When I was in the military, I was pulled over, given a field sobriety test, and found to be intoxicated. The problem is that, not only had I not had a drink that day, I don't drink at all. Not even a little bit. Not even a beer a year.
While in college, I got to be a field sobriety class participant for a police department in Mississippi. We went to a hotel with 15 or so other college kids, had an open bar of top shelf liquors being served to you by cops, and got smashed at 10 AM. All to be walked into a class of officers that made you do field sobriety tests. It was one of the coolest/craziest experiences.
I have 3 personal rules I follow: 1) Drink at home ~ it's cheaper 2) If i am not home and I have a drink it's because i'm spending the night. 3) Only go to bars that are in walking distance. That's just me, but they've never steered me wrong.
...and what were you doing to have a cuntbitch run up on you jump out with her hand on her gun and cuff you like you'd just killed somebody. Police don't just run up on you and risk their own safety for nothing. You were asking for it somehow. I've had my own experiences with cops and none of them ever treated me horribly. I was growing pot one year (1990, and it was 4 plants) and somehow they were told I had a large grow operation. I pulled into my driveway one night, a cop car blocked me from backing out, and 4 guns were pointed at me. I had, and still have, a concealed carry permit and I was armed. I was cool as a refrigerated cucumber, I didn't act like a dick, and they never even put me in handcuffs. 11 cops and a DEA agent were in my house having a look-around. Meanwhile, I was talking to the guy running the show, and by the end of the night my 9mm was handed back to me . I drove myself to the station for a mugshot and fingerprints, and then I was handed an appearance ticket for unlicensed cultivation. They took the 4 plants, but none of my grow lights. They said that they had no room for them, so I could keep them. I talked to them like a reasonable human being, and that's how they treated me. I got a lawyer and none of it even went to court. They wanted nothing to do with my little grow. So, lets recap: 1. Never placed in cuffs. 2. My sidearm was handed back to me. 3. They treated me like a reasonable human being. 4. They never pursued any charges against me. My experience with cops is that they don't want hassles or the paperwork any more than you or I do. Be cool, don't be uppity, give respect, and that's what you get in return.
Lasse Hansen BAC is digital, it can easily be corrupted. Leave one in a car and it can go blank. FL BAC show to have 40% of there BACs read double, some Triple "from" the correct reading. Its by design BTW. Prohibition has been Repealed FYI. And police wonder why citizens choose pills instead. Police need to use discretion more. Even if Drunk, let them get a taxi or call. Why destroy lives for a beer (Talking to Police).
That's, not the solution. Weed is illegal and people do it anyways. Cars now days are pretty safe. Make Bar owners more accountable. If you allow customers to leave without knowing they have a sober drive they could be held accountable. Yeah, store owners wouldn't like it but if they allow people to get stupid drunk you should now not let them leave until they are sober and or have a sober driver. Or Officers should not have to deal with repeat offenders. Stiffen up the laws on repeat offenders.
JustJacob i have no idea I'm not a law maker. i don't know the best solution but something needs to be done with stiffer laws. if they arrive sober they should leave sober or have someone sober driving home
What do you think of the cop that would arrest people based on his suspicion that they might have used drugs in the past? In many of his cases, he never gave them a drug test, just charged them and cost them thousands in legal fees, bond, maybe they lost their job. Only for months or years later to have the cases dismissed. In the mean time, he got his award for most arrests. Should he go to prison and have his pension confiscated to pay back the people whose lives he ruined?
it'scalled quota- here tey hang around bars downtown and bust people left and right but yet let the ones that really need to be put in jail running in the other lane
ROTFL! I'd love for a cop to arrest me. I can use the money. Hint: If you aren't engaged in commerce, no cop in the entire US has any legal jurisdiction whatsoever to stop you let alone arrest you. The problem is, cops are never taught this fact. They think they can arrest anyone as they see fit. But as long as common law remains the Supreme Law of the Land in the US, cops can still be sued for everything they own in a common-law court!
@Jr ALEXANDER Actually, there is indeed a designated common law court... The Federal District Court. Which should NEVER be confused with the US District Court. They are not the same thing. The Federal District Court is strictly and solely a 'court of record' and is thus, a common law court in all 50 states. In fact, all 'courts of record' are common law courts, but not all courts are "courts of record." Only "courts of record' are common law courts while 'non-courts of record' are Administrative law courts. If you had actually been listening to Eddy Craig, you'd already know this important fact distinction.
@Jr ALEXANDER Look in local your phone book for Federal District Court. Or, if you're in California, all courts are 'courts of record' so any court is a common law court. Since all states are different, I can't tell you where all the 'courts of record" are located. But, if you call your local courthouse, the court clerk can tell you where the nearest "court of record' is in your state. But keep in mind. To open a common law court, YOU have to first file a claim in a 'court of record,' declare it a common law court. Do not assume the clerk, judge or any court employees will do it for you. They won't.
I got a DUI 17 years ago. First offence, no accident, no body got hurt etc. I went to alcohol and traffic education school for 26 weeks. The videos we watched and stories we heard were OMG. It's been 17 years and I still dont have a sip of beer and drive. Not even a sip. I can get wasted no problem but either take a cab or uber or stay at a hotel. I wish that 26 weeks course was a mandatory part of getting a drivers licence.
