Care to quote me the law which compels a Dealership to do so in a business-to-business transaction? I will give you a big clue: a business is NOT a consumer...
@thepurplecat5975 come on, you know the law. Consumer protection act 2013. Vehicle is purchased and develops a fault in the first 12 weeks- deal has to be unwound if the customer asks to do so. If a fault develops week 13 to 26, the dealer has to be allowed one attempt to rectify. A vehicle can only be sold "as seen" without any chance of come back if the customer is given formal documentation stating the vehicle is not road worthy. If you're saying no such protection exists for a B2B transaction, I stand corrected on that one. Either way, offering a new tyre for a 4k repair seems pretty poor.
If the car was purchased on a credit card the card company are jointly liable and a section 75 refund can be requested. The best thing about this is that they will pull the money back from the dealer.
Oh you mean Section 75 of the CONSUMER Credit Act? Which covers CONSUMERS? Good luck enforcing a CONSUMER right in a BUSINESS TO BUSINESS transaction lmfao!
You HAVE to report the MOT testing station. There is no way that car should've passed an MOT, and as a tyre fitter and seeing how many sold cars have damaged or illegal tyres and have a "12-month ticket", well you'd be shocked. One customer of mine, bought a car the day before, and had an issue with the tyre going flat the next day. I went to investigate and the tyre had completely worn through and popped on the inner edge. She had done 5 miles in it, and 4 of those were driving it back from the dealership to her house. When i looked at the other tyres, 2 had eggs in the sidewall and the other front tyre was worn through to the metal on the inner edge. This was on a car that had NO MOT advisories. The MOT station was right next door to the car dealer but there was no way this car had gone through an inspection prior to being sold.
To all those baying for the MOT station’s blood, they could well be victims themselves. It is not uncommon for people to put a set of good tyres on a car just for the MOT and then take them back off when the car passes. Remember, an MOT simply says the the car was good when it was presented to them, not before nor after.

I think buying a car of this type, unseen, off a 'dealer' on instagram is asking for trouble. However, I would find out his location and pay for a lawyer to write him a stiff letter, sent signed for, giving him 14 days to refund you or you will take him to court. You would be amazed how well that can work.
A 'stiff solicitor's letter' is a complete waste of money. It does nothing and scares nobody. If the thought is to take the dealer to the Small Claims Court just fill in the forms, pay the fee and do that instead. Much cheaper.
Far too soft. When we all just say oh well and move on it leaves others who follow after us to be taken advantage as we were. I.E this dealer will only do this again to someone else.
youre too soft on the dealer..... Name and Shame, Inform Trading Standards & DVLA about the Dealer Seller & Dodgey MOT Centre. Once hes been under the microscope the amount you have lost in money will be his down fall in potential car sales in the future as for the Warranty its just on paper nothing more they wont do anything about the car now youre stuck with a bill to spend on fixing up the car, id inform the dealer to pay for the repairs out of his own pocket otherwise he'd be having the car back plus going to court for false advertisement
Like others have said the dealer is pulling your chain until the cooling off period has gone by. In future if you don't want a car that you bought via a distance sale just tell the seller you are rejecting it rather than getting into conversation with them
The Quattroporte is one of those vehicles everyone loves, yet is terrified of. Wherever this bold adventure takes you, I assure you we'll be watching. Thanks for featuring this...
Just looking underneath the car I can tell it didn't have typical Maserati owners. Wasnt garaged, most likely wasnt given services on schedule. When you buy a 'rich mans car' they tend to have clues about them. Low miles, very insignificant rust, Scheduled services (Catalogued). You wouldn't want to buy a car like this from a spiv.
I have to say it's not "fine". You've managed to catch these issues due to experience and connections with a reliable mechanic, but others may not be so lucky. At worst, they sold it to you to knowing these issues with a fake MOT and a dangerous tire that could've gotten you killed. At best, they are ignorant and shouldn't be in business doing what they're doing. Report them.
