Thank you Clay
Awesome!
CLAY - YOU ARE KILLING THIS!!!! 🎉 Thank you brother for keeping us updated and informed 🙏🏽
they need to add toxic exposure to bases in the US to the PACT ACT!!!
Include ALL U.S. Military Bases (state-side or over seas). Agent Orange is still on Okinawa: ua-cam.com/video/5tRkP2b3dsM/v-deo.htmlsi=KC9Pdyd-XXpuOZFF
My husband just got service connected for kidney failure due to Tera... after 20 plus years. He's still not 100%!! We're not giving up.
Great News , thank you Clayton.
Can’t beleive they don’t include ground zero 9/11 toxic exposure for pact act. Ridiculous. I was there a saw all branches there…
Call and write your Congressmen. It seems pointless, as just one guy, but I've actually managed to get through to mine at least.
Congress People don't care about you!!
Seems the Camp Lejeune water veterans are being left out again.
My VSO says her office has had granted presumptively quite a few migraines/headache claims under Pact Act under Gulf War participation
Yeah migraines can be presumptive. Explained here: ua-cam.com/video/x-jWR-q6_FM/v-deo.htmlsi=vS9KGnEqrVB2_cOy

Great work - clay. I submitted my claim - colon cancer under the agent orange/ Vietnam/ boots on the ground ( 1965-1966) Danang. they denied my claim - stating colon cancer does not come from agent orange; however prostate cancer does. Now, I have prostate cancer. I guess I can re-file under pact act for prostate cancer - this presumptive???
I just got rated 10% for Rhinitis last week. VA decision letter recommended I file a claim for Sinusitis. That was based off my CT scan indicating mild sinus disease. I HIGHLY recommend you get a CT scan. This will speed up the process.
THIS MAN SPEAKS THE TRUTH!
Great information thanks for sharing ✌🏾
I was in Kuwait during the PACT ACT time frame , current diagnosis for a presumptive condition and was still denied. 🤷🏻♂️
Send me that decision letter
- Clay
My husband served in the gulf war was in Kuwait it's on his dd214 and I have an article of his deployment. Unfortunately my husband passed away from colon cancer in 2019. I had been trying for the Camp lejeune he fought them but was denied 3x . While talking to a VSO they led me to this pact act. I may finally have the recognition that it was service related. He spent 22 years in the Marine Corp.
Need to add any toxic chemical exposures regardless of location and dates. Chemicals do not care when and where you got exposed. We had toxic chemicals in our fresh water supply on my Aircraft Carrier all the time. Also as a AIMD ships company Jet Engine Mech we used many toxic chemicals and got socked in JP-5 all the time, 1976-1980 USS Ranger CV-61. VA needs to stop playing games.
All of those would fall into TERA. You would need to show how your current condition is linked to your exposure.
- Clay
@TheCivDiv my self and my VA lawyer have. To many medical research papers state just that. I even added them to my caims. Two of my claims are setting in HLR for almost a year. VA errors. Does not help when reviewers have no clue what they are doing.
Got HLR claim back got 20% for Tera related toxic exposure for my diabetes and 0% for hearing loss as a jet engine mech. Now a true 90% rating. Working for that 100%.
Thanks Dad🤗
What about exposure to CARC paint in the 80’s
Not presumptive, that’s TERA
- Clay
Thanks for all you do. I got denied for COPD and am a Combat Veteran (OIF 09-10). They said my "favorable findings" was I have the diagnoses of COPD and I my local and time of service is TERA proven. BUT, they still denied on basis that there is NO Nexus (link) that my COPD was caused by my service as there was no record of complaints or med exam during service.
Can you Please Help?
-Man Down
So evidently I developed Asthma, which falls under the PACT ACT, while being at Johnston Atoll. They gave me 0% service connected. I hate the 0%, any thoughts? It’d be nice to get at least 10% for it. 🤷🏻♂️
What about undiagnosed problems such as CFS which you have been treated for but never diagnosed because it is a MUCMI?
Those can be presumptive and that’s explained here: ua-cam.com/video/x-jWR-q6_FM/v-deo.htmlsi=Lb5yH88PFMaXEA3e
- Clay
I had a ibs c&p exam for Ibs, and the examiner went against me because he said since my va doc diagnosed me with it then its not presumtive. Got a denial. Doesn't matter at this point but a true story.
What in the world? I was service connected through the c&p examiner, said there was documentation about stomach pain in medical records but at the end, I was given 0% service connected. So now I was filling the paperwork out again to get that claim. But your turn out seems like they will deny me again, even though I was service connected.
Yeah I know, how horrible to go through that experience and still no help, but let’s help other countries with their needs and let illegals come in and let us pour millions of dollars for their needs but not the needs of our own veterans? Horrible
How do I submit Evidence Base claim for IBS, if I am service connected for ptsd, and have been given a 0% for IBS, but now with this Pact act, how do I sew these 2 together, Help
Thank you Clay!
Thank YOU
- Clay
My Dad was a service connected Vietnam Marine and had pulmonary fibrosis and was told by his doctors at VA that is was not caused by Agent Orange, but I read on the internet that it is definitely on the list. He died from this in 2017. This really upset me.
If you can find the documents to support this claim you can file on his behalf
@@kdknowles40 Now with the pact act wouldn’t his condition been presumptive?
What good would it do to file on his behalf now that he has passed away?
You may need to talk to an accredited agent, but I’m sure you as a dependent can continue a claim after the service member has passed away.
