    What are the benefits if the child’s father lives in another country and we are not married nor plan to get married? Asking because I’m on the fence if I should put him on or not.

      Hi, marcishears3774!
      Thank you for reaching out with your question. Please note that the following information is general and does not constitute legal advice. It is important to consult with an attorney who can provide guidance specific to your situation. This communication does not create an attorney-client relationship.
      Understanding Paternity and Birth Certificates
      1. Establishing Paternity:
      When a child is born to unmarried parents, establishing paternity is the first step in recognizing the legal relationship between the father and the child. This can be done in various ways, depending on the jurisdiction:
      Voluntary Acknowledgment: The father can voluntarily acknowledge paternity by signing a voluntary declaration of paternity at the hospital when the child is born or later through a designated state agency.
      Court Order: If there is any dispute or hesitation about paternity, it can be established through a court order, often following a paternity test.
      2. Benefits of Establishing Paternity:
      There are several benefits to establishing the father's paternity, including:
      Legal Rights and Responsibilities: The father gains legal rights to seek custody or visitation and has a legal responsibility to provide child support.
      Identity and Relationships: Establishing paternity can help the child develop a sense of identity and relationship with both parents.
      Medical History: It provides access to the father's medical history, which can be important for the child's health.
      Financial Support: The child may be entitled to financial support from the father, including child support and potential inheritance rights.
      Benefits Eligibility: The child may be eligible for benefits such as social security, health insurance, veterans’ benefits, and life insurance from the father's side.
      3. Challenges and Considerations:
      There are also potential challenges and considerations to be aware of:
      Parental Rights: Once paternity is established, the father may seek custody or visitation rights, which could lead to legal disputes.
      Support Obligations: The father will be legally obligated to provide child support, which can lead to enforcement actions if not fulfilled.
      Jurisdictional Issues: Since the father lives in another country, international laws and treaties may complicate matters such as child support enforcement and custody.
      Determining the Validity of a Legal Claim
      To determine if you have a valid legal claim or the best course of action, consider the following:
      Voluntary Acknowledgment: If the father is willing to acknowledge paternity voluntarily, this can simplify the process.
      Legal Advice: Consulting with a family law attorney can help you understand your rights and obligations and the best steps to take given the father's international residence.
      Court Involvement: If there is any uncertainty or dispute, legal proceedings may be necessary to establish paternity and address custody and support issues. Remember, each situation is unique, and an attorney can help navigate the complexities of family law and international considerations. Feel free to reach out to us at 630.324.6666.

    Thank you for your content. My daughter was born in 1997. Her mother and I were not married. She took my last name. I also paid child support until she was 18. We recently discovered my name wasn’t on the birth certificate. My daughter is now 26. Her mother now wants me to sign the birth certificate. I don’t have a problem with it. I just wanted to make sure she isn’t up to any Tomfoolery outside the benefits you described in this video if something happens to me.

    How in the hell is a DNA test not enough??!!

    • @royalty12
      @royalty12 Рік тому +2

      Because a dna test does not obligate the father. The birth certificate and those contracts in child support court obligates him financially if he signs them. Which most people blindly do because they don’t have legal representation. If the father don’t show up in court he waive his rights. If he show up and refuses to sign those contracts I don’t think they can force him to pay until he sign.

I name is not on my daughters birth certificate and my wife passed away 18th of dec 2023. We had tried to get my name on it before and it did work. I had no idea how hard this was going to be. They asked for me to set up a court date and paid 350. to start. They have no idea how much this could cost. Right now it is just me and my daughter and I am shocked by this.

    My childs mother is not trying to let me see my daughter at all. Will not answer messages or anything. I haven't seen my daughter since she was a newborn and she turns 4 in September. I am not on the birth certificate because she lied and said she was waiting on it but just didn't want me on there at all. I did take her to court without a lawyer and basically the court didn't want anything to do with the case. Even though I proven that her mother didn't want to sign the affidavit. I did have a DNA test taken from a 3rd party but the court denied it because it came from a 3rd party. So I am just stuck and need to know the next step into actually being able to take care of my child and see her again. Thank you.