Ayratown A Navy corpsman told me a trick of his; get AAA+, and when you’re done drinking, if you don’t have a sober driver, they can put your car on a roll back truck, and bring you home. When you wake up the next day, your car is in your drive.
Higher Dimensions Open your hood. Unplug your MAF sensor or Fuel pump relay. Watch it not start. Tell them to shut the f*** up and just tie the car lol
If you presented your junk science testing of ocular motility to the American Academy Of Ophthalmology, they would laugh you out of the room. If anyone reading this has ever been charged with DUI based upon an ocular dexterity or pupillary exam performed by someone who doesn't have "MD" or "OD" at the end of their name, make sure your attorney hires an ophthalmologist or optometrist as an expert witness.
The point of this stuff is primarily to establish probable cause for further examination. These tests alone shouldn't be the only determining factor about whether or not somebody is under the influence. I get what you're saying about the eye exams, I'd likely fail them even though I haven't had a drop to drink in nearly 16 years. But, I've got some neurological issues that cause my eyes to jerk around abnormally. I got nowhere near 45 degrees on my left eye before it started to jerk around. IMHO, they shouldn't be able to bring DUI charges without some sort of blood test confirming that there's something in the defendant's system that would cause it.
You beat me to it. I was about to start rattling off a list of conditions that can cause nystagmus and dysmetria. Yes anyone with a MD/DO or OD is laughing at this.
Great video! I had a best friend from college test at .42 after he got to the hospital. He wasn’t driving, but he was found without a pulse and revived in a bathtub. Everyone stay safe!!
I am 14 years old and I have had a passion to become an officer since age 7.I am currently joining a training academy to later go strait in to the amazing job. You have very much inspired me to do this, thank you officer401
Love me some officer 401 content! Been in the habit lately of putting his videos on when I'm winding down to go to sleep after working the graveyard shift. If you're a cop, this guy can teach you something. For anyone who's not in law enforcement, he's doing a great job of bridging the gap between law enforcement and the public by educating the public on police related topics and being transparent. Keep up the good work sir 👊
hey guys are having problems. it will not only is this something I would be great if I could have done. it will be in a few years ago. it is a great day. it was the first to review the information. the only thing is to be a little more than a week or so. the only thing I
I am all for punishing people who drive under the influence but am I the only one here who thinks DUI checkpoints are RIDICULOUSLY unconstitutional?!?!? Love the content officer401. I'm glad to see things are still going along well after the face reveal! Keep up the good work
dennis reynolds they're not really looking for an accurate backwards alphabet, they're trying to see if you say letters wrong, slur your speech, and the king of all fuck ups... Saying "I couldn't even do this if I was sober"
About 10 years ago I went out drinking with my ex and her sister and brother in law. Her brother in law was and still is a detective. He had some officer buddies along with. All of us got completely hammered and he drove the four of us back to his place while the other officers took their vehicles home as well. It was a real eye opening experience that made me realize we're all human and all do potentially horrible things, but some just get away with it while some don't.
The tests after the stop is made are called 'field sobriety tests' to determine 'probable cause' to bring you in to test you on a machine that is certified at least once a year, and cannot be tampered with. You are tested twice and the machine is purged with ambient air in between, about 5 minutes at most, this even gives you a slight chance of sobering-up enough. This is the result that is used to either incarcerate you or let you go. If you are arrested this is the reading that will be used for your conviction.
Interesting how different it is to Australia. Over here they just test you for drugs and alcohol with a roadside breath test. Only takes about 30 seconds to qualify or fail. I prefer it as a civilian because it comes down to a scientific test rather than someone's opinions based on training. I don't think either are infallible but I put my faith in science. Peace.
Go0se I agree 100% but you have to remember they're not stray Leah those cops are probably decent people who aren't on some weird freaky Power Trip that if they don't hurt somebody everyday they can't get a bonerperiod in the US it's different they all want to be Killers when they shoot someone on duty they give him a card that you ride with the number 2 and if the person died they get a black one they're encouraged everyday regularly to maim mutilate and hurt people they steal property phones computers and money and in America police cannot be trusted
That's what's up bro if I got hella messed up or something happened even if the officer thought I was dead I would still want him to try and save my life I give you props for that keep doing stuff like that for real. Ty
Yeah that's what's up. So the scumbag can write you to tickets in the future. That and the media hype making him out to be some kind of hero are the only reason the narcissist traitors save lives. You assholes are so blind you really can't see these people are the reason our Country is on it's last breath. The Police are our last line of defence between overzealous corrupt politicians and Unconstitutional legislation. They've failed miserably!
I'm a Sheriff's Explorer in Forsyth county Post.975 we are one of the oldest Explorers post. Just wanted to know when we are getting an Explorers video.