A few things to mention about those “3rd party warranties” is that. 1. They’ll almost certainly be a clause in there telling you to stop driving the car immediately, obviously this video is evidence you haven’t done that 😂. 2. They will almost certainly insist that the car’s last service has been completed, I think I remember you saying in the last video it only came with an MOT certificate. 3. They will not pay for the whole issue, they’ll be something in the terms and conditions about making “new from old” or something like that, so they would probably only pay a 50% contribution towards the cost anyway. Had an epic battle with one of these companies last year that ultimately led to them paying me £3k towards a new gearbox so learned a few things along the way that I thought I’d share. Good luck 👍.
Yes, it was the cheapest in the country but I don't think the price paid is relevant when it's still misrepresented. Worth a complaint imo to whatever relevant authority there is -- presumably Trading Standards and the Motor Ombudsman?
Don’t get me wrong, we all want a car that is taken care of but jeez, I noticed a lot of people from the UK except old ass cars and even old luxury cars to be perfect. If the dealer deliberately hid information then okay, but these issues are totally normal for the age of said vehicle, especially if it wasn’t properly maintained. Buying any used car is a risk and I feel, if you can’t foot the bill if something happens then it isn’t the car for you. And a dealer isn’t a specialist, so we can’t expect them to know everything that could go wrong with a wide variety of other brand’s portfolio.
I recently bought an A45 AMG, and the car had ran out of air con gas, I immediately told the dealer and asked if this could be re-gassed (as it was never mentioned) and the dealer just completely ignored me repeatedly. I was honestly shocked, didn’t cost much but had to pay out of pocket, but just couldn’t believe the dealer
When I was a younger man in the car trade, I was always warned never to touch a car from a big city, and especially London. I would definitely report the garage MOT station and put it down to a massive lesson learned not to buy a premium brand this way again.
This outcome is the exact reason most of us prefer to live vicariously!!! Just enjoy the car while it lives and don’t through good money after bad, the price you’ve paid will be forgotten in the course of time, and you’ll do more research next time. Good luck 🍀
Both dealer and the MOT guy NEED to be reported as someone else might get conned and that person might not be able to afford it. As for the dodgy M.O.T they NEED to be repotted as the next dodgy M.O.T they do might seriously hurt someone. And if that dodgy M.O.T causes a crash, how would you feel? knowing potentially you could have stopped it. Basically what I’m saying is let’s stop these scumbags doing it to someone else.
Completely agree regarding the warranty companies. They won’t fix anything until it actually fails. I had a leaking differential seal on a car. “I was told until the differential fails, we won’t do anything” I don’t know what you’re planning to do to your car Joel, but fix it before you modify it. Get everything working as it should with no faults.
If it’s a company, to which you can find out on Gov website, then even if the 30 day surpasses you have notified them of the problem before the first month of ownership. Then they have to by law under trading standards attempt to repair the fault, if the fault continues then they have a second chance to repair or you have the right to reject the vehicle. He has admitted in writing that he noticed the noise so is aware there was an issue before selling but still withheld that from you. Regardless of price the vehicle is worth he has miss sold, misled you and left you in a disadvantaged position (out of pocket for the car so far). I’ve been through this personally, even had to take them to small claims court so if you need any advice I’m happy to help. The main thing to take away from this is that he IS liable to attempt a repair until the problem is solved or after the first attempt fails you have the right to reject
To clarify more of what I mean - these social media dealers want to cash in on the 'modern classic' craze, but without any understanding of what these cars are about, or what it takes to sell one properly. If you have a car with this kind of problem, it's either spares or repairs, or you fix it to sell it, albeit at a stronger price to promote to the new owner that it is "sorted". But most of these kind of dealers, I don't even know if they know anything about these marques other than the hype = cash.
I think its fair as pre price, like if everything was in good condition then they wouldn't have sold at this price in the first place, but of course its bad that they weren't transparent
I can't believe you are just letting the seller walk! And reving the guts out of it with the knocking! Id be getting that totally checked out before putting it through any test driving.
You should have stopped driving it if you are trying to reject it. As a distance sale you could reject it and send it back for any reason, including you just don’t like it, within the first 14 days. You should have stood firm and simply made it the dealers problem.
