My example regarding the need for a Foreign Filing License in Malaysia applies to many other countries of the world, for example Italy and India. My understanding of Australian Patent Law is based on my reading of publicly available information at the Australian government websites IPAustralia www.ipaustralia.gov.au/international-ip/how-to-apply-for-ip-overseas and of the Australian Patent Act of 1990 www.legislation.gov.au/C2004A04014/2021-08-26/text. Based on these sources, Australian law does not generally require a foreign filing license for applications filed directly in foreign countries unless the invention was made under specific circumstances involving government contracts or where national security concerns are implicated. Please note that I am not an Australian patent attorney and you should read these sources for yourself to confirm. Consult a legal professional in Australia if you still have questions on this. Hello, John. Thanks for this new video. I have found it particularly useful because I live in Mexico and until now I was not aware of the existence or the need of a foreign filing license. My intention is to file an online provisional patent application at the USPTO. My invention does not relate to any kind of technology or sensitive information for my government. In fact it is just an improved cleaning device. Do you think it is still necessary to file a foreign filing license with the Mexican Industrial Property Institute? Are there any specific conditions or recommended best practices to include a method of manufacture in a provisional patent application? And how broad should be the description of this method to be meaningful and useful in an eventual licensing agreement negotiation? Best regards
