  • Hostile Work Environment can be debilitating in the workplace.
To win your harassment case you must prove these 4 things.
    1. It must be discriminatory towards a protected classification
    2. It must be persistent overtime, not limited to a single time
    3. It is so severe that it disrupts your work or your career
    4. You've made your employer aware of it, but he/she refuses to take action
If you think you're working in an environment that is hostile or unsafe, please call us!
At the Cronin Law Firm, helping you is our passion. Please contact us! We will give you a 30 minute complementary consultation. We would really like to see you become a part of the Cronin Law Family.

It just sucks employees think hostile work environment can mean bad workplace due to a jerk boss-but to prove it’s due to a protected class, bosses will never make it due to your class.

I'm not a lawyer, but it may fall under the whistle-blower act.
Yes, you could find somewhere else to work, but that doesn't break the chain for future employees, and no one should be bullied out of a comfortable work environment.

The fact that you have to prove you are protected class makes zero sense. EVERYONE is, or should be, a protected class. No one deserves to be treated to a bully/hostile work environment. I'm going through it right now. I've been with the company for 10 months but my "colleague" has been there 10 years. I have heard that he was likely the reason others have left. I try to treat everyone with respect, civility and professionalism. This guy continues to harrass me. I have notified management but I'm still worried that because of his tenure he will continue with his abusive behavior. I know there is "training" for some people but if this is a character trait can it truly be unlearned? I hate it. I don't want to put up with it anymore. I don't want anyone else to have to put up with it. I'm worried for my future employment. All because one guy never learned to play nice with others. I sympathize with anyone who may be in a similar situation.

Good chance there'll be harassment at your next job. That's why quitting doesn't always help. A lot of work places are hostile.

By leaving you are letting the abusers know that their behaviour is okay. Report it to HR and then get a lawyer to claim

I have 8 minutes of audio recording from when I quit my previous job, I was quiting due to the way the owner had been treating me and started a recording because I knew he would lash out. In it he degrades my character, belittles my persons, as well as implicated others from our outside mutual organization of conspiring against me. I have both ptsd & adhd to which he was made aware, and belittled as well (not in audio). I was never paid for my work or ever put on the books, but I can prove I worked for him through txts & fb msgs he sent me.
Does this sound like enough for a case?

Are you a white straight non disabled male ? If the answer is yes you have no case. You have to be in a legally protected class. Example of legal protected class are persons of color, lgbtq, disabled , a female being harrass by a make co worker

Recording an individual without his knowledge is grounds for you to get countersued as it is illegal in majority of states. Look up your state law concerning recordings without consent of the other party.
Otherwise you better keep that recording private for your ears only to hear.
My heart goes out to you and others. I experienced something similar just a few days ago.

I work for a company contracted by the DOS overseas. I have been subjected to work place threats, bullying, intimidation and attempts to attack me while at work. This has caused me mental anguish, sleep disruption, loss of concentration, disruption in my work performance, loss of wages etc. I was told to either learn to deal with it or resign. I resigned out of fear of harm and reprials and because I was told I had not other choice other than continuing to work in the hostile and debilitating environment. Please advise

I worked at my Exes Parents Restaurant. While I was finishing after close with my boss(my exes step father), my ex came in and stole my phone from my pocket, demanding I gave her my car keys. She then grabbed a knife and pointed it at me, threatening me if I tried grabbing my phone back an hour later of arguing and having 2 knives and scissors pointed at me, she bit me. My boss did nothing to get my phone back, did nothing to disarm his daughter, and then demanded that I give her my car keys or he would call the cops on me.
She has constantly came into the restaurant and threatened and screamed at me over the months. But never to this point. The owner has never asked her to leave or stop her actions.
I filed a domestic violence report. The cops are trying to get footage now from their security cameras. But now, as I can not work there anymore due to this, I am trying to see if I can get workmans comp.
