Should I be Concerned About the Hypothetical Questions the Judge is Asking the Vocational Witness?

  • You SSDI hearing date has finally arrived. You have been waiting for this day for months and you have prepared with your lawyer. Your testimony goes well - you answer clearly questions posed to you by your lawyer and by the judge.
    Now the judge is talking to the vocational witness. These questions refer to a "hypothetical person" who is the same age as you with the same work history and level of education.
    Each question contains what seem like dozens of parts. When responding to some of these questions the vocational witness identifies jobs that you (the hypothetical person) could perform. Sometimes the vocational witness says "no jobs."
    What does all of this mean? Are you going to win? to lose?
    In this video, I explain how hypothetical questions work and why the judge is asking them. I'll also tell you what to ask your lawyer to find out whether these questions represent good news or bad.

    I thought my ALJ was ridiculous. He asked me if I still ride a motorcycle, am I still trying to learn Spanish and if I drive to the store. None of those things have to do with my ability to maintain gainful employment! He's clearly looking for a reason to deny me.

    Had hearing December 22nd judge asked me several questions about my pain meds daily activities and side effects my treating doctor has already filled out an rfc on me after the questions the judge asked the ve 3 hypotheticals 1-2 was light work and sedentary work with little restrictions outside of climbing stooping crawling and hazardous fumes and weather jobs were found on both the 3rd and final hypothetical is the one that really added my limitation he added pain 20% off task and me missing at least 3 days a month off to that no jobs were found the judge then accepted the ve testimony asked my lawyer did she wanna object to ve testimony which she answered no i thought she would've tried to dispute the first 2 hypotheticals but she didn't after that the judge ended the hearing what do you think about the hypotheticals should i be worried about the first 2 hypotheticals that produced jobs or the one with the pain 20% and need of 3 days off???

    Just had a hearing my Lawyer didn't prepare me at all I just seen this video he didn't cross examin the VE the judge asked the VE if there are any jobs for someone that can't be around anyone more then 2hours out of the day and the VE said no there are no jobs that would be available for a full time job and the judge said that's it and my lawyer said ok bye. Does that sound like a good sign? Can I recuse my attorney

      Did you get a big box attorney? I messed up and did this and my lawyer did not prepare me for ANYTHING. He said just show up about 30 min early and tell the truth. Well I did just that and thankfully my medical history and I guess my testimony was credible enough because I got a fully favorable decision(Thank GOD) however it pisses me off to know that it was through no help of my lawyer that I won. I guess I should just count my blessings but I try to tell people on here who have not hired a lawyer yet to NOT hire a huge firm because they do not prep you before the hearing or anything. The lawyer didn't even look at my medical records before taking me on as a client. I realized that these big firms just play the numbers game, instead of researching each case and taking it on its merits. They figure the more they take in, the overall percentage of cases won will increase. So people still looking, I would definitely recommend a local attorney like Mr. Ginsberg. He will actually evaluate your case before taking you on as a client and you can obviously see all the videos he posts online to help people he doesn't represent as well. He has helped me learn a ton of information on here and I thank you for that Jonathan Ginsberg!

    Hello Mr.Ginsberg. I just had my hearing a couple of days ago. The ALJ stated to the vocational expert angrily 4 times. Hypothetically I could declare her disabled! And the VE did not reply. I am curious? Is that a good sign?

    The judge just asked me what happened in the year I became disabled and what date. Other then that few questions about past job expórtenles. Then to the vocational emploayee. He asked about 5 hypotheticals and the first 3 seemed like there where jobs but the next 2 where no jobs. He then on mentioned all the commodities records that he had received in the past 3 years. After that he asked me if I had any questions I said no. He then said wish your family well and thank you Anthony. I was kind of confused as I was expecting many more questions. I was there without an attorney.
    Anyone know what this hearing could mean?

    I just had my hearing 3 days ago (January 23rd) for schizophrenia. The vocational expert said I could work and gave 3 job examples. The judge then asked the VE 3 hypothetical questions to which the ve said no jobs. What does this mean for my case? Is my chances good or bad? I'm a paranoid schizophrenic and 23 years young

      I just had mine for the same mental disability on feb 16 the ve said there are no jobs I can do I am also 100% va disabled hopefully I get approved.

    Quick question my judge said I would be limited to light work no lifting above my head and only work 6 hrs with every 2 hrs 30 min break then they changed to working 4 hrs same work with 30 min break limited to being around people than the ve said there will be no jobs for that requirements but at 1st with for 1st set of rules there was 5,000 jobs I'm so confused

    hi I have been looking at your videos and I find them very helpful...the ve said that I can be a laundry mat attendant..and my lawyer cross examined her and got her to say I couldn't do it..is that a good sign? my lawyer thinks that I won

    What would cause the judge to declare a person not disabled even though the VE said that there were no jobs under step 5 that the claimant could do?

      If the judge does not believe those limitations exist. Basically if the judge thinks your lying

    I just had my hearing and the hypothetical questions all 5 of the jobs the vocational expert said no I could not do them. What does that mean for me.
