      don't need a licence for private vehicles. Officer could ask to see the call log providing the officer with evidence. He certainly shouldn't have contacted anyone till after the encounter.

      I just watched a UA-cam short of a judge getting pulled over, got out his vehicle, cop told him to get back in, judge said “you better check that registration plate” in a threatening way, cop runs it, goes back n says “have a nice day judge”….almost sickening

    The police Lt who said not to write the ticket also needs to be investigated. No way a judge should be able to make a call and stop a ticket being written.

      The police never claimed to see him using the phone. They only claimed to see him holding it.
      The statute read @2:51 says "Using a cell phone" means: "holding in a persons hand an electronic device WHILE viewing or transmitting data, playing games, composing, sending messages, etc.
      The police neither claimed it and the guy they pulled over denied doing it. Not sure how there's a case here. Regardless of the call, the stop likely shouldnt have happened. If the officer saw any usage of the phone, they would have IMMEDIATELY disputed the claim that the phone wasnt being used, but again, they never did, even once.
      The officer just focused on the judges defensiveness the entire time and never actually addressed the specifics of the stops or acknowledging the defensiveness and dealing with it directly. The officer made it worse by sitting there and repeating the same thing over and over "why are you being like that?" which literally does nothing, isnt specific and always gets you nowhere.

      He may have been telling the truth regarding him not using the phone and it just being in his hand, however this is a gross overuse of position and people need to not vote for this guy to be a judge again. I do agree with an investigation as well.

    This angers me immensely. Who the hell does this Judge think he is. How entitled and completely inappropriate. He bullied that office. And the female police lieutenant needs to be reprimanded. No special treatment. This is so disgraceful

    For those wondering what happened to the Judge. May 2023 he was suspended for 6 months without pay and fined $5,000 for actions that “ventured past coercion into retaliation”. He currently still has a job. For those of you in who live in the West Virginia Judicial Circuit 22 Division 2 space. You can vote him out in your General Election in 2024.

    This judge has literally been caught shoplifting twice. Idc if he seemed distracted. I don't know anybody who would just "forget" they never went through a checkout lane and paid for their goods. If a normal citizen was accused of the same they would be fully charged. What trash

    May 2023 He was suspended without pay for 6 months, censured, fined $5,000, had to pay for disciplinary hearing, and monitored for 2 years by JLAP, a Judges and Lawyer Assistance Program. SMH

      I've only had to deal with a judge once in my life over a corporate matter. From what I saw there what the judge pulled, I am not surprised. I'm sure there are great judges out there but not the one I've seen. I was horrified by their incompetence and inability to find facts. Only good outcome from the judicial system is when you're not involved in any way yourself.

      Actually I think he would be a good judge to have in court for alot of these BS charges. This judge has other issues but he seemed to be bothered by this departments practices; which he probably sees plenty of.
      I am also bothered by pretextual stops so cops can ID you and go on a fishing expedition.

It gives the cops another reason to violate your rights. If your not driving safely let the cop pull you over for failure to maintain lane or whatever.

And this dude is SO UNSTABLE he let this ruin his entire day and hopefully career. He drove to the MAYORS HOUSE at 10pm to complain? How the hell is this person a judge of all things...

      Yes, that he could not just accept being stopped (not even ticketed) and felt the need to escalate the situation, looking for some affirmation to his perceived injustice, seriously undermines the credibility of his mental stability and his ability to be judicially impartial.

    This "judge" had an expired drivers license, been pulled over for running stop signs, not wearing seat belts. He's been caught walking out of Walmart without paying for his items!!! Wow! Talk about abuse of power!

    Just did some research on this case and not too long ago, it was finally resolved.
    (1) Respondent is suspended from his position as circuit judge in the Twenty-second Judicial Circuit for a period of six months, without pay;
    (2) Respondent will maintain compliance with the JLAP monitoring agreement for a period of two years, violation of which is reportable to the JIC;
    (3) Respondent is censured;
    (4) Respondent is ordered to pay a fine of $5,000; and
    (5) Respondent is ordered to pay the costs of this disciplinary proceeding, except that Respondent is not responsible for the costs associated with Dr. Clayman's review of VCAP records.
    Six-month suspension without pay and other sanctions ordered.

