In theory, the Courts can ban lighting agarbattis, performing havan and ringing bells for pujas. How is this possible? This is because the Courts have been delivering judgements, each of which have been ever more restrictive in terms of what is allowed.
We trace the origins in the Shirur Mutt case, through the Venkataramana Devaru case the Ajmer Durgah case to the Sabarimala case. The doctrine of essential practice is analyzed against the concept of religious denominations.

After having seen some of the comments from my Hindu Brother & Sisters, what I feel that we need not be so defensive (as we always usually do) by insisting our Sanatani Hindu religion should be based on one book or insisting for some definition. It is very hard to understand about resistance to associate India with Hinduism particularly by so-called progressive (पुरोगामी) Hindus. Very unfortunate…! How don’t these so-called secular liberals understand that Hinduism is entirely different from the Abrahamic religions? Its history, compared to Christianity and Islam, is undoubtedly the least violent as it spread in ancient times by convincing arguments and not by force. (The best example is: Aadi Shankaracharya who defeated great Buddhist scholar Mandan Mishra in debate and free Hindustan from Buddhist hold). It is not a belief system that demands blind acceptance of dogmas and the suspension of one’s intelligence. It is an inquiry into a truth based on a refined character and intellect. It comprises a huge body of ancient literature, not only regarding dharma and philosophy but also regarding ethics, psychology, music, architecture, dance, science, astronomy, economics, politics, medicine, etc. Hence, if at all we need to follow one book; such a book would be nothing but ‘Bhagawat-Gita’ because it would be perhaps acceptable to all sections of our contrast societies in spite of many regional differences. Moreover, if any section dares to oppose under the influences of foreign concepts of ideology, we all other Hindus must be united and resist such opposition not by the way of Buddha’s teaching; but we should follow as per its very valuable practical teaching of “Bhagawat-Gita”.
