    You are spot on. ✊🏾 I’m a producer and engineer. And work with songwriters who bring me complete songs to produce. And I never even think about being an automatic songwriter of their composition. I just charge an upfront fee for producing and engineering the song. And I’m ok with that. Thanks for this info and confirmation.

    I really appreciate this because I was told by a producer that because I didn’t play the instruments, I’m not a writer.. problem is, I created all the vocal lines and lyrics to make the instrumental into a song. It really took a toll on my artistic confidence being relegated to just “lyricist”. I know I can write even though I don’t play.

    Thank you. You broke it down fairly directly and simply stated.
    I'm curious your thoughts on a scenario -
    A writer creates a basic melody and puts their lyrics to it, using only a piano for the instrumental accompaniment on a demo of there song... then they submit the demo to a recording vocalist artist.
    The original writer submits the demo, but they do not attend the recording session.
    The vocalist at session also is somewhat of a musician themselves, so after listening to the demo submitted to them at the session, and listening to the piano accompaniment, the vocal-artist grabs a guitar and works through the arrangement, showing the guitar-player hired for the session ideas he has for wanting to add guitar parts to the song. Then the vocalist also does this with the drums.. (shows the drummer what type of percussion idea he has and would like added to the song).
    Then vocal-artist also does the same thing with piano player showing them on the piano what ideas he has for piano parts.
    So at this point the vocalist has created parts for the professional musicians in the studio .. They now have added guitar, bass, drums and piano to the sumitted song.
    Keeping in mind the original submitted demo was somewhat relatively under-produced with only piano accompaniment with the lyrics.
    The singer / musician, and his band members, they essentially took the songwriters initial creation to the next level, to the point of the bands finished recording resembles little of the initial submitted demo, (with exception of course to the initial songwriters lyrics and basic Melody also of course).
    All combined, with the initial songwriters demo, and then the transformative work done in the studio, some I've talked to in the industry say those involved with the changes in the recording session would be deserving of "producing credit", some even say "arranging credit" as well.
    Thus they would be worthy / deserving or requesting a percentage of royalties as active Producing.
    I have seen others speak to that scenario saying the musicians changes to original demo if musically significant enough would be worthy of requesting a percentage of Co-writing credit.
    I'm just always curious the viewpoints from others that speak of these Topics in the industry, what they say would be a fair expectation among all parties involved in scenario as described above?

    Wonderful information. So thankful for you & this platform. Quick question: If I wrote a gospel song a few years ago that was never released & an artist came along & wants to record & release it. If she adds adlibs throughout the song that wasn’t in the song originally is that considered a derivative?

      Thank you! As far as a derivative creation? No, it’s not;, especially if the melody, the lyrics, etc are the same. In Gospel, that's what we do, adlib! Smile! It would be a cover license for the Artist to use your song.

    Always great info! Question: I write lyrics and melody. Usually when I bring a song to someone to do the track, it's usually finished. Well, there maybe some changes I make or some arrangement changes, but usually the lyrics and melody are good to go. Should I first copyright the song before having a producer do the track and then copyright it again for the sound recording after the track is done? Should I share composition copyright if I give them the complete song? Or are they entitled to the sound recording copyright only? Would they own all of the sound recording copyright if I'm also the vocalist? I'm ok with splitting 50/50 if I'm toplining on a track. But I need guidance when I'm writing the full song. I'm ok with the producer having all or most of the sound recording copyright if that's how it should go. But often the producer wants composition copyright, too. Some don't understand that the song is the lyrics and melody and my contribution seems devalued. Thanks so much!

      Hopefully these two videos will answer your questions. When it comes to registering your song with the Library of Congress it’s up to you if you want to separately register both. You could do it after the song is finished and get both rights with the sound recording form.

      Sounds like you own 100% of the composition (melody + lyrics) = song. If you pay a producer for a recorded version of that song and you’re the vocalist too. Then the SR is yours too. Producers are paid for their service. And paid a little cut from the downloads from the SR only. Maybe 2 or 3 percent of each download. But that’s in the air and up to you. Usually producers will just charge you upfront maybe anywhere from 300 to 1000 dollars (locally) to produce your song.

      @@jewelthompson4210well, I can see why. If you wrote the song to their beat. Then they would want some type of percentage of the composition, because you wrote your song based of the producers beat. But demanding 50% I’m not sure. Usually when a singer/ songwriter writes to one of my tracks. They’re usually automatically open to give me 50% of the publishing because it’s considered a co-write.

    This is good advice. So if I created the beat and I wrote the lyrics, but I have a producer mix my song that doesn't mean he produced my song. Especially if he never stated it in the contract or if he was a industry producer posing as a mom and pop producer than he can't say he created my song because he mix it! Correct

    I need advice on a issue i have.
    I teamed up with a songwriter so we can send songs to major labels/artists.
    Now i wanna know how will she be credited (songwriter) for example if the major artist took one line out of her lyrics or if the artist used a bit of her melody, whether it’s just a tiny bit or more than 50%....

      It depends on the agreement you sign. You should always have a writing agreement that states the percentages you all agree to. Never let it just be assumed what it might be. Know what it will be by discussing it and signing a split sheet. Watch this video I did to help explain more.