Letting it go is the best thing, especially if you can get some recourse from the warranty. I had the same problem rejecting a car, dealer ignored all correspondence, eventually had to get solicitor and drag him through small claims. End of the day the only winners would be the solicitors, and if you lost, you’d risk loosing the shirt off your back! And have dealers legal fees to pay as well!
Only applies to CONSUMER transactions. He bought this business to business for his business (UA-cam channel). Stop trying to quote consumer laws that don't apply.
@@thepurplecat5975 . I believe its his everyday car and youtube is just a side gig. I don't think it was bought by a limited company . You sound like you know more...
Recently had both cam variators and full cambelt kit almost entirely paid for by a warranty company after buying an Alfa giulietta 1750 from a main dealer. It took ages to sort and I had to organise it all myself through a specialist because the main dealer just didn’t want to help at all, but we got there in the end so you might get lucky 😄
Whilst it was always a risky purchase you should expect an honest MOT and a description including faults at least. It won’t be perfect but at least you know what you’re letting yourself in for and can budget accordingly.
Good for you Joel, these dealers should not be allowed to get away with this type of thing, can’t stand liars. Hope you get it sorted mate! More people need to expose these dodgy dealers!!
You’re a braver man than me. 110,000 miles on a Maserati almost 20 years old, you’re gonna be fighting issues moving forward constantly, but best of luck and looking forward to the content 👏
I’ve been in a similar situation with an unscrupulous dealer. In my experience nothing is actually done to enforce the legislation that’s supposedly there to protect you.
Hey pal, I get your standpoints about "it is what it is for a cheap car". But that MOT is just dangerously Criminal. This is mainly a car enthousiast channel. But MOT's are a part of our lives for car enthousiasts. So please find out about how they managed to scam not only you, but the U.K. government, laws and regulations in a very very serious way. They risked not only your life, but that of others on the road.. imagine that tire blowing up on the highway, with a brand new MOT and causing injuries or worse. Please go to the police to make a report ASAP about the MOT crime. No one cares about the engine or exhaust state, those are just costs we accept when we buy cheap cars. I don't accept people putting vehicles on the road, ready to take people's lives and loved ones. At least do the police report for your country and fellow citizens (and us). If you want to go even further, like with the justice system, I would support you financially up to 10k euro if we go all in.
If you have plans for content, then fair enough but I think it would have been better to have rejected the car. The dealer appears to ahve been misleading at best, lying at worst and should be investigated and/or shut down to prevent others from also being sold cars that aren't as safe (roadworthy) or as well maintained as claimed. This kind of dealer is why the motor trade has the reputation that it has; same for the dodgy MoT station. Good luck with getting the car fixed and upgraded
All part of the journey and content for you. Install a pre-lube system to stop the variator clatter at start up. Be a couple of hundred quid. Then long term get it fixed correctly. I'd be more worried about the underside despite what the "expert" said - its a right state and needs the subframes removed and blasted to see what's left of them.
@@DontDrinkTheFlavorAid Absolutely. If a previous owner of a performance car has been penny pinching with the tyres then where else has he cheaped out?
Take a listen to “Al Wilson, The Snake”, beautiful exciting & dangerous but you know what you’re getting into. I admire anyone that has the guts to go out and buy this sort of car. You pay for the experience……..and the memories are truly yours.
Glad to see you back in something good & faulty again! Is there any content to be made from taking on the warranty company, to see if they'll actually sort anything? I guess that might drag on for a year, and only yield an email trail rather than interesting outcomes.
Shame about the dealer, I follow them on insta and had been considering a few of their cars. Not any more. Honestly you should push forward with rejection and find another cheap QPV to work on.
7:59 - it's not fine that thi person does business in this way. Most other people are not UA-camrs who can make content and therefore money whatever happens. Other are will get royally stitched up and/or have to spend considerable amounts of their time/money getting the dealer to do do the right thing and take the car back. Lesson here for everyone to see though.