I have 3 DUI’s on my record. First one was when I was 19 years old, I blew a .02 but was charged with DUI because I refused to do a urine test. The second DUI was when I was 21 or 22 years old, I blew a .38 and I wasn’t even mad that I had been charged because I was blacked out until the seen the cherries n berries and I had no business driving. My third DUI was when I was about 25 years old, I had drank about 3-4 mixed drinks of bottom shelf liquor and 1 shot in a 3 hour time span, I knew I wasn’t good enough to drive so I hung around the bar shooting pool drinking water for another 3 hours. I no longer felt the affects of alcohol so I decided to leave, got about 300 ft down the road and got pulled over, did all the field sobriety test and I blew a .10. After 2 DUI’s I was actually trying to drink responsibly but the officer didn’t see it that way. Lost my license for 3 years from that one so when I was finally able to get my license back I decided the only way to guarantee to not get a 4th DUI (because that would be a felony) was to quit drinking entirely. It’s been almost 7 years since my last DUI and I’ve only drank a hand full of times since then, I’ve been completely sober now for almost 3 years. I didn’t quit drinking from doing rehab or drug and alcohol classes either, I quit using will power and because I was tired of being a loser with no drivers license and I was tired of spending thousands of dollars on legal fees, fines and partying. I haven’t even had a ticket since my last DUI and I’m doing much better financially.
The issue with the shaking pupil test is that I was given it while at home and I have serious anxiety issues causing all of my body to shake, especially when not on my meds, and I failed because I had no meds or anything in my system.
@@punker4Real except they do she still has a license and she still drives because her seizure are controlled, as long as they are controlled they do not revoke licenses. She hasnt had a seizure in years. It just did damage when she was having them
got into a conversation at work with CHP officer about how to know if you are above or below permissable limits to drive. He said if you have to ask you probably are above the limit.
Hey Officer401. Here is a question. So when a school bus has its red lights and stop arm out. Does an emergency responder that is responding to a call have to stop when it approaches the stopped bus?
Andrew P we are expected to obey all traffic laws even when responding to an emergency or in a chase. We are exempt from speeding but we are technically supposed to stop at red lights and stop signs. We can pass cars but only when safe. But we have to be safe. If I run a red light and kill someone it's on me. Hope this answers your question. I would also say it depends on the call. If one of my guys is getting shot at. I'm probably gonna break a few laws getting there.
As a School Bus Driver, here is my Policy with my Bus, anytime I hear a Siren sounding, even if my Red Lights, and Stop Arm are Activated, and functioning, I hold all of my Students on my Bus until I figure out where the Siren is coming from in relation to where my Bus is. If I can actually see the Emergency Vehicle that is sounding the Siren, and it's coming either toward my Bus or approaching from behind, I immediately turn off my Reds, and close my Stop Arm, and allow that Emergency Vehicle to pass, along with any others that may be following it as well. I only reactivate my Reds and Stop Arm to either Discharge or load my Students after the Siren from the Vehicle is no longer audible. I always give them full right of way, because we never know who they are going to the aid of, and it may be someone we know.
Thanks for the info. Though I am not an LEO nor will I ever be one, your insight makes me appreciate the job that you do even more! I look forward to watching your videos since you picked up a new subscriber here in Dayton, Ohio. Thank you for all that you do and please, be safe.
Mostly, when a person is truly intoxicated, they don't really care what tests they are doing and just wish to be done with it...There are SOOOO many times when someone states, "Can't you just go ahead and arrest me because I already told ya that I'm drunk, you saw me leaving the bar at two in the morning, I can barely stand, I was urinating in public? You asked what I was doing and I told you that I was taking a piss and that I would respond upon finishing. You broke into insane laughter with the understanding that we had been betrayed more so than they. Besides, I would fail regardless of sobriety."
I don't know the percentage about that...It works both ways and if many of them were given the tests the way that you do not see in a pre-staged short video, then yes...many (if not all) would fail...Some of them knowing that the person does not have weapons is sick or relatively harmless will rest their hands on their weapons for intimidation and usually after several stops and/or a few arrests over a few weeks or months...It continues and while some of them have the chance to make a positive change for some, they refuse and then try to recite the laws again to us...
Then politely show up and take one for free on video as it is truly given by the majority of police and we'll see how you do...The people will not be known to you so that form of cheating will be void. The people will also be aggravated somewhat at shuffling paperwork all day and discovering how many lives were and are being ruined. Those giving the test will show up in two or three pairs and each will allowed to have holsters unsnapped and tapping their weapons or resting their hands on them...You will also be allowed to see two or three of them circle to somewhere behind you. Car headlights will be glaring at you with brights on...Let us know.
I'm not proud of this but I drank fifth of whiskey got pulled over and passed the field sobriety test. The only thing the officer that gave me the test is that my right eye doesn't go up and down like my left eye does. Now I know for a fact I can't do the walk and turn sober but, back in my drinking days I could do it fine while drunk. The difference between me and others is I know i'm drunk and how drunk I am. Long story short I do not drink anymore.
Funny I did the walk and turn after getting pulled over and my illness was acting up and I couldnt do it at all. I was 100% sober just a illness I have. But even tho I blew nothing since I couldnt do that test they revoked my licence for 2 years. That test needs to be removed. It's unfair to people who have balance issues while walking. Tho I think I should have stayed home that day but I wanted to meet up for friends for the world of warcraft expansion launch party downtown. :/
Precisely, I have heard of numerous cases such as yours where illness or someones metabolism makes it appear that they are impaired. You should have hired the best attorney in town!
