    why would kesha want to stay with sony records? no matter if she works with dr. luke or not, he will still make money off of her. he even admitted that he makes money off of the album “rainbow”. this who situation disgusts me because if a woman says that she was raped, everyone questions whether or not it is true, but if the woman says she was not raped, everyone takes it as a straight fact. what has our world come to?

  • @iloveblondy

    i believe kesha because rape is NEVER sexual. as many people might think it is it isnt. rape is a COMPLETE POWER TRIP. showing physical dominance. explicitly showing and telling the victim they have no control or power to stop what is happening to them.
    dr luke can go. let him go, let him end.

    The only problem was--is--, while Kesha, is of course, pursuing more music, he is still benefiting off of her. His team even released statements saying that exact thing. That Kesha is still working under his approval. That her new record and everything coming from it were still approved by him.

    one thing to note: as stated by the court, Kesha is free to create music on her own music without Dr.Luke's influence, but any music she wants to put out will be released through kemosabe records, of which Dr.Luke is the CEO. So while Kesha is "free" to make music, whether or not she actually gets to put anything out is still under Dr.Luke's control.

    Everything she makes with other producers, would still be legally owned by Dr.Luke. Hence why she hasn't taken the offer. If she were to, he would pick the singles released, the tracklist of the album, the promotion budget for the promotion of the music, everything...even if he had no involvement in making the music. Everything she does musically, belongs to him.

Luke is still her boss and anything she wants to release MUST go through him - he must okay everything she does if she wants to keep making music. That's what this is about. Cenk believes Kesha because "It's a helluva thing not to tell the truth about." But it happens: UVA Jackie, Duke LaCrosse, Columbia's "Mattress Girl", and the Brian Banks case are all cases where women made false rape charges.
    Kesha did not make her charges until AFTER she was in the contract dispute. She previously testified under oath that Dr. Luke did not rape her. Why would she get out of another contract to get back under contract with her rapist? Why would she not make the accusation until AFTER she was in the contract dispute. Then Sony tries to accommodate her by allowing her to work with another producer, but she refuses because she would still be under the same contract. I'd say she has a million reasons to make a false rape charge.

    Hi- can you guys do an update on Kesha? I know it's "just pop culture" and not considered "real news" by some....but I JUST got onto her new music... and considering what all she's been through- it's more powerful and soul stirring than anything I've heard or felt in a long time. She is Elevating Pop music right now in this moment. "Prayer" is victorious, and "Woman" is the most fun and empowering Pop song I've heard in ages- with real instruments and brass behind it too. Her name is now Kesha not Ke$ha. To me it's interesting how she's a great example of how her talent was being wasted and exploited so much before- Bc everyone is SHOCKED at her talent now, but it was always there, she was just being dumbed down and objectified- which considering what poignant stuff she is capable of- shows what a travesty that is- and it's a bigger issue than just Kesha- it's the whole music industry- and the messages they promote to the youth of the whole world. It's really meaningful now what Kesha is doing and that she's not broken and she's back with such a vengeance.

    innocent until proven guilty doesn't apply to rape allegations... That's the problem with rape allegations. No matter how innocent you are, it will still ruin you.
    Just look at Michael Jackson. Some people claimed he was a child molester. The lawyer advised him to settle and be done with it back in the day, so he did. Worst advise he got, because now people assumed he was guilty. So when he got accused again, everyone assumed he was guilty, again. This time, he didn't want to settle. He was acquitted in court, as in innocent, but people still think he did it.

Kesha obviously knew her contract was with sony, so why would she or we believe the threat by dr luke of ruining her career to be true (if it ever happened). 2. Since sony did offer Kesha a new producer why did kesha refuse? If Dr.Luke did rape her, a new producer must obviously been what she wanted, right? 3. Accounting for her fame and wealth in 2011 during the 2011 trial/deposition why should we believe that Kesha and her lawyers would not of used the opportunity to attest to the crime?

    I"m sorry, but this whole case is a joke. 1. There is no physical evidence. 2. It doesn't matter how many pop celebrities copy her by saying he raped them too, it doesn't make it more true. and 3. You signed you life away to be a corporate pop idol, they pay you millions, make your music for you, set up your tours, do all of your publicity, etc. You're damn right they are going to ask you to stop slandering someone who works at the company when there is no evidence. This isn't a admittance of guilt, it's them paying to make this problem go away because it's hurting their bottom line even if though it's probably going to turn out false in a court of law. Also, you're still under contract with them, so i'm not going to be teary eyed when a court rules that you still have to work for them.

