      It’s been this way lol. If he started this channel years ago, then it’s been bad since then at least😂😂. We just continue to paint ourselves into a corner and toxic environments don’t help. Companies don’t realize how much money they lose just from employee turnover.

    Every day we encounter novel challenges that have become the new standard. Although we previously perceived it as a crisis, we now acknowledge it as the new normal and must adapt accordingly. Given the current economic difficulties that the country is experiencing in 2024, how can we enhance our earnings during this period of adjustment? Additionally, although I possess $160,000, I find it challenging to take the plunge due to a shortage of funds.

    I was once fired because the employer overhired and lied that about my performance. Went to court, they never showed up and I got my UI. Always fight guys
    Never back down.

      Most companies don't want to waste time at a hearing for an ex-employee. It just isn't worth their time.

      Thank you for the encouragement.
      The nonprofit I worked for seemed to have studied how to gaslight and make every employee feel afraid that their coworkers were out to get them. they have a 2 star rating on Indeed now, and I fear like myself others had been really badly hurt by HR and upper management for doing their jobs well.
      They seem to be corrupt, beyond greed, they do not mind hurting minorities, staff or patients.
      The turnover is very high, quitting and being fired both.
      I asked why I was terminated, and they refused to say what I had done. However, they said on a piece of paper I am sexist, racist, and do not respect my supervisor. My supervisor loved me and wanted a hug nearly crying when I was fired, and she now is a job reference. She knew it was a lie and I was discriminated against.
      I did save all my proofs of discrimination along the way, and even had an HR say to record a warning meeting, so it is on video I saved. 😂
      I contacted the EEOC and they said it is hard to prove even with the proof I had with video and on paper, but said that from my description of what their DEI was doing they were asking for multiple lawsuits.
      I heard from a friend one former worker is suing them. I asked for their lawyer’s name. Perhaps several of us will find each other somehow and be able to increase that number to show how hateful they are to refuse us even unemployment. It has been nearly 5 months without any unemployment and one job interview, and while the government sided with me that I had a right to it, they said the company can appeal up to a year. Sigh.
      they know staff are poor, as they lied about giving us raises for years and never did, to keep us poor, so we could not afford a good lawyer. But on the Board is a crooked will making lawyer, so they feel safe screwing good people.
      I just wish the newspaper would care to do a story to protect the patients.

    My husband was fired for poor performance and he still got unemployment he got $661 a week. A fraction of what he was making but still helpful til he found the next job, which he loves!

    Sometimes the employer will pressure the employee to quit just to avoid paying unemployment. This happened to me once, but the employer was so bad, I simply acquiesced. There was no overt harassment, but the environment was quite passive-aggressive.

    I was once fied (in WA) for what the employer claimed was "misconduct". They denied my UI benefits. I asked for a hearing. The agency failed to show up. That made the Commissioner angry. So that fact plus my explaination of what happened, resulted in my getting all of my Unemployment benefits. The Commission stated that she could only grant UI, but reading between the lines she believed it was a wrongful termination. I didn't pursue it, because I moved to a different city and just wanted to be done with that agency. So my advice is that if you feel that you were wrongfully fired for cause and get denied UI, ask for a hearing. You have nothing to lose

      FYI: Employers cannot 'deny' unemployment benefits. They can contest them, but ultimately it's the state that reviews both sides and makes a determination.

    In California, they only look at the last job when determining if you qualify for unemployment insurance. Storytime. I quit a job, which would normally disqualify me. However, I then took a temp job for three days and was laid off as planned. Since I was laid off my last job, I qualified for unemployment, even though I quit the long-term job that proceeded it.

      Exactly!! And, it's the same for your state disability insurance: Only the last job counts!

      I don't know about California, but in many states, you would still potentially not qualify for the benefits paid in by the employer you quit, so if it was the only employer you worked for in the last 18 months (besides your temp job), you would get nothing.

    In Texas, gross misconduct, not low performance impedes your eligibility to get benefits. Max benefits is $577 per week. The best way to leave your employer and still qualify for unemployment is to file a good faith complaint with a government agency.

