Man I likely had a case against facebook for the same thing, the sincher was the 28 day warning to anyone who attempted to like my business page stating 'this page shares information against our community standards', while my account was deleted. I never once shared anything covid related to my business page, only my personal profile, but due to the business profile being created through my personal, they attached the warning.
Loved that he referred to the Indian protest. Indian Farmers protested for over a year being hands down the larger and longest protest ever. The protest was mainly spearheaded by the Sikhs who organized the protest. But thanks to the Indian government and companies like Facebook everything was downplayed and social media posts and videos were being deleted and only the state media posts were being left untouched.

I had a client have a run in with twitter and I’m not going to go into details but bottom line, I am absolutely terrified of these big media companies. They are never held responsible, (I am not political at all) but, they very clearly ban republicans more often and for lesser offensive and ignore major offenses for those on the far left, and the impact these companies have is mind boggling. Let it be known I am not saying what these companies are doing is illegal because as it sits now it is entirely legal. What I am saying is that is exactly the problem. I’m all for businesses doing what businesses do but the impact these companies have is absolutely unreal. The great divide in our country is vastly because of the impact these social platforms have. I've been bringing up that California case law about how even a private business can be considered public if it's entire business model is to allow people to use it's space freely and openly, and thus they must allow all forms of protective speech to go on there. And these social media companies are definitely public spaces that allow anyone to freely join those spaces, and thus should have freedom of speech protection. I think I've heard maybe one other person bring this up. Because all of these companies are based in California, the must adhere to both California's constitution and their supreme courts ruling.
But they aren’t allowed to use it freely and openly. They have to abide by certain terms to use it, terms that can be changed at any time. Their terms specifically state you are not allowed to post anything you want to say.

They are by no means as difficult to get around as an actual contracts. But even contracts can legally be broken for a number of reasons, from age, to unfair or illegal demands, especially obfuscated in the small print and written in such a way that it's virtually impossible for a normal person to make sense of it.

They have no right to do this. Indian Farmers protested for over a year being hands down the larger and longest protest ever. The protest was mainly spearheaded by the Sikhs who organized the protest. But thanks to the Indian government and companies like Facebook everything was downplayed and social media posts and videos were being deleted and only the state media posts were being left untouched.

I had a client have a run in with twitter and I’m not going to go into details but bottom line, I am absolutely terrified of these big media companies. They are never held responsible, (I am not political at all) but, they very clearly ban republicans more often and for lesser offensive and ignore major offenses for those on the far left, and the impact these companies have is mind boggling.
Let it be known I am not saying what these companies are doing is illegal because as it sits now it is entirely legal. What I am saying is that is exactly the problem. I’m all for businesses doing what businesses do but the impact these companies have is absolutely unreal. The great divide in our country is vastly because of the impact these social platforms have.
I mean good hell as a crystallizing example, after the death of Mr. Floyd people on the left were burning down cities, killing people, robbing businesses, etc. and CNN reporting it said “mostly peaceful protests” then jump to January 6 with the storming of the capital CNN reported that as “terroristic behavior”.

Wow. I've been bringing up that California case law about how even a private business can be considered public if it's entire business model is to allow people to use it's space freely and openly, and thus they must allow all forms of protective speech to go on there. And these social media companies are definitely public spaces that allow anyone to freely join those spaces, and thus should have freedom of speech protection. I think I've heard maybe one other person bring this up. Because all of these companies are based in California, the must adhere to both California's constitution and their supreme courts ruling.
But they aren’t allowed to use it freely and openly. They have to abide by certain terms to use it, terms that can be changed at any time. Their terms specifically state you are not allowed to post anything you want to say.
@@JJpmfc Believe it or not, but those "Terms and Conditions" like the ones on Facebook which are extremely long and written in lawyer speak that most people can not understand. They are by no means as difficult to get around as an actual contracts. But even contracts can legally be broken for a number of reasons, from age, to unfair or illegal demands, especially obfuscated in the small print and written in such a way that it's virtually impossible for a normal person to make sense of it.
@@augustgreig9420 Except the part that he's trying to "get around" was a suspension or termination, which Twitter has locked up pretty tight based on the exact wording in the ToS. It states quite clearly they can suspend or terminate an account at any time and for any or no reason, which is about as bulletproof a statement as can be made. Any time, and for any or no reason at all. Meaning they can do whatever the actual fu@$ they want when it comes to suspension/termination of an account.

They aren't allowed to curate content be sure it violates the law..a ToS can't contain anything illegal, it won't hold up, and in some states just one illegal condition will get the entire thing throw out. They have no right to do this. The only issue is there hasn't been enough people sueing them, and it would probably be great if it went to the appeals court where the law could really be codefide into law, and precedent set. It's just no one has really fought them on that point. The government can't just come after them without a combining victim.

happened with Patreon too if I remember. they changed their terms and conditions right before blocking a channel creator from UA-cam and they sued the Patreon on that.

By settling berenson dropped the ball. He could have gotten discovery if he went forward and to trial. They musta offered him a lot of money
I think it’s still a win. And I’m pretty sure he talked about all the things he saw in the discovery. I’m almost certain he had enough time to see the discovery before they settled outta court.

If any of the Silicon Valley companies are obtaining government subsidies or government contracts, they should not ban individuals relating to speech. It's not a private company per se.
