small people.
Great video straight from the source. This is much more clear now 100%
Glad it is useful!
Thank you for another informative drone video. I am a recreational pilot, that doesn’t fly a lot but I want to ensure I’m following the rules as to not wreck it for those that do fly every day and watching your videos especially one like this help me to stay on track and educated.I appreciate it.
Thanks, glad it is helpful to you!
Everything was all good information I love it Thank you I appreciate you a lot man
Glad you enjoyed!
@@AlienDrones yeah
Very informative.. thank you
A worthwhile dialog. Well done.
Hi Steve,
Just a quick comment. #1 Love your interviews with Kevin from the FAA. #2 a quick comment on Remote ID. as some one who has flown manned aircraft I see it as nothing different than the requirement to have a transponder with altitude read out on a manned aircraft'
Jeff
Thanks for sharing! If the transponder would also share the location of the pilots family who were on the ground in a park enjoying a picnic while the pilot was flying the aircraft, then I believe it would be a more similar analogy. Or if the remote ID would only share flight details like altitude and speed, not the pilots location on the ground... Good Flying!
As a new drone pilot, flying for my job (flying the drone is not even close to being my primary role FWIW), this was extremely helpful. Thanks!
Thank you, glad it is helpful!
@@AlienDrones hey, I'm about to send you an e-mail. I had a recent drone crash and have a few techy questions I'm hoping you can help me out with.

Great spokesman. He makes me feel that FAA is least bureaucratic government agency
It's good to put a human face to the letters for sure... Good Flying!
Keith thanx for all you do on here👍
You know you could almost pull off a Tim Mcgraw look alike😳
Thanks for the kind words! I'll wear my cowboy hat in a future video, see if I can pull it off... 🤠
Excellent video!
I fly a kit drone I made I had to register it with the faa and take the trust test I loved it learned a lot