The only reason I’d say name the dealer is to warn and protect others who may not be able to undertake the repairs or hassle involved. The good thing for you is that you can make videos and some money, but for someone who may have bought it thinking it’s their dream car may her stung hard.
Yes I think you are 100 % in your right to kick off as the way it was sold is not on at all. And the fact that they lied to you about the service work just done not give any confidence in anything else they say.
I’ve rejected a Merc ML back in 2012. You need to give the dealer the chance to repair the faults. I tried 3 times without success. Within 90 days you have to put in writing, in a specific way ( look on line or get legal advice) that you have given them every chance to repair the faults but unfortunately the fault/faults are still apparent; therefore you reject the vehicle. Unless you do it this way you have no chance
When you did Maserati and Porsche 996 back to back you just said home much better the 996 was despite it higher milage and 6/7 years older. You had a massive grin in the 996.
Its scary how many MOT no advisories actually are unsafe. I bought a mini as such from a dealer with very high customer feedback and asked my local garage ro service it. Was shocked to fine the tyre was ilegal. I complained and got given 500 compensation but there was far more that should have been found. Worn suspension bushes and drop links. Engine fault with thermostat. Only 2 months prior had MOT with some of these as advisories.
Obviously sold with a DUD MOT - I fell into that trap - Darren Carpenter car sales - (now defunct) flogged me a CL55 AMG (super charged) - pretty much like this I took to a specialist and there was around 5 thousand pounds of work or more required - it would NOT pass a MOT, it was of course sold with one. I basically got my money back after I sent the indy report over. I would be slightly worried about the engine on this but good luck and keep us updated.
Not fit for purpose. Sue the dealer. As an aside I had a problem with an item that was bought new. It would go wrong a few times a month so I stopped the payments. They threatened to sue and I said bring it on. Long story short. They sued me and the judge threw their case out of court. If you have documentation to prove your case you don't have to worry. Bad news travels fast and the dealer will normally capitulate to keep their name, although you will never buy from them again.
Maserati with 110k on it. 🤷🏻♂️ Depends on what the fix for the rattle is and the cost. I’ve had a number of (much) older cars-Volvo’s and Jagggggs. 1. “Caveat emptor”, and 2. Presume that any trade seller has “forgotten” to mention some things! Basically, for any luxury car expect you’ll be into for £££££
If the dealer has done you over Joel, what's stopping you from naming and shaming him? Any of your viewers could be about to buy a car from him right now.
I would send it back. These are great cars and offer tremendous value for money but you really do want to buy the best one you can find as parts can be expensive. Send it back and find a much better example with full service history (very important) - will cost you more but you will have a much better car on your hands. A cheap car is one thing but a misrepresented one is totally different. This car was misrepresented and the MOT is a scam. These cars are so much fun and the engine note is out of this world. I haven’t driven a ZF version but am with you on the single clutch automated manuals - I love them. I have a GranSport with the same engine (mine has a dry sump and I think the QP has a wet sump) and CambioCorsa and love the thing to bits. The downshifts in sport mode are just epic! I love masers from this era!
You are absolutely being too soft towards that cowboy of a dealer, really hope you won't leave him off the hook. On the plus side I'm delighted your keeping the thing as I'm really enjoying watching the series. You should check out M539 Restorations if you're interested. He's rebuilding one and it's a brilliant channel.
Ashley is the last person who would talk the job up! He is very honest and he will give an accurate appraisal of the car and identify areas that you may, or may not, wish to address. The decision as to whether to keep or return the car really depends on its value to you as youtube content. Hopefully you paid via a credit card, which would help get a refund, although you may have to pay delivery costs plus a charge for mileage.
I despise car dealers. We just managed to finally get a car rejected after 5 months. The finance company was the only saving grace as the dealer refused to do anything despite the fault being clearly their problem. They are all good at the same and appalling when you have a problem; in my experience.
