In this particular case Nintendo lied but that's completely separate from people looking for a reason to get games for free because publishers choose to distribute them digitally or via subscription rather than physically. That's completely up to the publishers to decide.

Stage Select theme from Mighty Gunvolt, which is an 8-bit spinoff of Azure Striker Gunvolt, and you can play as GV, Beck and Ekoro, from Mighty No 9 and Gal Gun respectively. It’s on Steam as well as 3DS.
I had recently did a 3ds transfer and i knew this was gonna be an issue down the line, thankfuly this dosent effect the wii u but this shouldnt have happend in the 1st place

No, 3DS DLC doesn't work that way. You have to do it from the eShop within the game.