Kyle I figured somebody was going to bring that up. I have mixed feelings about them. Do I think they are unconstitutional? Absolutely. The fact that you are illegally stopping someone is not a good thing. But I can speak from experience when I say that I have been apart of dozens of road safety checks. Every single one of them we end up with at least five drunks in custody. Most Road checks are only about an hour long. Imagine if one of those people would have kept driving and killed someone. Is it unconstitutional? To me, yes. But is it worth it? Yes. that's a tough question.
You're oath was to uphold the constitution. Why participate in something that violates the 4th amendment? I don't think an oath means anything to anyone. I took one as a nurse and live by it no matter what.
Police departments should have a community fund for those who end up over-intoxicated & a hotline to call an Uber to take the drunk person to an in-town home. It would save a ton of lives!
They have no interest in public safety or helping anyone these days. Used to be cops would give you ride home or follow you to make sure you got home safe. It is all about revenue and lowering the legal BAC creates more targets while those seriously impaired do not drive and thus are not subject to arrest. If you are drunk you can be arrested he moment you step out of the bar:public drunkenness. Catching you driving pays their system. Police should be drug tested once a month and audited by IRS yearly. If they have nothing to hide they have nothing to fear.
I had no idea what this video was about, just curious. But I must say your professional approach of trying to help people is wonderful! But, I am really just trying to point out the mere fact that if we had more cops like you there would be MUCH more appreciation for law enforcement in general! Keep up the great work, and thank you for trying to make the world a better place!
I was watching Cops and the officer had pulled someone over and gave them the walk the line test, I tried it sober and failed, I'm glad I don't drive or drink.
Too many officers are corrupt ass holes. One officer was busted for having 130 false arrests in ONE year! I, personally, even though I don't drink, would NEVER take a field test! It's about 1 in 4 chance you will be found wrong, even if you are completely sober.
Officer in Georgia, thanks for the blog you posted. IT was very informative. You gave a very excellent presentation, thanks. Pa. I know there are differences. It was nice hear a cops explaination.
I want to thank you for your openness and honesty, for your offering to stand in the way of harm to protect another person with your own life at risk. I offer my condolences for the horrible things you have seen and been through. I hope that it doesn't harden you too much. I have known, and know many good cops/people who act ethically and morally. I've also known those who were hypocritical and over zealous, even vicious. You are the former, and I pray you stay that way, and that you retire intact and live a peaceful life. And stand by your words and convictions. When you are not an officer, you are a citizen. What you work for on the job you may have to fight for later. Best wishes
I just watched a special on a D.R.E. officer that was being used to convict by testimony. While the department was shelving lab tests conflicting his testimony.
I volunteered! It's freaking great. Blew .82 after 8 beers on an empty stomach and blew a .7 30 minutes after stopping drinking.... I now believe .8 is too high. We need to lower it
Field sobriety and PBT is not admissible in court. It just gives the officers enough reason to do a breathalyzer or blood test which can be used in court.
@@motoxguy7 Maybe in the sense that he officer can talk about his investigation and what led him to use a Breathalyzer or blood test on the suspect. I worked at a jail and we did use the PBT to determine the level of intoxication of inmates. They had to be 0.02 or lower before they could bond out. We didn't share any of this information with the court.
Jason Hochman 👍. The FST or SFST (depends where your from), the PBT or PAS device, HGN, along with a bunch of other little “tests/observations” are simply used to confirm the effects of alcohol. The most critical part of a DUI is everything that happens....BEFORE these tests. Articulating impairment; most easily done with the ol’ dashcam. Basically, if you can make it in to UA-cam....your probably already gonna get convicted. Most states utilize 2 separate vehicle codes; 1 for impairment and 1 for “the BAC number”.....blah blah blah. You don’t need a sermon on this and football is on TV. Gotta get back to my BEER!
you should do a video on the ATF. i am not sure much about what they do, and if you know it would be cool hearing an explanation. also if you have had any past experiences or encounters with them, that would be cool too.
Can you do a video talking about how you like people to pull over after you hit your lights, in all the different scenarios like heavy traffic, interstate, roads that don't have an emergency lane, etc.
Bud Hobbs I wish he would do this. Any time a cop gets behind me on the highway I FREAK out because I feel like if I pulled off the next exit he would think I was trying to evade him lol
@@0xsergy not to sure about that. I tried pulling over in a safer place for the officer, and he gave me crap about it. I even told him i was just trying to help you stay safer bc there was basically no shoulder and it was night time. But hey I tried.
