@@lisafeck1537it’s because the 1934 act is still in place and has never been revised. The definition of both “rifle” and SBR within the actual written law are from this 1934 act. Nobody complains that the constitution is still part of the law even though it was written in 1787. The senate sits on its ass in vacation half the year, and doesn’t revise shit definitions like that a rifle is “a weapon… intended to be fired from the shoulder…” (18 U.S. code 921 - definitions) Which a pistol with a shoulder brace is intended to be fired from the shoulder, suddenly makes a pistol a rifle, and therefore an SBR. All because the senate are lazy pieces of shit and can’t write a laws even if it’s their only job.
..Obviously this ATF guy is abiding by the law of Mayorkas..."If you can't Dazzle 'em with Brilliance~Baffle 'em with Bullsh*t!" Congress just killin' time asking questions that will never be answered, I say unto thee verily...
He was trying, the Senator cut him off 4 times. Basically, the ATF is saying that the senate fucked up their definition of a rifle and by extension a short barreled rifle. The senate has not defined what a “pistol brace” is in law, only a rifle and short barreled rifle Under title 18, part 1, chapter 44, 921, of the U.S. code (7) reads “the term rifle means a weapon designed or redesigned, made or remade, and intended to be fired from the shoulder… fire a single projectile… through a rifled bore for each single pull of the trigger” (I removed some of the legalize to help, confirm yourself if you like) (8) reads as “the term short-barreled rifle means a rifle having one or or more barrels less than sixteen inches in length and any weapon made from a rifle… as modified has an overall length of less than twenty-six inches.” The argument the ATF is saying is that: since a rifle by definition is a weapon intended to be fired from the shoulder (including being made or remade to do so). When a brace is attached to a pistol, that pistol has been remade to have the intention to be fired from the shoulder. (A brace is designed to allow the weapon to be braced on the shoulder). Thus by the definition within the law, the pistol is now a rifle. Now that it is a rifle, it is now checked to see if its barrel is less than sixteen inches, or if the total length is less than twenty-six inches. If the “pistol” turned rifle is less than either of those measurements, it is a short barreled rifle. To me, the ATFs argument is actually sound, mainly because the Senate really fucked up their only job and messed up the law. The fix? Redefine a rifle and SBR to something that makes sense.
@@MrCoolguy425ok, so let’s say they did fuck up their definition. Then shouldn’t a new definition be proposed to congress so that the previous definition of SBRs can be amended? Instead the ATF is just deciding it means whatever the fuck they want without anyone else having a say. The ATF has overstepped their intended purpose and are being allowed to, in effect, change laws without congressional approval.
@@meowcachow9846 correct a new definition should be proposed to amend the current laws. That’s pretty much what I’m saying. Because a pistol with a stock is a weapon designed to be fired from the shoulder which by current definitions makes a pistol a rifle. By the current definition the ATF are pretty much correct in their interpretation as far as I’m concerned linguistically. The question really is, if a shoulder brace is put onto a pistol, is that pistol now modified with the intention to be fired from the shoulder. A shoulder brace is pretty clearly designed with the intent to allow a pistol to be fired from the shoulder. Making the pistol a rifle with a small barrel, which is a SBR by legal definition.

He is adding regulations without any authority. No external devices determines the rate of fire for any firearm. It is the internal mechanisms impacts the rate of fire. AR-15s are not used in the military grade weapon. PERIOD!!
The ATF regulates firearms. A “firearm” is defined as the receiver in which the firing mechanism is put in place. Braces are not firearms. Stocks are not firearms. Safety devices are not firearms. Yet the ATF regulates them all the same. The ATF cannot make laws, only enforce them and interpret them. They “interpret” definitions to fit their ideals and enforce the “rules” that they are in charge of defining. Pure tyranny.
The ATF Director is wrong. No where in 18 USC 922 does the word "intent" appear, especially in section (g)1, concerning Felons in Possession of a Firearm.
