    When flying a drone in public, it's important to be aware of the chance that you may have to deal with law enforcement. In this video I provide five tips on how to handle law enforcement if they are called while flying your drone.     As a Part 107 pilot and an Airport Operations professional, this video is great. You cover all the big points and address it from both an interaction with the police side as well as make sure your legal side.
    One thing I have to continually educate people on is the only entity (in the US) that can restrict airspace is the FAA. As such, if you are in clear airspace and launched/control/landed you drone from someplace you are legally allowed to do so, you are good. Obviously, have to fly it safely, but those are the big ones.
    I've had police called on me and turned it into a moment to educate the officers and even give them some time to fly it around. In that instance, having my license and waiver (I was under airspace in a 200 foot allowed grid with LAANC waivers for higher) as well as my business card took something from a "What are you doing, Citizen" to a "That is fun, I want one!" moment.

    I have a couple comments I want to share. First is the manner in which you speak, you are friendly and stay on track. Your advise is very good and to see a young guy (a lot younger than me) know how to deal with the police. As a former cop I can tell you that puffing out your chest or when stopped by a cop, not simply complying with requested items can escalate the situation until you get bracelets. If you believe the cops are wrong, still comply and file a complaint later. Getting into the "I KNOW MY RITES" mode will at a minimum, spoil the rest of your day. I have only seen this one video but it prompted me to subscribe. Want to hear more of what you share.

    Exactly. Great video. No: Do you have a reasonable articulable suspicion of me committing a crime? No: Am I being detained. Just remain calm, polite and cooperate and de-escalate the situation. They're just doing their job.

    I always address any person who interferes with my flight with this statement. "Please let me to land the UAV before we talk. You do know it is against the law to interfere with a pilot during a flight."

    Thank you for making this video. As a police officer and drone pilot, I can see both sides of the encounter. Your attitude has so much to do with how the interaction goes and you are acting as an ambassador for the hobby/job/sport to whoever is coming up to you. It's so nice to see someone advocating for a calm and approachable attitude rather than trying to have the "I schooled an idiot" type of mentality. Excellent job, sir!

      @v1rotation I agree. Unfortunately we have policies that we have to follow or we face suspensions over dereliction of duty possibly. My department requires that if dispatch sends us, we have to go. And if the complainant is standing there watching and we don't even approach we will get complained on for sure. And our dispatchers lack any sense of what a police-related vs non-police-related call is, so they send us on EVERYTHING. What departments are really lacking though is knowledge and training. Local authorities cannot police airspace. And if it's not prohibited by a property owner to launch and land from their property, it really isn't our concern. Trust when I say, for at least some of us, we are tired of Karen calling us out for completely legal drone flights. Just please follow FAA guidelines and fly safe!

      @v1rotation you might not believe how much we are on the same page. I've been begging for a long time for my departments leadership to come up with some way to lessen the number of BS calls we get sent on. My department alone is at around 4000 calls for service this year and it's only been 14 days into the year. That's STUPID! Good thing is I don't think there have been any drone related calls yet. Lol.

      @v1rotation I honestly couldn't agree with you more. There are a lot of calls though that come in from "anonymous" complainants who don't want to speak with us. Not just drone calls but all types. And when the department policy says the voice of dispatch is as if it were a direct order from the chief, you're hands are tied. There's a lot that the public doesn't know from behind the scenes that forces us into interactions we would rather not bother with because, as some are quick to remind us, we have better and more important things to do.

    You got the exact correct mindset. I run into stuff like this sometimes when doing photography. People have a tendency to harass drone operators, photographers, videographers. I actually got disrespected by a Chicago cop one time, but I was able to de-escalate it and I was able to keep my cam. Dude was totally out of pocket threatening to just take my gear.
    Also, if you get a random civilian harassing you while you are operating the drone ... you want to have video of everything. If some kind of Karen or Kevin is getting hostile while you are flying ... these people are creating a dangerous situation because you are the PIC. These people are interfering with the operation of an _AirCraft_.

      @@v1rotation That law should really be modified to protect legitimate, lawful operation of a drone from harassers because this kind of interference could create a serious safety issue. It's similar to road rage, but it's pedestrians.

    I’m not cooperating with the violation of my rights.
    I’m not offering any ID or pilots license.
    If I’m flying I’m telling “it is a federal and state felony to interfere with me while I’m flying”. I will bring it down and then you can ask your questions.
    What am I doing? I’m flying under and in compliance with federal regulations within federally controlled airspace.

      I've been stopped by the cops flying my drone more then 5 times and I've been flying for 6 years. I'll try to make better LUCK for myself but just handling the situation as a professional.. There's really not much else that can be done when being approached by law enforcement. Thanks for watching...

    In my experience the best way to approach this is by listening to what they have to say and not jump into the defense. Even if it's your right to fly there, just listen to their arguments and come up with a solution that both parties can live with.

