Not bad at all. Kind of makes me wish they'd release a small set of cases where the person you thought was guilty of murder ended up being guilty of a lesser crime and was tried for that. There are definitely a few of them.

I have some questions regarding this. If Payne actually had a transcript of the previous case... Could Godot be in trouble and had a guilty veredict? Also I guess the change of plea was absolutely necessary to get Godot out of the hook, but why he didn't change it on the begining? @@elj3ster *TLDR: You need evidence to prosecute so the transcripts were necessary. Diego Armando is a dramatic, but accurate man and his change in plea mistrial isn't unusual. This got long so click the read more with caution* I am going to preface this with several things (and apologise this got very long by accident). First, I am Canadian and the Criminal Codes is the what we use as a basis for criminal proceedings here. Criminal law is different from both American and Japanese law, especially Evidence law. Second, my main focus was in Employment law and I did my internship dealing with unlawful termination. I learned the basics of criminal and the only time I was directly involved in a case regarding the criminal code, it wasn't murder. I also never went on to pursue law once my schooling was done due to a hard case I was apart of that made me realise I couldn't do this for the rest of my life.. Third, Ace Attorney has always had a basis in actual criminal law (since it is suppose to be a spoof of the Japanese legal system) but employed it differently. The world is built in a way where there are some rules that match irl, but it doesn't mean it's employ in the correct manner. First, I am going to be looking at this as though I am applying the Charter of Freedoms and Rights and the Criminal Code of Canada, since that is what is what I know (and I have access to) with the disclaimer that I am not a lawyer and never took the bar. Here at least, whatever Diego confessed to in the last trial would not be able to be held against him period. Section 13 pertains to 'self-incrimination' which states that a witness can't have their testimony used against them as they "the right not to have any incriminating evidence so given used to incriminate that witness in any other proceedings....." Diego isn't a witness, but I don't think there's any case law out there of a lawyer confessing to murder, but I think that still stands. Payne would have to go through the whole procedure of proving him guilty without a confession, but obviously Payne is a shit lawyer and would of lost the trial immediately. If we were looking at this without this rule (since they're not Canadian obv), I still stand beside Diego. You need proof in order to get a conviction. It's been a while since I watched the video so idk if it was brought up, by Payne being like "well it was said here in court" is hearsay without any evidence to back it up. Hearsay is information you got second hand. Unless Payne had solid document showing what transpired, whatever he says can't be accepted as proper evidence. You always need evidence. It's something I've always enjoyed about AA is that Phoenix always needs proof for his theories which is how it would go in court (though less wild). The Judge can't be like "oh yes I remember that, guilty!" because that would open up the opportunity of appeal. The Judge wasn't correct in their sentencing and thus a miscarriage of justice while means a new trial. *You always need evidence when you are in court*. Edgeworth might be the King of Prosecutors, but he isn't shit compared to evidence. In the courtroom, evidence is king and trumps all. You can say whatever you like and reference whatever case you want, but unless you have the proof and documents to back it up, your words mean nothing. You are right about the plea, Diego should of changed his plea at the beginning, but this was for dramatic effect. As in 'not guilty of second degree murder but the defence enters a plea of defense of a third party'. Plea changes do happen midway through trial, but this normally seen with a plea bargain. I have seen it happen where the defence has changed their approach midway through trial too, but prosecution is aware of this. Defence and Prosecution often work in tandem, because the goal is less to punish a person but to see justice done. Our legal system is still corrupt, but there is a different outlook and approach. Rehabilitation, at least in cases I've dealt with, tends to be the goal more so than prison time. So again, Diego was well within his right to change the plea midtrial, but the way he did it was more on the dramatic side. In the end, I still stand by what I said before that this is one of the most accurate representations of how courts actually work and the way evidence is handled. That doesn't mean it's perfect and still at it's heart an AA case which means it's here more for the drama and story. Either way, the person who made this video should be very proud of themselves.

Godot only wanted to fight Wright in the end to know if Wright would protect the only connection left to Mia. after the case wouldn't he admit his crimes after all he was ready for death since there's nothing else to live for.

