Any persons falsely arrested should be compensated for legal fees, lost pay, pain/ suffering, and any other damages received from the arrest and related actions. I can’t believe that is not a state and federal law.

Someone called for an ambulance but the cop came first. 🙄 At that point I was sitting in the drivers seat with the door open and trying to get my bearings. The keys were around my wrist. He was a “drug recognition expert “ and said I seemed “under the influence “ because I seemed “confused and dazed”, no shit, I just had a seizure. Had another and was sent to the hospital. Come to find out that while unconscious they took blood AFTER the ambulance/ER medicated me. So yup, dui right there.

Realistically the possible consequences of the two are completely different. You messing up an order probably has 0 chances of causing a death whereas a police officer messing up a DUI arrest could end up with someone dead. Honestly and I'm probably going to catch a lot of shit about this, I'd rather see an innocent person arrested in error for a DUI than for someone who was actually impaired be let go. Too many innocent people lose their lives to impaired drivers every year and I'm thinking that number far outweighs the number of innocent people arrested in error. Unfortunately until there is some form of roadside testing available for drugs this is going to keep happening, but I think things definitely need to be changed with how the cases are handled until test results are received. The police doing the testing need to be completing the full tests not just stopping when they think they've detected impairment. They need to come up with a system where the arrest isn't recorded anywhere publicly accessible until the test results come back and only then if there was an actual DUI. I also think that any expenses incurred because of the arrest if the test results come back negative should be reimbursed by the police department. Unless they're lying about the number of negative test results this shouldn't be a large amount of money. The mentality that the testers are always right also needs to be changed. They're humans and whether they like it or not humans make mistakes in judgement. The training where they say the lab techs might be wrong even though the officer is right should in no way be included in the training. If the lab results say a test is negative own up to the fact you were probably wrong in your assessment and move on.
When found innocent with no trace of alcohol or drugs , police departments should pay for all their victim's legal fees plus more. Police should also hold the offending officer accountable for legal fees. This is unacceptable abuse of police powers.
Police Departments are run off of tax payers dollars. But I agree that crooked cops should be held liable for any financial burdens that victim's have incurred due to the actions of said crooked cop.
Happened to my friend one time. Charged him with DUI even though he blew UNDER the limit. Took him years and thousands of dollars to clear his name. Crooked police are everywhere.
False arrest should require compensation for the victims time and legal fees. It should also fall under the 3 strike rule for officers who think they are mind readers or who think they are a GURU. After 3 false arrest the officer is back on a 180 day probationary period. If a 4th false arrest occurs at anytime during the rest of his employment . The cop is fired.

There is no disincentive for the cops makings these types of arrests. In fact it looks good on their record, they get credit for the arrest and the fact that charges are dropped months later doesn't affect that. In addition by making the arrest they get to search the person and their car on the off chance they're able to find something illegal then it's another arrest. This happened to me in PA with a state police officer. He was called “the most aggressive dui officer” he has awards for duis. I had my license for 5 days and made an oopsie in the rain… he aggressively told me I was stoned. Said I was lying. If this happened now? I’d lose my job. He would be taking food from my child’s mouth. I proved my innocence, but this needs to end. I don’t deserve to live in fear.

I don't believe there's a "quota" although if the officer was held accountable after making a bad arrest this wouldn't happen as often. It's so sad they can ruin someone's life with a snap of a finger. I was almost arrested for DUI despite being several years sober (I was confused at a busy light and went over the line a little but it was clearly a dui trap zone in a college town). I told them I was sober and they scoffed. I then passed the field sobriety tests but they were still saying they didn't believe me until I blew zeros. Then they let me leave and sarcastically congratulated me on my sobriety. I'm kind of shocked they didn't arrest me just to do it
Always decline roadside tests. A dirty cop could've said you failed and that you blew over the limit. Carry two phones. Whenever you're stopped, start recording with one phone, and use the other one to call a witness.