    I want to emphasize something mentioned in the comments... It is GREAT to see you on camera!!! You have NO reason to be camera shy!!! I love that your videos are concise, yet EXTREMELY informative, at the same time. But, I do have an idea for you, that I believe will make your videos even better (I should note, that I have watched EVERY single video on your channel).
    You should film yourself (just like you did in this video), in conjunction with either stock videos and/or screen-captures, to create that more "immersive" feel.
    Basically, the idea is this:
    1.) You take a video of yourself discussing the video in its entirety (like this video)
    2.) For the Intro of every video, it will be you Full-Screen (providing a quick over-view of the topic)
    3.) Then you could "transition" the video of you into a Smaller Window in one of the corners (think FaceTime, Skype, etc.)
    - While simultaneously, showing the Stock Videos / Screen-Captures related to that video
    4.) Finally, you cut back Full-Screen to yourself, to do your Outro (where you say to Subscribe, visit your website, etc.)
    I hope this made sense. I love the channel, and believe you should have a THOUSAND times the followers!! If you have any questions regarding this, just let me know.

      Tdbo Business it makes sense and I understand the structure and the formatting of it all. I’m so busy, until I barely have time to do these, so when I personally am looking for something I hate having to wait for all of the intro, the talk before the topic.. That’s why I make my videos to get to the point right away. I don’t particularly care to be in the videos myself. It’s because I really am shy! 😅 Go figure when I’ve spent my entire life in public and out front! Now I’ve retreated a lot. To be honest, I'm not a fan of UA-camrs who have super long intros (or over-the-top "fake" energy), but that's not what I'm referring to. Honestly, the thing I love most about your videos, is that you get straight to the point. So, when I'm referring to Intros/Outros, I just mean the super quick "Highlights" of what the video(s) are about.
      My main point, was that you are a Beautiful person, with EXTENSIVE knowledge on ALL of the topics you cover. As such, you have no reason to be camera shy! I have learned more from you, than you can possibly imagine, and I was just trying to say that any (and all) inclusion of you displaying yourself, would only further promote the priceless info that you have to offer.

      You’re welcome! The truth is I explained this exact situation in the video. This is why I also stress making sure conversations are had BEFORE work begins. Also, to understand how things work in order to avoid these type of happenings. You are indeed the songwriter. However, anything is negotiable and if you want to give the producer credit you can. If not doing so causes him to stop working with you or not give you the tracks you’ll need to make a decision on how to proceed. Have you paid them? What was the agreement between the both of you? If he had already produced the music and you then wrote the lyrics and melody to that music, you both then would own the song. It’s now up to you to decide what you will do.

      @@TheMusicBusinessMadeEasy okay thank you so much! I needed the confirmation and i really should have negotiated before working with him! He did say he wanted a share of my royalties (in turn of him producing without me paying for this service) which i agreed to bc its fair but i didnt even think about the possibility of him crediting himself as a songwriter. Bc I wrote the entire song on my own, put the first part on a forum and he contacted me and made an instrumental arrangement to it. So no, i didnt use his instrumentals to write the song, he used my song to make his instrumental arrangements. And it kinda crushed me when he credited himself on his own as a songwriter-composer on this song. Also bc it is so personal to me and my experience with chronic illness and entirely my work. Like the song would still exist excactly like it is without him bc he didnt contributed to the vocal melody or lyrics. What he did was adding instruments and changing my guitar chords.     This has been a grey subject since people have gotten together to make music. Music producers in earlier days were easier related to movie producers, the songwriters sat around a piano to write a song (like script writers, writing a movie script) then they (both) handed the works over to producers to gather the personnel to create the song (studio musicians, arrangers, engineers etc for music ... director, actors, crew etc for films).
    Over time, music producers began to step from around their desks and get involved in the studio with the "creation" of the song. A good rule of thumb is if you pick up an instrument or sheet music (for example "writing" a string arrangement) to create an element to the song that wasn't there before, you have the RIGHT to be considered a songwriter.
    Now whether you are actually GRANTED that right at the end of the song, is up to a case by case basis. I've known people who have worked with large artists and have added fundamental elements to songs that did not get proper writers credits when the business got handled. Some have even gone to court/arbitrations to get it worked out. It's a sticky part of the business. It's best to have an understanding before you walk into a session, however sometimes you also just gotta way if the opportunity is big enough to maybe take a hit on this round to possibly open the door to more propositions down the road. Because gaining a reputation of not only being someone who turns out good music but also (and often more importantly) being someone who works well with others in the studio and at meetings will make your phone ring more often and eventually put you in a position to call your own shots!

    hello again I have a question I have a artist that have unregistered catalog of Music I want to purchase a stake of his music 10% writer share for exchange of registering his music, doing the metadata for each song also using my money to register his music with a distributor like a cdbaby or tunecore etc and registering his music with the copyright office so my question is this more of a co publishing deal situation or do I have to make some changes that will fit my situation?

      @@TheMusicBusinessMadeEasy hello again sorry for the late reply I thought it was more of a co pub deal due to the fact I'm investing my own money in exchange of 10 percent of each of his works I didn't you can do that with a admin deal I guess it makes more sense that its more of a admin because ill be providing a service for that artist registering his works and etc

      @@TheMusicBusinessMadeEasy thank you for the love I appreciate that I have another question the artist I told you about with handling his catalog for exchange of 10% writers he only have a writers share and publishing administration account with songtrust I told him I think its important to setup your publishing so that way if you collab with different artist you're have everything setup if he was to do a collab with a artist and he produce the track can he still do splits with only writers and publisher administration with songtrust?

    Suppose if i am the songwriter, with my own little vocal melody (not instruments), then producer addd extra melody to make full instrumental for my song, so who is the composer here?

      You are the songwriter if you wrote the melody and the lyrics. If the producer added music, it's still the same. You are the songwriter. Adding the melody that you created to music doesn't make him the songwriter. If you want to give him part of the credits you are welcome to do that.

      @@backpackingvillager1480did the producer write the music, and then you came and wrote lyrics and melody to that music? If so, then this makes the producer author of the music. If you wrote the melody and the lyrics and hired a producer to create music to your song, you are the writer. If you want, give him 50% for adding a little instrumental melody to your song. Hope this makes sense.