    So if i am understanding this right Men have to take an extra step after the child is born to actually have legal access to the child.

The child was born with in the marriage but it’s not the husband child, And in the State of Florida the law stated that no father can be added to the child birth certificate if the mother is married.

    • @royalty12
      @royalty12 Рік тому +2

      I don’t recommend signing any forms because they’re all contracts in which you agree to pay child support when you sign. Not sure if dna testing obligates you financially. But they will try to get you to sign a title IV- D form before taking your test. You are not required to sign that document but they’ll lie to you. Birth certificates and court contracts (IV-D and acknowledgment of paternity) obligates you to pay child support when you sign. I recommend you show up to court but don’t sign them, no matter what they say. It’s something fishy about those forms, they’ll try to have you quickly sign without explaining them or letting you read them.

      That's a great question, Elizabeth! If no father is listed on the birth certificate, the mother has sole legal rights and responsibility of the child. If the father expresses interest in participating in the child's life, he will be required to take a paternity test. Once paternity is established, the father will be listed on the birth certificate and he will have legal rights to the child. Hello, dilipghising9758!
      Thanks for reaching out. I can provide some general information. Please keep in mind this is not legal advice and communicating with me does not create an attorney client relationship. Feel free to reach out to us at 630.324.6666.
      Adding a Father’s Name to a Birth Certificate from Abroad
      When the father is in a foreign country, the process to add his name to the birth certificate is more complicated. In most cases, paternity must be established first whether the father is in the U.S. or abroad. Below are the steps and options when the father is outside the U.S.
      Steps to Establish Paternity Across Borders
      Voluntary Acknowledgment of Paternity (VAP):
      If the father agrees to be listed on the birth certificate, he can sign an Acknowledgment of Paternity form remotely.
      Some U.S. states (like Iowa) allow acknowledgment forms to be notarized abroad, usually through a U.S. embassy or consulate.
      Once signed and submitted to the state office, the father’s name can be added to the birth certificate.
      Paternity Testing (DNA Test) When the Father is Outside the U.S.
      If the father contests paternity or a test is required to prove biological parentage, the court or the state’s Child Support Recovery Unit (CSRU) can order a DNA test.
      When the father is in another country, coordination may be needed with foreign medical facilities or DNA testing centers. These facilities will send the test results to the U.S. authorities or the court.
      Court Action to Establish Paternity:
      If the father does not cooperate voluntarily, the mother may need to file paternity proceedings in U.S. family court.
      The U.S. court can issue an order for paternity testing and coordinate with international authorities or foreign courts if needed.
      The process may involve international treaties, like the Hague Convention on the Service of Documents Abroad, to serve the father with court documents.
      What Happens After Paternity is Established?
      Once paternity is established, the court will issue an order to add the father’s name to the birth certificate. If the father cooperates, his name can be added quickly through administrative channels. If paternity is established through court proceedings, the court will tell the vital records office to amend the birth certificate.
      What to Do Next Mother
      Contact the Vital Records Office:
      The mother should contact the state’s vital records office to find out how to add the father’s name to the birth certificate.
      She can ask if an acknowledgment of paternity form can be signed abroad and how to submit it.
      Coordinate with U.S. Embassy or Consulate (If Voluntary):
      If the father will acknowledge paternity, they can arrange for the form to be notarized at the U.S. embassy or consulate in the foreign country.
      File Paternity Proceedings:
      If the father does not cooperate, the mother may need to file a paternity petition in U.S. family court, even if the father is outside the U.S. A family law attorney can help with jurisdictional issues and coordinate with international authorities.
      Work with a Family Law Attorney:
      Since international cases are complex, the mother may want to consult with a family law attorney experienced in cross-border family law to make sure the right procedures are followed.

