      @@niccoleblackstock3628I believe James is going to fair much better. He’s home more with his son, his wife had an affair and wasn’t giving her full attention to the family, he had no clue of either the issues of either of them.

    My parents told me to suck it up about many things physically and mentally. At the point I was so bad I told them flat out I was depressed (now know it was post partum) and wanted to not live myself they bought me a car and told me to look for a job to feel productive. They NEVER even suggested mental health care for any of us kids. Waited until my bro was hallucinating from fever to take him to Dr. It's expensive and they were of the belief family takes care of each other internally.

    As a long-time Instructional Teacher Leader/Reading Specialist/Teacher in an urban setting for many years, I think the school has responsibility, too. I believe the note on the school paper was so compelling of an immediate, dire emergency, my school would have had the shooter, parents, teacher, social worker, and principal in the office to make sure he was going to get help immediately. As a school, we had the option of a "302" where the student would be involuntarily taken to a psychiatric hospital, examined, and remain there for 72 hours without any voluntary consent from anyone. Schools know a lot, but they don't want to get involved or to go against a parent. Teachers, in my area, are mandated reporters; the school should be a mandated reporter, too. I want schools to take a stronger stand to prevent horrific tragedies in the school setting. Teachers and school know so much, but have very little clout and don't want to "make waves." Schools need to be held accountable in these dire situations to try to get help for these students who need help.

    You’re exactly right about the Door Dash job. The prosecution belittles that job as something disposable when the dad has to earn a living.

      I think the point prosecution is making by him being a door dash driver is that he could have taken his son with him while door dashing. Hav8ng to work, as a door dasher, allows for that.

      I don’t agree that they were belittling James’ job. They made the point that after the parents met that morning with the school counselor and they saw that drawing that the father had plenty of time to stop at home and check on if that gun was at home or not before they learned of the shooting.

    Unbelievable! As a parent, who was summoned to school regarding my son, no way would I not take him home & stay with him OR go immediately to hospital to seek mental health for him

    Peter, replay crew member here! Big thanks for doing these recaps, it’s so helpful esp on very busy days! Many of these trials make my blood boil lately because they seem to involve irresponsible gun ownership. I’m a huge 2nd amendment believer, our family always has been, always will be. However, having that right comes with an enormous responsibility with said weapons…those who fail to keep them stored safely and are not vigilant about where they are, who can get them and what could happen if not safe, comes with very serious consequences… You’ll grow tired of this old ladies opinion throughout the trial. I’d like our community to know they are just the opinions of an old lady, with a bit of knowledge…I never want to disrespect anyone or their opinions… I only hope to add mine and Brian’s voice to the chorus ❤ Jil

    If you leave your teenager home alone for long periods of time you can’t “hide” anything in the house. If it’s something they really want, they will look for it until they find it. Need to lock it up or keep it out of the house.

      My teenage girls were the worst. I would have stuff locked in my closet then lock my bedroom door as well. They still got in so added deadbolt & they still got in. This was before smart phones etc. No high speed internet out in the country. With those available it's easy to look up how to get into almost anything. I have meds in a fire sentry safe lockbox and my ex looked up on UA-cam how to get into and stole my meds. 🤬 Just like the new hack that was on UA-cam which allowed 2 types of cars to be easily stolen it was on news for awhile. One Factory had software update to fix it. Scary sometimes...

      My cousin hid her pain meds inside a Christmas ornament in the back of a storage area in the bottom of a box and her husband still found them , if someone wants something bad enough there's no hiding it .

    I feel that this whole family is broken. They needed help long ago and now they are pointing fingers of blame too late. Interventions for families and at risk kids like Ethan needs to happen way earlier. Children lost their lives, tragic

      💯%! 🫶🏽 One of my younger sisters has a doctorate in psychology and she works with children that are struggling with their mental health… but what makes her work so successful is that she also works with each child’s family to ensure that everyone in the family is receiving the help and support that they need to thrive.

      If these guidance counselors that are trained to deal with troubled kids cared about them instead of only helping kids with their college applications they would help , I mean they are being paid for that not just college applications .