      Hi, I am in Texas, and I was recently let go from Progressive insurance. The reasoning was below average accuracy for claim submissions; it's a performance metric. That same day like 4 of my friends who were co-workers were let go also. How do I file this good faith complaint and do you think I qualify for unemployment? I have been searching for a new job for two weeks.

      Nope. The EEOC and Texas Work Commission concluded that I " just didn't like my job." Toxic people can lie against anyone. That happened in my case.

    I’m an attorney in NJ. Every state has different rules/regulations regarding eligibility. Always check the State’s unemployment office/website which should provide relatively easy-to-understand descriptions of the eligibility requirements. Many people are shocked to learn that you can still be eligible for unemployment if you quit (provided you can show that the employer’s improper conduct compelled you to quit.) in such cases, not only would the former employee be eligible for unemployment benefits, but maybe a civil cause of action as well.
    The one thing I would say is NEVER trust the employer’s HR department telling you whether you’re eligible for unemployment benefits. Even if they are not hostile, they often don’t know what they’re talking about. Always go with what the State’s Unemployment office says. And if you’re unsure whether you qualify or not, there’s no reason not to at least file an unemployment claim. The worst thing that could happen is the claim is simply denied. (Just don’t lie about anything on the application.)

      NJ here. I quit my job due to workplace psychological abuse and mobbing and bullying, grooming us to do fraud on customers accounts and not paying me overtime. I already have an attorney going after them, I have documented proof of all of these things 106 pages long. To prove my reason to quit. And if they fight me, me and my lawyer will fight back, including proof I have an attorney signed onto my case. I brought up the overtime issues and was ignored. Constantly. And told I’m salaried, and not qualified for overtime. They started to target me after this.

      @alanlevy1982 Good advice. The best place to get the correct advice is your state or states in which you were paid over the last 18 months. If you worked in multiple states you can sometimes combine state benefits or choose the state that pays the highest weekly and/or maximum benefit.

    In Massachusetts, max benefit is $1,149.90 per week, the most in the country. Plus you get more if you have dependents ($50 per dependent). Massachusetts is very liberal so employers have a very hard time winning unemployment cases.

    Two years ago I got unemployment by resigning from my position. My former employer did not get me the training I needed to be successful in my role. Just made sure to document everything. Also made multiple attempts to fix the situation with them.I just had to do an interview and send those documents over to unemployment. Got approved.

    Before watching; I got unemployment after being laid off, AND I got unemployment for being terminated due to poor performance. It could be a case-by-case thing but I was very surprised I got the assistance. It was VERY much needed and appreciated, though.

      @@charliedallachie3539 The first one tried quite hard to, yea. They had absolutely no good reason to terminate me, since it was because of some crap I honestly could have sued them for if I documented more. The second people actually had every reason to fire me, and appealed; but I made the argument that they could have gone a bit farther to try training me better (i.e. more hands-on training and supervision), and they awarded me with the assistance. I have hard feelings about that job because they didn't give me the time to get better, but unemployment took my side because it had only been a year into a very difficult role. Hope this helps

      @@charliedallachie3539 They both did, yeah. One worked a bit harder to do so lol.. which surprised me because the first one was 0% my fault. The second one had every reason to fight it, since I was fired for performance, but I explained that I did not feel I was truly given all of the tools to succeed, and they eventually granted me the compensation. I would have said that in desperation even if it were untrue, but I truly felt that way because I've never underperformed at a job before that one. Hope this helps

      I got unemployment after being fired for poor performance. They didn't even challenge it. After I exhausted my final paycheck, the balance of my paid time off they owed me and sat out a week, I received it for 6 months.

    I was fired the first time I was late after working there four years and I was able to collect unemployment, however when I got laid off due to the lockkdowns during the pandemic, I had only been working a few weeks so I had nothing to draw from so I was NOT able to collect unemployment.

