Just talked to someone today about this. They were under the impression that it is illegal and it's definitely not. The only time law can get involved is if the casino bans you from returning and you end up trespassing. That's it

Law can also get involved if you are using some type of device to count for you. If you’re using some type of hidden device to help you count, I’m pretty sure that’s when it really is considered cheating.

I’m not sure if anything has changed in the last 9 months though. But I highly doubt it. Neither federal nor state, or in Nevada or Colorado. It’s only illegal to use card counting electronics. As long as you use your brain it’s legal. Count away!

The problem is not enough people collext the compensation owed per law for being deprived of their rights under color of law. Obviously more people than ever before are doing so as it is becoming more commonly known that you dont need an attorney or even money to file and collect/issue letter of intent to sue and collecting settlement at least, but still not nearly enough and the NDA's inhibit the ability to spread the information even more after actually collecting a settlement.

Counting is not illegal, but they can refuse service or trespass you. Best not to wildly vary your wager (let it ride if the deck goes rich) and always tip the dealer. Don’t give other tells, like silently moving your lips or repositioning your feet as you count.