      +Information769 They certainly attempted to be open about it without invalidating her claims or painting him as definitely an evil rapist.
      *looking up* Leave it to the partisan commenters with chips on their shoulders and little more than personal gripes to go off to do that.
      It's like TYT are actually shining a light on how difficult and nuanced the courts and legal system can be. Or how it can be difficult for a genuine rape victim to come forward when it's tough to prove and our systems operate (so that they can't be abused) on a 'innocent until proven guilty' basis that doesn't help them if they have little evidence. Or how it can be equally difficult to defend yourself from an accusation for similar reasons - people lying about being rapists because they know it's hard to prove and people lying about being raped because they know it's an equally hard accusation to refute. Taking an austere point of view on either position really only helps people get away with doing one thing or the other, which in turn creates more and more people likely to do it.
      The fact is - whether we like it or not - each case is very different and should be treated differently, as an individual incidence when it comes to things like accusations, innocence, guilt and the court of public opinion. If there is a larger problem that problem needs to be addressed _outside_ the case at hand instead of applied so that we don't have to think too hard and can satisfy our 'Men = bad' or 'Women = bad' narratives. People are bad, not genders.
      Unfortunately the world is full of people who think that if you're a man you're just a rapist waiting to happen and if you're a woman you'll cast false accusations at the drop of a hat when the truth is - thankfully - that I think the law doesn't take either position very strongly and is more interested in the rocky, difficult and unenviable position of observing due process.
      For now, at least. Give it time and give the kinds of comments here enough attention and that will change, one way or the other and to the detriment of everyone.

      Most rape claims are coming from young woman who got drunk and slept with someone they wouldn't have if sober. Men find themselves in this situation as well but they don't cry rape they just chalk it up as a bad night. If a woman gets drunk and drives a car and causes an accident we don't forgive her because she was drunk. If a drunk woman stabs someone she isn't let off the hook, but when a drunk woman has consensual sex suddenly she is the victim and didn't know what she was doing.

    • @riss803
      @riss803 8 років тому +1

      crazywaffleking *most* rape cases aren't actually reported because theres a negative stigma associated with it like the one you're describing, victims will think others will assume they were faking it and have to live with emotional trauma from the event with no justice. most rapes occur in cultures where rape is not usually punished, so if we want rape to go down we need to stop accidentally supporting the criminal behavior.
      a drunk person driving is causing potential harm to other people, so is a stabbing. if you are drunk and a sober person takes advantage of you when you're in a delirious state then it is rape. drunk sex is considered rape when the person is physically unable to give consent, like passed out, having cognition issues, or unable to walk straight.....AND the other person would have to be sober-ish. this is why rape is so hard to convict people for, theres just no way to know what happens.
      having a few beers, getting drunk (but not really really drunk), and having sex with someone you regret later isn't rape, i agree, some people will take it too far. i wish there were a higher percentage of people who would know better than to have sex with a drunk person but its really not possible for everyone. the world is full of sick people, but i think rapists are much more dangerous to our society to begin with and i don't want to silence real victims.

      sgtsnakeeyes11 Well, argue for it then. You haven't done anything but make claims. Where are the supporting arguments or evidence?
      Even if, perhaps, some people are disproportionately violently denying Keshas claims, it would be understandable. Retarded feminists for years now have been pushing for absolute stupid solutions to rape, by saying that every rape victim should be believed and the accused should be punished regardless of evidence, or that comedians can't make jokes about rape, or using pregnant women who were raped, for their argument for abortion. Which is a fallacy, because they want abortion to be, as it is, a banal popular act, while defending it with small individual cases, where they appeal to sentimentality instead of argument. (This isn't an anti-abortion rant, but using rape as an argument for popularized abortion, available to everyone is nonsense ) Or the amount of famous rape cases, that the feminists went apeshit about, only for it to have been debunked and shown to either be fake or untrue.
      So looking at the track record of stupidity, concerning rape, I don't think it's to be of much amazement that many people are starting to be increasingly skeptical and it's your sides fault. Because you have been wrong many times, as it's expected, because you don't see the importance of evidence.