Check the area where he was stationed/served
You mentioned your friend was exposed to burn pits in Kosovo and some new changes were going to cover that. I served in Kosovo and was exposed to burn pits also and am waiting to hear about what you were talking about.
Great explanation.
What was part three about toxic exposure and the kidney?
When are they going to include dementia as a presumptive?
If you are stationed in the US through out your career, are you eligible under the PACT Act?
Nope. There are other presumptives you would want to look into assuming you would meet those criteria.
- Clay
@@TheCivDiv where can I find them?
Any vets from camp Lejeune did you developed a lipoma and did you have appendicitis. Like 2 years after for me i got out in 84 .
Please correct me if I’m wrong, I thought the pact act was for burn pits. I haven’t put in for this because I heard there was a cut off of last August, Please let me know one way or another if burn pits fall under the pact act and if I can still put in for it if I haven’t
this gives the VA a whole new list of things to deny!
I do not understand the first one at all. Are they saying no C&P exam or opinion is needed if you have a current diagnosis for a pact act presumptive that has been confirmed as an exposure via the veterans Tera memorandum? So confused.
I was stationed on Guam from 73-74 and have been diagnosed with cancer, heart issues and diabetes and all they required was documentation, Nexus letters, from the physicians treating me outside of the VA.
I submitted a claim for sinusitis after finding out I needed surgery for the condition and was given 0% after no exam.
The way I interpret this is it requires a higher level of evidence from the veteran to establish their participation in a TERA but the way it's worded I could be totally wrong. They write this crap so no one can understand it.
Same, I had to put in for an increase and I got it.
If you are stationed in the US through out your career, are you eligible under the PACT Act?
Where is link? I need to get this to my lawyer ASAP. Change number seven destroys my appeal for being denied lymphomatic cancer of any type :(
Clay, at 3:53 … “remove references to lymphomatic cancer of any type” …. How does removing lymphomatic cancer as a presumptive condition favorable for vets with lymphomatic cancer?
They didn't service connect me for my digestive system because they says crohn's disease is a structural gastrointestinal disorders and not a functional gastrointestinal disorders but I have a current diagnosis and was in iraq/Kuwait in 2008, but they medical examination says it's not a presumptive condition but it falls under the medical unexplained chronic multi-symptoms illness and the va still denied it. Can you I u illerate on the matter
They denied my presumptive IBS with diagnosis coming from VA. HLR pending for correcting an error over a year now.
Here’s an interesting question. My ITF was Aug 2023. May 2024 I submitted 4 new claims. June 7th I have my last C&P exam. June 9 I submitted a supplemental claim for old denials. If anything on that supplemental gets awarded, will it be back paid to Aug 2023?
I think you would have needed to submit them both on the same day.
The 4 new claims submitted in May (assuming they were submitted the same day) will use up that ITF. More info would be needed on the supplementals. They could be paid back further than Aug 2023 if you filed within a year of denial, continuously pursued the claims, etc. Otherwise the effective date is likely the date you filed. A knowledgeable person (VSO, lawyer, etc) would need to see your file to give you an accurate answer for those.
Awesome
Will these new conditions under pact take priority over non pact act claims that have been waiting for a decision?
That’s not how claims are processed
- Clay
Plain english------ explain #1!!!!!!!!!!
No thumbs up. Please explain it
@@jaybeezee4013 Find the a artical copy and pasta it into chatgpt and ask it to break it down for you in simpler terms.
@@jaybeezee4013 I don’t understand it either.
They are denying presumptives. It’s nuts, waiting on HLR for IBS.
Get the CFile and do a HLR. Likely rater error as their training sucks. Your claim has DD214 validating appropriate theater medal, private doc record with diagnosed ICD10 code, and free a VA Toxic Exposure screening = automatic 0%. Private and VA treatment for at least 4- 6 months = 30%.
Anything on Ulcerative Colitis?
Clay, at 3:53 … “remove references to lymphomatic cancer of any type” … what does this mean, how is it good? Does this not mean they are removing a presumptive condition?
What are the perks to each Membership? I am not seeing the perks only that one includes the previous, and the next includes the other prior perks. Can you update that, or send me a link where to see them? Thanks!
Good stuff Clay. What about psoriasis? I was denied psoriasis recently. Isn't psoriasis considered a MUCMI because it is a skin issue? I am a gulf war veteran that is covered under Sec.1117 and 1119. During my HLR I received favorable findings for the current diagnosis, participation in a toxic exposure risk activity is conceded, and the evidence shows that a qualifying event, injury, or disease had its onset during your service. How does this change affect my claim for presumptive?
Is your HLR still in process and now kicked back to develop the claim?
- Clay
@@TheCivDiv No my HLR was decided on January 27, 2024. I was continued and denied. I submitted a supplemental for the Psoriasis on January 29, 2024 and it was decided on June 7, 2024 and it was denied with a private IMO and favorable findings from the HLR. I was so frustrated that I submitted a NOD 10182 for direct review.

