- I have never seen a security captain get so upset with public photography. Even the deputies could not reason with this guy. The Richmond Deputy had to yell at this guy to calm down.
He claims to be a valid Riverdale Georgia police officer. I emailed the Chief of Riverdale Police Department (tspivey@riverdalega.gov). His response was; "He is not employed by the Riverdale Police Department at this time. He is a former employee". Did this security guard just commit a felony by impersonating a police officer?

HIPAA = Health Insurance Portability Accountability Act. Those laws were established for health professionals including doctors, nurses and clerks. They make mandatory those people are trained to keep the citizens health info secure and to make it easy to transfer one's insurance from employer to employer. The average citizen cannot violate HIPAA laws.

I want to bring an issue to your attention. There is a video circulating with the potential to reach tens of thousands of people across the country and around the world! This video takes place in the area of East Central Regional Hospital - Gracewood,Georgia.
At your facility you have security guards and staff who are in dire need of training. The problem is the lack of knowledge regarding HIPPA law, Georgia Law and Constitutional First Amendment Protected Rights of the United States Citizen, which includes the rights of citizen journalists.
The Standards of HIPPA ONLY apply to Covered Entities and Business Associates. Covered Entities are defined as health plans, health care clearinghouses, and health care providers who electronically transmit PHI in connection with transactions for which HHS has adopted standards.
Most health care providers qualify as a Covered Entity. If an individual is not one of these entities, they are not bound by HIPPA Law. The onus is on the Covered Entity to protect the privacy of any of their clients or patients.
First Amendment Of the U.S Constitution states; Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
The freedom of the press, protected by the First Amendment, is critical to a democracy in which the government is accountable to the people. A free media functions as a watchdog that can investigate and report on government wrongdoing. It is also a vibrant marketplace of ideas, a vehicle for ordinary citizens to express themselves and gain exposure to a wide range of information and opinions.
In the United States, there is and can be no legal requirement or accreditation of any kind required to assume the titles “member of the press”, “journalist”, “reporter”, etc. Simply put, any Citizen of the United States can pick up a camera and be a journalist to distribute information about matters to the public interest.
There is no universal official press credential. However, here are three common things that are often referred to as press passes, media credentials, etc.:
Typically news organizations issue identification badges or similar things that may say "Press" or "Media" on them. Those are often perceived as credentials but they, in reality, only indicate that a journalist works at an organization and any person with a home printer could manufacture such a badge.
The U.S. Court of Appeals for the Eleventh Circuit, which includes Georgia, has held that there is a First Amendment right to record matters of public interest from public property - Smith v. City of Cumming, 212 F.3d 1332 (11th Cir. 2000).
When one is in public, the law holds that a person cannot expect to have a high degree of privacy. Thus, surveillance cameras, audio recording devices, and other forms of in-person or remote observation and recording are legal.
The Citizen Journalists in the video were conducting a Constitutionally protected activity from publically accessible spaces. If the general public are permitted to be there, so can the Press.
The security guards were especially ignorant of the law. One Security Guard even impersonated a Law Enforcement Officer! He claims to be a valid Riverdale Georgia police officer. I emailed the Chief of Riverdale Police Department (tspivey@riverdalega.gov). His response was; "He is not employed by the Riverdale Police Department at this time.

@@georgiatransparency Of course Michael knew this. However, Michael is trained to lie as he did when he was a cop. He knows that HIPAA applies only to the hospital, but he thinks that you don't know that. In fact, if you watch other auditors who film in front of hospitals will experience the same thing. Almost like these security guards and other staff are trained to tell people who record near or on hospital grounds that doing so is a violation of HIPAA.
Rather than saying “funded by the taxpayers”, you could say “Owned by the public”, we own it and it is open to us

I’m fine with them filming other state facilities but for this particular facility the Clients Rights and Privacy are protected by the State because the clients can not do it themselves.

This is an example of the workplace violations hundreds suffer at the hands of theses people in this place daily . I am a survivor of this toxic environment.

Chief of Riverdale PD replied to my concerns that he does not think it is serious that an ex officer is out with some type of ID from Riverdale PD telling people that he is a police officer!!!??? They are the ones who did not arrest the security guard. Riverdale does need to address why he still has ID for their department. Riverdale is over 150 miles away from Gracewood.

HIPAA says nothing about preventing anyone from recording what we can see from a public place. HIPAA requires medical professionals to keep private “information” private, medical records and contact information. HIPAA does not apply to what can be seen from a public space

I just spoke with the Riverdale Police Department. He has not been a community officer with them since 2014. I asked him if it was a crime to impersonate a police officer and they told me yes. But it's out of their jurisdiction to do anything but they will be posting a comment on this video. They currently have a comment left on their Facebook page. Along with that the sheriff's department does not want to take your phone calls or answer any questions as they will continue to hang up on you

I used to practice driving over there a lot. It is weird how they act sometimes like it’s a secret operation. They need to put a public park and rec center in all that unused space they have.
Tyler Just FYI it’s not a secret place it’s just that the only individuals in there other than employees are Mentally Challenged. Many are incapable of protecting themselves and their rights as human beings, so the State provides for them and tries hard to protect their Dignity, Privacy and Rights. That is why they prevent individuals that do not have a valid reason to be on property to access the grounds. Just wanted to pass this information on to you to hopefully clear up your concerns.
@@imtheman4805 I’m very aware of what it is. Grew up right there near it. Went to Gracewood elementary , and cross creek around the corner by it and have relatives that have worked at the facilities. I’m a local obviously. There’s lots of unused property and space that can be used to educate and incorporate the public. It would kill much of the negative stereotypes that come from other Augustans when you mention Gracewood.

Why any officer would allow this guy security to state he’s a valid officer and to threaten go hands on berate give unlawful orders to a citizen that has not broken any laws in there presence and ask the auditor what has he did, wouldn’t even listen to the officers when stating he could be there. And allowed this behavior in there presence. Now that’s appalling. This chief sure isn’t a good look in your department. Your officers were clearly bias. This auditor was calm the entire time clear bias. What good officer would allow this behavior in there presence and take up for them. Even seen him battered and did nothing. Chief I am not anti police at all but you have some officers with no moral character how can you uphold such behavior unless this is how you police your department.