    How do you cooperate with a park ranger at a public beach who tells you that drones are not allowed to be flown there and I have my part 107?

      If it was me, I would land, put my drone up, and then try to talk it out. I've shown a cop my B4 you fly app the screen where it says CLEAR TO FLY, and that helps. But I've also been in the same spot, and the ranger didn't let me fly. I think it's better not to try to PROVE them wrong. It usually doesn't end well. Hope that helps.

    We can appreciate different perspective here because compliance is often no guarantee. In fact statistically surrendering our rights bares no correlation to police escalation during routine interactions. Everyday police interaction to unlawful orders are likely to escalate into use of force incidents regardless of compliance. In fact, the 'Council on Criminal Justice Task Force on Policing' called for " complete overhaul of U.S. police training and national standards". The task force found "most police training in the United States is misfocused, too short, uses ineffective teaching methods, and is out of alignment with both community safety priorities and research about what works to minimize bias and use of force." The task force concluded. “Police departments need policies and standards that hold officers accountable - and leaders committed to changing the internal culture of their departments.” Repeat offenders cost taxpayers billions of dollars in legal fees and settlements, essentially defunding law enforcement. [WP, "The hidden billion-dollar cost of repeated Police misconduct]
    Our 4th Amendment guarantees our right to be secure in our persons and papers against unreasonable searches and seizures. The necessary evil is not a rational argument when fundamental and well established rights are deprived under color of law. Exercising our rights is not anti-law enforcement - ignoring rule of law is anti-rights enforcement. The myth of stop and ID is totalitarian and untrue. Stop & ID is not legal in any state .. “the United States Supreme Court ruled that a police officer could not arrest a citizen merely for refusing to present identification.” (Kolender v. Lawson, 461 U.S. 352, 1983). Everytime we hand police our 'papers' they generally run us through NCIC (national criminal information clearinghouse) check and /or run us for nationwide 'wants and warrants' through their RMS (records management system). You don't have to imagine how these systems can be abused and flag innocent people as suspect due to so many enquiries. Citizen journalist, photojournalists and drone enthusiasts are regularly targeted by law enforcement for pretextual stops just to ID. It's not unusual for cumulative 'detainments' to end up on do not fly lists or flagged for any travel or worse scrutiny. It's easy for the innocent to end up in a loop where the more times your ID has been ran - means you're more suspect to more detainments, more records searches and background checks. The court call's the officer's conduct "at most negligent" and the result of "good-faith mistakes" but Supreme Court Justice Sonia Sotomayor isn't having any of this. And in an opinion joined by Justice Ruth Bader Ginsburg, she questioned the premises of the majority -- that "lawless police conduct" here was somehow uncommon or somehow not "systemic." She wrote, "Even if you are innocent, you will now join the 65 million Americans with an arrest record and experience the 'civil death' of discrimination by employers, landlords, and whoever else conducts a background check."
    "Show me your papers" was once just a mere inconvenient compliance, until the duplicity revealed itself in a final solution. If we're easily willing to hand over our rights, to submit papers without probable cause - we create inherent power imbalance between government the public. If we don't use our rights we lose our rights. Education is key with the public and police because it's important part of drone advocacy that works for everyone.

We must recognize the complacency, because it’s a significant part of cognitive dissonance in self-preservation of privilege.       'Order followers' comes to mind as a popular vernacular often used to make the point, so I will chose to stick with the spirit of the conversation. Psychopaths don't care if they hurt you because they lack empathy and law enforcement profession seems to attract more than its share of authoritarians in that respect. Researchers have long attempted to understand why people high in psychopathy have this emotional blind spot. The Standard Police Psychological Exam is designed to vette and weed out 'problem' candidates. Research abounds with empirical evidence of critical numbers and even whole police departments failing psych exams. ‘Two studies of recent times have found that at least 40 percent of police officer families experience domestic violence, in contrast to 10 percent of families in the general population.' [Johnson, L.B. (1991). On the front lines: Police stress and family well-being. Hearing before the Select Committee on Children, Youth, and Families House of Representatives: 102 Congress First Session May 20 (p. 32-48). Washington DC: US Government Printing Office. & Neidig, P.H., Russell, H.E. & Seng, A.F. (1992). Interspousal aggression in law enforcement families: A preliminary investigation. Police Studies, Vol. 15 (1), p. 30-38.]
      Orwellian conditioning seems to denote an attitude that promotes 'brutal policy of draconian control by propaganda, surveillance, disinformation, denial of truth (doublethink), and manipulation'. The publication "Ordinary Men" is a shocking account of how average middle-aged working-class men became cold-blooded order followers for Germany. 'The general argument the author and researcher makes is that most people can succumb to the pressures of a group setting and commit actions they would never do of their own volition.' Essentially lays claim that peer group 'cultural' pressure can lead ordinary men to commit the most heinous of crimes. The level of detail in the indictments and interrogations of ex-Nazis was chilling, especially because it revealed just how ordinary the men who perpetrated extreme acts of violence evidently were. This inspired Browning, a historian to write 'Ordinary Men' using the testimonies of more than 125 policemen from Reserve Police Battalion 101 (RPB 101). Another example of manufactured consent was revealed in the 'Milgram Experiment' where just 'over 60% of research subjects would execute orders to k*ll or injure another human being if the order came from someone of authority, someone with a title and someone in uniform, rank or a lab coat'.
      This same authoritarian ideology that thrust us into world wars used similar minions as useful tools 'destructive to the welfare of a free and open society'. History has amply demonstrated where this will end up - when servile followers submit & support an emerging police state. For servants of the anti-rights movement who oppress civil rights - they only have one goal - to silence govt transparency and accountability. To silence the critic, the photojournalist, the cameraman, the drone operator .. "The answer to injustice is not to silence the critic, but to end the injustice."
      If we agree with the Supreme court that, "The Constitution of the United States is the supreme law of the land," do our oath keepers not uphold and defend our fundamental and well-established rule of law. "All political power is inherent in the people, and governments derive their just powers from the consent of the governed, and are established to protect and maintain individual rights." [US CONSTITUTION- DECLARATION OF RIGHTS.]

