I am a relative newcomer to the world of wildlife photography and it bugs the hell out of me when scumbags steal content or don’t give credit to the creator when using other peoples content. I’d also go further - I see bird images on Instagram where I know the location of the shot was a small business owned hide yet the image owner makes no reference to the hides they took the shot at and make out as if they found the location for themselves. This bugs me on several levels - set aside the disingenuous idea they found the location themselves, the small business thrive on recommendation and referrals so if we enjoyed us8ng their hides the least we can do is give credit to them. Rant over - keep up the great work and hopefully one day I can get an Osprey or Eagle shot that comes close to yours!

I have your coffee table book in front of me now. “OSPREY The Glorious Pursuit of Unbridled Determination”. I would, and have, recommended this magnum opus of osprey photos to anyone I talk to. Have you had a DNA analysis done? I swear, I think you have some osprey DNA. You think, anticipate, and can capture this most magnificent of piscivores on the wing. Not only ospreys, but all avian denizens of Florida. You’re a national treasure, my friend. So glad UA-cam had your back. As if anyone could pass off a Mark Smith photo or video as their own.

Damn that was an epic fight scene! I feel you too man, I've had to deal with that a few times as well. No Bueno. I've had similar experiences too where after they got busted stealing my stuff they apologized and asked if I could rescind the copyright strike cause it's hurting their channel! 🤣
When there is a strike for blatant usage of content. Are those funds reclaimed and awarded to the originating channel? Further are those “channels” deleted and banned from UA-cam? UA-cam needs to take a firmer stance against this….

Dear Mark, Please try and refrain from referring to yourself as the little guy, or the small you tube channel, or anything else that has to do with other channels having more subscribers, more views, etc., than you do. Who cares ! There is no excuse for theft. This is about what is right and wrong. And for sure, there is rarely, if any, justice that can alleviate the sheer frustration one feels when something is stolen from them, especially something as personal as a video you may have put hundreds of hours into, to capture a short amount of footage. I am thrilled to learn from your video that you have chosen to ignore the attempts of the thief to offer an empty apology to you !!! I’m quite certain, like you have already mentioned, they are just trying to clear their name, and have no interest whatsoever in ending their career of copyright theft. Mark, congrats on defending your video ownership rights. I too have had similar instances to yours and will never license material to someone who has first stolen it. Over the years UA-cam and Vimeo have been great to work with in resolving my copyright claims. In one situation they removed the offenders entire channel of over 70 videos.
Mark sorry to hear that this happened to you! Like others I really feel it would be appropriate for you to name the people who did this. Our entire legal and moral system rests almost entirely upon accountability. To leave the thief, the corrupt, the deceitful unnamed is to literally encourage the very sort of behavior evident in this incident. "Getting even!" Is not one of mankind’s nobler motives and I admire your restraint in that regard. But "turning the other cheek" in incidents like this may well wind up putting other people' work in jeopardy.

Interesting. One of my squirrel videos was re-edited and a Chinese voiceover added. It got a huge number of views on some Chinese language UA-cam like website. It was quite amusing to listen to even if I didn’t understand the voiceover.
Ravens also do this. It seems to be part of their courtships. Once I watched a pair spiral down, and they didn't release in time. They crashed into the ground behind some sagebrush. One got up and flew off within a couple of seconds. I was worried about the other (they crashed hard). It was down for a while, but then was able to fly off. Might have been stunned or knocked unconscious. It seemed alright flying away, though.
As a professional motorsport photographer when I was using film customers would buy a 7x5 print then have it copied and enlarged to 20x16, imagining that it was OK. When I was sending out digital thumbnails they would copy them to put on FB. On one occasion I posted a image from the original underneath with the words, this is what it looks like if you don't steal it. When I was doing video I could buy software to remove copyright restrictions, but not to prevent it happening. Digital imaging is great, only now it is all too easy to steal stuff. I recently retired, it is no longer worth the hassle, people earning maybe £35kpa post reasonable images they have taken as free downloads, my income went from £60k to £6k over ten years. Bring back film!