Regardless, an existing fault is ground to refuse or expect repair, no arguments, financial ombudsman would back that as long as you got an independent inspection straightaway
The issue i have is what if the dealer sells a similar car with alot of issues and this causes a crash where people are hurt or worse!same goes for the MOT in fact its even worse if you don't report that MOT center
Definitely report the M.O.T testing station. As for the car, the seller definitely should have mentioned the rattle on start-up, but it is an old, complicated Italian luxury car at the end of the day, they do break, and they are expensive to fix. It's to be expected unfortunately.
Personally I wouldn’t want it because of the Cat S status which means structural damage. It could be fine, but I’d rather have one without Cat S. Other than that, it’s a supercar for £6k so it’s probably about right condition wise. If it already had the variators fixed, it would probably have been more. If the Cat S doesn’t bother you, I’d spend £5k getting it nice and hopefully you’ll boost the value to cover some of it. In terms of the dealer, he probably should have disclosed the noise, but to be fair it does drive ok and could probably be driven as it is for a while. Forward planning of the maintenance of the car will be essential so this is just another (big) item on the list. It might be cheap to buy, but it’s still a high maintenance supercar. I’ve always wanted one, but you have to be realistic with your expectations at this price level.
Maserati's, just like Ferraris, have a lifespan of max 60,000 miles or 15 years. After that, maintenance and repairs cost are more than the current value. This applies to all models - really all models, without exception - no matter what a dealer promises.
You’re lucky you’re in England with this MOT deal. In America none of that exists and when you buy a car you sign a contract saying the dealer is not liable if the car breaks down the moment you purchase it. I have a 2010 QP GT S that needed a variator cap job for $4,400 a month after I bought the car.
Exactly. Why hasn't the dealer been named and the show room also shown. What's the point of protecting the dealer. Makes what he says worthless even cowardly
“I buy stupid cars so you don’t have too”. This one certainly fits that category and is the bread and butter of the channel. What does your wife think ? Always take into consideration her point of view because a lot of time as she’s not a car person her judgement isn’t as clouded.
Excellent that’s what you want. So going forward Joel get the tyre and window regulator out the trader. Offer him a get out. Say you’ll soak up the rattle if he gives you they things as agreed. At least you’d have then got something. Run the car as it is for a few months to make sure you gel with it well and then start thinking about the repair. This is one to put in the museum of Joel.
I'm trying to work out if I'm more annoyed with the bent dealer/MOT relationship or you for buying a car like that blind and showing us all what not to do. So thanks for showing us what not to do. Always send someone to test it if you can't go. Ideally a mechanic or AA etc. Pay the money is better than headache car. Nice content tho
Sounds like the dealer has admitted with his messaging that he was aware of the main critical issue. If you wish to pursue a refund keep that messaging as proof. Do not go down the perilous route of naming and shaming. No one wins except the lawyers. If you have the MOT paperwork it may be worth reporting them to the relevant authority providing you have the documented proof. That seems like the responsibility thing to do.
What do you think? Have I done the right thing? Nonetheless, I’m really excited to show you what I’ve got planned for this Maserati!

The small claims court only goes up to £10,000. Of course you have to follow through with any legal threat. It's worked for me.
Report the dealer, and the MOT testing station. 👍
Like others have said the dealer is pulling your chain until the cooling off period has gone by. In future if you don't want a car that you bought via a distance sale just tell the seller you are rejecting it rather than getting into conversation with them
14 days to withdraw, right?
yep just reject the car and send a letter to see him in court if money not refunded in 5 working days
@@doru10922 That's what my girlfriend says.
The expert/specialist in the last video said it was in pretty good shape underneath for one of these at its age.
@@danmoney9932Exactly!
What did you expect? You bought a dirt cheap car off a guy on Instagram whom you had NO EVIDENCE to suggest was kosher.
And all the time, you're thrashing, on video, a 19 year old Maserati with a known engine issue.
Good luck in court - you'll need it.
“I was told until the differential fails, we won’t do anything”
I don’t know what you’re planning to do to your car Joel, but fix it before you modify it.
Wrong. He could if he was a consumer, but since he is a business and it was a business to business transaction then he can't use consumer protections.
Distant selling regulations mean you can just return the car within 14 days no questions asked.
