    Joyce wanted 25% of the performance royalties, not 25% of the band earnings. The song writing royalties went to Marr/Morrissey that was never in dispute.

    "Wretched drummer?" Come on, Mozz. The guy just wanted his share. Like Joyce has said, he was there for the whole ride. Every studio session and tour date, he and Rourke (minus his drug-related dismissal), were part of The Smiths. Get over it and reunite, dammit!! ;-)

    I know Mike(Joyce) since he was in his teens living in Hulme, Manchester. I've known Mike ever since he is engaging, witty and chatty and therefore understand what a bitter two-faced twat Steven Patrick Morrissey is. Never liked Steven Patrick Morrissey since I first met him in the club called Manhatton (their first gig before Rafters gig in Manchester). He was big-headed but yet, somehow, 'insecure' all false of course he just doen't like people.

    Joyce was somewhat replaceable but to say that Andy Rourke was just shows how little people know what his bass playing did for the smiths.

    Considering how strong an image he has, why all the concern in getting Mike Joyce out of the picture? Just listen how he works up the crowd before having a go at his past bandmate.
    Disappointing. Mike is much smarter; he just comes across as a nice bloke.

    Morrissey is a classic example of how an ego can go completely out of control. He has no proper perspective on anything and just because he feels he and Marr were more 'talented', he's forgetting that the buying public have a great affinity with groups and see them all as one whole. Without Joyce and Rourke The Smiths were nothing, another bedroom project never getting off the ground. The chemistry between ALL members of a group is vital to the overall shape of the music, regardless of who's

      You have it backwards, Moz & Marr WERE the Smiths and yes there was the other 2 who were recruited by Marr but they were exactly that. Drummers & bassists are the most replaceable of the 4, be real. Moz has the ego he deserves.

      @@johnnymeyer4253 your thinking is absolutely backwards mate, Marr and Moz were the most important parts of the smiths but some of the top smiths tracks would be dead in the water without the basslines that Rourke wrote and the drum grooves that Joyce played. Can you imagine Barbarism Begins at Home without the bassline? Or This Night Has Opened My Eyes without the melancholy, restrained drumming? Both songs wouldn't be half as popular without the effort of Rourke and Joyce.

      @@hgxnorton1986 Guess who taught and wrote for Andy Rourke on bass? His last name is Marr. Do some research. Read the book "The Severed Alliance" It was Moz's and Marr's band basically.

      @@johnnymeyer4253 Marr did not teach Rourke bass. From a young age he started learning the guitar, he then met Marr in school who was a better player, they started jamming together and then Marr introduced Rourke to the bass. Johnny Marr HIMSELF has said that the basslines were 100% by Rourke in an instagram Q&A 2 years ago. The Severed Alliance is a good book but it will always come second to words from the band members themselves.

    Well, Morrissey and Marr have always had 50% equal shares in the song rights, since they were the sole songwriters in The Smiths. Nobody has ever contested that. The court granted Mike Joyce 25% of what the Smiths get through record sales, and frankly, that's exactly what he (and Andy Rourke!) should be getting. To quote Nick Mason of Pink Floyd: "Like any band, you can never quite quantify who does what."

    mike joyce and andy rourke did not claim songwriting royalties as far as I know. They claimed performance royalties which is not the same. If you play on a record, write your parts, contribute to the arrangement you should be paid dont you think?. They dont deserve songwriting royalties really but surely everything else?.
    Not any bassist and drummer could have done that job. listen more carefully. Rusholme ruffians is all rourke providing the hook. otherwise its just elvis chords!

    Listen to the version of London from the rank album and handsome devil live from Madrid. Joyce was just immense. Marr is immense and so is Andy, they all made the band what it was and everything should have been split equally. Morrissey is a very talented song writer, but they made him. He should have been grateful they had their big break together, he could then pursue a solo career after the smiths. In my opinion he has never been able to come up with anything half as good on his own and he says stuff like this about his fellow band mates!? What a moron! I love the smiths and respect Morrissey's work, for that I want to like him, but the man is just greedy and up himself.

      Bullshit. Both of them, but especially Joyce, could've easily been replaced. Yes, they were part of the stage performances and recordings, but whose songs did they perform? Any drummer could hit the drums, it were Marr's and Morrissey's songs that made the band popular and finacial succesful. Marr might be the greater musicial genius, but Morrissey gave the lyrics to the Johnny's melodies and this way made it stand out of the mainstream. Marr and Morrissey were The Smiths and they carried Joyce and Rourke on their backs. Any musician (Rourke included!) would've been completely satisfied with 10% of the earnings.
      Joyce does not deserve the slightest inch of everything he's receiving now.

    The Smiths will always be mainly Morrissey/Marr imo. Rourke played a massive role in the band and Joyce just did his job, he's a very good drummer but by no means irreplacable. I don't see why Mozza shouldn't moan about Mike Joyce, afterall Joyce hasn't stopped moaning about Moz. I think that Andy and Mike should have got a larger part of the royalties but as Johnny and Morrissey actually wrote the songs it is not wrong that they should get quite a bit more.

      Well, bear in mind Joyce didn't go after publishing - in other words, songwriting. He just went after the money for performance royalties. Even then he just wanted 25%, he'd gotten 10. Publishing was never disputed.