      ​@therealz360z7 I think you are not taking into account that guidence counselors have 250+ kids on their caseload. They don't even talk to these kids day to day, and they don't even have sessions with them (only the ones who have it in their IEP) so honestly what do you expect these people to do? Parents are the first ones that need to step up

    I’m so glad that you pointed out that the prosecutor keeps saying that Ethan told his dad or told his mom about how he was feeling or that he needed to go to the doctors, but I have worked with kids for 15+ years & I know for a fact that what a kid says to his friends is often exaggerated (especially at that age). It would not surprise me if he told stories or made things sound more crazy to his 1 friend than he acted around his parents.
    Kids compartmentalize their lives at that age too!! He knew/understood that if he let his parents know that he was struggling or that he was angry or anything like that, that it would likely delay them purchasing a that gun. If they suspected that he was dangerous I’m sure he feared that he wouldn’t get what he wanted.

      The defense def has to present the shooter as incredible regarding what he says to his parents. The mom's attorney tried to do that but IMO didn't do a good job.

      Making absolutes about any group’s typical behaviors is a slippery slope imho. While certain trends exist in different age groups and demographics, this can never be generalized to a group as a whole. So many factors can contribute to a person’s behavior with their parents, peers, close friends, etc. Their intelligence, mental state, religious beliefs, where they are being raised, socio-economic status, hobbies and personal interests, etc. can all play a role plus while we are all human, we are also unique individuals that may act similarly or differently to others in a plethora of different scenarios and circumstances.

      I am a youth mental health first aid instructor and my training is kids don't tell parents and the best thing a parent can do his rely on his peers for information. Kids do not tell parents about feelings of suicide and so we train professionals and parents so find others to talk to the teenagers who may be more app to open up. Also when your child is struggling we teach parents and professionals how to ask if they are considering hurting themselves. If you are not prepared to hear the truth you may not react properly. Because you need to know if they have a plan which if they do, then they are dangerously at risk. Ethan started planning and he was very dangerous at that point to himself and others. All parents need to take Youth Mental Health First Aid, a lot of helpful information.

    At a minimum, if they would've disclosed to the school that EC had access to a gun as shown in the picture that may have prompted them to look in his backpack.

    Great quick recap, love the sped up info and breakdown. Watched the mothers trial and want to compare their knowledge and actions. Evidence used vs mothers should be interesting but don’t need to sit through all the same testimony again. Thanks for the highlighting and thoughtful law insight.

    My husband was an Army MP and medic. He is currently a FF/Medic/Engineer, and a cardiac ER RN. He takes part in many classes and teaches them. He says you are taught "anyone suicidal can be homicidal." These parents and teachers need to understand that and act accordingly. Never leave a weapon accessible to any child, but especially one in Ethan's mental/emotional condition. Our 17 year old son was taught about weapons and how to shoot. However, he does not "own" a weapon or have access to one. Ethan's parents bought him a weapon and did not secure it.

    I am a Youth Mental Health First Aid Instructor who trains adults the warning signs of the onset of mental illness in teenagers. With certainty they did not know what was going to happen. That is why we teach adults who work with teenagers and parents the warning signs and what to do. I am in a county north of Oxford and I teach the whole school district here, teachers, counselors, etc. Normal teenage behavior and the onset of a mental illness is a very fine line. Now having said that no teenager should have access to a gun with or without a mental illness and that is really the question here. I do believe that the charges are over charge and the weapon is really the issue. Teachers and counselors even did know he was of danger. Thousands of parents miss the warning signs with suicide in their teenagers and when anyone is suicidal they are in danger and so is everyone else. It is really a shame that countless trials neglect the facts and news media convicts before the trial. If the parents attorney's have a youth mental health first aid instructor on the stand that would be of help in this situation in his trial.

      The Counselor and Dean did have the training you speak off. The school authorities CHOSE not to protect the student body, the school or Ethan.

