- I was pulled over by officer Rodriguez and officer Sexton of the DeLand, Fl Police Department after i was filming the 2 cops in this video. they tried to tell me to stop. I kept filming and then got in my car and was immediately pulled over and given bogus tickets. the cop tells me i have the option of not signing. then gives me a ticket for not signing. he never did allow me to sign the other 3 so they are void. and the one i signed was under duress because i was threatened with imprisonment and there were 2 officers there with there hands on their guns. there isnt even a statute or ordinance number on the "refusal to sign ticket". please send this video to every one you know and favorite it. thank you

No it's not. He accepted that instrument (citation), so he agreed to what he was being charged. He then became "holder in due course". Now he accepted the charges regardless if he signed or not. Sadly, majority of people don't re-cognize what is going on. It's a commercial interaction where silence and acceptance is agreement (a binding contract). He didn't have to sign it or accept it. Had they attempted to take him to jail for not signing nor accepting it, he can then write a writ of Habeas Corpus or a friend and give it to his captor (The person that jailed him) and demand to immediately see a judge for them to provide proof that they have grounds to hold him. There is a lot going on in those little interactions that many aren't aware of. People also need to be familiar with their state Constitution as all 50 Republic lands have one and they are in harmony with the united States Constitution while State Statutes are not.

He doesn’t have to sign it, he still gets charged. They’re not going to let him go simply because people choose not to sign. You get the consequences no matter what.

Oh. My. God. This officer. Rodriguez.. Sexually assaulted me when I was 19 years old when I lived in New Smryna Beach Florida. I will never forget it. And it was the first time I was arrested. For buying beer with a fake ID. He dismissed all other officers including the female and proceeded to search me when the female officer had already done so. He said some sexual things and touched me in places he shouldn't have. I remember him. Never will forget him.

I've been pulled over twice now in the past year, both times I was technically speeding one 15 over and one 13 over (regardless of traffic flow), and one time I didn't have my tags up to date due to pending repairs for smog. Neither time was I cited by either officer..... I wonder why? Maybe it's because I did everything this tool didn't do. I was polite, from the beginning, I didn't play these little half way window games, I had my documents in order and I provided them as requested. Then the officers simply ran my DL#, it cleared, Then they said "Do me a favor, watch your speed and have a nice day."
Each traffic stop took maybe 5 mins.

Personally, I am all for teaching cops the law, and I have done it many times. But... heres the deal. If I get pulled over for some petty traffic violations i just act polite, give them my documents and thank them when I pull away, whether I got a ticket or not. This guy is just acting like an irritable 3 year old that thinks hes cool cause he saw some youtube videos and wants to be "just like Matt pleading the 5th!". and he wasnt even good at it. Ill give you and the driver in the video a tip. If you are going to stand up to johnny law, make sure its for a god damned good reason in which your freedoms and basic rights are being infringed on.

This officer stated that the individual did not have to sign the ticket (likely knowing that he will get to write more tickets for his quota). This is simply coercion through force/threat of arrest and imprisonment. For all criminal corrupt police do the people of the United States a favor and quit.

that is not the point, that is why the cops are the way they are. people want it to be easy and go on their way with a simple ticket or nothing if they are lucky but a lost hour of their time because of harrasment. cops make everbodies life difficult but i have never seen 1 protect a citizen they claim to serve! i know people who have been robbed, stabbed, harrassed, assulted, etc... and not one of the people have justice served unless it is a cake walk for the cop or makes them a profit. they bust teenagers with drugs, smugglers, traffic violations, anything that will be a fine (disorderly conduct, open container, etc...).
when has a cop ever helped you? have you ever gotten your identity stolen locally? if not take a guess what they say, "it is too much to try and find the person, it is your loss and you will have to solve this through a private investigator". so basically, you can pay somebody to do it and we will arrest them, but we cant help you in any other way as it is not profitable though they have committed fraud and have not crossed federal or even county lines. what a shame.
The only thing that he did that was difficult was the window thing... but the window was down far enough and if he didn't want to roll it all the way down because it sticks sometimes then he shouldn't have to... the cop was being more difficult than he was. Everything else that most people are saying he was being difficult about was actually him making sure that he wasn't signing anything that was going to incriminate himself further than need be.. the cop was an asshole and this guy was right for being cautious.
the cop was being an asshole because the guy was being an asshole first. like when he said he didnt want to sign it without even reading it and the cop tried explaining it to him but he did not let the cop finish. if he would have read or let the cop talk he would have seen that the ticket says that you signing it is not admitting guilt you are just signing that the cope gave you the ticket. i have gotten 3 tickets so i know it says that about not admitting guilt, two for speeding and one for running a red light. i have been stopped a total of 4 times in a little over 3 years. if you are nice and respectful the cops will help you out (when they can). one let me go with a warning doing like 10 over, the one with the red light i actually ran a stop sign, the red light, and was speeding but i was nice and he only gave me the red light. the other 2 was speeding in a school zone which i didn't know was a school zone so i did deserve that one because i could have ran over a kid, and the other one was doing 25 or 30 over so that one he couldn't really do anything but he dropped the speed so i could still go to defensive driving. none of those tickets are on my record :)

Nope, Trent. It doesn't work that way. Cops back up one another. It is why they're more than happy to show up in traffic court to fight you if you want to fight your ticket. At that point, the judge doesn't give a flying fuck about what the cop knew or didn't know. You have to show him why your ticket should be dismissed. Any lying is only wrong if done under oath.

not necessarily. I have no tickets in 5 years of driving legally. no juvenile tickets for driving either. but i have been pulled over various times. More times than not I was removed from driver seat onto the curb or backseat of the patrol car. Before i'm even completely stopped, I see the squad cars both front doors swing open at the same time and two officers jump out at me. Reading their body language I said oh shit wtf did i do. They rush both windows ask where im going. take me out the car and search it. after they find nothing, they let me go without saying why they pulled me over lol

We need to do that even without the issues of the times. What this tape really is useful for is showing a police officer of color being very respectful and professional to a grown white man acting like a child and just asking for trouble. A person is free to refuse to sign a traffic ticket however the police officer is then free to place him/her under arrest and take him/her into custody.
By signing the traffic ticket, you remain free and retain the right to show up at the hearing to contest the issuance of the citation or summons.

When you drive there are laws you are required to observe, speed limits, DUI, etc. You have the opportunity to comply or choose to violate those laws. When you violate traffic laws you get a ticket. You can sign the ticket which acknowledges receipt and your agreement to appear in court. In this jurisdiction refusal to sign (like refusal to a DUI test) is another crime. If the driver had chose to refuse to sign the final ticket he would have been arrested and held for an arraignment hearing.

Then at 3:25 the cop said it is a crime to refuse to sign the tickets and the driver could be arrested and again gave the driver another chance. After that the driver still did not sign the tickets so he was also cited for his refusal to sign. But the driver has the video so ultimately a judge will decide whether he refused to sign the tickets.
