      we have "freedom of speech" until we say the wrong thing to the wrong person. then we have to get an attorney, spend a bunch of money to prove we had the right to say what we said. its the American way!!!

      Can't sue them because they gave themselves immunity from suit and 99.9% of the time prosecutors refuse to prosecute them and 10 out of 16 members on the judicial ethics board are hand picked "appointed " by the supreme court , so the remaining 6 members could be saints and they are the known minority, so the 10 carefully hand picked will always control the outcome which 99.9% of the time will protect the traitorous corrupt criminal judges. Extremely unamerican!

    Steve, a great topic and an incredibly important issue. Though you hinted at it, I'd say that not only should citizens have the right to dig for the skeletons buried by government/judicial institutions but that, in a democracy, it should almost be an obligation. "We the people" is not just about rights, but also the responsibilities of self governance. This case highlights a trend of elected or appointed government officials trying to use or abuse the law to shut down investigation or criticism of their activities by the people. I have seen many posts on UA-cam over the years where citizens, lawyers or journalists have been threatened with arrest or been arrested for just trying to get information that should be legally available (FOI) or for asserting their rights in a civic building or courthouse. Seems that the "hick" towns and counties are bad for this. Reason? Not the law - just an abuse of power to keep malfeasance or incompetence swept under the rug. Democracy needs the full light of day to flourish, and it's the right and responsibility of any citizen to call those in power on their real or perceived failings - just do it without threats and it's all good.

    You seem to feel as strongly about this as I do, and I commend your bringing this case to worldwide attention. I think if I were an attorney licensed to practice in Michigan, I'd be taking this on pro bono and filing emergency briefs with the appropriate appeals court to get this man released immediately. They are playing with fire here, and it looks like the good citizens of Michigan are going to wind up paying this guy a shit ton of money. The judge should step down as she clearly doesn't understand the Constitution she swore to defend.

    I hope this guy sues the crap out of this county, the cops, and the judge. Apparently 1st amendment does not apply to criticizing judges in this county. Inappropriateness is not illegal. I hope she gets removed from being a judge. Half a million for bond, what a joke. I heard of people on bond for attempted murder or murder for the same amount or less. Sucks for that guy he is in jail until December 13. I would love to hear the DA argue for this case in court. This guy needs a civil rights attorney. Upon winning this case, I hope this guy sues.

      @@humansvd3269 They usually do. That will follow a lawsuit by this guy for sure. He does not seem like the kind of guy to give up. 3 months in jail because 500K bond is outrageous for said supposed crime he committed. This guy can get a lawyer for pro bono when he goes for a lawsuit, giving all I heard about this case.

    The facts are that there is no incitement or any life threatening angle to the case. This is unconstitutional on its face, as a direct violation of the First Amendment. Frankly, the court should face a First Amendment charge. We need to make the 'powers that be' (including judicial, police, polititions, etc) accountable.

    I bet this was the judge's thought process: "I can't immediately cite this person for contempt of court. I know! I'll manufacture some bogus charge to get him involved in criminal legal proceedings so I can then use the tools of the court to shut him up, even though I'll probably never get a conviction on the underlying charges."

      This is another sovereign citizen argument: That you can "go after" the judges and cops and take their bonds, pensions and so on. Which, as you know, does not work and never happens. But it makes them feel better when they say it.

      @@stevelehto Yep, Ive been involved in the patriot movement for many years (which some call sovereign citizen) and I have heard this. While we SHOULD be able to do this, you are right..... It just does not work. I also understand that it is qualified immunity, therefore, if you could prove that this government servant broke the law, they might be "disqualified" , but I understand that would be a nightmare to prove in court.
      If I had to find any shortcoming of our Constitution, which is difficult to do, I would say that it is WAAAAY too difficult for citizens to end tyrannical government servants. The local governments have structured it this way, of course. The problem that these people do not see is that this is like closing the valve on a pressure cooker as it will have dire consequences.

      There is a petition to remove for Judge RACHEL RANCILIO. You may be able to find it and sign it THIS IS A VIOLATION OF CIVIL RIGHTS PLUS $500,000 BOND THE FINE FOR THE CHARGE IS $1,000 IF CONVICTED.