    Well even Michael Jackson spoke up about Sonny and called them the devil, but nobody wanted to believe him cause he was made out to look crazy and a child molester.
    So obviously Sony got some skeletons in their closets and most up and coming artists are afraid to speak up. If he biggest star in the industry tried it already and failed miserably then what's a lil barely known person going to to do?
    Even Mariah Carey hated her husband and Sony for the abuse she suffered from them and that's why she left him.
    MJ said she came crying to him and didn't see no way out and then as she got free for some reason she started having "mental and drug issues" and had to check herself in a clinic.
    Coincidence? I don't think so!

    just asking and please correct me if i have a flaw in my logic: if kesha in 2011 swore under oath that dr. luke did not sexually abuse her and she never had sex with him and now she says he did rape her, doesn't it make her commit perjury if her new statements were true? or a liar for the current cases if her statements under oath were true?
    wasn't it the argumentation why she lost the recent cases because of her statments under oath? i mean her statements under oath and her allegations now can't be true at the same time, at least not legally or can they?
    can there be punishments for lying under oath retroactivly, like if she wins a court case where dr. luke gets cinvicted as a rapist, but that's in conflict with her statements under oath, can she get the up to 5 years in prison punishment? i mean wouldn't it be prove for her statements under oath being not true?

      King Andy Interesting. I'd say all that makes her story more believable, not less. Think about why she had to deny it in the first place: because she was talking about it while in rehab, to doctors and so on. For people who don't believe her, is that supposed to be some kind of calculated move in anticipation of maybe wanting to get out of her contract later? That doesn't sound very likely. She actually says in one of those letters to her fans that she and her family had been tortured; kinda works with the argument that she and her mother might have made those depositions under some kind of threat.
      Lakobos Merkel Sounds to me like her legal team will be arguing that she made that deposition under duress, which would probably work as a defense against perjury.

    Ya know alot of guys never dealt with a woman who just abused the R word.
    Im thinking this guy had sex with her... when she was "raped" and she renewed her contract with him after...???? Which is like... Something she didnt have to do... and now she wants out of her contract because its not working out with DR Luke.. and now shes calling him a rapist...
    See where this is going? The courts show Kesha isnt favored by the facts. Its all too easy for a woman to just say rape when relationships dont go the way they want and ruin a whole mans life. For this im actually thankful republicans put in laws across states needing burden of proof.. for awhile it wasnt needed for you to go to jail or be held or be charged.
    He might be a jerk. Did they have a working and sexual relationship? yes. Did it work out? no. I feel just because shes sick of the guy hes now being labled a rapist and the courts showed kesha had every oppurtunity to get away or report or not renew with. She was already a star... none of us knew who dr luke was..Its not like omg she mad a new song... yeah but theres no DR LUKE... ? like wtf... plz... I think this is a mentally unstable drug abusing woman who wants to ruin a mans rep because their relationship didnt work well.

      But personally i do have experience in that field. Id say more actual women and society and sensationalized media don't know what rape is. If she went through an aggressive or under duress sexual encounter than i would understand. That is rape in many instances outside of a relationship. A woman's moodswings and hatered of someone for being an asshole isnt.
      Sex is complicated. Yelling the R word shoudnt be so simple.

    Here is the problem with rape allegations and trying to pick a side. Sexual assault is VERY hard to prove. What most people think of sexual assault isn't the type of assault that happens everyday. Rape is sex without consent. Consent is only given if the party is able to give consent. Every weekend many women have sex while drunk, and they are not able to give consent. These are cases of rape. Many times women feel pressured into having sex when they don't want to, this also is a form of sexual assault. But many women just put up with it. When a woman is asleep, and the man has sex with her, that's also a form of rape. Many times this goes unreported as the questions come as to why are you in their bed, you must have had it coming? These are all VERY hard to prove in the court of law that they happened, BUT by definition they are all sexual assault. I have no problem believing Keisha's side on this, and like all of these people, they said it's more than likely to have happened and I believe it's more than likely to have happen. With that said, if this was to go to a court of law, I highly doubt Dr. Luke would get charged let alone convicted. Sexual assault is something that's very blurry and if there is no hard evidence (which there is rarely is) then you can't convict without a reasonable doubt. I truly feel sorry for those like Keisha, the many who are caught in these grey areas of the legal system that was designed in a time when it was illegal for a woman to testify against a man. We now have to fix our legal system to adjust to sexual assault.