      @Desibeatnik Unfortunately, you lived in Texas. Many states offered pandemic-related benefits even if you hadn't any benefits to draw from, but you had to prove you lived in that state (so people from TX and some other states wouldn't try to get unemployment from the states that offered pandemic unemployment).

    I was a part of many many negotiations related to employees receiving unemployment. In my state, if the employer does not contest and provide evidence of misconduct, you basically get it. But here they do hearings to allow each side to give their side of the story. Pretty nice, unless the employee misses the call. Then, the agency can use that against the employee. Unemployment is such a life saver for so many employees I helped when I worked for the government, good stuff, love your channel!

    brother, I just came here to thank you: today I got the call, I landed my dream job. And they also agreed to pay me my current-in-mind dream salary.     I'm Irish based in the UK. I have been out of work a few times and sometimes for stretches. When I was unemployed (hopefully never again) I had to look for a certain amount of jobs or training opportunities inside a certain period of time. I got my allowance and was paying into my state pension. I also got help with healthcare appointments and travel to interviews etc even discount on courses at college. despite this I felt worthless when I was unemployed. The benefits system changed to what is known as universal credit, I was expected to spend 40 hours a week doing everything possible to get work or training (this was made worse by the pandemic), I had to complete several cycles (almost two months) before I got any payment. I still paid into state pension and got help with healthcare etc as well as travelling to interviews etc. some people think unemployment benefits is like begging, if you are genuinely looking for work (like I was) and doing everything possible to gain employment, the benefits office could be most helpful and supportive. I needed money to live and also needed to think about the future (pension). I hope I never experience unemployment ever again, it's not the nicest thing. Have a good day reader

    You should do a video about recruiters using different tactics/excuses to delay the hiring process. Most likely stringing the 2nd candidate along until the 1st candidate accepts the offer. I think I’ve heard them all. “I had a personal issue, have been sick, out of office so haven’t had a chance to speak to hiring manager, hiring manager was off.”

    As someone who has quit his job a few times in life I would recommend that you keep notes and talk to your areas department of labor before outright quitting especially if the business is taking care of the unemployment insurance. I say this because they may change what your reported reason for quitting is. Yes it is unethical but I have had this happen to me and eventually it will catch up with you. I was young, ignorant and these were low quality employers but that is why you should study the employer before taking a job.

    In California you can get unemployment even if you quit. I know, I had an employee do that.

      I quit a job in CA and wasn't eligible. CA is a "good cause" state meaning that there are certain eligibility requirements even if an employee quits or is fired. Like described in the video you should have received a letter from the state stating the reasons the employee is applying for unemployment and what your "side" of the story was for the employee quitting.

    What if you quit job A to take job B then job B withdraws the offer? We're seeing a lot of companies withdrawing job offers lately and I've always wondered about this scenario?

      If you have a written offer then you can sue them. Always get a written offer that outlines the job duties and the salary.

    When I was put on probation after starting a new job (awful manager who refused to answer questions during the training phase) I asked HR about information about the state unemployment as I was new to the state and got told to Google it.

    I worked at a retail pharmacy. I didn't get to take the certification exam soon enough, so I told my supervisor and manager. The manager asked if I was still willing to take it. I said yes. She emailed the District Manager, who said no, that it was too late.( There were still 2 months in which I could take it) The manager and supervisor said that I could work in the store, and to tell the store manager so that she could put me on the schedule, so I did and she was favorable to me working in the store. The,, several weeks later, my pharmacy supervisor said I should go see the store manager again, and when I did, the store manager said she doesn't have any hours for me. (I later found out that she was hiring new people after our conversation).
    When I left, I immediately filed unemployment. It was denied because the company said I left voluntarily. Straight up lie! Now I have to appeal it. Such a headache.
    Also, I have noticed that I'm not getting call backs for interviews since this happened. I think my former boss is bad-mouthing me to prospective employers.

    My experience after working for temp agencies for a decade is that 100% of the time they will lie on the unemployment form to try and deny you benefits, so if you're working for one of those agencies, make sure you take notes, get things in writing, etc. And yes, despite what the agencies tell you, in most states if you finish an assignment and they have no more work for you then you qualify for unemployment. They have to provide you with a minimum number of hours or you are considered laid off.