    I have a psychiatric history going back to before I was 3. I cannot just take a beating without doing what I can to reduce the amount that I am getting clobbered.
    In 1980 two state troopers were responding to a "disorderly conduct call".
    The 1st trooper approached and asked to see my identification.
    I took my I.D. out of my wallet and handed it to the officer.
    He started to walk off with it to the patrol car without asking to do it.
    I said, "Hey you can't do that" (I simply wanted him to ask).
    He said, "Oh yes I can" and I replied "you only asked to see my identification. You can't take it from my possession!"
    He came close so there was barely an inch between us and poked me hard in the chest with the tail end of his flashlight and said loudly in my face "Oh, Yea!"
    He was out of line in that action, so I pished him back just enough to put a foot of space between us.
    While hitting my wallet out of my hand and hitting me in the back with his flashlight hard enough that the intention was clearly meant to through my 300 lbs. body against my mother's car.
    I hit him back.
    The other trooper came to the aid of the attacker rather than the victim. That is contrary to what an officer said to us students in the 2nd-grade class in the 1960s.
    I have no fighting ability and everyone always said that I hit like a girl.
    I then had 2 troopers assaulting me. I remembered from watching television in the late 1960s advice to college girls that said, "when being attacked, to grab for your attacker's eyes."
    I had no other means of defending myself!
    To shorten the story, I will jump ahead now.
    I was clobbered pretty good.
    My mother was taken to the E.R.
    My mother had a heart condition that was caused by angina which was caused by stress.
    At the hospital, the Doctor told my mother that the stress from that incident caused her further irreparable heart damage.
    My mother died of her final heart attack less than a year later (if not for the further heart damage caused by the troopers felony assault upon me, she probably wouldn't have had that final heart attack)
    I had been charged on the day if the incident with 2 counts of assaulting the officers!?!?!? WTF!!!
    I started talking about suing the troopers for my mother's wrongful death!
    So they had me railroaded through the court.
    When the troopers committed their felony assault upon me, they caused my mother irreparable Heart damage leading to my mother's death.
    So, by law, The 2 troopers were legally guilty of my mother's murder!!!
    So, when they assaulted me, they put their ass in a sling. They then compounded their crime by abusing the court system to get their ass back out of a sling.
    I will forever hold the court system in contempt, and if a judge ever says that he holds ne in contempt, I will say that that nakes it mutual!

    Thanks to Steve Lehto for taking on this emblematic though extreme case.
    Family courts operate their own separate justice system with different standards that regulalry abrogate free speech, due process and equal protection. Judicial discretion in family law comes from laziness, incompetence, and weak laws. Family attorneys are largely complicit.
    This case is egregious and unconscionable. Chilling. However, it's not surprising to a certain class of litigants in high conflict custody cases which are increasingly clogging family courts.
    Reform is needed now. Presumption (rebuttable) of joint custody and restrictions on judicial discretion are a good start.

      I wonder about the friend of the court. My brother was going through a divorce years ago. His ex-wifes sister worked for childrens services and keep fabricating evidence that kept showing up in official documents till she made a mistake and said something happened on when he was meeting with a different judge (Federal) at the judges home about a kitchen upgrade.

      Not only should child custody be 50/50 by default between both parents, but due to this, there should be no child support paid from one parent to the other. This act alone will eliminate many family court cases.

    This abuse of power by the judge was made worse by the police who should have reminded her that the man was excercising his Constitutional rights but they blindly carried out orders to arrest him. I hope a lot of people get pissed off at this and get this man a good lawyer and also get the judge and any other member of the judiciary involved removed from their jobs.

    Based on the information provided on this case, it appears to be an egregious case of abuse of power. Seriously???? Have you no shame?!?! This judge should reprimanded and disbarred promptly. What an egotistical drunk on power representative of the state. She and others of her ilk are adding to the distrust of the legal system. That judge must be placed before the scales of Justice and judged harshly.

      Oh, and Anger? If that's what you garnered from my post you sir, totally misunderstood the sentiments of my message. A better classification would be disgust and disappointment. I don't have any dulsions of grander, the Sherri's Office is not without their fair share of blame on this one. The judge communicated to the Sheriff's Office which precipitated the events that appeared as an attempt to silence this citizen's right to Free Speech. It does not appear that the gentleman overstepped that right into the realm of breaking the law.
      So what is a logical person to think would happen after sending such a communication to the Sheriff's office? Definitely not pay the guy a visit, share jokes about the situation and tell him to have a nice day. Or better yet, dismiss it as the judge is just being overly sensitive. Is this amateur hour? Is this the best the judicial system has to offer? The best of law enforcement? I think not. There are plenty of government officials and law enforcement who honor their profession daily to the best of their abilities. This wasn't that.
      This is an attack on the First Amendment and both were culpable in this situation.
      Who cares what judges do right? They aren't actually telling law enforcement what to do. However, in this case the judge didn't exactly instruct them on what not to do. Accountability and common sense goes a long way. Placing one's head in the sand simply tares at the fabric of humanity's dignity.

