Officer Tells Me that He Doesn't Have a Name

  • This is my first video I've made for citizen journalism. Please give me feedback in the comments section, tell me what you thought I could have done better.
    Lieutenant Wright with the Buncombe County Sheriff's Department did not want to give me his name.
    My general purpose (not just with this video) is to bring awareness that citizens are watching public servants and to help obtain a more transparent government through accountability.

Is that they could make up a bullshit reason, that gets thrown out of court just to give you some hassle too. I sure as hell wouldn't want to be arrested for no reason and then sit a night in jail to have the case dismissed.

      The Man had many opportunities to rebut it. He chose to make the repeated claim, "You can tell me your name a badge number." So the so Called Officer's statement stands. It's his property according to their CON-verse-action. (Conversation). Could it be that the Officer knows more about the law and played the game better? Hope this helps my friend.

      Depends. In some places they are required to do so by law, in other places it is only department policy that they do so, in others they have zero obligation to do so.

      ***** You have to be a child with your thought process. The city did not buy the property or pay taxes on it. The "kid" had to buy his and pays yearly for the use of the land. Which is crazy if you think about it. When you buy a home you buy the land with it. Why does the city think they can charge you a tax on something you bought??

      The only thing he was trying to hide was the simmering conflict waging just beneath the surface. While on the one hand his [clearly] enormous ego was sufficiently humiliated that he was actually seeing flashing visions of himself snapping at any moment and absolutely destroying you in the process. However, this was counter balanced by his deeper fear-- that being the exposure of his quite remedial intellect and complete inability to think either critically or calmly under any kind of pressure-- especially the kind of pressure which bluntly confronts him with "education" and so in summing up I would wager a bet that he got that job through a respected relative and his application is full of contrived walter mitty ramblings- a bit like this one in fact. And on that bombshell... Goodnight! :)

      Unfortunately, there is no chance of this demonstration being protected by the 1st Amendment in court, the second you said you were recording for 'personal reasons'. You could either remain silent or state that you intend to share the video with the public which would lend to the idea that this is a journalistic recording and therefore would be protected by the 1st Amendment.

      OneScorpio Really? Can't people record their public officials in a public setting regardless of the motivation? This varies state by state with audio as some can claim wiretapping... Can an amateur photographer not take a bunch of pictures that would be suitable for some men in blue stroke calendar? That amateur photographer is only allowed to take photos of public employees if they're in the employ of a media outlet. I think that's specious.

      muteuser I didn't say that they couldn't do it, I just said that it isn't protected behavior. Most demonstrations like this are to exercise the First Amendment and 'personal use' of video/audio recording isn't protected.

      Jamel Wooten Please clarify the difference between the two, I don't follow. It seems as though it is something that would be protected regardless of a person's motivation. Can't recording yourself be a part of that first amendment? You're capturing your voice, your view and information, is a recording not protected speech?

    Credit where credit is due, the officers who responded were cordial and respectful. The second officer even said "They seem to think that's there's..." about the sidewalk. As much as we should expose bullies like the Sheriff's deputy, we should also recognize good officers like the two that responded. They didn't even ask about recording or anything, they respected his rights. Even if they don't agree with what someone is doing, they should respect our rights to do it. Too many cops, like Deputy Curly, want to show everyone how big their peckers are.

    Outstanding camera work. You handled the situation with the first cop, and his clones perfect. He was rude, evasive, and without your camera probably would have tazed you and alleged you assaulted.
    The responding officers..wow, they must be new or rare because those two were great.

    I will say I have a lot of respect for how the city 'Peace Officer' handled himself. Refreshing to se a police officer say, "I don't Know" instead of making up stuff, seemingly to enforce their authority (they don't have).

    The next time a cop says leave my property, or get off my street, remind him that actually the property, and the streets actually belong to the people. We pay for them with our tax dollars. Also ask for a supervisor, or someone higher than him.

    I think anyone, whether in uniform or not, has the right to ask why they are being videotaped by random strangers. It is just creepy.

      If a random stranger asks for you to stop and you don't it's against the law, if a public servant (paramedic, doctor, fireman, police, etc.) ask you to stop it is entirely your decision whether or not you want to stop filming and they can't do shit about it

      ***** not in the united states. in the US of A you can legally film ANYONE IN PUBLIC. there is absolutely no expectation of privacy. however.... that being said making money off of people you film is an entirely different story. If you film someone on the street and then monotize your video without their permision you are using their likeness and can become actionable. as in law suit.

    As for the distinction that there is a difference between county and city property, that confuses me a little as I live in Australia, and we get confused easily lol.
    As far as I understand the matter here, I believe that so called " public property" if it's in the within the built up area of a city or town, then it's Council land, and if it's outside city limits then it's owned by the State Gubbermint.
    Ultimately, all land in Australia is owned by "THE CROWN" which should not be confused with the stolen jewellery that QE2 wears for ceremonial floggings of peasants, it actually is " THE CROWN CORPORATION" .
    However, I believe that the same principle applies here as well. The police have the power to give you a "move on" order, which was designed to be able to calm down aggressive people who were in the middle of, or about to create a public order nuisance, affray, disturbance or something of that order.
    By the way, I think you handle yourself brilliantly.... well done.

