    I think that's one of the most frustrating things, she was able to raise her right hand, then proceed to lie like I've never seen before, and have no consequences for it.

      Well, no legal consequences. She is paying a price in other ways. But she should be made to pay legally as well. Even if it is a civil case. Especially in a case of defamation. That lie nearly destroyed a man's life.

      @@pandorafox3944 legal consequences are what I'm referring to. What's the point of swearing under oath to tell the truth, under the penalty of perjury, if you can get up there and blatantly lie? It's crazy. But I am so glad she lost this case and and really hope she has some sort of financial consequence and doesn't get off Scott free. One way or another, she has to be held accountable for her recklessness.

Even more disgusting is that AH had years to compile her hoax with significant legal advice. - remember that she allegedly developed much of her story and hoax when collaborating with ACLU- a powerful rich organization with significant legal resources. FYI: your contributions to ACLU ( American civil Liberties Union) “fund our litigation and public education efforts” (per their web site). THEREFORE, your contribution financially supported aclu to draft and legally review the defamatory statements in her op-Ed article, which were made WITH MALICE per a jury of the American justice system. IS THIS WHAT YOU WANT TO SUPPORT WITH YOUR MONEY.??

      The question is ‘why bother to swear to tell the truth…’ under penalty of perjury, (in a civil trial) if there ARE no actual consequences?
      Which I agree with, that IF sworn in as such and you lie; should be consequential regardless if civil or criminal. It’s the same…..’swear.’

      @@HiroForever -- There are consequences. The other side shows that you're lying, it impeaches your credibility with the jury and you lose. They might not be the consequences that you'd like, but that's definitely a consequence.

    Just a FYI, prosecutors aren't elected in Australia. So if there's a provable case of perjury against AH in Australia, they may lay charges in advance should she ever set foot here again. Whether they will go to the expense of extradite her, I very much doubt. But if she sets foot in the UK, Canada or any other commonwealth country she might soon find her freedom has been curtailed rather quickly.

      @@josieluna5737 she was held accountable. Meaninglessly, but that ship has sailed. As for the apparent lies she told Australian authorities, is there any new proof she lied? It’s pretty clear based on her past she did, but in a she said, she said, I don’t think perjury is justified.

      @Malus Although I don't think charging AH and/or JD with perjury will ultimately go forward, the whole thing with the dogs is very valid. We have no rabies here, and there are other diseases we also don't have here, which is why the quarantine rules are so strict. And, just because she's a celebrity, it doesn't make her exempt. Smuggling is also a crime all on its own. Having said that, I agee that it's ridiculous to pursue this after such a long time, and that it won't really achieve anything of added value. 🤷‍♀️

      @@qwerty112311 AFAIK the Australians are still investigating perjury charges against Amber, I'm pretty sure there was even a representative or cabinet member who demanded to know why they hadn't charged her yet about two months ago.
      If I'm not mistaken, the new information that re-opened her case after her conviction came via the UK trial, where it was revealed that her role in the smuggling was much more extensive than what she had pled guilty to. Her "confession and apology" was still a lie. What's more, she had gotten off with a slap on the wrist precisely because of her apparent candour and remorse, so there was all the more reason to go after her on perjury charges.

    What greatly concerns me, as a citizen of the US, a military vet, & as a woman who has male family/loved ones, I fear that since her lies were so many, so obvious, & so ludicrous, & since this trial is so well known, & since it's currently popular for women to target wealthy men in hopes of a $$ settlement, that it will teach others how EASY it is to outright LIE in court. I wonder if those in the VA justice system have considered this like I & many others have?

      Right? I'm also pretty bothered by the apparent lack of consequences for "expert" witnesses who apparently will say anything for a paycheck.
      There really ought to be a mechanism for weeding out experts who abuse the court's trust in their credentials.

    The oath has gone from, "Do you swear to tell the truth, the whole truth and nothing but the truth, so help you God?" to, "Will you tell the truth under law?"
    It might as well be, "Are you gonna say whatever suits your needs?"
    These days in America, lying liars can flout oaths with impunity. The ends justify the means.

    She’s heard on audio saying “I was hitting you” and “I did start a physical fight” perjury??
    Johnny describing her attacks in audio, she didn’t deny it, perjury??

Said he never saw the lipstick. Problem is, the black paint crosses over on top of the red lipstick. So he clearly wasn’t telling the truth and he wrote the Carly Simon remark

Just like she said she donated the money when in fact she didn't, or that he was trying to get into the bathroom when it's on audio that he was inside and she was trying to get in. Or that she denied to have written the oped about him but then said that's why she wrote it. Or that she denied she was arrested for DV when there is an actual police report etc And all those fantastic incidents she told when photos from the next hours or days clearly show that she was perfectly fine.

