  • What’s happening in this Breaking Bad clip?
    Jesse and Walter have locked themselves within the RV while Hank tries to force the door open. Old Joe steps in and tells Hank that an RV is a domicile, and therefore, he cannot legally search it without a warrant. Hank relents and goes back to his car.

    What’s the TV show Breaking Bad about?
    Walter White (Bryan Cranston from Godzilla and Total Recall), a chemistry teacher, is diagnosed with lung cancer. He decides to make and sell methamphetamine to repay his medical debts and secure his family’s future.
    Season 3 of Breaking Bad:
    Gus (Giancarlo Esposito de The Mandalorian et Maze Runner) offers Walter a job cooking meth at a hidden lab. Walter demands Jesse (Aaron Paul) to be his assistant rather than Gus' choice of Gale. Skyler (Anna Gunn) learns of Walter's meth cooking and demands a divorce. Hank's (Dean Norris) investigation leads him to Jesse, but he finds no evidence and assaults Jesse, forcing him into a short leave. Hank is forewarned about an attack from two assassins and kills them, but he becomes paralyzed in the aftermath. Jesse's behavior becomes erratic, and Gus replaces him with Gale (David Costabile). Later, Walter fears Gus will kill him and Jesse once Gale learns enough about their methods, and instructs Jesse to kill Gale.

      Yea he knows his stuff. But if I’m not mistaken, theres a case in the past that would’ve allowed Hank in there. There’s the automobile exception, which allows warrant less searches of any vehicle with proper probable cause including Mobile homes because of the potential to flee. That one could be tricky because it is at a junkyard, the second being hot pursuit. Once he heard Jessie, if jesse had any type of wanted heat, he could enter.

    One of the things that makes this scene so great is that even though Hank is basically the good guy here, the viewers are so emotionally invested in Walt and Jesse's characters that Hank instead becomes like this monster from a horror film scratching the walls and knocking on doors (even the RV has dim lighting and all), because you know that if he sees Walt, it's the end.

    What I always loved about this show is it would make me simultaneously want Jesse and Walt to get away, and for Hank to not succeed in his investigation.. but then also make me want to see Hank catch Jesse and Walt and succeed in the case.

      That’s the key to excellent tension, when you desperately want to see both possible outcomes, you’ll be unable to stop watching. Works a lot better than if you’re just rooting for the good guys, because rarely will a movie or TV show dissapointed us by having “the bad outcome”

      @Marsh Gotcha. Makes sense. That makes this scene even more marvelous as it shows the writers were so invested in the story they went back and created foreshadowing based on previous scenes. I just find it hard to believe that this is a coincidence. Already knew BB has good writers this makes them that much better in my book.

    If Hank did break in there I’m extremely confident Saul would’ve been able to get them off scott free since he didn’t have a warrant. The only issue is Walt’a personal life would be ruined.

      Walt wouldn’t even need Saul in this situation. If Hank successfully broke in, seized evidence, and arrested Walt and Jesse the case against them would be thrown out and all evidence found would be null and void because the way Hank obtains the evidence was very much illegal.

Plus we wouldn't have had the awesome follow up scene where Saul's receptionist calls Hank pretending to be a cop reporting his 'wife's accident' if they went that route.

      @@MrRemixV3 it would only require 1 warrant. If Hank secured a warrant for the RV and the RV was on private property, he would be able to enter the property to search the RV, but would NOT be able to search anything else.
      He was amazingly wrong about probable cause also. Probable cause as it relates to vehicles allows officers to perform warrantless searches of vehicles based off of exigent circumstances. Exigent circumstances basically means that since the vehicle is mobile, Officers do not have time to secure a warrant and can perform a search after developing probable cause. The RV being considered a domicile or a vehicle is a moot point to this case since the RV is not on a roadway and does not appear to be able to be moved easily, so no exigent circumstances appear to be present. The vehicle is also on private property which Hank did not have permission to enter. This represents an unlawful search. Even if Hank developed probable cause and secured a warrant for the RV, any evidence discovered during the subsequent search of the RV would be inadmissible since Hank violated the rights of the property owner. Furthermore, the bullet holes in the side of the vehicle would most likely not be sufficient evidence to secure a search warrant. Hank would have to articulate that the holes constituted a crime and there is evidence inside that needed to be secured. The presence of the tape over the holes suggests that they are not recent and there was no reason to believe anyone inside was in need of medical assistance.

