    Amazing. I never heard of this VFW director, but now he is my hero! I have always been an advocate on naming names, especially in Congress instead of just saying, "They". Thus no names are mentioned in any big issues. The main stream media is guilty of allowing names slip through their accountability to the American populace! Enough is enough!

    Yea man it’s a shitty situation I’m in IDES not far from medical retirement and I can’t collect it because I only have 16 years and no combat. It’s 16 more years than 99% of the population that didn’t wish to serve. I know this is the first step for the combat guys and I hope they can get this passed, but once that happens we can’t forget about the guys and girls that also put in the time have no combat but where medically retired because of injuries while serving.

    Clay requested a hearing at Walter Reed trying to stay in and it was forced. Clay they lied. They dismantled me and lied about it. It took me contacting an already Retired CTM who was following me of whom I was under early on. When he retired he became a Director of a Healthcare facility and he had to contact the Navy to write letters. He was the one who arranged for medical intervention after the navy had dropped the ball.

    Richard Star Act needs to pass . It not my fault that at 17 1/2 yrs I got hurt from 3 tours and the in Indiana National Guard medically retired me . PLEASE CALL YOUR REPRESENTATIVES

      I’m so confused. I thought that veterans in this circumstances do you get retirement and disability? It’s just offset, but they actually are awarded. It’s the offset that’s the issue am I wrong please advise

      @@judyromero7794 You're pretty close. Yes, longevity retirements with 10%-40% SC disability are paid as an offset. The offset is equal to the percentage rating which is subtracted out of the DOD pot or pension check and "moved" to coming out of the VA pot of money (so DOD has more to pay their contractor boondoggles). It is two checks never larger than original longevity pension would be with the only benefit being the offset (VA pot portion) is tax-free.

      So if I understand you correctly, if you’re a veteran with more than 20 years of service and you are then medically discharged, you can still receive the concurrent VA disability and medical retirement without an offset

    Not mentioned but TERA (early retirement) allowed for some that had 15+ but less than 20, still get retired and va if 50% or more. It’s crazy how most services ended the program soon, even though the authority runs through 2025. I was lucky that the Marines was still allowing people to do it in 2023, and I was able to TERA after my med board results.

      Yup, this is what I've been saying. I'm a former Republican. One of the reasons why I left the party is because of their recorded treatment of veterans. Republicans are anti-veterans. Democrats are not a great party, but their voting records indicate that they are big supporters of veterans.

      Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
      SECTION 1. Short title.
      This Act may be cited as the “Major Richard Star Act”.
      SEC. 2. Expansions of eligibility to certain military retirees for concurrent receipt of veterans’ disability compensation and retired pay or combat-related special compensation.
      (a) Inclusion of chapter 61 disability retirees with fewer than 20 years of service who are eligible for combat-Related special compensation.-Section 1413a(b)(3) of title 10, United States Code, is amended-
      (1) in subparagraph (A), by striking “In” and inserting “Subject to subparagraph (B), in”; and
      (2) in subparagraph (B), by striking “In the case of” and all that follows and inserting “The retired pay of an eligible combat-related disabled uniformed services retiree, who is retired under chapter 61 of this title with fewer than 20 years of creditable service, is not subject to reduction under sections 5304 and 5305 of title 38.”.
      (b) Technical and conforming amendments.-
      (1) SECTION HEADING.-The heading of section 1414 of such title is amended to read as follows:
      “§ 1414. Members eligible for retired pay who are also eligible for veterans’ disability compensation: concurrent receipt”.
      (2) TABLE OF SECTIONS.-The item relating to such section 1414 in the table of sections at the beginning of chapter 71 of such title is amended to read as follows:
      “1414. Members eligible for retired pay who are also eligible for veterans’ disability compensation: concurrent receipt.”.
      (3) CONFORMING AMENDMENTS REFLECTING END OF CONCURRENT RECEIPT PHASE-IN PERIOD.-Such section 1414 is further amended-
      (A) in subsection (a)(1)-
      (i) by striking the second sentence; and
      (ii) by striking subparagraphs (A) and (B);
      (B) by striking subsection (c) and redesignating subsections (d) and (e) as subsections (c) and (d), respectively; and
      (C) in subsection (d), as redesignated, by striking paragraphs (3) and (4).
      (c) Effective date.-The amendments made by this section shall take effect on the first day of the first month beginning after the date of the enactment of this Act and shall apply to payments for months beginning on or after such date.

    Odd you mentioned 14 years. I was medically retired just shy of 14 years and went through the ringer with DFAS and the temporary vs permanent disability retirement list. There's a lot they don't tell you when they serve you the medical retirement papers. My intent was to do a full 20+ but medically my plans had to change.