    This judge has no control over his emotions. The anger being so far out of proportion to what he was getting pulled over for proves this. So just imagine what might happen to a defendant in his court when this judge is having a bad day, and the defendant says the wrong thing at the wrong time. This man should not be a judge.

      @Telleva I saw it happen in Aurora, Colorado when the judge gave the defendant 30 days and the kids said " Shit I'll do that standing on my head " so the judge said "make that 60 days, now would you like to make it 120 ". Just to point it out black defendant and black judge, and I was next with my white lawyer and I'm Native American . I had a DUI & 99 mph in a 55 turned into driving while impaired & 59 in 55 zone with no fines and kept my license but it sure cost me for a lawyer .

    i've run into a few retired and active judges in my day and I've not met one who didn't demand preferential treatment, whether explicit or implicitly. They really are the worst because they know they are above the law.

      Maybe not an abuse of power. We have no idea what is going on in that community. Maybe the police officers when out and about are being to causal in their application of the law. Maybe the judge has seen this many times before. Or maybe the judge just got emotional and should have just taken the ticket and then challenged it but then again maybe the prosecutors would use this charge and try and piggyback it into a wider political issue.

      Perhaps not corruption but stupidity. What upsets we more is the stupidity of jurors. I was the Bailiff on a murder case where a husband stabbed his wife with a knife and killed her. The husband went to his daughter's room and told her to call 9-1-1, "I hurt your Mother". The suspect hired Leslie Abramson to defend him. The first day of trial, the entire Jury brought her book and wanted her to autograph them. The Judge admonished the Jury and told them to have no contact until the trial was over. I warned the Judge, "You should dismiss this Jury. There's no way they will find her client guilty because the like her too much". The Judge said, "I think they're smarter than that". The Attorney argued that the victim attacked her client and she fell on the knife. The problem? The victim had defensive wounds and the suspect had none. The victim was struck so hard with the kitchen knife, it went completely through her neck. When the Jury returned "Not Guilty", the Judge was so dumbfounded, he got off the bench and went into the hallway and screamed, "I'VE NEVER SEEN A DUMBER BUNCH OF PEOPLE IN MY LIFE!".

      @@rickuyeda4818 in this case I would call it corruption, because rather than a case of disinterest swaying in an irrational direciton, we're looking at a case of the proces being subverted in a very much concerted direction, starting with the LT ordering the officer to rescind the ticket. I know it took the officer a lot of guts to object to the extent that he did, but unfortunately that is not enough, but that is not on him. This is indeed a cultural problem if it starts with a judge and immediately trickles down to a PD LT, and he should not have to "risk his career" to do the right thing. Every time a hard line is drawn on this, the sketchy people who dabble in the gray will object, but ultimately they were the ones who would ultimately draw our institution into the black. I find it concerning this judge thought his cellphone ticket (what, $110?) was more important than the judicial integrity he harmed by racketeering like this, which is what it is. Were it in my hands I'd bring the hammer down on everyone in this picture save for the officer, in order to redeem the public standing and systemic reliability lost by their actions, and that officer shouldn't just be commended but cultivated, because we need more people like him in the right places.

    On May 4, 2023 the West Virginia Supreme Court of Appeals issued the following finding for the traffic stop. Looks like the Walmart episodes were also included.
    For the reasons stated above, we impose the following sanctions:
    (1) Respondent is suspended from his position as circuit judge in the Twenty-second Judicial Circuit for a period of six months, without pay;
    (2) Respondent will maintain compliance with the JLAP monitoring agreement for a period of two years, violation of which is reportable to the JIC;
    (3) Respondent is censured;
    (4) Respondent is ordered to pay a fine of $5,000; and
    (5)Respondent is ordered to pay the costs of this disciplinary proceeding, except that Respondent is not responsible for the costs associated with Dr. Clayman’s review of VCAP records.