    Hi, my child father doesn’t want to sign the birth certificate, but I a set up a DNA test to be done. Is there a way that the father name can be automatically added to the birth certificate in Indiana after the DNA test is established?

    • @Learn-about-law
      @Learn-about-law  12 днів тому

      Hi, queenlauren7389!
      Thank you for reaching out with your question.
      In Indiana, if the father doesn’t sign the paternity affidavit the father’s name can’t be added to the birth certificate even after a DNA test confirms paternity. To establish legal paternity and get the father’s name added you must file a paternity action in court. The court can order genetic testing and if paternity is confirmed they will issue an order establishing the father’s rights and responsibilities. Then the Indiana Department of Health will add the father’s name to the birth certificate.
      Talk to a family law attorney in Indiana about your paternity case. This is not legal advice and does not constitute an attorney-client relationship.

    • @queenlauren7389
      @queenlauren7389 8 днів тому

      @ Okay, thank you. The court set up a paternity hearing. I just wanted to make sure his name would be added after that’s established.

    If both parents of the child go to child support court, and the father acknowledges that the he’s is his but the birth certificate is the same with only the mother’s name . So is this the same rights for the father as a married couple, since the couple isn’t married but had a long term relationship at the time the baby was born .

      team zabloxz you may have to talk that over with a lawyer there in JA. The laws will more than likely be different here in the U.S.

    My birth certificate has my dads birth date 1953 on my amended birth certifcate the same date as the date of his dads death 1958 I dont understand does that mean that my dad is not actually my dad or does it mean that I am fully adopted I found out today nobody told me anything about my life as a 26 year old so Im sorry of the question but the video said I can ask and whenever you can and if not thats fine I made an attempt to get my birth certificate this year for identity theft purposes but now I did not know as of today that I can use my amended birth certificate to find out about my family besides using a dna test 23&me

    I'm 49 and recently obtained a copy of my birth certificate and my father's name isn't on my birth certificate. My parents weren't married at the time of my birth, and in the state of Alabama you have to be married for the fathers name to go on the bc. Although I used my father's last name my entire life, the name listed on my bc is my mom's maiden name. My father passed away when I was 11, and I'm now trying to get a passport and my name is different from what is listed on the bc and what I've gone by. I need help getting my bc corrected? Please advise.

    I have a question, how would I go about getting the fathers name on the certificate if he is incarcerated? And if he is not present for signing the paternity?

      Water Boy yeah definitely love when people assume what they think they know what is happening, give your self a pat on the shoulder. Maybe next time ask what someone’s situation is before assuming, it, makes you look extremely dumb being single minded answering a question with a question.

      shes most likely trying to get welfare in order to get welfare you need the fathers name ... either or hes gonna have to be put into the system but what she doesnt know is the state and contractors profit from this system.
      otherwise you woudnt exactly need the fathers name for almost anything tbh

    Hey what if the couple is unmarried and the father doesnt want to sign the birth certificate, can the mother still put him on child support.

    • @twilightstar9973
      @twilightstar9973 3 роки тому +2

      No she cannot; don't sign the BC bro if you are unmarried, you'll regret it. If you get CS papers in the mail return it to sender unsigned via the postal mail system. Don't give CS any info on your bank* accounts or go into their offices for a discussion

      @@javierbaltazar5130 Depends on what state you are in; look at your "process of service" for legal documents in your state. Make sure that they don't do process of service by deputy* sheriff or to your job and only by mail. If your paperwork is served by mail only then don't open it and just write on the envelope "return to sender" and send it right back (you don't have to be honest to any US postal system at all); a CS case cannot be taken up against you unless you have been served correctly. If you live in a state that serves by sheriff or to your job and you cannot leave your current state then you need to prepare now; get an S-CORP* and LLC* set up and put your earnings into that so your money cannot be garnished if you know the baby is yours. I'm assuming you have not been to court and no DNA* test has been done??