    Personally, I'm OK with her not being charged with perjury ONLY because it sounds like there's too good a chance (mainly due to the journalist protection) of her being found not guilty. And if that happened it would mean she'd be all over our screens feeling smug and vindicated and saying "see, I didn't lie!"
    I think having a charge of perjury brought against AH would be more important, crucial even, if she had won the defamation case. The fact that she lost tells us that, despite her attempts at falsification, the jury did not believe her.
    And we may have to be satisfied with that.

      I don't think we should be satisfied with Heard merely losing her case, because it sends the message that lying in court bears no extra penalty; if you have a losing case you might as well start fibbing.
      What's more I think they have Amber dead to rights on at least some of her lies: the "donated" settlement money and her photoshopped evidence spring to mind.
      They ought to have enough evidence of fraud perpetrated on the court to at least open a case and start demanding discovery. Even if they can't prove the TMZ lie, although I'd say there is enough circumstantial evidence, they can still nail Heard on a bunch of other lies she told.

      That seems very unlikely. Even Heard probably won't face perjury charges for the abuse hoax writ large, I don't think. If they go after her at all it'll be on smaller, provable lies like the (non-)donation, the edited photos, etc.

      Not just the American public 😆 we are following AH’s cringe worthy behaviour in the U.K. and Europe too.
      I know that these sad, mentally unhinged and quite frankly “ A danger to others “ ( a sectional term under the U.K. mental health act) persons exist in everyday life, however it’s been fascinating to watch AH demonstrate these very disturbing behaviours on live TV for all The World to see , it’s extraordinary !
      Depp tried to point the above out to her by advising her to go for a quiet, private divorce.
      She obviously lost the run of herself when she managed to make Depp marry her and became his significant other , believing that she had talent, however it is obvious that Depp got her the Aquaman role, which due to her cardboard acting she would not have been considered for without his influence.Just watching her hamming it up in the trial proves this fact. She has only ever played “sexy blond woman” before this,a role she is good at in real life and uses to snare influential men.
      She is now not a significant other and has no significance, except as a woman who tried to ruin Depp’s life.
      I sincerely hope she comes to her senses, considers Dr Curry’s diagnosis of her mental health difficulties, probably caused by damage done to her growing up and seeks appropriate treatment, for the sake of her young child.

    Thank you Andrea for your input regarding the restoration of faith in the criminal justice system. I think that is especially important in the current crisis we are seeing now. The general feeling among the people is that there are “us” (the average person) and “them” (the wealthy or politically connected) and that there are two different sets of rules between these groups. The people need to see Justice. We need to see the rules being applied equally. If the laws are not being applied equally that is leading to more unrest! People are sick and tired of the different sets of rules.

    You look fabulous today and your information is clear, substantiated and informative. It is such a shame that cases like this and liars like AH make a mockery of swearing a solemn oath. Law's are not good unless they are enforced, sets a very bad precedence for those who come after. There should be an enforceable deterrent, if not, chaos and anarchy reigns. This very public trial could do so much to restore confidence in your judiciary. I am from the U.K. and like many over here, we are embarrassed by the debarcle and travesty that was the U.K. trial against the Sun.
    We need to restore faith.

The average person on the street would be too scared to lie on the stand - AH seems to be able to get away with it.       I really hope Australia decides to pursue this. Her lies about the dogs violated Australia’s biosecurity laws, which has the potential to be catastrophic for the island nation! I think it’s important to demonstrate that the rules about importing certain flora and fauna without proper declarations/protocols is deadly serious business.

    If you are going to lie on the stand and sit in the witness box and you’ve been sworn in, and you get caught out lying, you have to be held accountable for it… If you are not held accountable for lying then it’s a given that it’s ok to do it and that you are able to just keep lying..
    Here in Queensland Australia 🇦🇺, if you lie on the stand and you get caught, you can spend up to 3 years in prison.. The Judges here don’t play… You will go to prison..

    One of my biggest things for perjury for her, was submitting the EXACT same photo and saying it was from different incidents. Multiple times! Guarantee the prosecutor would be reelected if they brought perjury charges against the Turd.

    Here's a related question. During Amber's direct testimony, she said about the incident before her TV appearance 'Johnny Depp broke my nose'. On cross, she changed her statement to 'I thought Johnny Depp broke my nose'. Since she said both, on the stand and under oath, and both can't be correct, is the first statement a lie under oath? Can you contradict yourself while testifying and more or less swear to multiple versions of the same event or fact? Or does a later statement supersede an earlier statement?