Loved the ‘gulp’ after the ‘sorry officer’. A quick moment of contemplation going through your head!
Way too soft on the dealer, you have paid the money and his responsibility is to uphold his end and either refund or repair.
I’ve been in a similar situation with an unscrupulous dealer. In my experience nothing is actually done to enforce the legislation that’s supposedly there to protect you.
First mistake - buying a car off instagram blind.
Instagram ..instant bargain car purchases maybe not ...
Hats off to you to give fixing it a go, it’s rewarding when you get the car sorted! The Maserati sounds incredible!
Autogreen tyres, no expense spared!! 😂
Name and shame them
take that dealer to court fella,
...... or at the very least name him and his business here so we can all avoid dealing with him!
Deffo. If that bloke won’t take this seriously, then small-claims court will. Twenty-quid in the ashtray likely got that thing signed-off.
Name and shame them
7:59 - it's not fine that thi person does business in this way. Most other people are not UA-camrs who can make content and therefore money whatever happens. Other are will get royally stitched up and/or have to spend considerable amounts of their time/money getting the dealer to do do the right thing and take the car back.
Lesson here for everyone to see though.
Its Italian mate...what did u expect :):). But thats also why I love them
Disgusting treatment from the dealer and that MOT centre needs to be penalised. Great video as always Joel! 😄
Im not expert ...but if vosa did get involved ....all They may do do is put on ...the said MOT tester on refresher course
@@johndeacetis4707 That may be the case unfortunately… 😡
Simply no substitution for a good old fashioned test drive before committing to buying a vehicle
Joel. Grab an invoice for repair and take the dealer to small claims court for that amount. I've done this in the past and it works great!
As soon as I saw you sent the dealer a message, ‘hey matey’… all sympathy had for you was lost 😭😭
Quattroporte is a name that gives the car far more "grandeur" than it actually is. Maserati Four Door wouldn't sound so good.
What’s worth more? Using the car for content or getting your money back?
When you did Maserati and Porsche 996 back to back you just said home much better the 996 was despite it higher milage and 6/7 years older. You had a massive grin in the 996.
Those 12 month warranties are normally not worth the paper that they are written on. Hw much is the car worth if you break it for parts?
Its scary how many MOT no advisories actually are unsafe. I bought a mini as such from a dealer with very high customer feedback and asked my local garage ro service it. Was shocked to fine the tyre was ilegal. I complained and got given 500 compensation but there was far more that should have been found. Worn suspension bushes and drop links. Engine fault with thermostat. Only 2 months prior had MOT with some of these as advisories.
I’ve always have had issues with small and big dealers they are all the same. Keep going get the car fixed to how you want it
Agree with most of the comments, name and shame. These people need to understand they can't get away with conning people. John
Came back here after a while yes I can confirm my thoughts you’ve upgraded your headache substantially!
Any of your viewers could be about to buy a car from him right now.
the engine issue is 50 /50 but the dealer owes you for a full service and to fix the issues to get a VALID MOT
Beautiful car sorry to hear about your poor buying experience but hope things get better for you. Thanks for the video.
The 12 months warranty is the key here. Otherwise I’d say, reject, reject, reject! In six to eight month, it’s decision time!
Your fault 100%. Bought the silliest car brand
Fact
Consumer protection act 2013- as described, fit for purpose and capable of carrying out the purpose for which is was bought.
I'm happy you keeping it! Have fun with it and make great content for us to enjoy 🙏
It has the looks ,it has the sound,I can see why you want to keep it ,I just hope the engine doesn’t cost you thousands in repairs, cheers Joel 👍💪😉
Which garage was it? Save the rest of us getting scammed Joel 👍
My wife encourages me to do these things 😂she’s great
Excellent that’s what you want.
I've used Click Mechanic as a pre inspection when purchasing cars that are to far to travel .
Sounds sublime. Do us all a favour and name that dealer!
You absolutely MUST report the MOT centre and name and shame this shoddy dealer.
Showing my geek side, the engine is the Ferrari F136, the M139 is Maserati’s designation for the 5th gen Quattroporte
