A Difficult Patient

- Originally aired on October 17, 1996 (HIPPA was enacted on August 21, 1996) this episode gives a humorous look at the issue of a patient having access to their medical record. After getting a look at her medical chart, Elaine learns that her doctor thinks she's "difficult." Pressed for details, Dr. Stern does not allow Elaine to see her chart and quickly dismisses her without treating her irritating rash. Upon trying to see someone else, she's surprised to find her reputation, and medical record, has preceded her. Kramer then unsuccessfully tries to obtain a copy of her chart for her.

That scarf actually goes really well with Kramer’s outfit.

I love how perplexed Kramer was when he found out Elaines last name was Benes.
And that he looks at her to question, "Are you SURE?" LOL.
Elaine is brutal.. When she called kramer a and i quote "ya jackass"
@@kcck2442 It’s Benes ya jackass! This episode aired in 1996. The first episode aired in 1989. Based on an early episode where Jerry visits his parents, think the audience is supposed to assume that Elaine and Jerry were dating before the show started, but broke up right before it aired, so sometime in 1989. That means, at this point, Kramer had known her for 7 years, but didn’t know her last name. Priceless.
And the great part was she knew he was perplexed and just said Yeah ! before he could gather his thoughts. Also the very next scene shows just how brilliant the writing was on the show Dr Van Nostrand ( Kramer ) is #1 smoking a pipe
" Inside " a Doctors office and # 2 telling another Dr. whose looking at Xrays I like what you've done there ha ha ha the Dr's done nothing he's looking at a negative ~picture~ xray .
She certainly had George scared. Kramer though would be mostly oblivious.

That's the best line haha. He remembers it from her talking about it in 1992.
'I like what you've done there'....🤣🤣
So many good lines here. I also just realized at the end when Kramer gets pushed out of the building his pipe gets caught on the glass door- nice little detail there.
Every kramer scene is stacked with tiny little stuff like that one of the reasons this is the best show ever
This hits too close to home! Love this episode!
This is one of my favorite episodes. They should also have included that call Elaine gets from the American Medical Association in the end.. "Good Bye".. LOL
Kramer having to look over Elaine's shoulder to believe her last name is Benes!
I love the way the second doctor holds his finger up to get Elain to shut up.
So real from the patient's point of view.
Kramer's responses in mumbles and bs were my favorite part!
Modern-day equivalent is Nurse walking away from exam room computer without logging out of EPIC Hyperspace.
I think it's funny that the doctor didn't want Elaine to read her own chart, almost sounds like lawsuit material
It's actually a very complicated legal issue. A fascinating read.
Excellent and True to Life Episode!! Funny, but Sad for all patients today in 2023 and prior. Patients need an enforceable “Bill of Rights.”
The part where she rubs the phone on the rash while saying she hopes it's contagious was hilarious.
"Its Bennet right?" LOL
"its Benes you jackass."
let off some steam, bennet.
Ah Elaine, never one to suffer fools gladly.
It's Bennett you jackass!
I love how Kafkaesque this episode is in regards to Elaine. No matter how hard she tries to fix the problem, she doesn't get anywhere.
My doctor (who died of lung cancer) would smoke in his office all the time. I could see him while I was waiting in the room to see him. It did not bother me and he was a great doctor. He looked after my father as well when my father was very ill. He ended up dying before my father and both died from smoking related illness. Very sad for both of them. Life is short so respect others space and at the same time do whatever you want.
I am so glad that I quit smoking.
Elaine is dealing with stigma. Stigma is no fun.
You are so sweet for saying that. Thank you.❤
2:56 LMAO The way he just randomly walks up out of nowhere admiring his X-Ray.
this is the reason i go to a veterinarian...

@@mikeg1378 They've got to be able to cure a pig, a chicken, a horse and a lizard all in one day!
This doesn't cover the full subplot. It gets worse later. What is really scary is that many decades later it's still so close to reality. This is not paranoia. Don't be difficult folks, don't argue, don't ask questions (MD are fragile creatures, especially when it comes to their ego). Don't look them in the eyes either. Just look down and be on your way out asap.
Unfortunately, much of what you say is exactly right. There are some very good physicians out there, but our entire medical establishment is broken. I don't even want to call it a healthCARE system because health is not the priority.
No other actor can make me laugh more than Michael Richards. Such a shame his career has ended prematurely because of that one stupid mistake.

