  • The prosecution on Wednesday moved to dismiss a juror who they say was sleeping during testimony on Tuesday during the Apple River stabbing trial. The judge did not dismiss the juror.

      Are you serious??! The juror in question is over 90yrs old??! I agree, anyone over a certain age should be relieved from any such duties…but then again on the other hand, we have an elderly president falling asleep on the job supposedly running our country so….😵‍💫

      @@Faretheewell608at every trial they have the head investigator very close to the prosecution. Like the Darrel Brooks trial Detective Casey was just behind the prosecution table along with a plain clothed under cover law enforcement officer.

    Aren't there cameras in the courtroom?? Can't they look at that? Also the AWFUL people out there speculating it MUST be the lady in her 90's are speculating based on age. No one said it was her. I was on a jury FULL sessions 9-5 every day for 3 months, where a 19 year old boy fell asleep. AGE has nothing to do with it. Even the judge said he didn't see anyone sleeping and even if they did the video is recorded and can be replayed for them.

      The problem is if a juror is sleeping throughout the trial at different times, that means they most likely already have an agenda and they already had their mind made up prior to even listening to all the evidence. So that means no matter what you argue with them what you talked to them about what you show them they're already going to have their mind made up. Weather is guilty or not guilty nobody knows but still it's not right because that person is just going off of assumptions and feelings instead of listening to evidence

      @@bamadad53No, he should’ve told the prosecutor who would’ve asked the Judge if he could approach to discuss an issue he just became aware of concerning the jury. The Judge would’ve then excused the jury and they would’ve dealt with it just like they did here, except the juror probably would’ve been called to testify.

I guess I look at it like this.. if you observe a nodding juror, and you find it troublesome enough that it could have an impact on their ability to do their duties as a juror, or an impact on either sides' right to a fair trial...so much so, that you speak up about it...then stand on business and mean what you say with some conviction and purpose!?!? He seems so confused about every related question 🤔 it's weird and not convincing at ALL, imo.. and that just makes it seem sketchy, at best..Considering that he's an investigator on this very important and public trial, as well as a witness in the case (amongst other cases too, presumably), AND he was willing to go as far as testifying under oath about the alleged drowsy juror, then he should be well equipped to firmly and concisely state what he witnessed, and answer any questions about it quickly and confidently, without hesitation, while standing tall and carrying on with his day💯🤷🏾‍♀️ but that did not happen.. he seemed forced, confused, and almost like he was questioning his own words in real time on the stand as if it was his very 1st time in a courtroom or on the stand..... Weird af

      I wonder how you would feel if it was your unarmed son who was gutted like a fish and died within 2 minutes, over something so senseless, even if he was acting like a jerk before hand. The kid was a straight A student who worked and had plans to attend college. I lost my son at age 26. It is devastating and heartbreaking.

    Given that the altercation was captured on video, this whole case should not have lasted more than two or three days. 90 percent of the witnesses were totally unproductive or so overtly fantasizing ("he was molesting little kids") that they should never have been called to testify.

      This “poor guy” is a tool for the prosecution to replace a member of jury they figured out was so unimpressed with the prosecution’s tactics of wearing down the defendant and the witnesses for the defense with lengthy pointless interrogations that she fell asleep. Of course, they want to get her out. And that’s precisely why the defense should rightly protest - that member of jury will sure take it personally and be even more critical of the prosecution’s job in this case.

      A request to dismiss a juror is a major event in a trial, they are absolutely within their rights to grill this tattletale thoroughly. And the fact that this "lead" investigator can't really substantiate his claim with exact detail is ridiculous.

    Haven't watched the whole trial, but it seems the state wants that particular juror dismissed while the defense does not want her dismissed. State might have received information that this juror is hostile to the prosecution and the state feels their case is shaky as it is.

      It is possible that they already knew that this specific juror was biased for the defense from the beginning (lawyers from each side can only boot off so many people when picking the jury to begin with - they have a limited amount of bootings they can do). However, it should be noted that this person isn’t even on the jury as of yet, because it was stated in this video that she is an alternate, so she might not have any input on this trial at all.

    this is a very interesting trial. The state built up sympathy against the defendant. But appeared to get it wrong. Clear to me the kids were bullying, harassing and picking a harmful fight. I don't often route for the defense.

      I would hope the jury isn’t sleeping through parts of the trial where they might miss something crucial as a result. If they are sleeping and not taking the case seriously they could make a incorrect decision at the end. Removing a sleeping juror has multiple reasons of why they should be removed.

I found it hard to listen to that attorney at times because he began every sentence/question with “And” and then ended every statement/question with “right?”. I wonder if since all of these trials are being filmed now, if the jury could technically request to review any part they might want to see again. Cause the judge said “it’s not like live testimony that is lost forever”… but in actuality it won’t be lost forever. It’s on UA-cam 😂

Ever!!! If they were feeling scared which the video shows they were not scared at all until it was too late! I can't believe out of that many teens that not one of them stepped up and did the right thing and called the police immediately and or told these so called friends to stop their behavior right now or I'm going to fuck your life up! That's what I would have said to my friends if I ever saw them do something so vile to anyone especially an old man by himself! You. Better believe I would have called the police and told the truth on them because I certainly would not continue a friendship with evil kids that saw that as entertainment! Sickening

    This investigator is terrible. I wouldn’t put him on any case. Looks unprofessional. He could’ve written a note as it happened. Sounds terrible on the stand. Ugh

The state was sweating that whole time. Any half wit could see that. This just shows how little prepared a State can be to sway a jury as well as how dumb it is to talk to police. Nothing else.

It's the people that scrub toilets, cook, clean, and sweat every day at work that keep this Country going and you'd do well to remember that. I'm not an attorney but I'll wager I have a more impressive caseload than you do. I beat bogus felony assault charges from solitary confinement with a BS public pretender but I was smart enough to use that time to hit the law library that was suddenly readily available. Law books that blue collar folks won't ever have access too but the term the prosecutor used b4 I got released was "jail house lawyer". The hardest part about being a lawyer is filling out the legal paperwork and making sure it's all correct and it's the paralegals that do that for them. A blue collar worker. So suck on that bruh.