    • @Boobalopbop
      @Boobalopbop 8 років тому

      Seriously? So if a grown woman decides to take (for example) some ecstasy, Coke or Molly and this makes her horny and she decides to have sex with someone... He is now a rapist and needs to be thrown in jail and labeled a sexual predator for the rest of his life? Should men walk around with a printed sex contract that every woman they have sex with must sigh swearing she is 100% of sound mind and body, has I consumed no alcohol or drugs legal or otherwise.... Oh wait, even if he had that contract it wouldn't be valid because of you sign a contract while under the influence, it's void. OK so maybe men should somehow be able to purchase their own breathalyzers or drug tests, just to be safe or your whole life can be destroyed by a rape claim, because it'll be your job to prove your not guilty. That's bullshit.

    • @martyc909
      @martyc909 8 років тому

      alex2143 I agree and disagree. Also, you have to remember other things were legal when the justice system was set up, we are slow to modernize it.
      What I'm saying is that we need to have a system set up to deal with rape and sexual assault. There needs to be something, because many times, like this case, there are many around the situation that say this more than likely happened, but you can't really prove anything. Because of our, without a reasonable doubt standard, many men get away with sexual assault and when nothing happens to them, they repeat the actions. This is a problem. Men are always worried about false accusations, but the stats show that many more women are assaulted and it's not reported than men are falsely accused, in fact the numbers are not even close. So we have to find a way to make sure we deal with this issue.

    • @martyc909
      @martyc909 8 років тому

      alex2143 Tell me, what do we do about the fact 1 in 6 women in the United States have been sexual assaulted. That's about 2.6 million women in this country. Between the ages of 12-30 are at the greatest risk. So we're not even just talking young women, who you seem to think of as pray, but also young children. This 1 in 6 number is actually a conservative number, the NY Times reports 1 in 5 according to their own polling. But I'm using 1 in 6 which is the number used by RAINN (Rape, Abuse & Incest National Network).
      We need to update the legal system to deal with these situations. I don't know about you, but I've known many women over my lifetime, including close family, who've had to deal with sexual assault. In almost all cases, the guy walked free because of lack of evidence and they repeated their behavior. This needs to be fixed.

    • @alex2143
      @alex2143 8 років тому

      martyc909 Pray tell, how would you update the legal system then? You say that the guy walked free because of lack of evidence. How would you fix this problem? Guilty until proven innocent?
      Please tell me, I have no idea. How would you fix this problem?

    • @martyc909
      @martyc909 8 років тому

      alex2143 You know, if it was just close family, I might say that what we dealt with was isolated. But the jarring problem comes with how many women are affected by this. And in order to improve this huge flaw in our justice system it's two fold. One being the actual court system and the other being prevention.
      The first starts with teaching young people their rights. Not just women but men too. What is consent, what to do if something happens and you didn't give consent, all of these areas. Go beyond thinking that sexual predators are creepy men in dark alleys, but let them know that the vase majority of sex assault happens by someone you know. How to report, and who to tell. Also train police to better handle these situations. Many police are trained to right away question victims, but in many of these cases police reports that are filed turn out to not be relevant because at the time victims go through shock and don't remember much. After time they remember more which counters their report at the scene. So then this is used to discredit the victim. Instead train police to more appropriately handle these situations.
      Now for the courts, a few things they can do. Have legal experts there for victims. Many times women are filing complaints on their own. There have been cases that prove something happened, but the woman didn't have a lawyer and the DA's drop the case no matter how much evidence there is. DA is a publicly elected official, these are cases they are normally not looking to take on because it's hard to win these cases. We need to fix that and find a way to get these victims support. Out of 100 incidents, only 7 are even filed and 3 are even heard. The system must find ways to support victims and help them legally through the process.

    The problem is that she continued to work with this guy for almost a decade after he supposedly raped her. At the height of her fame, she decided to bring those allegations forward...probably in hopes of getting out of her terrible contract. Unfortunately, I do believe she is of the character to make false rape accusations.
    Ultimately, she provided no evidence, creating a he said/she said case in a crime that is notoriously difficult to prove if the victim doesn't report the crime as soon as it happens.
    Now, would Sony offer her that deal? Yep. Its bad PR to have somebody running around associating your brand with rape. At the same time, it would ruin her career. Nobody would work with a person who who admitted to false rape accusations...which is why she chose to go to court. That way, she can still save face.