I was arrested for extortion for trying to recover $7000 a dentist cheated me out of - I could prove that he cheated me- the court wouldn't even.look at my proof - the dentist had.NO proof- I couldn't afford an attorney so the court just ran right over me - if I would've gone to trial I would have gone to prison- I was forced to plead guilty and was given a two year probation.costing $111 a month and a $500 fine- that is what happens when you can't afford an attorney- also afterwards I found there is plea u can enter that u plead guilty but u don't have to say u ate guilty- well, the person from the public defenders office that was supposed to defend me never told me about this plea- so what it looks like is the public defenders office does not defend you- they just set u up for the prosecution- now that is just my opinion based on my case- just in case they see this and decided to come after me

We said, let's go be in law enforcement. I flirted with being in the scientific aspects of it (forensics, I.T) something related to my newly acquired school documentation and background. We filled out the application and the Sergeant asked my why I wanted to be a beat cop. I quote her words, "you're too smart to be a cop" you won't get hired" I then revealed my request for computer forensics and data recovery. Still she said well... "we'll see". She then proceeded to ask repeatedly if I had any dirt and inquired about marijuana more than five times because, another quote " a little dirt is fine". I was shocked, I was young and thought they wanted the best and brightest.

I understand your reasoning but it's worth noting that most qualitative (rather than quantitive) drug tests will lean more towards giving a false negative rather than a false positive.

Think of all the victims of false arrest (like me) who couldn't find an attorney to take their case. In my case, all the attorneys I could contact within the statute of limitations, which is actually quite brief, against a government agency said my case had merit but either were swamped with cases or didn't find my case lucrative enough. I live with injustice.

I am a licensed physician and have been practicing medicine for over 40 years with over 200,000 patient encounters during this time. I can absolutely tell you that there is NO physical finding, or group of physical findings, on a physical exam, which can diagnose marijuana ingestion. NONE. PERIOD. Now if a patient is "falling down drunk, reeks of alcohol, and there is an open can of beer or whiskey in the car", then you can make a diagnosis of alcohol intoxication/impairment with about a 99% accuracy. But even this diagnosis scenario is not 100% accurate because a diabetic in DKA can show the same symptoms. Short of a blatantly obvious diagnosis, then, ALL of what I saw on this video, from a clinical medical perspective, is pure GUESSWORK. DRIVERS BEWARE.....AND DON'T DRIVE AT NIGHT IF YOU DON'T HAVE TO. When driving at night, you especially stand out and are a sitting duck target just waiting for some police officer who thinks he's an "expert" , to ruin your life.
To be fair have ingested smoke to whatever tons there are tall tale physical signs lazy eyes red eyes sometimes slurred speech giggly effect if you ingest it the giggly effects tenfold, the funniest thing I can't get over is where I grew up the cops were pretty cool they'd stop you ask if you have any drugs or whatever on you. If you are talking specifically about a case like the above where the people were not guilty and were arrested, then you may not need to hire a lawyer in the first place. They will take blood at the station, if the blood finds nothing, then you can go to court yourself and ask the judge for dismissal. But hiring an attorney for traffic violations like these, are pretty cheap from 50 bucks to 250 dollars. Most anyone can come up with that these days. So no, peoples lives do not need to be ruined if they are in fact innocent. You are not talking about thousands of dollars to hire an attorney for traffic court proceedings. This is much cheaper than getting charged convicted of a DUI and paying the thousands of dollars in fines and paying for traffic school and missed work etc. Or if traffic school is not an option, the extra added $ your insurance will go up with the points on your record. If you are talking about the case where the three people are suing the department, I would bet the attorneys are doing it for free for a cut of the settlement so again, not out of pocket for the victims.

In other words, they are right, and the test is only correct if it validates their initial determination. If the tests are negative, then that means the test is wrong. This is insane.
My wife is a board-certified MD neurologist, and this type of misuse of neurological signs drives her crazy. Brain specialists like her who have trained for seven or eight intensive years recognize the imprecision and inherent fallibility of these tests when administered in the best of situations. Some dude with an associates degree, a badge, and a week of training drawing life-altering conclusions about imagined drug intoxication by the side of the road in pitch darkness based on a couple of tests with only modest specificity is insane.
Well yeah but this is about generating revenue for their own police departments and whichever municipal corporation they work for. If there's no harm, damage, or loss (inadvertent or otherwise) then there's no enforcing of the law necessary as no laws were violated. Anything else is for revenue generating purposes only. This happened to me. Except when they couldn't find alcohol, they did a drug test and found nothing except one of my medication's was still in my system. It's a very common medication and it's not illegal to drive while taking it. If anything, people should be more scared of my driving when I don't take it. Although there is no caselaw in Wisconsin of anyone being convicted of driving under the influence of this medication, instead of dismissing the charges outright, they dismissed them with presidents. They told me if I get pulled over again, they will re-charge me for this offense. Anyone I've ever told this story to can't believe it. But if you don't have money to fight the government this abusive power will continue to happen. Any intelligent person would've said she wasn't drunk or on drugs and dismissed it. I fought the law and the law won. Justice and freedom is an illusion.
There’s a LOT of medications that can cause a person to have a false negative for opioids. I’ve always known this but I’m really finding this out. Recently a friend of mine’s son had a seizure at school. She took him to the ER at a children’s hospital. They did a UDS and found fentanyl in his system. My friends and I did some of our own research and found that one of his meds can not do that but also cause seizures to begin with. We’re finding out just exactly how many medications can do this. Even the ones I’m on can.