It’s in the definitions under 921 U.S. code title 18 section 921 subsection 8 reads “the term ‘rifle’ means a weapon designed or redesigned, made or remade, and intended to be fired from the shoulder… fire only a single projectile through a rifled bore for each single pull of the trigger” I see the word “intended” in that definition
There is literally no way they did not know that he had a firearm. None. It was the reason they were there. Executing the warrant this way, unannounced, meant that he had no warning, and that he had no way of knowing the home invaders were federal agents. Absolutely no care was taken to bring this man in alive.
I don't owe anyone $200 so I have permission to exercise my rights. Who the hell do these people think they are that they believe that they have the authority to infringe on people's rights? They have no right to do so. They are extorting people and kidnapping under color of law. It is illegal for senators, representatives, judges and LEAs to make and enforce "laws" that require people to have written permission to do things and have things that we were born with the right to do and have. The constitution says "The right of the people to keep and bear arms shall not be infringed". That is the supreme law of the land. When someone is put in prison because they had a fire arm and it was not registered or they had it in their pocket or in their car, the arresting officer is a thief and a kidnapper. The judge is a cartel leader, and the jailers are kidnappers as well. The prisoner had the right and did nothing criminal. The legislature betrayed the people and committed treason in direct violation of the law. The definition of a crime is when something is done that is against the law and generates a victim. It is against the law for the members of the legislature to make laws that are unconstitutional. That also means the act of enforcing unconstitutional laws is a crime. Enforcing an unconstitutional law is the same thing as kidnapping, extortion, robbery, assault and murder. And the strip search done on the people put in jail who have been arrested unconstitutionally is rape. Most people are too stupid to wrap their head around this fact.
They are going to push this type of stuff harder and harder, because they want those 200 tax stamps since the gov as a whole is broke!!! I just don't see how it isn't taxation without representation? Of course it is, but they don't legally have that right. Even so, they'll do it anyways.
Please stop giving a blanket defense to all "rank and file" law enforcement. There are many good ones, but there are a whole lot of bad ones. All of them could have executed the search warrant when he wasn't home. They rescheduled so he would be home and surprised by their intrusion. Everyone participating in that murder is guilty. Period.
Because the ATF are legally safe because of bogus Senate laws. A pistol with a shoulder brace by senate definition is a rifle, look it up. It’s under the definition of rifle in title 18 section 921 subsection 8
They had so many different options to take if they just wanted to arrest the man , and they chose the most dangerous and often deadly option , which is a no-knock raid at 6:00 in the morning !😮😢
In this hearing, the ATF calls a 'Short-Barreled Rifle', an "unusually dangerous" weapon. Yet, my local Police Department's issued carbines are SBR configured AR15s.
AR pistols and pistol braces were ruled completely legal by the ATF and they have written letters saying such. Then the administration changed and suddenly they are “unusually dangerous” and we need to ban them. The ATF doesn’t have the power to do that, but they can “interpret” the definition of a SBR to include a braced AR pistol, thus taking back their original “interpretation” and turning millions of people into felons overnight.
A pistol brace makes a handgun more accurate, and that's a crime? So it's much better to have a handgun that's not accurate? Can you imagine if that logic applied to everything?
They only wanted to serve the warrant while he was there because of "shock/awe" in hopes the guy would self incriminate himself to make their jobs easier when they prosecuted him.
Have to justify wasting tax dollars on tactical hit squads by creating firefights that could have easily been avoided. Why does the ATF need armored vehicles and machine guns? Because instead of arresting criminals in a safe way they turn towns into war zones and common criminals into terrorists. Can’t stop mass shootings, or gangs, or gun running Cartels (who get their weapons from the ATF directly) but they can show up to your house in an LAV and turn a search/arrest warrant into a siege/skirmish.