You should absolutely name that UA-cam channel that stole your content. These channels should be named and shamed, maybe then they will think twice before doing it again!
They are now claiming they have the right to use my clip and you’ve is going to reinstate the video unless I have a court order… so it may come to name and shame them

I don't know about the US, but in the UK fair use of copyright material for teaching purposes can only be done if it contains only minor use of the original material, if its to illustrative a specific point (for teaching), if its for done for non-commercial reasons and if there is acknowledgement of the author/creator of the content. From what you're saying, they didn't provide acknowledgement, their channel is a business so they probably monetized the video, they likely showed the entire video you posted (or a large portion of it) and probably didn't actually teach the viewer anything! So I reckon that fair excuse wouldn't fly in the UK and hopefully not in the US, as its just plain theft.
One of my photo workshop instructors mentioned that he collects info on instances of people stealing his images and, once a year, has an attorney contact them. He collects a substantial amount of money each year. I may be incorrect, but I think the basis for the Fair Use doctrine was for reviewers to use as examples in their articles, or for academics to use for instruction or examples in their articles or books. Ideally, it should promote, not steal from, the creators’ works. It may be that it is complicated by the fact that we are talking about UA-cam or Instagram, but it still may be worth your while to speak with a law firm that deals with intellectual property.
I had the same thing happen to me even though the video was no where near your level. UA-cam did take care of it promptly. The weird thing was the producer of the compilation could have asked for permission and given me credit and I would have been OK with it. I would guess that UA-cam is also well aware of the theft problem with compilations, so that may explain why they are so quick to act. They legally have to act, least they become liable I think. (Not that I'm a lawyer.)

When I first started photography I didn't mind if people used my photos without credit, it was just flattering to know someone likes your image and all that matters is I know personally it's my work but... the table completely turned when I realised people could make money from your work. This now puts it into the category of theft in my opinion. My photos are not even being stolen, but what made me realise this is a logo i created for my photography and a comment said it was going to be put on a NFT website, imagine someone selling it for thousands of dollars...

I do collect pics and vids I like to post them on my FB page the last account was hacked unfortunately. I would like your permission to post a vid from you on there. No altered of coarse. When it comes to social media, too many people are just shameless in what they do and what they post. I dont know, but maybe that is the price of a digitized world. Good that UA-cam backed up about your rights. I look forward to see that video with those eagles.

Just privated the video, preemptively, we do a lot of news commentary on our channel, so most of our content is covered by those fair use codes… that said. It's tricky because you could watermark the 🤬 out of your clips, but that also distracts from the beautiful moments you're sharing. And it's not a viable option for every single clip. I guess part of sharing amazing work and growing an audience involves dealing with unscrupulous thieves. Your true fans / friends will continue to have your back. 😎👍🏻
Hi Mark. I think it is disgusting when someone steals the results of someone else's hard work, whether it is videos, photographs, cars or anything really. I think the penalties need to be greater. In a flagrant violation, such as this, rather than just taking down the video, UA-cam should remove their entire channel and block them from further content. That would send a real message to others like them.
Its like all the people reposting audio of novels that either the books or narrators have the copywrite. They insert random music to try and bypass the copywrite.

The weird thing was the producer of the compilation could have asked for permission and given me credit and I would have been OK with it. I would guess that UA-cam is also well aware of the theft problem with compilations, so that may explain why they are so quick to act. They legally have to act, least they become liable I think. (Not that I'm a lawyer.)

When I first started photography I didn't mind if people used my photos without credit, it was just flattering to know someone likes your image and all that matters is I know personally it's my work but... the table completely turned when I realised people could make money from your work. This now puts it into the category of theft in my opinion.
My photos are not even being stolen, but what made me realise this is a logo i created for my photography and a comment said it was going to be put on a NFT website, imagine someone selling it for thousands of dollars...

Hey Mark, I used your Eagle Fighting Clip on Our Podcast show from last week, and used it as a clip the following week for content as a UA-cam short. I did leave your photo mark on there : “Mark Smith Photography” not trying to pass it as our own. We just needed it for context on the proceeding comment. It was only used for a few seconds.. anyways if you want me to unlist the video, just let me know. I too thought it was covered under some type of “fair use” case

Just privated the video, preemptively, we do a lot of news commentary on our channel, so most of our content is covered by those fair use codes… that said. I appreciate your work a lot, just seeing more about what you have been going through, And I want to protect your work.

At the minimum it's common courtesy to give credit to creator . This footage is awesome btw.
It's tricky because you could watermark the 🤬 out of your clips, but that also distracts from the beautiful moments you're sharing. And it's not a viable option for every single clip. I guess part of sharing amazing work and growing an audience involves dealing with unscrupulous thieves. Your true fans / friends will continue to have your back. 😎👍🏻

Hi Mark. I think it is disgusting when someone steals the results of someone else's hard work, whether it is videos, photographs, cars or anything really. I think the penalties need to be greater. In a flagrant violation, such as this, rather than just taking down the video, UA-cam should remove their entire channel and block them from further content. That would send a real message to others like them.
UA-cam actually reinstated the video because the thief claimed “fair use.”