      Same here brother. I retired from the US Navy Submarine Service. Chief Electronics Technician Submarines (SS/IDW). I was already enlisted out to a little past 21 with extensions. I had a bad chiropractor mess my lower back up bad and had 3 lower lumbar fusion surgeries in short succession, not counting another 9 random surgeries as well. I am rated 90% with 9 service connected ratings. Highest being Fibro for 40%. My back is only 20%..... and I can't work for at all really. I struggle to do yard work and house stuff. I feel like a complete failure to my wife of 22 years. She is the only reason I am still on this Earth, because with the way we are looked at as basically a nuisance by VA doctors, so whats the point any more. Still in decent shape, just hurts, everywhere for a plethora of reasons, all related to service. I am 6'6" so submarines already was a BAD idea. From what I am seeing this Richard Star Act won't cover my situation, or yours, it seems. Some bull crap IMHO.

    Chicken butt. I've been trying to get my disability claims approved and got denied on all 20. I filed through a third party agency. Whenever I received my denial letter I noticed that the time frame was only for my basic and AIT. Is there anything that I can do besides doing higher review?

    To hell with the VFW..they shunned me when I came home from Vietnam just like most others..and I never looked back!! Semper Fi RVN 69’ Kilo 3/5 0331 guns, currently 100% Angent Orange disability..since 2022..Nam’ didn’t kill me 55 years ago but it’s working its magic all these years latter..we were scorned for even thinking about sickbay..I knew nothing about VA disability for decades keeping everything in..but in my later years of life it’s spilling out of my inner soul..There’s no doubt about it that I have PTSD..but I’m learning about not poking the bear.. at 100% ..but if needed I’ll go there!!     Amen brother. This affects me. Deployed during Covid to Saudi Arabia. We didn't have the equipment needed to do the job and I got hurt in the process and the said it was not combat related due to not being in a hostel environment even though we got rocket attacks weekly.

The real reason was the bill was sponsored by a Dem and would have been signed into law by a Dem President and they didn't want to give Biden a win so they voted no at the expense of veterans. How many of those Repubs who voted "no" actually claimed credit for the bill after it passed? I know that cow Marsha Blackburn from my state did.

    Bro please do a video about veterans who were forced to accept SILT, CHAPTER 10, OR CHAPTER 4 and given OTH discharges after coming back from combat deployments and diagnosed with PTSD or MST only to have their discharges upgraded as a result of the HAGEL AND KURTA MEMOS and still have the VA SAY THEIR SERVICE WAS NOT HONORABLE FOR VA PURPOSES. THIS ISSUE NEEDS ATTENTION. MANY VETERANS HAVE WAITED YEARS TO BE ABLE TO RECEIVE BENEFITS AND ARE STILL BEING DENIED!! There are THOUSANDS of veterans dealing with this issue! How many would still potentially be here if they were able to just have their service recognized and not walk around with a scarlet letter on their service.

    @TheCivDiv. Please try to collaborate with more VA content creators to get more of the word out ( like virtual town hall quarterly for example). I know you do so much already and you have your family to prioritize first but if the opportunity comes about. Just if you can. Also American journalists in the media are bought and paid for. They are hardly worth investing much into I’ve learned. We gotta do it all ourselves.

And last I checked the Repubs were in control of the House so they're pretty much controlling appropriations. Maybe pull that head out of the dark place it spends most of it's time and actually research why there is a shortfall.

    the issue is the bill needs minimum retirement age for medical retirement like say 15 years in addition to slightly reduced benefits instead of the full 40% of pay at 20 years maybe 30% at 15 years
    or else you will have everyone and their mom retiring at 15 instead of 20 in the military

Why should I be screwed over because of a Navy Doctors decisions to force me to see a chiropractor who compounded a bad issue. I served with Distinguished record. I mean Distinguished. I have the Evals, Medals/Awards, Sailor of the Years(s) for entire fleets, etc. to prove it.

    I haven't been able to get my health care the entire 50 some years the VA had me on their rolls. A fire in one building, and a flood in another building, all your records lost...always they are always correct and you are always wrong. I don't know about now, if, upon separation you are given your medical and other records, but when I got out I wasn't given anything but a shove out the door. Contact your congressman or senator and they can't do anything but ring the instillation or send a letter, then the local VA gets in your face, i.e. send you an appointment letter and the time on that letter has one time, but at the VA the person behind the desk tells you your an hour late, or, your name isn't on the list for an appointment. Oh, just a type-o or huh, how did that happened? I don't feel safe. That feeling descends upon us Veterans from Biden and the Nancy People they have created to be their minions; they start the wars and never fight them...