I basically took aride as an addict looking at other addicts, now I can walk thru the mall and tell you if people are high and what they are high on, I’ll be the best parent I’ll know exactly what they’re doing lmao
Many places still have subjective laws that can still be used against you based on officer opinion. If you can't prove bad faith either, one false delay or word will often be enough for the DMV to take your license for a year even if no criminal charges are proven. Sometimes you are just on the end of their bad day and it is incredible how easy a technical signal violation is used when nothing else. They (in this state) are not required to tell you why they stopped you. They are not required to inform you of the right for their warrant requirement for blood draws (they will coerce you with the civil matters until you bend or make an error), they are allowed to select the chemical test even if you have a medical condition (famous PA case of a diabetic with blot clots in the arm that suggested a different test still lost his license by DMV standards because it isn't his choice of chemical test, its the cops [note the dmv is a lot of retired cops in charge]) even if it is medically dangerous. The cops are not viable, and they have ruled against liability against medical professionals complying as they too can be in trouble if a blood draw is ordered. Until you realize the mountain of problems, you fall into that trap of believing cops never seek easy targets. Doesn't help the fact the system is essentially useless to prevent the general public from knowing YOUR record, but good luck finding provable times the justice system wiped itself clear. You do realize, it wasn't until this summer that PA cops couldn't have sex with those they were interrogating or investigating? They literally robed hookers because paying them meant they could arrest them. Stop feeding into the nonsense until you get a grip on the insanity of criminal procedure vs civil that doesn't agree, and there is no one to ask. I can't even find the reason to submit a perjury complaint (specific and articulate fact never proven (an item) that altered a case through the removal of my ability to use an affirmative defense. Mind you, it was on footage they could just ask for. Hint - they made the sworn fact and they also could obtain the evidence. You really expect most lawyers to successfully obtain the information from a store that relies on the police when robbed? Read up on the problems of the system before you simply become the naive idiot that could have avoided thousands upon thousands simply proving something the DA could have reviewed dash cam footage for - knowing they will likely get you to plea out because of how hard it is to prove you are innocent. FYI: meds with inactive metabolites that have long half lives still are fully able to sentence you for the highest level of DUI. The metabolites doesn't prove intoxication is one expensive fact to have to raise in a system that knows it already yet don't care. May you never live in a poor area with cops that grind axes all day.... I still cannot believe it took this long to outlaw cops robbing hookers.
@@Samuel-I you do realize actual poppy seeds vary greatly in their ability to cause that issue? It also depends on what all metabolites exist that can be tested to rule out the chance it was poppy seeds? Each type of testing makes assumptions. 4am is indicative of heroin. 20 mins about in the blood, or much longer in the urine. Morphine in blood that is detected as a later metabolite can be problematic to determine if someone is taking morphine tablets, or its the result of heroin. Riddle me this. Why should the state say you cannot refuse a chemical test, and not allow the noninvasive test to be used? Why should the request be viewed as a refusal when the form itself lists both under the umbrella of chemical testing. If one isn't as good as the other, that seems inherently problematic. anything else I can enlighten you on?
@@Samuel-I plus here is another funny thing. you know MADD? they spend more money simply to gather more money than in any other manner. As an organization, they have become pretty dirty. Take in large car manufacturer donors in exchange for avoiding any topic regarding safety risks (takata is also a huge sponsor) other than alcohol. They refuse to talk about cellphone use, other distractions, safety flaws etc. It isn't because of one topic focus, its the agreement they make with platinum donors.
I'm new to your channel Officer401. Not a cop. Just a citizen. An older and getting older all the time, citizen. I've never had a DWI/DUI mainly due to the fact that the last time I drove even slightly chemically altered was about 30 years ago. However, some of your descriptions of Nystagmus, I actually have that impairment or condition normally, where my gaze stops and starts or halts.I have autoimmune disease(s) and conditions that effect the way my eyes react to light. The eye diseases are iritis/uevitis. I have had four eye surgeries and lens replacements due to early onset cataracts. My vision is corrected for the most part with lenses. My ophthalmologist's intern caught the Nystagmus and asked him "why due my eyes seem to stop and snap to the next point. I don't have the really aggressive Nystagmus vibration. It's more like how you are describing a drunk's eyes my react. I also have on pupil larger than the other due to scaring of the aperture of iris. As to my feet, I have neuromas in my feet that cause me great pain and difficulty walking. Oddly enough I can still drive, but try not to drive after dark due to photosensitivity. On coming headlights can be really painful. I should add I've never been pulled over for suspicion of DWI/DUI either, but I'm not dead yet. What would you suggest I might say to a trooper if I should get pulled over? Based upon some of the these you explain here, I might failed such and exam. Cheers!
He explained in the video that you can pass a breath test while still driving under the influence. The breath test measures your blood alcohol level, but does not measure whether or not you have recently done drugs of any kind. It is also illegal to drive a vehicle if you have not slept within 24 hours
In Sweden the legal limit is 0.02, with a steeper penalty above 0.1. The small breathalyzer is used for screening, and if someone is above the legal limit, and don't confess to the DYI at the roadside they get tested by the Evidencer at the station. No looking at eye-movement or walking on lines.
Mr Paulinho 78 unfortunately I have to work evening shift tomorrow so I'll be at the office until after midnight, which is why I wanted to get the video out today.
The walk and turn its a very very bad test. It is difficult to explain and even more difficult to perform under stress when not intoxicated. That shows a test that is designed to produce failure not produce significant data to determine intoxication. I like you officer 401 and I wish more officers held your level of professionalism but it's sad that you regard the walk and turn test as valid.
