Send him far away, I do mean far. He should have got 1st degree. I'm guessing since they never found her head, hands, and feet had a lot to do with his sentence.
A full body is not necessary for a murder 1 conviction, in fact no body at all is required if other circumstantial and physical evidence can provide the evidence for a conviction on that charge. A perfect example is Scott Peterson, who was convicted of murder in the first degree of his wife Laci and their unborn child, and her body was never found. The primary reason that many prosecutors go for murder 2 instead of murder 1 is that it is a much easier charge to prove to a jury. Many prosecutors deem it too risky a charge to go for murder 1 because it hands the defense many opportunities to introduce doubt regarding the killers intent, planning, etc.... and if you get an acquittal on murder 1 you are not permitted to come back and recharge them with murder 2. Most likely there was not enough available evidence of planning or premeditation available for the prosecutors to feel good about pursuing a murder 1 charge. Nonetheless, he won’t be seeing the light of day as a free person anytime soon.