      It's not necessarily a discrepancy she thought he broke her nose and then she shortly found out after that he did break her nose. That might be a defense she might use against perjury in this case.

      @@virtue_signal_ No it is a discrepancy. 'He broke my nose' is a statement of fact...that he performed an action that broke her nose.
      'I thought he broke my nose' is also a statement of fact. It means 'He performed an action that I thought broke my nose, but later found out I was mistaken'.
      She never went to a doctor. She said that she self-treated it with ice and that it healed on it's own. How did she know then that it wasn't broken?

    Thank you, Andrea, for another fantastic video. She has essentially shown how a person can take a stance based on their perception and emotional truth rather than the truth, with the accountability on the other side to have the facts and work with and from them. I’m glad in this instance, Jd’s team took that approach and had the witnesses, the footage and cameras to the world to back themselves and let people make up their own minds, cutting through the manipulation and agendas posed by her team and MSM.

    For most of our history as an English speaking civilization, we swore an oath to God to tell the truth and not to bear false witness against our neighbors. People understood they could do that, but people also understood that they ultimately wouldn't get away with it. The further we get away from that cornerstone prospect, the harder it gets to define "truth" itself. Objective facts are harder to pin down than anyone ever realized they would be and whether or not those facts have value is pretty much the only part of the concept that still survives as "common sense". We throw it all away at our own peril.
    And as many others have noted - you look beautiful! I think you do anyway, but :)

    Great series, Andrea!! I think that the fact that this trial was SO public should also be a factor in deciding whether or not to charge Amber with perjury. Millions of people know that she lied on the stand. If she doesn’t face the consequences of that, millions of people will be keenly aware of the lack of justice and integrity in our judicial system.

    Thank you so much for doing this series. I think a lot of the reason that people feel so unfinished about this trial, and this case, is because of issues just such as this. It's not that we're obsessed with celebrity and the whole Hollywood scene. For me, I'm fascinated with the fact that there's a person like Amber Heard, who has demonstrated such audacity, blatant deceit, and over-the-top hubris. I'm a retired mental health professional, so her case holds deep fascination for me as it's rare to get to see someone with her combination of personality disorders in action.
    I would also like to add that when we have an ex-president who is effectively getting away with blatantly lying under multiple circumstances, even under oath, that it's hard to hold the rest of us accountable for things like perjury.
    And BTW Andrea...your hair looks so pretty! I love it! 💘

    I've never understood the purpose of taking an oath when there's never any consequences for perjury. Far to many people get away with things based on lies leaving a path of destruction in their wake!!
    AH angers me so much at what she did to JD all for $$ & revenge 😤

    Really interesting. I think why the public are still so involved & passionate about this case is that it doesn't feel closed or that justice has been done fully because everyone who watched the whole trial saw her blatantly lie time after time & although she lost ,it doesn't feel right because of her behaviour in & post trial that she has been held truly accountable. She has no remorse,& has completely ruined a man for many years. Everyone has seen she committed perjury & it feels like she has been allowed to do it.

    Thank you so much, Andrea, for this in-depth look at perjury charges (or lack thereof). It is really disheartening that people like Amber Heard are able to not only get away with things of this nature, but practically spit in the eye of anyone who wishes to hold her accountable. I shudder to think how many other unscrupulous people have studied this case carefully and will attempt to get away with the same thing. Our judicial system truly is quite a disappointment in this regard. Maybe there is still hope that the prosecutors in Fairfax County, Virginia, will file charges against Amber Heard and, therefore, discourage others in following suit. I’m holding out hope that they are simply awaiting the outcome of the appeal.

    I loved this series, I loved the series on Isaac Baruch too! So, I will be here with bells on anytime you have something you believe is important to learn from! Every where I go on UA-cam there are people in the comments saying they cannot believe that Amber has not been charged with perjury! And you're right, there is so much mistrust of our justice system. From my perspective telling the truth in our daily lives was very important but I remember in probably 5th grade (I'm pushing 60 so we were slower to tackle things in school than kids today) we had watched enough TV, for me it was Dragnet, Perry Mason, etc. That's where I remember hearing about perjury, what it is and why it's important to be truthful all the time, not just in court. All we can do is wait and see what happens. Whatever does happen I like so many will be here on your channel waiting to be enlightened from you! Thanks for being here for us!