      No they dont - I challenge you to prove it. Show me a law ( not department policy which is not legally binding) which states the cops have to show ID.
      It's a very common myth that people claim cops have to show ID on demand -- but I have yet to see anyone show me any law which states that is the case
      Unless the cops are arresting or detaining someone they dont have to show ID.
      Of course if you disagree with me I challenge you to show me the law which states they need to show ID on demand.

    I think law enforcement is starting to SLOWLY get the message that citizens are tired of them being able to operate without impunity. Many citizens, who would never have thought of filming "cops" have now begun to do so. It is because they have seen videos of disgraceful behavior, and want to do something about it. I find it funny and ironic that it is directly related to the behavior of law enforcement that don't want to be filmed, that is making more videos. They are the product of the very thing they fight against. Well done!

    I'm all for on duty cops being required to give name and badge numbers on request. I'm going to advocate here (a little bit) for an understanding. It seems in this circumstance you have Sheriffs getting off work and walking out of the building. Getting into their personal cars - and you're putting that on UA-cam. A spouse may be picking them up, kids could be in the car, they don't know you or trust you with that. This is a detention facility, so emotions run high, guards get set up and blackmailed, families get threatened, and posting the images and names of the people that work inside can put them at risk. Say you record a Deputy getting in his car and show the plate, and later his wife or 16 year old kid is in the car and someone confronts them?
    With that said, Lieutenant Wright was out of line, he should have explained (on camera) his alarm at your filming his officers coming to and leaving work. If he had, I expect he'd have accomplished his goal, mitigating any danger to his Deputies and the facility. I'm putting this on him as you were pretty cool through out, and he seemed mostly interested in impressing his staff by swinging his balls at you.
    How would you have responded if he has explained his concerns, then offered - "You know I can't give impromptu interviews, we all have jobs to do inside at the moment, but I can give you the card of the media liaison and request that you can come back, be invited inside and interview me all you like. Can we do that?"
    I'm betting your video would have been a lot more pro-Sheriff. Am I wrong?

    Damn dude... If you would have known the reason for the name and badge number it would have shut him down... You need a name and badge number so you KNOW he is a cop. It is so they can identify themselves as part of the county. Any person can dress up like law enforcement; but if you are actually ENFORCING the law, you have to identify yourself as a cop with your name and badge number. That way, any discrepancies you may have with that person can be called in to the county, and they can tell you whether or not the person is a cop.

    What most assholes don't get is that police officers are people too. The law may state that he has to give a name, but if a creep with a camera randomly asks you your name and ID without saying why he wants it and refuses to leave, I fully understand the police officer not wanting to give out his infos. Now it's just about shitting on anything related to law enforcement to appear as the tough guy.

      What YOU don't understand is that cops swear an OATH to uphold the Law and our Constitution. Not the laws that apply only to the public or ones the don't feel like complying with, but ALL of them. If you look up this particular Departments website, I'm sure you'll see a bunch of crap about their integrity. Integrity is doing the right things at all times, not when you feel like. So what if the guy recording is a jerk, ( which I disagree ) the cops should be able to take it. If not, they should get another job.

      uh... no. police officers are not civilians. they are public servants. it's not about shitting on the law, it's about police accountability. when police try to bully you into doing something by telling you it's the law,and if you don't do it they'll arrest you or get violent with you, generally we tend to take that as face value, but a lot of the time, they are lying unlawfully. It's about the principle. We pay taxes to have them protect us. Not so that they can detain us and bully us. In fact I'm tired of this bullshit.

    On several occasions I've had police refuse to identify themselves to me, yet they all asked me for I.d. in response with the added threat of noncompliance and refusing to obey the orders of an officer of the law. I finally called internal affairs, which informed me that all police officers must identify themselves and that I am not required to identify myself unless I have commited a crime or I'm part of a criminal investigation; but, that I never have to show I.d. (not required by U.S. law). I was told that I can verbally give my name, date of birth and current address... or, they can fingerprint me (if I've commited a crime) if I choose not to give them any information.

    99% of the time I side with the citizens on videos like this, and I agree that the police are out of line. However, this is one of those examples where the person filming is just meddling with police and ultimately trying to get a reaction out of them. The point of these videos is documenting the abuse of power, not starting unnecessary conflicts with the police.

      Although I agree he seems to be just trying to stir up trouble, how hard would it be to handle this professionally? Either ignore him until he does something which he probably won't or answer his request as you are required to. This cop/public employee by not giving his name gives the camera man something to hold onto.

    Seriously this vid is a fucking joke, The officer was very polite, you were on private property.
    He wouldnt tell you the information because he felt threatened by your presence with a camera and didn't want to give you his personal information, as you wouldnt tell him why you're filming (he thougt you are some psycho who would come to his home and try and kill his family)
    You provoked him, he didnt provoke you, if you would of been well mannered and a bit HUMAN the officer would have no problem in telling you the required information, instead you set him up by being rude, ignorant and threatening, to get a response which would make us think he is the bad guy.
    You do know that he is a fellow human being just like all of us and you are after the wrong people? These people are not at the high end of the pyramid, they are merely soldier just doing what they are told to put a meal on their families table.

