That citizen was not under threat and had not justification to unholster and ready his weapon. Driver is an Indian. No respect for human life whatsoever. One of them hit my car before and after exchanging details with me he failed to pay for the damages and have an ongoing court case against him. The most insane thing is that his brother have been sending me text messages asking me out despite me telling him straight in the face that I don’t date his type and it would be very humiliating to me as a woman to be spotted in public with him. Given the situation, there's no wrong doing on his part. he saw a crime reported it and held the suspect there until police got there. He got a pat on the back from the cops and went about his day I imagine.
It is a fair question whether there is wrongdoing, though. Any time someone holds someone else at gunpoint, they’ve got to have one heck of a good reason, supported by law, or they’ll be the one going to prison. Citizen’s arrest laws are pretty complicated and very state-dependent. This wasn’t a case of self-defense or a scenario where he stopped an imminent danger to another person. If all the boxes allowing a citizen to use lethal force to detain another citizen weren’t checked, he could be looking at felony charges and prison time. He may very well have complied with the law, but I don’t fault the news for pointing out that that’s not readily apparent and is a question that needs to be answered.
Here's the issue. The guy with the bike under his bumper didn't have to be the guy involved in the hit and run. Chasing down people at gunpoint is problematic. In this case he was right. It could have went wrong but didn't. Also it can escalate a situation. Lets say this pleads out to a misdemeanor but 1/3 times this same behavior leads to someone getting shot. Is it worth it? I support the citizen that intervened. That said , some things are better left to law enforcement.

Good for the citizen who stepped in to stop him from running. 2 days before Christmas I was rear-ended by a guy who was drunk driving and he immediately fled the scene. Come to find out, about an hour later he ended up getting into a head-on collision with a truck and killing himself and hurting the other guy. Guy had been charged 70 times for other offenses over the last 10 years. The judges letting these people out need to be held accountable as well.
I'm with the guy who helped catch the hit and run guy on this one, even though it should be technically something like illegal detention or something like that. But I'm glad that people like that are willing to do stuff like that to help serve justice. Additionally, I think the judge should drop any eventual charges on the guy who pulled the gun considering the purpose
Here’s a similar story I was involved in. The guy in a truck and ran over a guy on a bicycle and took off. I chased him in my truck. He crashed and exited the truck and ran. I was on the phone with police dispatch indicating where he was and that he had ducked into a rescue mission. Cops showed up and had go in with them to identify the guy. I showed up in court to testify against him and he went to jail. I was guaranteed that they would contact me when he was released. I never heard a word so I called the prosecutor and was informed he had been released some time ago on parole. He was a dangerous dirtbag with a history of violent crime and I didn’t appreciate the fact that he was released and I was not notified. I don’t have a lot of faith in the judicial system.

We don’t know what lead up to him pulling his pistol. All we can do is speculate with out video and audio evidence. He could have pulled it out after he threaten his life or others. Any decent defense lawyer could show cause that this man felt his life and others lives were in danger because he already ran somebody over and kept on driving to potentially run someone else over. But I understand what you mean. If the guy was just sitting there afterwards and was not threatening anyone then a DA could have charges pressed against him especially a anti-gun DA.

Once a firearm is drawn, the situation becomes life or death. We do not invent silly little reasons to make a criminal's life more valuable than his victim's, that's true. If the victim is legally permitted to engage, in most cases the victim is legally permitted to maintain the engagement until they no longer feel threatened.

Driver is an Indian. No respect for human life whatsoever. One of them hit my car before and after exchanging details with me he failed to pay for the damages and have an ongoing court case against him. Given the situation, there's no wrong doing on his part. he saw a crime reported it and held the suspect there until police got there. He got a pat on the back from the cops and went about his day I imagine.

It is a fair question whether there is wrongdoing, though. Any time someone holds someone else at gunpoint, they’ve got to have one heck of a good reason, supported by law, or they’ll be the one going to prison. Citizen’s arrest laws are pretty complicated and very state-dependent.
This wasn’t a case of self-defense or a scenario where he stopped an imminent danger to another person. If all the boxes allowing a citizen to use lethal force to detain another citizen weren’t checked, he could be looking at felony charges and prison time.
He may very well have complied with the law, but I don’t fault the news for pointing out that that’s not readily apparent and is a question that needs to be answered.
Here's the issue. The guy with the bike under his bumper didn't have to be the guy involved in the hit and run. Chasing down people at gunpoint is problematic. In this case he was right. It could have went wrong but didn't. Also it can escalate a situation. Lets say this pleads out to a misdemeanor but 1/3 times this same behavior leads to someone getting shot. Is it worth it? I support the citizen that intervened. That said , some things are better left to law enforcement.

Good for the citizen who stepped in to stop him from running. 2 days before Christmas I was rear-ended by a guy who was drunk driving and he immediately fled the scene. Come to find out, about an hour later he ended up getting into a head-on collision with a truck and killing himself and hurting the other guy. Guy had been charged 70 times for other offenses over the last 10 years. The judges letting these people out need to be held accountable as well.

I'm with the guy who helped catch the hit and run guy on this one, even though it should be technically something like illegal detention or something like that. But I'm glad that people like that are willing to do stuff like that to help serve justice. Additionally, I think the judge should drop any eventual charges on the guy who pulled the gun considering the purpose

Here’s a similar story I was involved in. The guy in a truck and ran over a guy on a bicycle and took off. I chased him in my truck. He crashed and exited the truck and ran. I was on the phone with police dispatch indicating where he was and that he had ducked into a rescue mission. Cops showed up and had go in with them to identify the guy. I showed up in court to testify against him and he went to jail. I was guaranteed that they would contact me when he was released. I never heard a word so I called the prosecutor and was informed he had been released some time ago on parole. He was a dangerous dirtbag with a history of violent crime and I didn’t appreciate the fact that he was released and I was not notified. I don’t have a lot of faith in the judicial system.