    If the bond was illegal could he sue for wrongful imprisonment? A judge that is willing to use the "violence" of imprisonment (an hour in prison can be far more damaging than any punch on the nose) to silence a critic, should be considered a fairly significant skeleton.

    I think he should sue under 1983 for denial of civil rights especially the 8th for excessive bail. Also wrongful prosecution, the law they cited was for making phone calls... LOL I think they should also prosecute for imprisonment under color of law.

    Part of the problem with people not knowing or understanding the constitution is the fact they arent teaching it in school anymore. My daughter is going into the 6th grade and until the other day she didnt even know how many states there are in the US. I went and got 2 posters to teach my girls myself. The Bill of Rights and the Constitution of the United States. They are picking up on it. It seems to me that our kids should be learning this information in elementary school!!! Why arent more ppl outraged over this whole thing?

    How is this not an abuse of power? This judge contacts the sheriff to arrest (cease and desist?) a citizen from exercising their Constitutional rights. Something smells bad here. If this is allowed to stand, this mean any judge who reads something on social media they disagree with or take issue with can have that person arrested on trumped up charges.
    You've made clear the power of a judge within THEIR courtroom. I get it, understand it, and agree order needs to be maintained. I do not understand how a judge can direct the sheriff to arrest someone because the judge's feelings were hurt.

    Digging up skeletons in a court's closet isn't just lawful, it's good citizenship. It's the boss checking up on the help.
    By the way, if the defendant doesn't have the right of free speech, which includes the right to petition the government, does he have the right to enter a plea in court?
    It sounds to me like the judge is a moron. Far worse, in the context of all the sacrifice for our country's liberties, the judge sounds like a tyrant.

    I guess Judge Rancilio, the prosecutor and the judge who is letting this go to trial slept though their constitutional law classes. The most important right of free speech is the right to criticize those in power.

    Steve #682; I'm glad you posted this video. If I might add, Judges,Lawmen,Prosecutors, etc. know full well what the Constitution says and means but many of them just don't care.

    I had a protection order filed against me by my wife during our divorce for texting her the Confucius quote “Before you embark on a journey of revenge, dig two graves.” (She had told me to my face that she was devoting her life to destroying me.) This wasn't a threat - it was me telling her that she needs to knock off her attacks before she suffers her own consequences. That was my first introduction to the stupidity of the court system - no one understood the meaning (except my lawyer after extended explanation - but he was never able to convey the meaning to the judge). My ex still uses this to claim I had made a threat on her life...

    Why not! Judges can run a mock, with no personal penalties, Other then their job in that county. The tax payers will be on the hook for lawsuit that going to proceed. Your first amendment rights are now guilty until proven innocent.

      His lawyer should file a motion to dismiss the charges and schedule it for hearing in front of the least biased judge he knows, if not request an out-of-county judge to hear the motion. Bad thing is the guy rots in jail while waiting for his day in court. So, probably should also request a bond reduction.

    The charge is obvious prosecutorial misconduct. The bond condition is prior restraint. Both unconstitutional, and judicial misconduct.
    File judicial and prosecutorial misconduct complaints, at both county and state levels, with the presiding judge of the local Court, and at the court of appeals level. Also file the same complaints with any administrative office of the courts on the state level, as well as a civil rights complaint with the State Attorney General.
    Hire a private investigator to dig up truthful dirt on the judge, the prosecutor, the special referee in the custody case, and the county sheriffs involved. Then go to the news media and smear them all publicly with anything questionable they have done in the past or are doing in the present.
    Absolutely refuse to comply with any First Amendment protected free speech prior restraint bond conditions or gag orders. Every time the judge infringes upon your civil rights in an attempt to shut you up, they incur more potential liability: removal from the bench, disbarment, monetary damages, injunctive relief. Poke a stick in the bee hive, stir it up, sooner or later you're going to get some honey....
    Reach out to the Institute for Justice, I can almost guarantee they will take a case like this pro bono.

      This is why prosecutorial immunity needs to be curtailed or even eliminated. If they can't be held accountable for unethical or illegal behavior, they will continue to do WTF they want to with impunity.

    If people only knew how unfair the family court system is in the United States they would cringe. My wife and I have been living a nightmare for over two years now dealing with the family court system. We have not seen nor spoken to our two boys in over two years. Now facing termination of parental rights and the judge in our case denied us appointed counsel for the termination hearing. So we are forced to self defend against the state...yes the system is unfair. I can fully relate to the feelings of this father. As we were told by an attorney here, you cannot criticize the court or the police....you cannot do it. Thanks for posting this video Steve....and remember that if this can happen to a retired law enforcement officer then it can happen to you.