      Police name and badge number is required by law upon request of a citizen. They swore an oath to uphold the law and so they must comply.
      Next time a police officer tries to pull you over, refuse to give ID, see how that turns out, he may be a psycho in uniform wanting to kill your family. You'll not be able to walk away from it.
      The man was just standing there filming nothing, the police officers initiated the conversation, there was no provoking involved. The cameraman was very well mannered, he simply must a lawful request and was refused.
      Once he puts on that uniform he is no longer a fellow human being like all of us, he is a servant to the rest of us. Police are the ones enforcing the bullshit, so yes they are responsible. Sure, the government tries to enact bogus acts and statues and what not, but it is at the police officers discretion to enforce them.

    I would just like to say those people that are saying that the person who recorded this video of the officer, even though he was being polite you are forgetting is an officer of the law therefore accountable for his actions. Therefor you have to abide by the law the lost its ears to give his number when a complaint is been made. You said he didn't give his number because he felt threatened. With six, maybe 7 large offices behind him. Really? If the person recording this film had the equivalent number why would you feel threatened? This fella deserves a medal for making the ploice and people of authority accountable. Mate i will buy you a pint if i see you, you are a genuine star. Carry on doing what you are doing and encourage other people to do what you are doing. Obviously do not break the law but let officers and people of authority know that they are accountable if they do something wrong. You are a good man.

    This cop is a prime example of why police all over America are not only mistrusted but despised by the people that they continue to harass.. This cop was really scary as his demeanor was very aggressive before he asked the first question. As far as his authority to do what he did I believe he was acting outside the law and without identifying himself would be acting outside the law at any time about any issue and anybody would be within their right to bust his chops and send him home crying to his mama.. There is little else one can do accept sue to have dickweeds like him stripped of their "costume" his badge and thereby his paycheck.. Dickweeds like him should not be allowed to continue in a job that places great responsibility on them considering that he packs a gun and in this particular incident certainly showed his quick temper, his misuse of authority, his willingness to lie and to break the very laws he has sworn to(and paid to) uphold..

    the cop was wrong period the camera guy was wrong too as far as I know schools hospitals and jails are usually off limits to pics because of privacy of the patient, students, prisoners and because they usually are not in positions to give consent, yes I know they are public places but because of patient, minor, and judicial rights it is what it is besides say you catch a prisoner and because of the video he claims he cant get a job, now he can sue you frivolous maybe but they would be in their right

      Actually the cop wasn't wrong. You are granted a limited license for entering government property on official business. You can see where the guard asked the camera guy if he had official business at 0:59. He asked him a series of questions about his business and at 1:40 revoked his license to conduct official business on county property. At that moment, the camera guy was required by law to immediately leave the property. He could not legally remain and ask for the names of the people who were revoking his license. By not leaving immediately, he committed the crime of criminal trespass. If you invite someone over to your house and then ask them to leave and they refuse, the same exact law protects you as well. The officers in this video did not arrest him when they had probable cause to do so. He has no lawsuit against them, he should thank them for ignoring his crimes.

      That's a policy, not a law. He can try to complain to the sheriff and then the sheriff has the option but not the requirement to reprimand. The sheriff could also develop a policy whereby officers never give their name and badge number. Now if he had been arrested, it would be discoverable evidence. What this guy can do is engage in political speech with like minded individuals and attempt to elect a different sheriff who would enforce a policy of giving names and badge numbers. That is the extent of his recourse.

    I understand the point of documenting unprofessional police behaviour and misuse of power, BUT when you actively hunt for it you are actually part of a setup. Waiting around outside a police station filming is a suspicious thing to be doing and is going to provoke the police. It's obvious you're going to call police attention and it's obvious what type of reaction you're going to get when you then refuse to answer their questions. In this way it isn't the same as if you were simply sitting around on that sidewalk and were then harassed by police. These kinds of films may show certain aspects of police behaviour which are unprofessional, but the way it was instigated by you filming is not right either.

      He wasn't hunting or instigating, nor are 85% of the film makers I've seen who do this sort of thing. Cops don't like being filmed. They have a massive problem with being filmed. Quite literally, as it's been shown in many videos, people can stand a half a block or more away from the police, and still end up getting harassed. The lieutenant is an asshole on a power trip.

      Right or wrong is irrelevant. He's not a public servant. I'm not saying he is but he gets to "hunt" for police attention and they are supposed to attend to him professionally and lawfully. Asking him to answer a question is fine but when he doesn't, that's not supposed to provoke harassment. The articulation of one's rights is NOT the same thing as suspicious, as defined by the courts. This cop doesn't LIKE it, which is a different matter, having to do with his egos and insecurities and is something that has no place in a person who has the power to shoot and arrest you. Not giving his ID number is his passive way of asserting dominance and shows his utter contempt for his real position and the responsibilities in entails.
