I have a child with a lady I told her I wasn't be able to be a dad for him I told her the first Month I would pay for the abortion so she wouldn't struggle alone but she told me not to worry that she won't look for me again so 2 years after she opened a case that she wanted to put the child last name like me that's not fair
Because a dna test does not obligate the father. The birth certificate and those contracts in child support court obligates him financially if he signs them. Which most people blindly do because they don’t have legal representation. If the father don’t show up in court he waive his rights. If he show up and refuses to sign those contracts I don’t think they can force him to pay until he sign.
If the child isn’t yours go take a court dna test and get the child support removed. If you went to court you probably signed forms which are contracts that obligates you to pay.
How about custody?? If the father doesn’t sign the birth certificate and does not have a COP, can he still have rights on the baby? Is that considered the mother have full custody?

my wife and I were not married when my daughter was born. We were living together and letter we got married. I name is not on my daughters birth certificate and my wife passed away 18th of dec 2023. My childs mother is not trying to let me see my daughter at all. Will not answer messages or anything. I haven't seen my daughter since she was a newborn and she turns 4 in September. I am not on the birth certificate because she lied and said she was waiting on it but just didn't want me on there at all. I did take her to court without a lawyer and basically the court didn't want anything to do with the case. Even though I proven that her mother didn't want to sign the affidavit. I did have a DNA test taken from a 3rd party but the court denied it because it came from a 3rd party. Holy snap idk signing birth certificate is basically signing up for child support but not child access. So if i am understanding this right Men have to take an extra step after the child is born to actually have legal access to the child.
Well yeah because everyone knows that the mother is the mother because the baby came out of her, but thats not always the case for the males in the situation so it needs to be clarified through DNA.

Ok what if the father doesn't want to be on the birth certificate and doesn't want any obligations? If paternity is determined is he forced on the certificate and carries obligations? And if so is there a way to appeal this?

If the father is not on the birth certificate but has DNA proof that he is the father, does he still have to pay child support? Also if both parents live in different states how would the father go about putting his name on his child birth certificate?
I don’t recommend signing any forms because they’re all contracts in which you agree to pay child support when you sign. Not sure if dna testing obligates you financially. But they will try to get you to sign a title IV- D form before taking your test. You are not required to sign that document but they’ll lie to you. Birth certificates and court contracts (IV-D and acknowledgment of paternity) obligates you to pay child support when you sign. I recommend you show up to court but don’t sign them, no matter what they say. It’s something fishy about those forms, they’ll try to have you quickly sign without explaining them or letting you read them.

That's a great question, Elizabeth! If no father is listed on the birth certificate, the mother has sole legal rights and responsibility of the child. If the father expresses interest in participating in the child's life, he will be required to take a paternity test. Once paternity is established, the father will be listed on the birth certificate and he will have legal rights to the child. In most cases, paternity must be established first whether the father is in the U.S. or abroad. Below are the steps and options when the father is outside the U.S. Steps to Establish Paternity Across Borders Voluntary Acknowledgment of Paternity (VAP): If the father agrees to be listed on the birth certificate, he can sign an Acknowledgment of Paternity form remotely. Some U.S. states (like Iowa) allow acknowledgment forms to be notarized abroad, usually through a U.S. embassy or consulate. Once signed and submitted to the state office, the father’s name can be added to the birth certificate. Paternity Testing (DNA Test) When the Father is Outside the U.S. If the father contests paternity or a test is required to prove biological parentage, the court or the state’s Child Support Recovery Unit (CSRU) can order a DNA test. In Indiana, if the father doesn’t sign the paternity affidavit the father’s name can’t be added to the birth certificate even after a DNA test confirms paternity. To establish legal paternity and get the father’s name added you must file a paternity action in court. The court can order genetic testing and if paternity is confirmed they will issue an order establishing the father’s rights and responsibilities. Then the Indiana Department of Health will add the father’s name to the birth certificate. Talk to a family law attorney in Indiana about your paternity case. If both parents of the child go to child support court, and the father acknowledges that the he’s is his but the birth certificate is the same with only the mother’s name . Im 36 and noticed that my father's name or signature was not listed at all on my birth certificate. Both bio logical parents never got married and are alive. I got my answer it’s no father has no legal rights. Only way he has rights is if he goes to court then establishes paternity n court order is out in place.

I know this is late but yes since your mom has sole legal custody of her son your brother then she does not need the fathers consent to apply for a passport.

Idiot you don’t wanna be on child support trust me I see my kid every week and pay 350 a month and I still buy her stuff it’s not enough for me to survive on my own if I pay 350 a month with her mom then I gotta pay 350 a month when she’s with me that’s 700 a month no kid cost that much when parents are together and if your out of work for a while it racks up super quick shit happens and Eventually is impossible to catch up on then they garnish more from your check it’s not worth it to sign honestly but I herd they still get you for child support even thou you don’t sign it designed to fuck you for 18 years if you owe it’s longer then 18 years until you pay everything off not even fair at that point kids a adult and wouldn’t need a check that’s why all baby moms are living right

He's not the father, the father is the one who is on the birth certificate. If they are a couple, planning or already married, it must be assumed they are the parents. Any outside party, unless the person did cheat on the man's spouse, is not considered the father in legal terms.