Wow this was really well put together! Everyone acted in character and the dialogue was great. Only thing I'll say is in my headcannon Godot would probably just let everything after T&T happen without his input but if he did decide to defend himself this is exactly how I'd want it!
That's what he was implying at the end of the game, but I'd compare it to pro fighters saying they're retiring after a bad loss. I mean he just had his whole view of someone shattered, he's bound to say something out of emotion.

This... is surprisingly well thought-out, damn. Godot was right - even if Maya or the Judge said "it was because a demoness was attacking" no difference. With the transcript, he might have gotten a harsher punishment, but even then, he might have been able to plea Heat of the Moment due to his trauma with the silhouette of Dahlia Hawthorne.
If another Ace Attorney game comes, I want to see Godot and Franziska Von Karma back. That would be so epic. And to hear Godot's theme when he comes back... noice

MMMMMMMMMMMMMMMMMMM It's tough because I 100% buy that Godot is absolutely smart enough to get himself out of a murder charge, and it would be awesome if he 'did' to that... but I'm not sure it's in character for him to just decide to do this when he seemingly resigned himself to his fate at the end of T&T. I feel like there'd have to be a 3rd party to force his hand. Maybe a Redd White type of corrupt businessman character comes and is like "You need to get yourself out of this situation, and if you don't I'll do XYZ" and kind of forces Godot to undo his own confession. It would even explain how Winston Payne would prosecute a case like this; some back deal was made by said 3rd party.
I would agree if not for two things: 1. Godot is very sentimental after getting caught, but he never gives a hard confession to murder. He says he doesn't know what he was thinking, which led to Payne's fumble in this trial. This could probably be explained by him getting caught up in the emotions from seeing Mia's spirit. We can assume that his attitude would change when he gets some time to stew on it and think (such as in a jail cell). 2. He likely feels some sense of duty toward Maya. We can tell he holds Phoenix personally responsible for Mia's death up until the end of 3-5. If he weren't in the coma when she was killed, he would be unbearably guilty for not being able to save her. Now that he's out of the coma he may feel like he has to protect Maya to do what he couldn't do for Mia. I honestly believe it's more out of character for a man like Godot to lay down and die than to try and fight.
Wow, this is amazing quality! I don’t know what objection.lol was like a year ago, but having finagled with the website myself, I can tell you put a lot of work into the pacing and text formatting. Plus, the dialogue itself felt true to canon. The ending was sublime 😊
I love this! I like the change from the usual pounding of the evidence to the pounding of the law. Although personally I imgained a lot bigger of a point on if the court would recognize a difference between channeler and the spirit. Cause that would be precedent setting and what not
We can assume the courts don't accept anything regarding spirit channeling as evidence from the lack of its mention in 2-2 and the DL-6 incident being so controversial in-universe. I suppose it would sound weird to hear an attorney say "No, it wasn't my client but the person posessing them".

this reminds me of a fan case here on youtube a long time ago about edgeworth trying to help godot right after the events of bridge to the turnabout, but i can't find it nor remember its name, does it ring a bell to anyone here?, i think the prosecutor was payne and at some point double jeopardy being mentioned but not much else

Well, why wouldn't Payne have the case transcript? That's just weird. Anyway, could have built up more on the contradiction of the victim's wounds not fitting with Dahlia's testimony from the transcript (her back was to the wall, and we know that to be true because of the upside-down message, so how did Godot stab her in the back with a sword?)
There is not a single case in the main 6 games where a court transcript shows up as a piece of evidence. You could say it's just because it was never needed, but I like to think it's just not common practice to keep it in evidence. Sure, maybe a competent lawyer like Edgeworth would have it, just in case, but Payne? Payne's a nitwit, of course he wouldn't have it. And the location of the wounds is irrelevant if there's reasonable doubt in that it was defense of a third party rather than murder. You would need to go back into the case to explain how it was murder in spite of the defense of Maya, which Payne would never be equipped to do against a lawyer of Godot's caliber. And again, he didn't have the transcript, so it would be he said, she said. With Godot's pure humiliation of Payne, there would be no reason for the judge to grant an extra day, which is the only way he'd be able to fumble together a coherent argument. Thanks for watching!