I have an honest question for you about the One-leg Stand and Walk and Turn tests. How does a person with disabilities handle being asked to do these tests when they know they will fail sober? I have disabled parking license plates and I carry my medical paperwork with me at all times in my truck but I'm curious about how to explain to an officer that you have this condition without appearing to be lying about it?
The officer is likely required to ask if you have any conditions that might be a hindrance to completing the tests. It's not necessarily going to help you on the side of the road but may help in court. Also, there is another battery of test that are conducted while sitting. I used these most often because I dealt with folks on boats and that screws with balance.
Chris Ofsthun. Here in South Carolina we ask if you have medical problems that would hinder one in performing the test. The officer would take that into consideration.
I have balance issues after having a messed up leg back in 2013. Officer asked me to perform that test and I looked at him, laughed and said yea that's not going to happen. He asked why, I said my legs messed up, he said prove it. Lifted my pant leg, showed him the scars and even he went holy shit. Honestly a good officer.
You are not required to take roadside sobriety tests. You must submit to breath or blood if you admit to drinking or if the officer has reason to believe you are DUI.
Chris Ofsthun they beat u til u loose consciousness. Next, they lock u in a small room with sexual predators wanting to violate u. Then they give u a green sandwich. U give that sandwich to the biggest bad ass in ur cell or he will beat u unconscious. Next, u pay a lawyer to do nothing for u. Then u pay a judge to order u to attend classes u pay for. The judge also takes ur licence making it challenging to pay for all this. Don't worry, insurance companies make $ off u too. U get to pay for high dollar insurance even when u can't drive. Drinking and driving is a sh*t thing to do. Problem is they make limit too low. Check points unconstitutional. Keeping true drunks from driving is a valuable service. Making it a source of revenue is a dis service. I hoped this helped!
This is my first video of you that I see and I’m very impressed! Thx for all the information, it’s great to know the how and why of this stuff :) Also you’re a very cool sounding guy, I like how you see no point in doing the line walking test on a guy (or gal) you already are confident they are drunk and expose them to falling and injuring themselves... these videos show us there’s good guys in the force, it not all made up of the bad stuff we see in UA-cam
Just about 'everything' described in this video will result in sane, healthy, totally sober, ... but probably most people over *60-65 years of age* to be falsely and mistakenly arrested.
What is the functional difference between .1 and .08? Even though I don't drink anymore even I feel that lowering the bac was more about politics and increasing revenue than saving lives. It just keeps people from drinking at all and is prohibition by inches.
Drinking is a testosterone destroying, brain-weakening poison, anyway. I mean, to each his/her own, but I don't see why it's so popular, other than the fact that in 'ye olde times', the water was even worse, so alcohol insured you didn't get brutally sick. So while the morons in office try to shit up the 2nd Amendment, the one thing people fought over was back in the 20's over their right to poison themselves. Real bright people...
Prohibition gave rise to organized crime. The Kennedy (JFK, Bobby, & Ted) family's fortune was made by their father, who was a rum runner, bringing in booze from Canada to the US by boat.
The difference is that organizations like MADD go out of their way to constantly get the legal BAC lowered. Joe Rogan did a podcast with a guy named Mike Smith (I think) who is a defense attorney and he goes into why basically all these roadside tests are complete bullshit. These tests were designed when the legal limit was closer to .2 and when they lowered the limits down and down and down to .08 or .06 they never changed the fucking tests. They didn't even change the data. They just said these tests, that are supposed to start working around .18, are magically valid at levels much lower than that. This is something that every DUI attorney knows and almost no police officer knows....
Depends on your state's laws and how much you had to drink. In my state, failure to comply with the tests results in a mandatory loss of license for, I believe, 6 months. Definitely better, from a loss of license, fine, and insurance rate standpoint than failing the test and being convicted of DUI, but still pretty bad. I would say that it is usually best to refuse the tests only if you KNOW that you will fail, as a good lawyer may find a procedural or other issue that could help in that case, but this is much more difficult to do when the police have more information regarding your level of inebriation that you willingly provided. A personal anecdote - I made the mistake of leaving my high beams on while passing a cop on the way home from a friend's birthday celebration, which was held at a bar, and was pulled over for this mistake (wasn't speeding or anything else). I then admitted to the cop who pulled me over that I had come from a bar that I had been at for at least 3-4 hours and had about a drink an hour (he asked where I was coming from/going - probably a mistake to admit that, in hindsight). I knew that I was sober, so took the roadside test, apparently passed (I recall doing just fine, although hard to say how well I did on the eye shake test, given my perspective), and was released without issue.
You are right, I misread. It is the failure to submit to a *chemical* test that triggers the penalties I mentioned. Sorry about putting bad information out there/thanks for calling me on it.
I have a medical condition. MS. It causes me to have slurred speech and some visual impairment but I can still drive just have to compensate for it. Like don’t drive after dark or allow more space to stop and turn the vehicle.
Dustin Gautreaux me too, except I was being given the field sobriety test. Seemingly, everyone was being given the test on this certain night.
jrn00498 lmao
thatallredheadude yep! Hail State!