@@javierbaltazar5130 Depends on what state you are in; look at your "process of service" for legal documents in your state. Make sure that they don't do process of service by deputy* sheriff or to your job and only by mail. If your paperwork is served by mail only then don't open it and just write on the envelope "return to sender" and send it right back (you don't have to be honest to any US postal system at all); a CS case cannot be taken up against you unless you have been served correctly. If you live in a state that serves by sheriff or to your job and you cannot leave your current state then you need to prepare now; get an S-CORP* and LLC* set up and put your earnings into that so your money cannot be garnished if you know the baby is yours. I'm assuming you have not been to court and no DNA* test has been done??

Because a dna test does not obligate the father. The birth certificate and those contracts in child support court obligates him financially if he signs them. Which most people blindly do because they don’t have legal representation. If the father don’t show up in court he waive his rights. If he show up and refuses to sign those contracts I don’t think they can force him to pay until he sign.
What if you been paying child support since the child was born for 14years, but not on the birth certificate but child has your last name ?
If the child isn’t yours go take a court dna test and get the child support removed. If you went to court you probably signed forms which are contracts that obligates you to pay.

My childs mother is not trying to let me see my daughter at all. Will not answer messages or anything. I haven't seen my daughter since she was a newborn and she turns 4 in September. I am not on the birth certificate because she lied and said she was waiting on it but just didn't want me on there at all. I did take her to court without a lawyer and basically the court didn't want anything to do with the case. Even though I proven that her mother didn't want to sign the affidavit. I don’t recommend signing any forms because they’re all contracts in which you agree to pay child support when you sign. Not sure if dna testing obligates you financially. But they will try to get you to sign a title IV- D form before taking your test. You are not required to sign that document but they’ll lie to you. Birth certificates and court contracts (IV-D and acknowledgment of paternity) obligates you to pay child support when you sign. I recommend you show up to court but don’t sign them, no matter what they say. It’s something fishy about those forms, they’ll try to have you quickly sign without explaining them or letting you read them.

That's a great question, Elizabeth! If no father is listed on the birth certificate, the mother has sole legal rights and responsibility of the child. If the father expresses interest in participating in the child's life, he will be required to take a paternity test. When the father is in a foreign country, the process to add his name to the birth certificate is more complicated. In most cases, paternity must be established first whether the father is in the U.S. or abroad. Below are the steps and options when the father is outside the U.S.
Steps to Establish Paternity Across Borders
Voluntary Acknowledgment of Paternity (VAP):
If the father agrees to be listed on the birth certificate, he can sign an Acknowledgment of Paternity form remotely.
Some U.S. states (like Iowa) allow acknowledgment forms to be notarized abroad, usually through a U.S. embassy or consulate.
Once signed and submitted to the state office, the father’s name can be added to the birth certificate.
Paternity Testing (DNA Test) When the Father is Outside the U.S.
If the father contests paternity or a test is required to prove biological parentage, the court or the state’s Child Support Recovery Unit (CSRU) can order a DNA test.

@@oasisfullfilled7617 This was a year ago and the process went like this. I didn’t sign birth certificate at hospital. Hospital sends the paperwork and then I had to amend it if I wanted in. I took dna test and came out mine, I then amended birth certificate and got on.

In Indiana, if the father doesn’t sign the paternity affidavit the father’s name can’t be added to the birth certificate even after a DNA test confirms paternity. To establish legal paternity and get the father’s name added you must file a paternity action in court. The court can order genetic testing and if paternity is confirmed they will issue an order establishing the father’s rights and responsibilities. Then the Indiana Department of Health will add the father’s name to the birth certificate.

If both parents of the child go to child support court, and the father acknowledges that the he’s is his but the birth certificate is the same with only the mother’s name . I got my answer it’s no father has no legal rights. Only way he has rights is if he goes to court then establishes paternity n court order is out in place.

I know this is late but yes since your mom has sole legal custody of her son your brother then she does not need the fathers consent to apply for a passport.

He's not the father, the father is the one who is on the birth certificate. If they are a couple, planning or already married, it must be assumed they are the parents. Any outside party, unless the person did cheat on the man's spouse, is not considered the father in legal terms.

@@javierbaltazar5130 Depends on what state you are in; look at your "process of service" for legal documents in your state. Make sure that they don't do process of service by deputy* sheriff or to your job and only by mail. If your paperwork is served by mail only then don't open it and just write on the envelope "return to sender" and send it right back (you don't have to be honest to any US postal system at all); a CS case cannot be taken up against you unless you have been served correctly. If you live in a state that serves by sheriff or to your job and you cannot leave your current state then you need to prepare now; get an S-CORP* and LLC* set up and put your earnings into that so your money cannot be garnished if you know the baby is yours. I'm assuming you have not been to court and no DNA* test has been done??