Clay ... would love to work with you ... I have filed Pact Act Claims .. or at least claims that fall under the presumptive conditions and just received a decision letter saying I was DENIED ... I have time in service ... location ... and a diagnosis from my Primary Care ... and was Denied ... what are your thoughts on this?
Send me the decision letter

Great info Clay Question if you submit a nexus and a DBQ (private dr filled out) do you have to go to the exam scheduled by the VA? Thanks for what you do?
Yes
Interesting. Question maybe someone can help with. On my VA Information Letter Regarding Benefits it's states the following * Exposed to Ionizing Radiation while in the military. The problem is I have no idea how or when. How can I find this out?
I would start with looking into my C-file.
I got denied for chronic rhinitis which falls under the pact act even thou it is documented I was deployed to afghan and iraq
Send me the decision letter and I guarantee that you weren’t diagnosed. Having it in service doesn’t mean anything for presumptive conditions.
- Clay
@@TheCivDiv i know some people that threw that in there, 0 diagnosis and got it, and I shredded that paper, I was mad since I got denied some claims without being seeing
Does gastrointestinal disease (rated at 10%) fall under pact act? I was hospitalized in tent city in Saudi Arabia (DesertShield/Storm) for gastrointestinal disease
Same for me with Chronic Sinusitis, got denied although it is a presumptive condition and I have the symptons/medication as well. I filed a HLR for it, so currently waiting on a descision.
Link to register missing
Number one made zero sense to me
I’m Air Force and even I don’t understand it. Lol
I didn’t understand a word you said
will they add blood cancers like lymphomas?
I’m rated for anxiety and Ibs so does this mean that I can file a claim for Ibs secondary to anxiety. Gulf War Marine Veteran also.
If you’re already rated for IBS then I’m confused…
- Clay
@@TheCivDiv thank you I guess the answer is no. I appreciate all of the information that you give.
Do you receive compensation even if your 100 percent P&T ?
I was rated 0 percent for sinusitis, do I ask for an increase?

Great. Now add sleep apnea for gulf war vets
They probably will in a few months after they get finished making the overall rating 0% for OSA.
I put in for SA in my submission to the VA and got granted 50%. I took a sleep test three years ago and stated to NP on exam it was contributed to Gulf War. Also had a medical study submitted stating GW vets are more likely to get SA from war. Hope this helps.
@@MetalRipper67 where did you find the study? I just submitted my claim but can still add stuff as it has been a little over a week
It was the US Army Health and Science Site. Just google that and it should pop up about Desert Storm Vets more like to have Sleep Apnea. If you can't find it give me another shout out and I'll grab it tonight when i get back home and send it tomorrow to you.
Is IBS linked to PTSD?
Yes
- Clay
That's what I thought
Yep
Is it too late to apply?
Question should you pyramid all the secondaries
That question doesn’t make sense
- Clay
meaning should you list all your secondaries to your service connection all at once or separatly thats what I mean
@@paulshields5340 I would send them all at once.
What’s an OG veteran?
OG is original gangster and I would define that as Vietnam era 😂

I have a pact act and toxic exposure on 2 of my claims that are deferred is this good?
It's neither good or bad at this point. The VA is allowing themselves extra time to make a decision.
@@user-ds1vq3mi2r thank you, was wondering why my claims are taking so long to make a decision
Day 81!!! Still waiting no movement for 81 days
give it about 120 days... then worry
Camp Lejeune, bug juice 😢😢
How is REMOVIGN adrenal cancer a good thing?
Read it, they aren’t flat out removing anything
- Clay
My issue is that I neither served in any of the locations nor timeframes but was service-connected for my adrenal tumor by the VA for Southwest Asia service. My argument was that I was exposed to Agent Orange in Okinawa (where the VA has 250+ Agent Orange claims) but has now placed it in the Persian Gulf where hundreds of thousands of Veterans became ill. To me the VA has opened a Pandora’s box of claims for Agent Orange (or did they use the rainbow) for all Veterans from 1990-2024 who became ill for Southeast Asia service.
waiting for them to add leukemia / lymphoma because DUH
The amount of BS out there these days is wild. I'm 100% sure that he is NOT my father!
