In this case, there is no Actus Reus, as he was acting within the law; therefore, there is no Mens Rea to presuppose the Actus Reus. In conclusion, she acted on behalf of a private company, contrary to her oath. And, she made the law up as she went along.

Its a shame. Most of these situations can be approached with a friendly curiosity instead of veiled threats and lies. She was too focused on trying to coerce the guy to stop instead of simply connecting and explaining the staff concerns. Many women are good at the more positive approach.

Did the PCSO show her ignorance of the law of her own accord or was she deliberately sent to harass? I can't see a police officer making an arrest, why is that I wonder?
It's always best to keep recording them until they leave or you do and you're well out of their way. If they don't know the law, or can't follow policy or even being close to right, best to just simply ask for them to ID properly and when that fails then request their supervisor, as they are obviously out on the streets not knowing our rights and unsupervised in them.
You can tell this PCSO has received training from a normal police officer. It seems that we are guilty now and have to prove that we are innocent and not the other way around.

Under article 8 of the human rights act you don't have to explain anything. The police association put out an all forces memo stating members of the public are allowed to film whatever they want from a public place this includes buildings and or police officers once a digital image video or photograph has been taken it is then the property of the person who took said image or images the police have no powers to demand you delete any footage and no powers to seize any equipment without a court order. The law courts in England have already ruled that their is no perception of privacy in a public place. That's why the council can put up camera's and the government can put up camera's and businesses can put up camera's and even the tyrant pigs can video and we the public can video in public. I can't ring the council and say I am going into town next Wednesday and I don't want to be filmed so turn the camera's off - because their is no perception of privacy in a public place.

Could have been better handled. “There’s no law against it, what is it?” “I could go and research it” “Right off you go then, come back when you have found the law”. Job done. Under article 8 of the human rights act you don't have to explain anything. The police association put out an all forces memo stating members of the public are allowed to film whatever they want from a public place this includes buildings and or police officers once a digital image video or photograph has been taken it is then the property of the person who took said image or images the police have no powers to demand you delete any footage and no powers to seize any equipment without a court order.
The law courts in England have already ruled that their is no perception of privacy in a public place.
That's why the council can put up camera's and the government can put up camera's and businesses can put up camera's and even the tyrant pigs can video and we the public can video in public.
I can't ring the council and say I am going into town next Wednesday and I don't want to be filmed so turn the camera's off - because their is no perception of privacy in a public place.

Public domain surveillance camera's should be abolished, including all dash cams and speed camera's should they not? There is no expectation of privacy in public for a reason, if an individual wants to have a private space in public then they are expected to make that space themselves and not expect other members of the public to stifle their own right to record or take photographs just to accommodate people who are uncomfortable seeing a camera.

On a personal level, I could see and the quiver in her voice showed she was scared and knew she was out of her depth with the confrontation, and it was brave of her to take on the task she’d been ordered to perform.