They should have gone through the entire arrest procedure (joking)
Dustin Gautreaux hotty toddy😂😂😂
I have 3 personal rules I follow:
1) Drink at home ~ it's cheaper
2) If i am not home and I have a drink it's because i'm spending the night.
3) Only go to bars that are in walking distance.
That's just me, but they've never steered me wrong.
Same.
...and what were you doing to have a cuntbitch run up on you jump out with her hand on her gun and cuff you like you'd just killed somebody.
Atouk Thats just one example. Doesn't mean anything. Some cops are just assholes, some are not.
M D J well if it works it works actually sounds pretty good
I have 1. Don't drink.
I came home one night and a female officer was in my bed. She was working undercover.

I hate DUI/DWI with a passion. One of the most preventable tragedies to the most innocent of people
Stay safe Brotha!!!
2LateIWon/Organized Chaos
Ban alcohol & make cars safer
That's, not the solution. Weed is illegal and people do it anyways. Cars now days are pretty safe. Make Bar owners more accountable. If you allow customers to leave without knowing they have a sober drive they could be held accountable. Yeah, store owners wouldn't like it but if they allow people to get stupid drunk you should now not let them leave until they are sober and or have a sober driver. Or Officers should not have to deal with repeat offenders. Stiffen up the laws on repeat offenders.
2LateIWon/Organized Chaos
So you're implying that we should hold third parties responsible for the actions of one individual?
JustJacob i have no idea I'm not a law maker. i don't know the best solution but something needs to be done with stiffer laws. if they arrive sober they should leave sober or have someone sober driving home
2LateIWon/Organized Chaos don't bar owners in some states already have to cut you off and not let you leave
“I’ll just volunteer at home every night” Best cop ever
Hint:
If you aren't engaged in commerce, no cop in the entire US has
any legal jurisdiction whatsoever to stop you let alone arrest you.
The problem is, cops are never taught this fact. They think they
can arrest anyone as they see fit. But as long as common law remains
the Supreme Law of the Land in the US, cops can still be sued for
everything they own in a common-law court!
I vote for prison.
@Jr ALEXANDER
Actually, there is indeed a
designated common law court...
The Federal District Court. Which
should NEVER be confused with
the US District Court. They are
not the same thing.
The Federal District Court is
strictly and solely a 'court of
record' and is thus, a common
law court in all 50 states. In fact,
all 'courts of record' are common
law courts, but not all courts are
"courts of record." Only "courts of
record' are common law courts
while 'non-courts of record' are
Administrative law courts. If
you had actually been listening to
Eddy Craig, you'd already know this
important fact distinction.
@Jr ALEXANDER
Look in local your phone book
for Federal District Court. Or,
if you're in California, all courts
are 'courts of record' so any
court is a common law court.
Since all states are different, I
can't tell you where all the
'courts of record" are located.
But, if you call your local
courthouse, the court clerk can
tell you where the nearest
"court of record' is in your state.
But keep in mind. To open a
common law court, YOU have
to first file a claim in a 'court of
record,' declare it a common
law court. Do not assume the
clerk, judge or any court employees
will do it for you. They won't.
Never take a roadside test. Never ever. Always say you want the blood test at the hospital. ALWAYS. And then call a lawyer.

I had to watch two hours of videos that explains how drinking and driving in Texas they strongly require it
GunGuru AAA has gotten wise though. If you're drunk and just looming for a ride they'll refuse you.

Plenty of people still being charged with DUI even after blowing a 0.00. Apparently, cops no longer need evidence to charge a DUI.
The pupil size difference thing is a real sign of serious brain injury.
He did say he doesn't use in court only as a gauge to see if more testing is needed.
Great video! I had a best friend from college test at .42 after he got to the hospital. He wasn’t driving, but he was found without a pulse and revived in a bathtub. Everyone stay safe!!

If you are arrested this is the reading that will be used for your conviction.
lol when he started about the eye twitching my right eye started twitching.
Peace.
Same in Canada. If they fail they are given a blood test.
How can you test for drugs in a breath test? Alcohol, yes. Drugs? Also, a person in the US can refuse a breath test
Cranky Grandma if you refuse they take your license tho.

Hey Officer401. Here is a question. So when a school bus has its red lights and stop arm out. Does an emergency responder that is responding to a call have to stop when it approaches the stopped bus?
Andrew P Good question... I hope detective401 makes a video explaining this.
Honestly doubt it bc sirens are VERY loud. Also police they're cautious just ride thru it slow and there won't be a problem.
Thanks. That what my dad was saying he does with his bus.
Officer 401 and Donut are awesome/ Thanx!

Still can't figure out why anyone would agree to do an FST. It's solely designed to generate PC for an arrest.
Kinda late but in my state (New Jersey) if you don’t agree to it the law says your automatically drunk for refusing
Excellent content. Thank you. Stay safe.
there is no way any sober person could pass all these tests roadside...designed to fail favors the officer 95-1
Chad Valentine Really, they think they are doctors now that they took a course and fit to examine people, give me a break,,
Chad Valentine: Hey stupid! Where did you learn your math to figure out those odds? Kmart😨?, dumb shit!
Chad Valentine the eye tests are easy to pass if you are sober...
So are the coordination ones.