    Here’s my question, if TMZ is going to be claiming or striking videos on UA-cam for using material that they own the Copyright to and obviously didn’t produce themselves, it seems like they would be obligated to provide proof of ownership?
    I don’t see how this isn’t a matter of Public Record?
    Owning a Copyright & how you obtained that ownership, shouldn’t be privileged or “private” information, think of the mess that would cause if anyone could claim ownership of any IP without having to provide documentation?
    I would think that anyone who was struck on UA-cam by TMZ for using a video filmed by Amber Heard, would be within their rights to request verification of Copyright Ownership and documentation that their Ownership was legally obtained.
    The Virginia Court, at the very least, should be able to request proof of Ownership of that Copyright, since it was entered into evidence in their court and it became a matter of dispute by AH saying “she didn’t sell the Copyright to TMZ”, they should be able to ask TMZ to provide proof of how and who they obtained that Copyright from & if they paid for it and how much they paid?
    That could prove if AH did commit perjury, or if she transferred the Copyright to someone else first, who then sold it to TMZ.
    My point is, we shouldn’t have to solely rely on Morgan Tremaines’ testimony alone.
    TMZ isn’t treating the video in question as “information from a source”, they are actively treating it as “published media being essentially licensed to UA-cam and used for monetary gain” and striking anyone else using their media with a Copyright claim, that should really clear the “Press source protection” hurdle, in my opinion?
    I might even support their “source protection” stance, if they were treating it as something that fell under “Fair Use”, but by actively protecting their Copyright and licensing it to NBC, and anyone who wants to use it, with a monetary gain for TMZ, it becomes “content”, that gives them the burden of “proof of ownership” IMHO.

    I have to stop for a second and make a comment before the comments really start to come in. After and during watching Andrea's fine videos, I feel like I'm in a fine art gallery or museum. Andrea is like the tour guide. Offering, experience and thoughtful insights to the paintings and sculptures. "And in this painting we see the portrait of a man with power. He uses his power, balancing the various needs in a society..." "And over here in this section we can see the brush strokes change. Was the artist working with additional passion? Or did the painter hurry up because lunchtime is coming in less than an hour. We don't know."

    It's insane if Morgan Tremaine is the best (& apparently only) instance of perjury charges that can be considered being brought against AH. The last minute of this video spells out what has and is happening to the justice system, if there is even 20% of America that believes in it any more, that is being generous.

    One of her lies I think about a lot that often gets overlooked is that in her 2016 deposition, she said very confidently that she could not remember whether she hit Johnny during the stair incident, but in the Virginia trial, she somehow “remembered” very clearly that she definitely “landed a blow” and somehow remembered all this new detail… Watching those two clips side by side is wild. If perjury isn’t pursued it’ll send the message that the court system is a free for all and you can just make up whatever you want with no consequences. Ps- I love that you called out Amber’s hoax (à la Adam Waldman). Very badass! 🙂 Keep up the great work!

    It's very strange to me that the decision to pursue perjury is essentially up to an individual political actor. It seems to me that lying to the court should trigger some automatic perjury procedure and not just when the prosecutor feels like it.

    The constant lying, under oath, by our elected officials and others like AH is really getting to me. I always assumed that the reason perjury charges are rarely pursued is because of the public expense - the taxpayer's money. To me, this was a reasonable response. I think we all have better things to do with our money than pursue the obvious liar, like AH.
    I'm a big believer in the court of public opinion. We've all seen where someone was acquitted of murder and the grief of the friends and relatives who know better but we've also seen the repercussions of "not guilty" on the accused - think Casey Anthony. Whatever the court may have decided, public opinion is rendering a judgment and I do believe that makes a difference.
    Does anybody doubt that Amber Heard is feeling the effects of the public's opinion of her and her actions? It may not seem like much, sitting here at our keyboards pounding away, but worldwide condemnation surrounds Amber Heard wherever she goes. And I find that very satisfying.

    They're never going to charge her with perjury...if they were, it would have happened already. Plus, now that she's out of the country, they aren't going to go after her. US won't do a damn thing....neither will Austrailia. And she'll probably come up with some scheme to get out of paying JD what she owes him....or what she owes anyone else. If the legal world actually worked and functioned like it's SUPPOSED to do, she would already be in JAIL....WHERE SHE BELONGS!!!!!

    First off, awesome look. Second, it seems like the minor details aren't as important as the overall effect. The old precedent you showed even stated that whether it was a stick or a sword didn't matter, only the fact that someone was beaten with it.

    I’m so glad you covered the perjury issue. Indeed, I’ve seen many comments and questions regarding why Amber Heard isn’t being charged with perjury, or facing any criminal charges whatsoever. After everything she’s done that is illegal -not the least of which being the physical abuse of her spouse -a layman might wonder why she seems to be above the law. It helps to know how difficult it actually is to prove perjury. Nevertheless, Amber’s apparent immunity does not shine a very positive light on the justice system.