He was a “drug recognition expert “ and said I seemed “under the influence “ because I seemed “confused and dazed”, no shit, I just had a seizure. Had another and was sent to the hospital. Come to find out that while unconscious they took blood AFTER the ambulance/ER medicated me. So yup, dui right there.

Realistically the possible consequences of the two are completely different. You messing up an order probably has 0 chances of causing a death whereas a police officer messing up a DUI arrest could end up with someone dead. Honestly and I'm probably going to catch a lot of shit about this, I'd rather see an innocent person arrested in error for a DUI than for someone who was actually impaired be let go. Too many innocent people lose their lives to impaired drivers every year and I'm thinking that number far outweighs the number of innocent people arrested in error.
Unfortunately until there is some form of roadside testing available for drugs this is going to keep happening, but I think things definitely need to be changed with how the cases are handled until test results are received. The police doing the testing need to be completing the full tests not just stopping when they think they've detected impairment. They need to come up with a system where the arrest isn't recorded anywhere publicly accessible until the test results come back and only then if there was an actual DUI. I also think that any expenses incurred because of the arrest if the test results come back negative should be reimbursed by the police department. Unless they're lying about the number of negative test results this shouldn't be a large amount of money.
The mentality that the testers are always right also needs to be changed. They're humans and whether they like it or not humans make mistakes in judgement. The training where they say the lab techs might be wrong even though the officer is right should in no way be included in the training. If the lab results say a test is negative own up to the fact you were probably wrong in your assessment and move on.

When found innocent with no trace of alcohol or drugs , police departments should pay for all their victim's legal fees plus more. Police should also hold the offending officer accountable for legal fees. This is unacceptable abuse of police powers.

False arrest should require compensation for the victims time and legal fees. It should also fall under the 3 strike rule for officers who think they are mind readers or who think they are a GURU. After 3 false arrest the officer is back on a 180 day probationary period. If a 4th false arrest occurs at anytime during the rest of his employment . The cop is fired.

There is no disincentive for the cops makings these types of arrests. In fact it looks good on their record, they get credit for the arrest and the fact that charges are dropped months later doesn't affect that. In addition by making the arrest they get to search the person and their car on the off chance they're able to find something illegal then it's another arrest. This happened to me in PA with a state police officer. He was called “the most aggressive dui officer” he has awards for duis. I had my license for 5 days and made an oopsie in the rain… he aggressively told me I was stoned. Said I was lying. If this happened now? I’d lose my job. He would be taking food from my child’s mouth. I proved my innocence, but this needs to end. I don’t deserve to live in fear.

I was almost arrested for DUI despite being several years sober (I was confused at a busy light and went over the line a little but it was clearly a dui trap zone in a college town). I told them I was sober and they scoffed. I then passed the field sobriety tests but they were still saying they didn't believe me until I blew zeros. Then they let me leave and sarcastically congratulated me on my sobriety. I'm kind of shocked they didn't arrest me just to do it
Always decline roadside tests. A dirty cop could've said you failed and that you blew over the limit.

I was arrested for extortion for trying to recover $7000 a dentist cheated me out of - I could prove that he cheated me- the court wouldn't even.look at my proof - the dentist had.NO proof- I couldn't afford an attorney so the court just ran right over me - if I would've gone to trial I would have gone to prison- I was forced to plead guilty and was given a two year probation.costing $111 a month and a $500 fine- that is what happens when you can't afford an attorney- also afterwards I found there is plea u can enter that u plead guilty but u don't have to say u ate guilty- well, the person from the public defenders office that was supposed to defend me never told me about this plea- so what it looks like is the public defenders office does not defend you- they just set u up for the prosecution- now that is just my opinion based on my case- just in case they see this and decided to come after me

We said, let's go be in law enforcement. I flirted with being in the scientific aspects of it (forensics, I.T) something related to my newly acquired school documentation and background. Think of all the victims of false arrest (like me) who couldn't find an attorney to take their case. And who is to say that there wasn't a 4th or 5th or 10 others who also weren't intoxicated and didn' t have the ability or resources to fight it?