      There are special rules for agency workers. In Texas, you have to continue asking the agency for a new assignment on a periodic basis. I did so using email with a return receipt.

    I had a former employer fail to respond, or not respond within the guidelines of the law, to my claim. This delayed my benefits and caused a lot of stress.

    If youre ever fired or laid off, dont ageee to or sifn anything. Hire an attorney and file a lawsuit for wrongful termination. Dont assume you know the law or if wrong doing was in play. Get a second set of eyes on your situation. Force the employer to do a full audit of why they fired you....or even better, theyll settle. This isnt all cases but hey, if youre inconvenienced by a sudden job loss, dont hope you qualify for unemployment...dont sign nothing

    I was fired from one of the first jobs I had outside of college because I refused to spontaneously work in a town that was 1+ hours from my location... and at the time I was experiencing really bad symptoms from a medical condition *my boss knew I had*. I applied for Unemployment and the WA state Unemployment commission sided with me over my employer and found their requirement that I spontaneously work in town far away from my location unreasonable. You can get Unemployment from being fired, but it's up to the discretion of whatever office handles Unemployment in your state.

    I was let go early last month and I never got any sort of letter (13 years with no misconduct issues). I was planning to file for FMLA and was waiting for my brother (stroke) to see his PCP in order to get the letter from them. I let HR and management know and 2 weeks later I was terminated for "failure to meet business expectations." I filed for unemployment and found out the company failed to respond. It has been more than 30 days and I am still waiting for the first claim to be paid. I still plan to push the FMLA request and I hope the state ROASTS my old company for this.       If that employer has competent legal counsel, they will tell the company to ignore the unemployment claim and let it time out so they don't accidentally provide information that could used against the company in a lawsuit. Such a sequence of events will cause you to get accumulated benefits after everything times out.

      Idk what state you live in, but if you have written record of the FMLA request and then fired with no prior performance issues, maybe consider talking to a lawyer about it. That could be wrongful termination... I can't give any legal advice other than "it depends"

    I've qualified for unemployment from being fired because the employer failed to participate in the hearing. Honestly, it was a god send because my manager was being very militant and unreasonable and fired me. Some states also let you collect unemployment for quitting under certain specific circumstances such as harassment, safety conditions, etc.

      My guess is that it was reviewed by their attorney. The risk of providing information that could result in a lawsuit judgment outweighs the cost of being assessed a higher unemployment premium.

    Some people just don't mesh after time, even if you love your job and have worked really hard. You will find that some workers will have others they will hang out with and have conversations with from time to time. You may feel kind of alone or left out or just not really part of the group. There may not be anything you can really do to fit in until they start hunting around for a reason to let you go. They can pretty much wordsmith it on the exit paperwork. I have had a friend fight a situation like that and won with the unemployment board. Also, if they don't have you sign any paperwork at all (mom and pop operations), you can usually still get unemployment.
    Do you really have to sign the exit paperwork if you know they are throwing you under the bus? What is the worse that can happen? They aren't giving you any severance pay anyway? Just curious.

    In most cases, you CAN get unemployment if you did Not Quit, especially if the employer is known to be in a layoff mode, or have a record/history of laying off employees for ambiguous cause.

    Guys, never sign anything when you are leaving after a layoff. You dont realize you are signing a resignation letter that removes the employer for any responsibility for unemployment benefits. 1

      I used to work for Xerox a long time ago. A guy I worked with believed HR and signed a resignation letter. They assured him he would get unemployment benefits. When he applied for unemployment he was denied by NY State because they said he had resigned. Also, being a veteran of the corp sales position wars, I have seen another scam pulled by companies. When the sales manager becomes incredibly abusive it means they are trying to get you to resign. If you resign they don't have to pay unemployment. I saw young female sales reps leave the sales managers office in tears because he was so abusive. Trust me I have seen all the corp HRf games!!