    Oh come on. The firearm is kept where they live. You don't think children don't snoop around their own residences? We as children were expected to be almost perfect and we snooped around. We opened the pill bottles for our parents because we could fangled the safety caps easier than they could. I know, because as a child, I never had problems opening a safety cap on anything. Now as an adult, I have problems. However, my purse is really good at opening them as evidenced by the empty bottle I pull out with a pile of pills in the purse. So, please don't tell me that kid couldn't figure out where the gun was. You never want a child to happen upon a dangerous weapon that is unsecured. That should be obvious. Lot's of small children have found mom's or dad's gun that is unsecured and killed themselves or their siblings playing with it. That's how we know to secure the guns. Add a teen who is depressed, and you should know you have a potential problem.

      Exactly! And with children in the home, any responsible gun owner would keep their firearms in a locked safe as well as keep the ammo locked up separately from the guns. smh.

      According to these comments you keep your guns locked up and the ammo hidden. Ok, but what are you going to do when a psycho criminal breaks into your home to rape you and kill you and your kids? Do you tell the rapist "hang on a minute while I go get my gun and ammo and then wait for me to load it before you rape me?" Seriously just wondering what the solution is? Because I'm 101% positive the criminal is not going to agree to letting you go get your gun, unlock it, and load it! I actually know the solution but I want to hear what you all think. How does a locked up, empty gun help you when your life is imminently in danger? There's no point in having a gun for protection when it's EMPTY AND LOCKED UP.

    YES, YES, YES - his parents had the duty to make sure he didn't have unsupervised access to the firearm. Definitely, especially since we know they knew he was having trouble.

    As a mom of two 11months apart I always trusted my children until that trust gets broken. I raised my kiddos every choice you make has a consequence whether or not its a favorable consequence or not favorable. If you get into trouble I will come get you on my time not yours and you better believe you will need to be able to explain your actions and choice. I always used my gut feelings.I knew when something was wrong example 16yr old driving yo school its snowing I give my 16yr old instructions of what street to ho on and no one in the car after school do not take anyone home since they plow the main roads first not the side streets. If you font to this the consequence is you will loose your privilege to drive. Well he didn't listen he took a friend home ran into someone damage to both cars got a warning . well he handed Mr his license when I got home. He said I'm sorry I will listen next time. We fixed our own car just a headlight.other car 1500.00 so for two weeks he wouldn't drive his dad had to convince him to drive and took him out in the snow to show him how to drive in bad weather. . I always knew when my kids were up to no good and body language from their friends. Sit back and just listen. So why were these parents not in tune with their child? I think family dysfunction and financial issues can cause distraction. Sad sad case..

    They'd have to be living under a rock not to know that drawing was a cry for help or a declaration of future possibilities, whether or not it might mean self harm or harming others. It warranted immediate action - take the kid home, talk to him, and search 4 that gun. Whether or not they are truly liable for manslaughter is my question but they are definitely liable for negligence, whether that be a 4th class felony like Hannah or a misdemeanor that requires restitution.

      I think at the very least they should have thought the risk of suicide was high. You'd think that would be reason enough to have their son hang out with one of them for the day, make an appt with therapist, and talk about his issues. At least take him out to lunch or something for Pete's sake.

    They found the money to call a vet for her horse, but could not take their son for counseling and/or medical evaluation. GUILTY!

    Thanks Peter. I get chatty more when I catch up later. But with my experience, I feel it's vital to do the proper and appropriate duty to school and to your children. It is so damaging to keep your child from the necessary counseling especially when he is crying out for help. I suffer PTSD with my depression and other disabilities. I'm even angry with myself for giving in to my parents to gain their love instead of advocating for myself when everyone keeps telling me I had no way to do that in my past. I can totally relate to the absolute suffering that Ethan went thru. It does not excuse him for harming others - not at all. But he did harm himself in the process even though he didn't kill himself or get killed by cop. He is sane enough to know he needed help but his parents neglected obtaining the help he needed. You don't tell people suffering from depression to suck it up and then refuse to get them help. The amount of pain suffered from depression is so profound rpthat it destroys - it is soul crushing. His parents helped to crush him further. I don't give him any excuses for harming others. He was sane enough to know right from wrong. But he harmed himself in the process. Maybe he'll get the counseling he needs in prison. I hope that for him. When you don't give your children dignity they can learn from you not to view others' dignity.