    Love your breakdown of your legal system, it really infuriates me how much the media is protected & gives them carte blanch to write whatever they like.     Ok, im not a lawyer and am probably in way over my head with this. But would there be a way to turn the whole AH, TMZ thing into something against TMZ to prove they had the legal copyright to that video? So the guy from TMZ who testified (sorry I forget his name) said the *only way* that TMZ could have legally published that video on the timeline they did is if they got permission from AH.... AH says she didnt give permission... could they then go after TMZ and say "hey, this video might have been pirated, you need to show us that it is legally yours"? Again this might be complete gibberish... just a thought 😁

      I was thinking, since TMZ copyright struck UA-cam videos over the clip Amber swore she had not given them, which when presented at trial was obviously made by her. Could the UA-camr demand TMZ prove they actually held the copyright. Then a person not working forTMZ person would have first hand knowledge of who sold or gave TMZ the copyright and be able to testify in court proving without a shadow of a doubt she had committed perjury.

      @@katiehettinger7857 I like the angle of the youtubers who were copyright struck on the video having standing to pursue something against UA-cam which would result in the production of the source of the copyright claim, but it seems like a torturous route, and one that possibly wouldn't bear fruit on thr perjury against Heard issue, as they may be able to convince a judge to seal the evidence on the basis of protecting journalistic sources or aomesuch.

    As the days go on & she hasn't admitted or apologised for her abusing behaviour I just hope she gets charged in Australia, Depp wins his appeal and the case in the UK gets over turned.     Federal law requires copyright transfers be in writing except work for hires. Maybe one of the lawtubers that was copyright struck by tmz for the video could bring a declaratory judgement for non-infringement. Either tmz loses the case, or has to show the transfer document in discovery?

Are there other cases where people have been charged and prosecuted? My fear is that everyone learned that it is just fine to lie, the threat of perjury charges is a 'hoax'!

    I have long suspected that IO Tillet Wright was involved with editing the video and supplying to TMZ. In IO deposition played in Virginia trial, IO confirmed he received the video in a text exchange from Amber on February 10 2016.
    Watching your video, I wondered what if Amber transferred the copyright to a third party (such as IO) and then the third-party transferred to TMZ? Amber seems capable of muddying the situation and shifting blame to others.

      I believe Elaine asked for the jury's identity be kept underseal for one year after the verdict. Something like that is my understanding. I figured it may precludes them from coming forward publicly for a year.

    This is great, (as usual :) ) im mexican and growing up i remember learning that the basis of USA’s court sistem was the truth. That the worst thing you could do in the USA was to lie. The truth was the most valued belief. When i saw the trial i was really thinking and feeling that if by any chance she’d won, a very important cornerstone of the USA was going to be lost. I really see this lying in court and as you say taking the time of so many people with reckless disregard for the truth, is something very very serious. And that she is continuing doing things because shes mad, only shows that she doesnt care. I found that very disrispectful and dangerous! Thankyouuu , i love your videos.

    "She can get away with things and other people can't" That sounds like the exact same mentality of a certain ex-president who's been caught in multiple lies and should be in prison for multiple crimes, but probably won't be convicted. The justice system in the USA is already a joke and if he and people like Amber face no repercussions for their crimes then what good is the justice system?

    I'm so glad that in my country, Sweden, there is basically no prosecutorial discretion (except for very limited charges of a more private nature).
    Nor are they elected but as with the rest of the country are under independent agencies where our elected people are forbidden to interfere in a case by case nature.
    The prosecutor has an absolute duty to prosecute all crimes where there are enough evidence that a crime has been committed and it is possible to prove who has done it.
    (They are also less adversarial than in the states while the lawyers basically only have their duty to their clients.)

      American lawyers don't only have duties to their clients but also to their state and bar association. And you're joking if you think Swedish laws are remotely equally enforced, how many prosecutions have there been for hets mot folkgrupp where the folkgrupp were Swedes being degraded and threatened? Last I checked it was literally none which is pretty shocking because there certainly are plenty of cases of people using slurs etc against people based on their Swedish ethnicity.
      Further, our jury system in Sweden is nuts. There's no jury by the people, just elected party members- not elected by the public like in the US. Which is much bigger problem than elected prosecutors.

      On the world justice project Sweden is on place four globally on 8.4 | Criminal System is impartial.

They would then be forced to prove that they own it, which would require that the paperwork be produced.