I am a licensed physician and have been practicing medicine for over 40 years with over 200,000 patient encounters during this time. I can absolutely tell you that there is NO physical finding, or group of physical findings, on a physical exam, which can diagnose marijuana ingestion. NONE. PERIOD. Now if a patient is "falling down drunk, reeks of alcohol, and there is an open can of beer or whiskey in the car", then you can make a diagnosis of alcohol intoxication/impairment with about a 99% accuracy. But even this diagnosis scenario is not 100% accurate because a diabetic in DKA can show the same symptoms. Short of a blatantly obvious diagnosis, then, ALL of what I saw on this video, from a clinical medical perspective, is pure GUESSWORK. DRIVERS BEWARE.....AND DON'T DRIVE AT NIGHT IF YOU DON'T HAVE TO. When driving at night, you especially stand out and are a sitting duck target just waiting for some police officer who thinks he's an "expert" , to ruin your life.

To be fair have ingested smoke to whatever tons there are tall tale physical signs lazy eyes red eyes sometimes slurred speech giggly effect if you ingest it the giggly effects tenfold, the funniest thing I can't get over is where I grew up the cops were pretty cool they'd stop you ask if you have any drugs or whatever on you. I had said something like "I just got some weed on me a smoke", they were always cool and cause you were honest and didn't act ignorant or belligerent they would just look at you and laugh and say man I was talking about drugs.

One thing I know about weed is that it's hard to get rid of the odor. If someone smoked weed they almost certainly smell like weed.

If you are talking specifically about a case like the above where the people were not guilty and were arrested, then you may not need to hire a lawyer in the first place. They will take blood at the station, if the blood finds nothing, then you can go to court yourself and ask the judge for dismissal. But hiring an attorney for traffic violations like these, are pretty cheap from 50 bucks to 250 dollars. Most anyone can come up with that these days. So no, peoples lives do not need to be ruined if they are in fact innocent. You are not talking about thousands of dollars to hire an attorney for traffic court proceedings.
This is much cheaper than getting charged convicted of a DUI and paying the thousands of dollars in fines and paying for traffic school and missed work etc. Or if traffic school is not an option, the extra added $ your insurance will go up with the points on your record.
If you are talking about the case where the three people are suing the department, I would bet the attorneys are doing it for free for a cut of the settlement so again, not out of pocket for the victims.

In other words, they are right, and the test is only correct if it validates their initial determination. If the tests are negative, then that means the test is wrong. This is insane.

Brain specialists like her who have trained for seven or eight intensive years recognize the imprecision and inherent fallibility of these tests when administered in the best of situations. Some dude with an associates degree, a badge, and a week of training drawing life-altering conclusions about imagined drug intoxication by the side of the road in pitch darkness based on a couple of tests with only modest specificity is insane.

Well yeah but this is about generating revenue for their own police departments and whichever municipal corporation they work for. If there's no harm, damage, or loss (inadvertent or otherwise) then there's no enforcing of the law necessary as no laws were violated. Anything else is for revenue generating purposes only. It amazes me that the vast majority of people still don't understand how it works. "I didn't realize you could be arrested for something you didn't do until it happened to me." I laughed when the first lady said that. She learned the hard way, but I bet she won't make the same mistakes again believing agents are on her side.

This happened to me.
Except when they couldn't find alcohol, they did a drug test and found nothing except one of my medication's was still in my system. It's a very common medication and it's not illegal to drive while taking it. If anything, people should be more scared of my driving when I don't take it. Although there is no caselaw in Wisconsin of anyone being convicted of driving under the influence of this medication, instead of dismissing the charges outright, they dismissed them with presidents. They told me if I get pulled over again, they will re-charge me for this offense. Anyone I've ever told this story to can't believe it. But if you don't have money to fight the government this abusive power will continue to happen. Any intelligent person would've said she wasn't drunk or on drugs and dismissed it. I fought the law and the law won. Justice and freedom is an illusion.
There’s a LOT of medications that can cause a person to have a false negative for opioids. I’ve always known this but I’m really finding this out. Recently a friend of mine’s son had a seizure at school. She took him to the ER at a children’s hospital. They did a UDS and found fentanyl in his system. My friends and I did some of our own research and found that one of his meds can not do that but also cause seizures to begin with. We’re finding out just exactly how many medications can do this. Even the ones I’m on can.