    We grew up with Columbine. And so many more school shootings by young men dealing with isolation, bullying and mental health issues. It’s your job as a gun owner to make sure your teen doesn’t have access to your gun. There’s no way a parent in our day and age can be so clueless.

    Peter, thank you for your insight and sharing this with us once again. I honestly think, as you do, that neither James nor Jennifer knew what Ethan would do that day. I can't imagine the grief they're experiencing because of their son's actions. What I don't understand how cell messages between Ethan and his friend can be admitted for the truth of the matter when there's no proof that James or Jennifer read the messages. I'm sure parents aren't expected to read text messages between their child and a friend. So how are these messages not hearsay?

    We sadly had a family member go through a mental breakdown. I'm very grateful that we had a strong support system but you know the number one thing people asked us first? Are there any firearms that this individual has access to? We had multiple people offer to take the guns into their homes to be properly locked away. It was the first thing we handled solely out of concern for them harming themselves. Both of the parents lack of action in this case just astounds me.

      What really bothers me is that they lived 5 minutes from the school and couldn't be bothered to stop home and check for the gun.
      I guess James had some urgent food deliveries to make and maybe Jennifer had to get to the Costco parking lot.
      I am still not 100% sure they committed involuntary manslaughter, but not checking for the gun was incredibly lazy and stupid.

    I just think they were too lazy to do their job and keep him in the office until his parents picked him up at then end of the day. And if they left him, then they could call the police

    Thanks for the breakdown. If James' team was smart, they woudlnt call him to the stand. It feels like from the opening statements alone, the prosectors made changes from Jennifers trial. I would have thought they would have use the same situation. Crazy that the prosectors basically admitted that they wont be able to call Jennifer or Ethan as both are fighting their convictions.I am shocked James' team didnt take a deal. Considering the polticial climate with school shooting and how fresh Jennifers trial is still in everybodys mind, they are up a creek without a paddle.

    As a Canadian, gone to Law School in Canada, I absolutely agreed with Jennifer's verdict. James deserves the same verdict. In civiliized countries parents are absolutley responsible.

    Both attorneys speak so fast I think you have the tape sped up, but then I hear other people speak and I know it’s at normal. Attorneys should be aware of that. It makes them seem unlikeable.

    No reason 2 drive by house had bag been searched! ALL 💯the adults, including school officials, "allowed extreme "privileges of PRIVACY" & trust. Our children's BACK-PK & phones would have been wrangled away from their possession period point blank! No matter risks in the future of possible Law suit which may come2 the school.
    No way our children would be allowed 2 bring any weapons

    Yes, sue the teacher if he/she allowed the student back in class. Sue the principal or whomever supported that decision, if that was the case. Because those people sho7ld actually be criminally liable and they won't be. The only way to make teachers and school officials do their minimal job of protecting the school is to make them know the parents will come after them. The minimal requirement from the safety protocols put in place fter a number of school shootings happens require them to take the necessary actions to protect the other students and staff when there is clear sign that a student is disturbed. This was a clear sign. We all know that. So, sue their asses - the parents cn get together and pay for the lawsuits. I certainly would. We have to hold the daytime guardians of our children responsible when they don't do the minimal duty to protect lives.

      In my state, teachers cannot legally search a student’s backpack. As a teacher, you also do NOT have authority or power to deny a student in your room if administration sends them back to class. Remember, the teacher was the one concerned enough by the drawing and took it to her superiors and counselors. That is LEGALLY all she could do!

    You probably won’t read this but I appreciate your objective comments regarding the potential jailhouse threat discussed at the end of yesterday. I now understand it makes no difference regarding the case unless it’s admitted as evidence. Another fact, the reason Ethan would plead the fifth is because he is appealing his sentence of life “without parole”.

    The school's negligence is just as bad, if not worse, then the parents. They literally broke vital school safety protocols because they were too lazy to watch him in the office.