    What you are required to do is have your drone registration, TRUST, and / or your Part 107 certificate. You are required by law to give that information to law enforcement when flying your drone upon request.

    I am a recreational flyer and I live in a rural area in NW Pa. 95% of my flights are out of my yard. An incident occurred on September 3, 2023 and the PA State police now have my Air 2S. I was filming a hyper lapse video of the sunset when I received a critical battery error (my own stupidity) and the drone made an emergency landing about 400 meters from home. I could see that it had landed on a neighbors property and waited until the next morning to go there and ask permission to search. When I did they told me that they had found it and called the police who came and took the drone. I was happy to hear that it was found and figured that all I needed to do was call, explain what happened, and go retrieve it from them. I made that call on September 4 and was told that the officer involved would have to call me back. I waited a few days without hearing a word then he finally contacted me. He informed me that I wouldn't be getting the drone back soon if at all because there had been other complaints, about drone flyers in my neighborhood. I explained that I could easily prove that there was no malicious intent on my part by showing him the flight logs. I also told him that everything I filmed would be on the memory card in the drone and, if he removed the battery, he would find a sticker with my name, address and phone number on it. He didn't want to hear that though and was very arrogant and downright rude when he told me that he was gathering everyone in the area who had complained and they were taking me to court. When I inquired about a timeline he said that he couldn't even start the 'investigation' until he gets off of 3rd shift. Its been a month and he still has not started the investigation. Since then I've done some research and found that civil forfeiture laws exist that allow them to keep property indefinitely even if there is never an arrest.
    UPDATE
    I received a call from Trooper Lewis of the PSP today (12/10/23) and he informed me that he would be filing 'unlawful use of an unmanned aircraft ' and also 'disorderly conduct ' charges against me. The disorderly conduct charge really blows my mind. When I asked him about it he said it was because 2 other officers had visited me with warnings. Those officers never issued any warning either written or verbal. Unfortunately with my wife battling breast cancer and heart problems and with both of us being retired on a fixed income the money won't be there to hire a lawyer and fight this and my income will keep me from getting legal assistance.

      I was officially charged with 4 counts of 'unlawful use of a 'MANNED' aircraft (yes I said manned) to conduct surveillance and 1 count of disorderly conduct/physical. I had a pre-lim on Jan 29 but the judge issued a continuance because one of the so called victims has covid and also they forgot to subpoena the second cop. I remain frustrated because I still can not get anyone to consider my flight records. This would have proved my innocence and stopped this waste of time and taxpayers dollars from the start.

    Hey, I got a better idea. It's none of the copper's business! If the coppers ask you any questions, just pretend you are mentally drawing a blank page! Tell them you are just flying around a bit testing your drone. If they ask you exactly where your drone is, then just say it's "coming back". Besides, as soon as you see any coppers you should always press the RTH button.

    First off I'll tell you I come from LEO, the first thing you have to ask yourself why was the police called? was it really the drone or that it was a black guy flying a drone? The fear from others is a strong cause of involving authorities as they are fearful to engage you. From the information you gave in this post would not constitute any reasonable reason to call law enforcement. I can only imagine 911 call :" there is a black guy looking suspicious with a drone, I just don't feel comfortable with him in our area"

    Never talk to the police, period. Your recommendations are likely to lead to a good outcome, but you should never assume that. The best advice anyone can give is to just simply never talk to the police.