    I had filed a complaint with OSHA and the day the company was hit with the complaint, I was suddenly the worst employee in their eyes and was threatened with my job for "not being a good fit" and if I had ANY other issues, I would be fired. A month later, I had told another employee something that was said about them and that supposedly "created too much drama" and was fired. After filing unemployment, the company claimed I was fired for profane language. THAT didn't happen and the owner is the most profane person there. I had always had good reviews and got raises every time those came around. The hearing is coming up this week and we will see how that goes

      In some states, if you have to sign a 'Severance Agreement' in order to get the severance, it doesn't postpone your unemployment weeks.

    In CA, you can get unemployment if you quit. They are very pro employee. You do need a reason for leaving that qualifies. The burden of proof lies on the ex employer. If you have evidence to your claim (a simple email would suffice), you pretty much have it in the bag.

    Brian it would also help if you could talk about the benefits of using Temporary Agencies to get jobs while people are looking for that so-called dream job. I love temp agencies because they do not ask those stupid questions and waste my time.
    Some temp agencies also offer medical and dental benefits after being with them for 30 days. Also there are temp to hire or contract to permanent jobs.

    In the event you are going to quit always always get an employment lawyer, thry will make sure you check the boxes before pulling the trigger and will guide you in a way to not just get unemployment but also get you whatwver is due to you so your not out in the cold.

    Depends on your state, and yes always apply for it unless you quit your job (unless you were forced to quit). Even if it’s appealed, you have a good shot at winning it. Always fight for it, it’s a benefit you’re entitled to. Performance is often not a good enough reason to be denied benefits.

Because of severance I have to wait 6 months but I am learning from others that were laid off around this time are being denied due to not signing up in 30 days with the local career center due to technical problems. My question is what happens to the money that has been paid to this system? I did not have any sign up problems but I am curious.

    I appreciate your videos. I was curious if you've got any thoughts on the one-way video interviews that have started to be a thing.
    On a personal level, I hate them. I don't mind video calls because you get to have an actual conversation, but these one-way video interviews feel like another meaningless hoop to jump through. Maybe it's good for the Gen Z job hunters who are used to doing Tiktok all the time, but if it's going to be followed up with by a regular interview anyway, I don't really see the point.
    I feel like it's also wasting time from a recruiter or hiring manager's side. Most of the questions asked for these are the same kind that they could get written answers for, and it would take a lot less time to review the answers.
    If there's a benefit to these I'm not seeing that isn't met by another part of the hiring process, I'd love to know.

      PIPs are quite often made up BS to get you out the door for "cause" even when there is no real reason to fire someone. A company can say anything on a PIP bcz it is just someone's opinion.

    Don't forget all the layoffs during the pandemic! Even though I had a number of performance issues at my last job and it was getting stagnating for me, it really had nothing to do with that but because of pandemic closures with my employer "closed until further notice." Thus I left that job on a positive note and was able to collect unemployment for 3 months till my next job. 😊

    I left my job because they laid off half the salaried work force, and then of the remaining half salaried staff, of which I was part of, they relocated randomly to facilities across the country (well world, actually). I was "offered" a position that was at least a two hour commute, where current was 20 minutes. I couldn't move again, and the commute was not feasible being a single dad of two grade school kids.
    I just moved my kids closer to work a year prior. I will never do that again. They struggled to acclimate and one ended up with severe anxiety issues having to leave a school and friends they knew. The unemployment office didn't give shit and just asked my employer why I was no longer working there and never game me a chance to plead my case. Such a joke.
    I even offered to work remotely and come in as needed, since 90% of my job could be done remotely and they refused. This was just before the pandemic. And then guess what, a few months later they had to let everyone work remotely. And then companies wonder why there's no employee commitment to the company.

    ??? I guess every state has different laws but in Florida you only get unemployment if you get fired, laid off or quit via a doctor’s notice. If you get fired however for insubordination, it becomes a back and forth.
    Quitting you get nothing unless again it’s because a doctor told you had to and in writing.

