Does Insurance Company owe more money after paying for matching endorsement? EX: D&R items / Code?

  • Lets hear what you believe should happen in this circumstance. The right elevation had damage from a storm. The remaining portions had coverage extended due to a matching endorsement.
    Does that matching endorsement apply to the detach and reset items? Does it also include the code items?
    I believe that those items are not to be a part of the matching endorsement.

    I would want to see a copy of the actual matching endorsement, and also a copy of the code endorsement, to see if the coverages overlap or add additional coverage or just open up the option to utilize previously excluded items. It usually spouse out pretty clearly, and when it is gray that allows for us to make our best arguments. Still need the wording in order to know how to proceed. Thanks for the video

      DWELLING MATCHING UNDAMAGED VINYL OR METAL SIDING COVERAGE
      The terms of the policy apply except as changed by this endorsement.
      With respect only to the coverage this endorsement provides, changes are made to the following:
      SECTION I - ADDITIONAL COVERAGE
      The following Additional Coverage is added:
      Dwelling Matching Of Undamaged Vinyl Or Metal Siding.
      We will reimburse you up to the amount shown in the Declarations for the cost you incur to replace any
      undamaged siding (including soffit and fascia) with material and finishes in current use and of similar quality to
      match those materials that were used to replace siding damaged by a loss to your dwelling covered by this policy.
      This Coverage applies only if similar siding is no longer available to repair or replace the damaged portion of the
      siding on your dwelling.
      This Coverage:
      1. does not apply to mismatches caused by weathering, fading, oxidizing, or wear and tear; and
      2. only applies to vinyl or metal siding.
      We will not pay to match the siding on your dwelling to match the siding of any other structure.
      SECTION I - HOW WE SETTLE LOSSES
      Loss Settlement For All Covered Property is deleted and replaced by the following:
      Loss Settlement For All Covered Property:
      1. Except for the Additional Coverage provided by this endorsement, we will not pay to refinish, repair, or replace
      any undamaged property that does not match new materials used to refinish, repair, or replace damaged
      property.
      2. We do not cover any diminished value of any property due to mismatch between undamaged material and new
      material used to repair or replace damaged or stolen material.
      3. We do not cover any diminished value of any property resulting from the repair or replacement of such property.

      Thanks so much for this information. Well first off, this endorsement is annoyingly vague, and actually a pretty shity matching endorsement. That being said, I would feel confident making the argument that the siding itself which is visually seen, as in the outer shell, is what is covered in this endorsement, and it never mentions anything other than metal or vinyl siding and fascia and soffit. Especially when it takes the time to list fascia and soffit, it is reasonable to assume that other items aren’t listed. Then there is the fact that this endorsement is designed to “match the siding” anything under the exterior siding isn’t really a concern for match, like tyvek, and sheathing. I would say that then triggers additional coverages such as code coverage and then you need to see what coverage you have there, or even go further to say that the siding was code compliant when it was installed and any additional costs to have it be code compliant now isn’t actually under cover upgrades, because it isn’t an upgrade to keep up to minimum current standards. (That is a VERY difficult stance to take) but I remember you saying they have code coverage so not really necessary. I would clearly outline and separate the siding which falls under matching from any other items, and consider those necessary and consequential, like dominos falling one by one. I’d love to get your feedback on this.

      Great minds think alike. I feel strongly that the detention reset items as well as the code items don't belong under the matching endorsement as it is truly vague. I believe the code items are intended to be code only. I do agree with you that if they didn't have a matching endorsement I would position the claim under code coverage as it wasn't meeting the minimum code requirements.
      I'm glad there's others out there that truly know how to help their homeowners.

    Seems pretty clear to me. What is the “cost incurred to replace” the undamaged siding? If a bunch of fluffy D&R items are part of that “cost incurred”, you’ve got your answer.