      He's been pulled over countless times and always seems to get by unscathed. So I now suspect there may be a level of blackmailing going on in that county and many powerful people are compromised and owe 'favors' to one another. I'd be looking into that mayor...............

    Props to that officer for being polite, calm, not giving in to the “im a judge” bs.
    The irony of this spoiled ass judge not thinking the law applies to him infuriates me. He shouldn’t have called ANYONE. The officer let him go- and he still kept calling people the rest of the day.
    This is not someone I’d want to be in front of in court. If you can’t appreciate the law being applied fairly- you have no damn business being on the bench.
    The multiple complaints like this and the two very CLEARLY SHOPLIFTING complaints should get him removed. Law & order for all- even you, “judge”.
    I think he should’ve been checked for dui. That is not normal behavior. Anyone else would’ve been.
    But the poor officer had to give in to a superior. But that person should be checked out as well.
    This is why more people don’t respect or trust the system.
    In 2023- he was suspended 6 months w/o pay & given a $5000 fine.
    He should be disbarred. I’m afraid for any cops with cases in his courtroom. He’s vindictive.

It raises concerns to me that his court cases should be reviewed because at least in this instance the judge is not thinking logically and that's supposed to be a hallmark of a judge.

    This is in my neighborhood. This judge is also a thief. He was caught stealing from our Walmart via the self checkout where he didn't pay for 10 or so items which added up to about $60.00 and he truly believes he is above the law. He is a true pos with absolutely no conscious or morals. Absolutely disgusting!

    So the cop totally let him off and didn't write him a ticket, but he's still raging about it hours later, making phone calls and hammering on the mayor's door, just because the cop didn't immediately apologise and send him on his way the moment he said he was a judge. The level of anger and entitlement he displays is incredible, and should preclude him from holding any such position.

      she MAY have, considering the above, told him to let it go to protect the officer, as his commanding officer she now has the responsibility to report the judges conduct. by letting him off the hook for a ticket, now the judge has actually used his authority for personal gain. or something along those lines. if this was her intentions, i personally think she was doing the right thing here, considering we have seen this guys personal history....and ill bet there is more. Also, by letting the judge off without a ticket, it may also have removed them from having to face complaints, or him sending IA after them, or lord knows what other BS he could try to do. Again, assuming this was a tactical move to use against the judge.
      with all that said, i do not disagree with your statement.

      It’s not understandable though. He knows the law and he therefore should know that the cop doesn’t know if he’s telling the truth, and even if the cop DID it doesn’t matter. Having his phone in his hand was against the law period he should’ve accepted it gracefully.

      @@postbloom9767 it is..as no matter you cane upset for being pulled over.. and if he did nothing else wouldnt have been a serious issue and the subsequent charges wouldnt have been filed.. the following issues after the fact is not understandable and the reason for multiple charges. Even if I know I break a traffic violation I'm upset cause depending on the officer your sitting in traffic for anywhere between 5 and 15 minutes which is a long time in a circumstance like that. Also a judge and we all have seen cops not on official duty using fines yet for cops is hard to get the proof needed which is a triple standard. Apart in this case of the judges perceived anger.

      I'm very much sure that the vast majority of judges are entitled, narcissistic and egocentric POS who truly believe they are above other people. Just look how they treat people in court rooms and how they behave when they themselves are being judged. You give a human being some power and authority and he or she starts believing they're something different with only extremely rare exceptions. However, most of their shit is swept under the rug, the fact that we heard about this case tells me he was unwanted by some people in power and they decided to throw him under the bus!

      Knock it off with the moral high ground. You can't expect a person to be 100% in control the whole time. He wasn't in the court. A judge is still human and is allowed an outburst from time to time as long as it is not within his professional attributes.
      The lieutenant however is 100% corrupt and is abusing her power to get on the judge's good side.