    Keep in mind that unemployment rules are very complicated. Most unemployment agencies have pdf 'manuals' or information on their website that explain at least the basics. After reading as much as they offer, make a list of questions for the items you're still unsure of. Then call them and ask....if you can get a hold of them.

    What about an employer actively lying and making up a cause to save its own lackluster upper-management? Anything someone wrongfully terminated due to these people making shit up?
    A friend of mine was working at a "rival" company and got wrongfully terminated in early December, he just got denied his unemployment benefits because the company did everything they could to block him from getting it.
    I feel bad for him and I don't know how to help him anymore, I've been giving him advice this whole time but he's starting to lose hope on that front.
    Jobs in our field aren't exactly plentiful right now either.
    Canada, Québec, if anyone local has more advice. (I already told him to contact the CNESST for psychological harassment, which they do, constantly but everyone's afraid to do anything about it.)

    Actually, getting fired is the only way you can get benefits. If you quit, by law, you are disqualified. But you'll have to fight for your money at the unemployment benefit hearing. Write down everything that has happened, save every document and fight, fight, fight whomever the employer sends to testify to the referee (usually a lawyer). Just like in court you use questions to make your case and you must brace yourself for an opponent who lies.

    A. Your contract is not renewed and you are let go at the end of it
    B. You are fired or released before the official end of the contract?
    Do you still get unemployment in these scenarios?
    I'm guessing the funds come out of the contracting agencies bucket not the end client?

      During Covid, Colorado just handed out unemployment benefits seemingly without verifying the claim or the person's identity. If you lived and worked in Colorado, it was almost a certainly that your identity got stolen and a fraudulent claim was filed in your name. Then when you needed to file your own claim, the state would not let you due to the existing claim. It would take months and months (if ever) to clean up the mess and finally get your rightful payments.

In addition, Colorado had just completely changed out their 1980s system right when Covid hit. The new system was full of bugs, which is normal when changing to a new system, plus the employees had to LEARN how to work in the new system. Did you eventually get paid?

      Assuming that the mandate demands relocation, apply for several apartments near the office. If those applications get rejected, you can prove that you attempted, but failed to return to office. If a health care provider provides documentation that you need to work remotely to accommodate a disability, you can also short-circuit a return to office mandate that way.

    I’m surprised you didn’t cover a huge part of this - the employer only has 14 days after you file to try to fight your claim. If they take 15 days or longer (in every state I’ve live in anyway) then the unemployment office automatically approves your claim. ESPN tried to fight me and say i was fired for cause when they actually fired me over the domestic violence situation i was going through - they filed the paperwork 15 days late though so i won. It was so stupid. I wish i could go after them in court but i have no money for a lawyer to go head to head against the capitalistic mouse. But the moral of the story is that you can usually still get unemployment even if your employer fired you for an illegal reason and they are trying to slander your name and lie about you because these stupid big employers tend to not do the paperwork in time.

    Actually...yes! My wife was fired because another sales employee allegedly heard her utter the words to a customer something to the effect of "she's so stupid". (toward the customer). Fired on the spot when the other associate concocted the story to their manager. She never said those words. It was made up. Fast forward to the unemployment hearing and her manager was on stating the employers case of cause as to why she was terminated. Unfortunately for the employer, the actual witness to allegedly hearing her words was a no show to the unemployment hearing. Claim was awarded to her because...hearsay. Boom.

    In my experience, the most common employer response to filing an unemployment claim is to let the request time out and you eventually get your benefits.

      Yes, but that takes weeks (months), I had direct contact with HR, and they still screwed it up. In CO, the employer does not file the paperwork but they have 12 calendar days to respond to what is mailed to them. Colorado unemployment, BTW, is incredibly slow and they state upfront it may take 6-9, 10-12 weeks, depending the web page you hit.

    Yes. In 2008 a boss fired me because he believed I knew his wife was cheating on him and was helping her hide the affair. Not true and NOT work related issue. Long story short I drew unemployment. In my state you can go before an employment commission judge and back then it was via phone.