I have three problems with this whole thing... Dettlebach is doing exactly what they paid him to do, obstruct. The whole inquiry that he started was part of the obstruction, the thing we have to look at is the writ for the search warrant. 1. If it was to be exercised with extreme prejudice, they would have had to justify the threat 2. If extreme prejudice was not to be exercised, then nothing they did was lawful, this guy was "sanctioned"for whatever their excuse is, because there's no reason behind it... for all intents and purposes, this guy was murdered. So now comes the dog and pony show, where the guy is really making his salary. He was the one that advanced the inquiry for the investigation, not the congressional, the local investigation, if there was a local investigation, then he could come back boldly and say well I can't comment because there's an investigation, don't fall for that BS!!! that's part of the rouse!!! The investigation he started is the obstruction

At that time I was still naive enough to try to make clear to them the madness of their ideas; in my small circle I talked until my tongue was weary and till my throat was hoarse, and I thought I could succeed in convincing them of the destructiveness of their Marxist doctrine of irrationality; but the result was contrary. It seemed as though the increasing realization of the destructive influence of Social Democratic theories would serve only to strengthen their determination. The more I argued with them, the more I got to know their dialectics. First they counted on the ignorance of their adversary; then, when there was no way out, they themselves pretended stupidity. If all this was of no avail, they refused to understand or they changed the subject when driven into a corner; they brought up truisms, but they immediately transferred their acceptance to quite different subjects, and, if attacked again, they gave way and pretended to know nothing exactly. Wherever one attacked one of these prophets, one's hands seized slimy jelly; it slipped through one's fingers only to collect again in the next moment. If one smote one of them so thoroughly that, with the bystanders watching, he could but agree, and if one thus thought he had advanced at least one step, one was greatly astonished the following day. They did not in the least remember the day before, he continued to talk in the same old strain as if nothing had happened, and if indignantly confronted, he pretended to be astonished and could not remember anything except that his assertions had already been proved true the day before. Often I was stunned. One did not know what to admire more: their glibness of tongue or their skill in lying. I gradually began to hate them.
Let's not excuse the rank and file. Don't forget we did not excuse the rank and file of Nazi Germany after WWII. "I was just following orders" didn't fly. A man needs to evaluate himself and his job. If his job mandates he do evil (such as violating the constitutional rights of American citizens among other things), then a man needs to object. If his objections are overruled, he needs to quit in protest and follow up with vocal, determined, and long-term, public protestations. Stand up and be men. Every Agency and Department that cannot be found in the US Constitution needs to be disbanded. Every "Act" or statute that violates the US Constitution needs to be repealed. Every regulation that carries the power of legislated law needs to be repealed, and Congress absolutely needs to take their authority back.

A “crime” that the director can’t even explain with no clear guidelines, which was only made a rule a few months ago in a 500 page document that courts are still trying to interpret.
SBRs are 100% legal. As long as you give ATF $200. You have to buy permission to own it. So why does the ATF say one is illegal and dangerous but if you give them $200 that same firearm is ok?
Its all about control through fear & Taxation. Not about "safety". If it were the case Fast & furious wouldn't of happened & ATF would be all over cities like chicago where actual crime takes place but they dont. They rather mess with us.
The NFA was created to lock certain weapons behind a paywall, thus preventing lower-income people from using them. $200 in 1934 is the equivalent of about $4,500-5000 today. So ask yourself, who were those low-income people? What demographics did that impact?

ATF authored millions of letters saying pistol braces were completely legal and this clown tries to refer to the 1934 anti gun act for reason to say they’re SBRs
I knew he was spouting lies and BS, excuses, and refreshing a **1934**? gun law. Also, I had seen in comments (SBRS). Your comment helped bring some clarity for me. Thanks.
@@lisafeck1537it’s because the 1934 act is still in place and has never been revised. The definition of both “rifle” and SBR within the actual written law are from this 1934 act.
Nobody complains that the constitution is still part of the law even though it was written in 1787.
The senate sits on its ass in vacation half the year, and doesn’t revise shit definitions like that a rifle is “a weapon… intended to be fired from the shoulder…” (18 U.S. code 921 - definitions)
Which a pistol with a shoulder brace is intended to be fired from the shoulder, suddenly makes a pistol a rifle, and therefore an SBR. All because the senate are lazy pieces of shit and can’t write a laws even if it’s their only job.
They never answer questions. Sick of their dancing around the answer.
..Obviously this ATF guy is abiding by the law of Mayorkas..."If you can't Dazzle 'em with Brilliance~Baffle 'em with Bullsh*t!" Congress just killin' time asking questions that will never be answered, I say unto thee verily...