    I would never suggest the shooter's minor friend had a legal responsibility to tell anyone about the warning signs and concerning texts, but it is surprising to me that the friend didn't tell his parents anything. They seemed like they were very close. If the friend didn't take it seriously and they already proved they texted 20x more than everyone else combined, then how should the parents have known? I'm surprised that's not elaborated on more. I wonder if either side ever interviewed that friend.

      It's also possible that he told his parents but those parents never confronted EC's parents. It's a hard conversation to have with another set of parents and I can totally imagine someone saying they didn't want to get involved.

    39:30 All they had to was check his book bag before they left. They could have pulled him aside and asked him away from everyone else. I can't imagine them seeing the drawing on the homework. And not thinking does he have the gun. I Dont want to be either of these type of parents, Laundry protective. Or Crumbly neglectful.

    I agree. The school officials who let this kid back in class should be charged with the same felony charges as the parents. They have the training and knowledge enuf to head off this possibility.

      But the school officials did not purchase the gun. The school officials did not fail to lock the gun. Yes, they were stupid and I have no doubt that they will be paying for it through a civil judgment.

      Any school counselor worth his salt should have asked about access to weapons, I've been asked that question just when dealing with basic depression episodes.

    I can't remember for sure, but during the mom's trial, wasn't it stated that they could/should have checked his backpack for the gun? Seems that would have been a more direct, quick option than even checking whether it was at home. Because he potentially could have decided to start his rampage sooner after his parents left.

    I can't understand how these parents weren't worried about their kid shooting *himself.* I get how the parents wouldn't leap to the conclusion that their kid will be the next school shooter but what about suicide? I certainly would be worried about my kid commiting suicide if he was struggling so much and therefore would not buy a gun!! It is so tragic.

    The biggest thing that points to guilty with Dad is while 1700 students parents were trying to find their children escaping the school, his first thought was to check the gun! How many parents that day decided they needed to see if their guns were at home or was their child the shooter?? You have to be aware your son has mental issues to even have your mind go there at all.

    Ouch! I had leaned toward the parents being not guilty, then to see this on his math homework!!! That’s serious. “The thoughts won’t stop please help me,” with a gun and a person with blood, had that come to my attention about my kid, I hope I’d stop everything right then and take my child home and never leave his/her side. That image gave me chills.

      Your comment about some people watching the State of the Union address and you not wanting to watch politicians speak was also a bit harsh. This is the President and Americans should care what he has to say. Lord knows we hear enough BS daily from all the other so called politicians and news media, both from this country and foreign ones! Your comment let us all know where your politics lie. You strive to keep politics out of your channel and that’s a great idea but the way you said it was offensive to people who do care what the other side has to offer. I know…it’s my right to educate myself in whatever is important to me. The President is my choice . I will watch Crumbly on replay. Thank you

    Peter--VOLUME SOLUTION--Since we have Michigan judge whisperer, you'll need to keep your volume down since theirs from court is so LOW. I'm constantly getting ears blown by TV or if use phone, not as bad, but when volume differences are constant, try to adjust yours then proceed so constantly fishing for remote or can't put it down bc constantly adjusting between court & your informed comments. I've had to turn a video once of yours w Jennifer Crumbley case. It's not all your cases w L & C.. this Oxford one is just bad. Love your show. Thanks.

    More sloppy gun safety, more dead bodies. An adult dropped the ball by not securing a weapon he bought for his child. It's COMPLETELY foreseeable. No helicopter parent would miss how unwell this boy was, and they threw a firearm into the mix. Terrible parenting isn't illegal (unfortunately) but gun safety should be. So many ways this could be avoided. My Dad had rifles for game keeping and clay pigeon shoots and he was more vigilant than the police who have to come and make sure everything is stored safely (in U.K.). Not responsible enough to look after the weapons or kids.

    It was mentioned several times that he should have gone home to check on the firearm. The very fact he didn't, to me, shows his oblivion of what could (& would) happen. Should he have known is a different thing, but he plainly didn't.

    Why did they show the text messages between Jennifer and the guy she had an affair with (when Jennifer and James were "on the run"). What do texts between his wife and her side piece have to do with James? And there was no objection from the defense as to relevance. So clearly I'm missing something.