I love watching this channel! Very informative, keep it up! :)

Can you speak on your thoughts about DUI checkpoints. I know there is a lot of controversy about them and i'd love to hear your thoughts on them.
So illegally stopping people doesn't matter?
You're oath was to uphold the constitution. Why participate in something that violates the 4th amendment? I don't think an oath means anything to anyone. I took one as a nurse and live by it no matter what.
Think of it this way Uber is cheaper than DUI!
Police departments should have a community fund for those who end up over-intoxicated & a hotline to call an Uber to take the drunk person to an in-town home. It would save a ton of lives!
@Crawford Hogan Ouch
If they have nothing to hide they have nothing to fear.
cravinbob your dumb
This video is so interesting!like it a lot!
I can't do a one-leg stand sober because I have bad ankles. I start wobbling almost immediately.
Respect that you’re pretty straight up in your videos, you’d fit right in with cops 40-50 years ago.
Destined to Fail.
Wow, interesting. Glad I don't drink. Thank you for sharing your expertise!! Stay safe out there & thank you for all you do!!
Best wishes
They're having us fold fitted sheets to test here in California!
John Dicus lmao
Lol, I just do the roll method, 🤣🤣🤣
YOU, volunteer to fold those sheets.... there's this thing called the 5th amendment.
Officer 401, as a civilian, what do I do if I know the officer is drunk?
Officer: Have you been drinking?
You: No have you?
I just watched a special on a D.R.E. officer that was being used to convict by testimony. While the department was shelving lab tests conflicting his testimony.
Thanks for sharing the info man
I volunteered! It's freaking great. Blew .82 after 8 beers on an empty stomach and blew a .7 30 minutes after stopping drinking.... I now believe .8 is too high. We need to lower it
.8 is too high lol maybe they should change it to .08
Field sobriety and PBT is not admissible in court. It just gives the officers enough reason to do a breathalyzer or blood test which can be used in court.
......so then it is admissible in court🤔
Just go to the next exit, or wait for a traffic cutout. Most cops will prefer this and would probably thank you.
@@0xsergy not to sure about that. I tried pulling over in a safer place for the officer, and he gave me crap about it. I even told him i was just trying to help you stay safer bc there was basically no shoulder and it was night time. But hey I tried.
Lotta good wisdom there. Helpful. Never saw ur face.
I basically took aride as an addict looking at other addicts, now I can walk thru the mall and tell you if people are high and what they are high on, I’ll be the best parent I’ll know exactly what they’re doing lmao
And this is the best reason to not submit to a sobriety test on the road.👍👍
Pro tip
Just don't drink and drive..
@@trumpet12345
Damn those poppy seed bagels.
Have you ever pulled over one of your subscribers?
Cheers!
Thanks for the information, I wish all cops communicated as well as you.
What if I'm just tired? You should watch some of the videos where the sober women went to jail even after passing a breath test.
He explained in the video that you can pass a breath test while still driving under the influence. The breath test measures your blood alcohol level, but does not measure whether or not you have recently done drugs of any kind. It is also illegal to drive a vehicle if you have not slept within 24 hours
I'm I the only one drinking and watching this?
crissy dumeny yea I got me a glass of water
Nope
crissy dumeny
Im drink too. Lol!
crissy dumeny ironic
Chrissy...I hope your driving also ! ! !
No thanks officer, I don't answer questions and I'm not performing like your trained seal
Thank you for the honesty! ! I know your catching crap but again thank you...ride safe...
Will you do a 4th jully special or something like that?
Thx for all the information, it’s great to know the how and why of this stuff :)
Also you’re a very cool sounding guy, I like how you see no point in doing the line walking test on a guy (or gal) you already are confident they are drunk and expose them to falling and injuring themselves... these videos show us there’s good guys in the force, it not all made up of the bad stuff we see in UA-cam
Just about 'everything' described in this video will result in sane, healthy, totally sober, ... but probably most people over *60-65 years of age* to be falsely and mistakenly arrested.
CDL drivers have a .04 bac while driving a CDL vehicle only. While in their own car it's .08, if I'm correct?
Not in MA
You are correct
Benson .03 here
we've had a lot a drunk semi drivers in this state
Yes
.06 here.
What is the functional difference between .1 and .08? Even though I don't drink anymore even I feel that lowering the bac was more about politics and increasing revenue than saving lives. It just keeps people from drinking at all and is prohibition by inches.
Right on point!
The Kennedy (JFK, Bobby, & Ted) family's fortune was made by their father, who was a rum runner, bringing in booze from Canada to the US by boat.
jnzkngs You don't get a .08 BAC from 1 beer dude. Having a BAC as low as .04 can impair one's driving.
Never perform a roadside impairment test ever!
Hogwash. You have to submit to breath or blood tests only.
You are right, I misread. It is the failure to submit to a *chemical* test that triggers the penalties I mentioned. Sorry about putting bad information out there/thanks for calling me on it.
Thank you, Officer. Interesting information.
I have a medical condition. MS. It causes me to have slurred speech and some visual impairment but I can still drive just have to compensate for it.
Like don’t drive after dark or allow more space to stop and turn the vehicle.
You're easy prey for them.