    @thesmithsmad That's because they didn't get songwriting credit, which is partly why the lawsuit occurred. Just because you don't receive songwriting credit doesn't mean that you didn't write part of it

    Income is shared equally in apartnership in the absence of a written agreement. Morrissey and Marr came up with the 40:40:10:10 distribution and it seems that initially Rourke and Joyce went along with that. But it wasn't written down!

    Joyce and Rourke were by FAR, by FAR the most expendable members. However it isnt fair to call them hired hands because the smiths wouldnt really be the same without them. How much do joyce and rourke make off the smiths sales?

    They did all the bass and drum work for the band, they weren't session musicians. Morrisey didn't write the bass lines or play the drums. They also made a contract without their knowledge, which was proven in court. This isn't some solo pop artist,The Smiths were a BAND, the bass was very important in the songs, so were the drums...Morrisey sucks on his own, personally.

      Rourke's bass lines are an integral part of the sound of the band. Listen to Stephen Street's 12 part interview and he states that all four members were a tight unit. It was a group effort.

      If you were a musician Hannah, you'd realise how far off the mark you are. Whilst Joyce was not the best drummer in the world, his approach prevented the Smiths from being just another rock band. As for Andy Rourke, he is actually an exceptional bassist; his basslines are melodies within melodies. Whilst Morrissey is undoubtedly a brilliant songwriter, I think he is yet to recapture the unique charm and inspired elan of the Smiths - that being the case, I rest mine.

    "Contractually" & "private arrangement with no need for a contract" does not make much sense to me.
    It's quite obvious the Smiths would never have made it without either Mozz or Marr, but I think Rourke & Joyce played very well and were also quite important.
    And btw: It says "The Smiths are, left to right:
    Andy Rourke, Morrissey, Johnny Marr, Mike Joyce" on my copy of "The Queen Is Dead"...

    Get over it Morrissey. "All the money goes to that wretched drummer". We've seen you driving about LA in your flash jag and your head is just far too big at this stage. The Smiths were incredibly special to me growing up and it wasn't 100% down to you. In fact much of your solo material bores me to death. Leave off Mike and Andy. Money Changes Everything indeed!

    Joyce only ever speaks highly of Morrissey and as people have pointed out, Joyce drummed on every Smiths track and was on stage at every gig. Yet Mozza deems him not worthy of more than 10% of the bands earnings. Morrissey is a multi-millionaire yet he just can't bear seeing Mike and Andy have any of that money, he needs to grow up.

    The stupidity of Morrissey is unmatched regarding this issue. He would rather hold an old grudge that's due to money, than make tens of millions by reforming the band. To this day he doesn't understand the enormous importance of The Smiths in music history. It's true that a band is greater than the sum of its members, he never got around that

    to the people saying joyce and rourke deserved more than 10%, don't you understand it does not matter what you believe they deserved, (which is a highly debatable topic in and of itself) as the point is it was agreed during the days of the smiths that it would be split in a certain way, therefore they had no right to sue. It took Mike Joyce ages of trying before a single lawyer took him seriously as they could see it was all for money, not for justice and morrissey was not a crook. You can read about it in Moz's autobiography if you'd like to know what happened instead of commenting out of your arse. It's quite compelling actually, and involves an incredibly biased judge with the personality of a spiteful headmaster.

    Whatever happened to 'It's Easy to Love it's Easy to Hate, it takes Guts to be Gentle and Kind'....I Love The Smiths...Morrissey and Marr are Geniuses in my eyes but Moz shouldn't have stiffed Rourke and Joyce over the 'performing rights'...frankly ( Mr. Shankly )it was embarrassing...so while I'm sure there will be many who will defend Moz to the hilt over his comments I wont....to be honest he just made himself look like a Greedy Bitter Twat !!

    Think about this...Had Morrisey and Marr been "Fair" individuals and split event thing 25% , kept the Smiths together. And gotten a proper manager to handle hotel, show bookings correctly etc. They would have made at lease 5-6 more albums....made lots more money, would have been a lot more famous and happier. Morrisey and Marr (although talented) blew their carriers. Now they are disrespected by fans for their treatment of their peers. I recently saw Morrisey live and his band is trash...he is nothing without the Smiths anymore.

    morrissey and marr had 40% equal shares in the song rights and joyce and rouke have the same 10% morrissey didn't robb them if they did they both did, hey u try writing a song, and try producing the music for it and then you receive less then 40% for it and give the drummer what is told to play and bassist what is told to play aload of money

    joyce really shot himself in the foot and fucked things up for himself and every smiths fan because there would be a chance of a smiths reunion if he didnt take morrissey to court,imagine the amount of money that would have generated for him,much more than a million pounds.he should know morrissey holds grudges and will NEVER agree to a reunion now.mike never wrote a single song but still thinks he is entitled to an equal share of the royalties?anyway he must be kicking himself now.

    I was at Hull as well and felt the same about the shouting, more like a football match than a cultral event. Though thats my opinion and I should not take anything away from all the shouters who are also true fans in their own way. Love the man but he realy should bury the hatchet with Mike and Andy. It's a slight taint on a brilliant career although I'm sure Moz does not look at it as a career. It could have been any drummer in the Smiths and any Bass. Only Moz and Johnny gave us the Smith