It's a cool idea but remember he did tamper with evidence by clearing away the bloody snow around the stone lantern. He did miss the spot that had Maya's name, but him clearing away the snow is evidence enough for the crime.

Under current California law, Godot's situation fits the definition. You could argue that it may be different in the AA universe, but this is just a headcanon anyway.

It's tough because I 100% buy that Godot is absolutely smart enough to get himself out of a murder charge, and it would be awesome if he 'did' to that... but I'm not sure it's in character for him to just decide to do this when he seemingly resigned himself to his fate at the end of T&T.
I feel like there'd have to be a 3rd party to force his hand. Maybe a Redd White type of corrupt businessman character comes and is like "You need to get yourself out of this situation, and if you don't I'll do XYZ" and kind of forces Godot to undo his own confession. It would even explain how Winston Payne would prosecute a case like this; some back deal was made by said 3rd party.
But also I really like the interactions between Godot and Payne, where Payne literally can't keep his composure when Godot just 'stares' at him XD
I would agree if not for two things:
1. Godot is very sentimental after getting caught, but he never gives a hard confession to murder. He says he doesn't know what he was thinking, which led to Payne's fumble in this trial. This could probably be explained by him getting caught up in the emotions from seeing Mia's spirit. We can assume that his attitude would change when he gets some time to stew on it and think (such as in a jail cell).
2. He likely feels some sense of duty toward Maya. We can tell he holds Phoenix personally responsible for Mia's death up until the end of 3-5. If he weren't in the coma when she was killed, he would be unbearably guilty for not being able to save her. Now that he's out of the coma he may feel like he has to protect Maya to do what he couldn't do for Mia.
I honestly believe it's more out of character for a man like Godot to lay down and die than to try and fight.

Wow, this is amazing quality! I don’t know what objection.lol was like a year ago, but having finagled with the website myself, I can tell you put a lot of work into the pacing and text formatting. Plus, the dialogue itself felt true to canon. The ending was sublime 😊
I love this! I like the change from the usual pounding of the evidence to the pounding of the law. Although personally I imgained a lot bigger of a point on if the court would recognize a difference between channeler and the spirit. Cause that would be precedent setting and what not
We can assume the courts don't accept anything regarding spirit channeling as evidence from the lack of its mention in 2-2 and the DL-6 incident being so controversial in-universe. I suppose it would sound weird to hear an attorney say "No, it wasn't my client but the person posessing them".
@@Hmm_Ace_Attorney_Channel yeah. Payne doesn't seem like the kind of prosecutor who would try to change the precedent. Also it's ironic that if there's already precedent about not separating spirit mediums from spirits, that what hurt Maya once, helped Godot

Well, why wouldn't Payne have the case transcript? That's just weird. Anyway, could have built up more on the contradiction of the victim's wounds not fitting with Dahlia's testimony from the transcript (her back was to the wall, and we know that to be true because of the upside-down message, so how did Godot stab her in the back with a sword?)
There is not a single case in the main 6 games where a court transcript shows up as a piece of evidence. You could say it's just because it was never needed, but I like to think it's just not common practice to keep it in evidence. Sure, maybe a competent lawyer like Edgeworth would have it, just in case, but Payne? Payne's a nitwit, of course he wouldn't have it.
And the location of the wounds is irrelevant if there's reasonable doubt in that it was defense of a third party rather than murder. You would need to go back into the case to explain how it was murder in spite of the defense of Maya, which Payne would never be equipped to do against a lawyer of Godot's caliber. And again, he didn't have the transcript, so it would be he said, she said. With Godot's pure humiliation of Payne, there would be no reason for the judge to grant an extra day, which is the only way he'd be able to fumble together a coherent argument.

It's a cool idea but remember he did tamper with evidence by clearing away the bloody snow around the stone lantern. He did miss the spot that had Maya's name, but him clearing away the snow is evidence enough for the crime.

@@aussiehtc5635 Not in many states in the US. Defense of a third party is a perfectly legal defense, even through killing the attacker. Under current California law, Godot's situation fits the definition. You could argue that it may be different in the AA universe, but this is just a headcanon anyway.