He was trying, the Senator cut him off 4 times. Basically, the ATF is saying that the senate fucked up their definition of a rifle and by extension a short barreled rifle. The senate has not defined what a “pistol brace” is in law, only a rifle and short barreled rifle
Under title 18, part 1, chapter 44, 921, of the U.S. code (7) reads “the term rifle means a weapon designed or redesigned, made or remade, and intended to be fired from the shoulder… fire a single projectile… through a rifled bore for each single pull of the trigger” (I removed some of the legalize to help, confirm yourself if you like)
(8) reads as “the term short-barreled rifle means a rifle having one or or more barrels less than sixteen inches in length and any weapon made from a rifle… as modified has an overall length of less than twenty-six inches.”
The argument the ATF is saying is that: since a rifle by definition is a weapon intended to be fired from the shoulder (including being made or remade to do so).
@@MrCoolguy425doesn’t explain their neglect of just admitting previous administration was wrong and in need of a reformed ruling. Won’t happen though. They’ll keep digging their grave.

No where in 18 USC 922 does the word "intent" appear, especially in section (g)1, concerning Felons in Possession of a Firearm.
not surprised
It’s in the definitions under 921
U.S. code title 18 section 921 subsection 8 reads “the term ‘rifle’ means a weapon designed or redesigned, made or remade, and intended to be fired from the shoulder… fire only a single projectile through a rifled bore for each single pull of the trigger”
I see the word “intended” in that definition
There is literally no way they did not know that he had a firearm. None. It was the reason they were there. Executing the warrant this way, unannounced, meant that he had no warning, and that he had no way of knowing the home invaders were federal agents. Absolutely no care was taken to bring this man in alive.
A brace is not a firearm. A brace can not fire a bullet. Where does the ATF get the authority to regulate it?
Extremely well said.

Yes, but that is with ATF's numbers (the low end by the way). When you actually talk to people in the industry who have actual records kept of the items sold, it is between 10 and 40 million sold. Also, do you really think it is a good idea to imprison millions of people who have never committed a violent crime? The Soviets tried that.... It didn't end well.
Thank God the USA is not the Soviet Union.
With how much dancing around even the simplest and most minute of points this guy does, it's a wonder how anyone at the ATF gets any clear instructions or orders out of him.
ATF must be disbanded and many of its people arrested for conspiracy against rights. There are also many people who served time and/or paid heavy fines for practicing their constitutionally protected rights who need to be compensated.
Every Agency and Department that cannot be found in the US Constitution needs to be disbanded. Every "Act" or statute that violates the US Constitution needs to be repealed. Every regulation that carries the power of legislated law needs to be repealed, and Congress absolutely needs to take their authority back.
If you want it to be illegal, have congress do its job and then we can fight it out in court but this is ridiculous!
A rule is NOT A LAW, a mandate is NOT A LAW , an executive order is NOT A LAW. THEY ARE NOT RULE ENFORCEMENT THEY ARE LAW ENFORCEMENT. THEY ARE NOT MANDATE ENFORCEMENT OR EXECUTIVE ORDER ENFORCEMENT. THEY ARE MERELY LAW ENFORCEMENT. NOT LAWMAKERS. LAW ENFORCEMENT.
The ATF needs to be dissolved
How is a buttstock more concealable? Because you can take it apart? So... the pistol just becomes a regular, legal pistol and with the brace it's less concealable yet more so, therefore illegal? None of this makes sense, but this guy can his friend couldn't even dissemble a pistol.
I do believe the ATF has way overstepped the authority, by reinterpreting their guidelines and not going through congress. The ATF was, I believe was to make recommendations and to stem the flow of weapons into the US and to curb the bad guys from getting guns. Kind of like the EPA which also has overstepped their authority and intent of their original charter.
Amazing it still only costs $200
90 years later, I guess inflation doesn't effect FFLs.
I just no longer respect our federal government agencies
Yes. Correct.
Excellent questions.
I can't think of one government agency that shouldn't be Abolished
DEFUND THE ATF!