@THE CALAZ INFOWARRIOR the Left always excuses racist behavior committed by their own. #hypocrites
@@NunyaBizznaz
I'm quite certain that most leftists actually ostracize their own if they turn out to be a bigot in any way. Just look at what happened to Richard Dawkins lately after he said some transphobic shit on social media; nobody likes him anymore.
Now, if we're going to be truly honest, it's in fact the right-wingers that not only excuse bigotry in their own ranks, but encourage it. They believe it's their "God given right" to behave as an exclusionary PoS.
There's no better example than Donald Trump who's vocal bigotry was not only tolerated by his supporters but also reciprocated.
@@MarcusDailyMedia It was a mistake. We all have racism in us right? I think today its called 'Unconscious bias.' But not you...you are a saint.
@@MarcusDailyMedia You don't have to be a racist to say a racist thing. You just have to be really angry and try to hurt the other person as much as you can. I don't defend doing that, just an observation.
a Dr Van Nostrand comes highly recommended, I hear.
He's a Juilliard-trained dermatologist.
"Oh he's the best.....and the worst"
Too funny Kramer not knowing Elaines last name was Benes....would have been hilarious if he had said " I thought the name was Lilly"
Kramer getting 'escorted' out the doors - saw that happen at a hospital in Manhattan. The guy was also being 'difficult' with the NYPD officers before entering.
Just a typical day in NYC!
I know it's a sitcom and not to be taken seriously but it's bullshit that she "shouldn't be reading that" (her file). Everyone has the right to read their own file.
Elaine's hair looks amazing...
It's a wall!
Damn those charts…until I need one. I need charts!
The Netherlands? Isn't that Holland and if so, who are the Dutch?
Holland is in the Netherlands, and they are Dutch!
@He Is That's real!
This is such a real problem, especially when it comes to your mental health chart. No matter how badly the professional misunderstood what you said, or how irrelevant to your current problem, all of your future interactions can be biased by whatever they read there. And you'll never know what's written in it.
This is why I have started getting paper copies of any info my new/other doctors will need. The receptionists can be a pain about it but it's typically devoid of any personal accounts made by the doctors. Even better, now the results of tests and other stuff is available on the patient portals of some offices, so you can print them out yourself. Just the important info. And I'm keeping it sorted in a binder. Some doctors don't like this but I honestly don't care anymore. This show is satire so it's obviously very dramatic but the point is very real and has only gotten worse since the 90s
Love how Kramer could just smoke a pipe in the doctor's Office XD. Different times
To his credit, Larry David did actually bring up an important social issue with this episode. Anyone who doesn't think that there's a system of discrimination in the healthcare industry is... ill.
Yes, and patient access to their own health information is a very important topic.
@@ahier transparency!