      To an extent I think that is true but I’m also pretty sure that if a company is open for business anyone is aloud to enter, like I said I could be wrong about that but either way I still think he could have said he doesn’t want him on his property

      @@newwave7908 he could’ve. As mentioned when Joe first appeared, he told Hank he was trespassing on private property and trying to commit B&E without a warrant. Joe was well within his rights to tell Hank to remain off his property until the warrant arrived that said the officer could enter the lot to conduct a search of the RV.

    Technically Hank was breaking and entering. Unless he was acting under exigent circumstances, he could be charged accordingly. Even if the bullet holes were apparent it wouldn't qualify as probable cause as he observed no gun shot nor was he responding to a gunshot, and the vehicle wasn't moving. There was no immediate suspicion that a crime involving a firearm had occurred. Even with narcotics and the materials to make methamphetamine the two would almost certainly have had the charges dropped.

      Indeed, and what this clip doesn’t show was when Hank was first inspecting the RV, he was trying to open the windows to peek inside of it to establish probable cause. The problem with that is that as Joe mentioned probable cause needs to be readily apparent. An example is someone getting pulled over for a traffic violation and there’s a bong in the shotgun seat in plain view. At that point the LEO has the right to search the vehicle

      Charges dropped or a mistrial? Does it really work that way? Even though the court knows well they are cooking felony quantities of meth the charges are dropped anyway since the DEA had no right to break in?

      @@METALLICARULES11 yes it does. The rights are there for a reason. What if Schrader had broken in and there was no evidence that it happened? He just committed breaking and entering against a citizen without probable cause. Even if there was evidence that a crime was being committed, cops can’t just be breaking down doors of anyone because they have a hunch. That would lead to massive amounts of police abuse of power that was common place before cases like Miranda v Arizona reestablished that people have rights that protect against the lowest level of government

    This scene is such an underrated moment in the show, it’s not very talked about or mentioned much.
    It’s probably in my top 5 favorite moments in the show. I still remember seeing it for the 1st time and being on the edge of my seat thinking “how the fuck are they getting out of this”. Legit classic. 😎

    I remember watching this clip for the first time while doing my assignment during my US Government period in my Senior year. 2 years later, I'm binging Breaking Bad & caught up to this scene & got lost in the nostalgia, not the best year ngl, 2020 go die in a bathtub of hydrofluoric acid, but this moment really stood out to me then since my teacher loved this show, also helped that he seemed mid 20s at least & that gave me the scope of how engaging & relatable he makes his classes out to be, something a lot of teachers can learn nowadays to make their classes better.
    Here i am now wishing i got to know him better since our time was limited & 2020 meant i was paying attention to a Zoom class 60% of the time, he was also had media preferences like gaming & Twitch & always made US Government less of a class & more of a engaging discussion.

    1:58 One of the things I love about this show is how they implement symbolism or interpretation in the whole series. If you look closely when Hank retires those piece of tape the light enters in the RV and the first ray of light points to Walter in the abdomen on the right side... if you've seen all of breaking bad you know what I mean.
    Another thing that I noticed is that in the series they subtly show us characters that in a reflection you can see a point on the forehead as if they were going to die and indeed each one that I saw died in some way, I will not say names for those people who have not yet done themselves a favor and watched the series. Anyway I found it very interesting and wanted to share it.

    Funny thing is, from a standpoint of avoiding criminal liability, it almost would have been better for them to let Hank break in. It’s a textbook illegal search, and ANY evidence gathered as a result, including the lab, Walt’s overall involvement, and any information that comes from the discovery of Walt’s involvement would be thrown out as fruit of the poisonous tree. Both Jesse and Walt would have walked out of court free men with most, if not all charges dropped after the first preliminary hearing.

    I just realised that the light shadow of the bullet holes reflect light almost exactly where Walt is shot in the final episode of Breaking Bad (when Hank pulls the tape off). It may well not have been intentional but damn I hope that this was some serious planned foreshadowing!. 🤯

    Man, the last moment with Walt and Jesse in the Rv. The atmosphere of the shoe really changed in season 3. It was like way more of the show took place indoors, since they were cooking in an underground superlab. When Walt and Jesse cooked in the RV breaking bad really felt like a neo-western show, because every time walt and jesse cooked you got several great shots of the outdoors.