Ah the 90s. When you can smoke indoors all casual..
Kramer not knowing her last name reminds me of a guy that was part of a social group we had. He didn't know our last names or addresses. We had no idea until another guy with the same first name as someone in the group started hanging out with us. Neither were with us one night when we were drinking. Somebody asked this guy if he knew where they were and he said " which one"? So we gave him a last name...he just stared at us and then we started asking him if he knew our last names...and he didn't. This is a guy that had been hanging with us for 2 years...bbq's, camping, etc. We started laughing so freaking hard...
My favorite parts of this scene are:
1. Kramer asking Elaine for her scarf
2. Elaine calling Kramer a "jack ass".
oh, and I almost forgot:
3. Elaine being extra friendly to the nurse.
I swear im actually on a medical blacklist.
I laughed till I cried that it hurts. How come I've never seen this.
It seems over the past decades, doctors have moved away from the old school “I will prescribe what you should do, and you will follow my directions or else”, and they are more open to patient questions, suggestions, input. All that might have gotten you labeled difficult in years past, with a lot of doctors. Maybe still does
Its funny in this comedic world, real world Elaine would be like ''Ok, I am sorry if I am a difficult patient. My bad. Now help me or I will sue your asses!''.
Play Seinfeld Theme.
And what clinic is that again?
Oh that's correct
That interchange was perfect
Just started "the patient will see you now". Let's see where it will take us!
You should treat me fairly and adequately whether I'm difficult or not.
somewhere around 1999 or so, i just stopped respecting doctors, and it really worked out for me. they work for us, so i treat them accordingly. i mostly say no to things i dont want to do, like those dumb smocks. i came to see the doctor about my ankle, im not putting that dumb thing on, you can if you want, but im not gonna. theyre already getting to be around me, im not giving them 2 treats
they actually passed a federal law about medical privacy because of this episode
Well, that's good because I think it's total bullshit to write on someone's chart that they're being "difficult" and cause you to miss out on having the right care and medicine. Freaking ridiculous, man!
@@CourtneyLachiver I agree Court, but then again I hate doctors in general so.. Lol
" I'm dr. Vannistrem from the clinic "😅😅😅😅
It’s the difficult doctor that’s the effing problem.
I wish someone from the medical board told the doctors, regardless of how difficult a patient is, they all took an oath.
If a patient is diffcult, you quone him.
it’s just a joke. In real life there is no space on those documents to write notes like that, it’s all just stating the symptoms and tests.
They do write notes like that for legal reasons. If you have a very close friend that's a practitioner you can ask.
Maybe they crossed their fingers.

That's why they got so much $$$$$$$$$$$$ - these never get old.
I do. 😥 But these are still hilarious 30 years later. 🍻
This is happening to me right now. Difference is I have almost died twice as a result and now my heart is permanently damaged. The more I try to get help the worse things get. I do not know where to turn for help.
You can’t read your own chart? That’s ridiculous.
This episode was originally aired on October 17, 1996, bu the HIPPA health privacy and security law wasn't enacted until August 21, 1996. That is one thing that makes this clip so relevant. People have been fighting for patients right to access and control their own health information ever since.
I like what you've done there.
Elaine and Kramer's scheme to get the chart wouldn't work nowadays as everything is EHR nowadays (Electronic Health Records). Only way to get rid of the "difficult" would be to hack into various computer systems and erase every file.
Nowadays you have the absolute right to access and see all of your electronic health data. The EHR makes it easier for the patient to control their own data when the rules are followed.
@@ahier Elaine should have hired Jackie Chiles and sued the doctors and the AMA! That would have been a hilarious plot.
this show is so classically hilarious
There are two things I've always wanted to say to a doctor.
1. "Listen here, you quack" and then have no followup from there.
2. I want a doctor with Surname Jones, they tell me to do something, and I say "okey dokey dotta Jones" like Short Round.
I really thought the second one would be an Aqua reference.
Any Doctor that would understand these references would no longer be practicing. You better get to it quick. Time's running out.
This would be a lot funnier if women were not actually treated like this at the doctor. I was a nurse for years and definitely had the difficult patients but I would have to be almost dying to go to the doctor now.
This is how Kaiser treats me. Wish I were joking.
I believe you. This is a good episode, but of course there are hundreds of billions of dollars in the healthcare industry that says it's a bad episode. They put it in their chart.

lol...I love the references in Seinfeld to how so many people don't understand where/what the Netherlands are vs. Holland and Belgium...and Who are the Dutch?
I do kinda feel for the first doctor though. I can't help but feel if I was in his shoes and a patient came to me supposedly for a rash but then spent the visit talking about anything but the rash, I would consider it a joke and waste of my time and find a way to end the visit as quickly as possible.
It’s kind of weird that they didn’t think about a pharmacy for that rash.
You cannot legally leave a medical chart laying around like that because it could be altered, or things stolen from it.
You also can't legally pass it between doctors in a non-emergency, without consent from the patient.
you are reminded this is filmed in the 1990's, when Elaine mentioned the date 1992, which is now 40 years ago.
Yes, this was aired on October 17, 1996
