Let us compare dual citizenship and permanent residency: No. 1, if you are a Philippine dual citizen, you have the right to travel with a Philippine Passport, something that you cannot enjoy by simply being a permanent resident in the Philippines. According to some, having a Philippine passport makes travel to the Philippines easier because you can avoid long queues in the Immigration. Your Philippine passport may also allow you to enter with ease some countries which you cannot easily enter using your foreign passport. But what really makes the difference, I think, is about the sense of pride and joy that it brings to a person who deeply values his/her original citizenship - his/her being a Filipino. No. 2, the right to own real property in the Philippines. Kung ikaw ay isang Philippine dual citizen, you have the right to own land in the Philippines. It could be residential, commercial, industrial or agricultural. The only limitation on land ownership is that you can own up to a maximum of 5 hectares only of agricultural land, which limitation applies to all citizens of the Philippines as imposed by the agrarian reform law. • Kung ikaw naman ay isang former Natural-born Filipino citizen, in short, a foreigner, you can still own land in the Philippines but subject to the lot size limitation: for residential purposes - up to 1000 sqm of urban land or 1 hectare of rural land (RA 8179) and for business or investment purposes - up to 5000 sqm of urban land or 3 hectares of rural land (BP185). Condominiums are subject only to 40% limitation on foreign ownership, so you don’t have to become a Filipino dual citizen to buy a condominium unit. No. 3, as a Philippine dual citizen, you can engage in a business in the Philippines, without the restrictions that apply to foreigners. For foreigners po kasi, kasama po dito ang mga former Filipinos, you can engage only in business wherein foreign ownership is allowed. Although recent amendatory laws have relaxed the restrictions on foreign investors. No. 4, the right to practice one’s profession. Kapag na-retain o na-reacquire mo ang Philippine citizenship mo under RA 9225, pwede mong ma-practice ang profession mo sa Pilipinas provided that you get your license from the Professional Regulation Commission or in the case of lawyers, from the Supreme Court. But if you stay as a foreigner, you cannot engage in the practice of the profession na naka-lista sa Negative List na binanggit ko kanina. Maliban na lang kung may agreement ang Pilipinas with the other country on reciprocity; meaning, pinapayagan din ang mga Pilipino na mag-practice ng nasabing profession sa bansang yun.

    Thanks for the detailed info about the comparison between dual citizenship and permanent resident visa. I am a lawyer by profession but had no inkling about both rights. I became a dual citizen last September, 2022. At least now, I believe that I made the right choice of applying for dual citizenship.Although I am a lawyer by profession as a member of the Bar, I don't intend to practice the same. Your detailed comparison was a good for thought for me.

    the only downside as a Filipino citizen with philippine passport is that kung mahilig kang magtravel all over the world lagi ka mag aaply ng visa vs. powerful passport pede up to 30 days in some countries without visa...and also opening a peso account or philippines bank account only available sa filipinos? im not sure...

      I am a non quota immigrant 13 G visa. I am 60 years old, and I have a senior card in the Philippines.
      I asked the Office of Senior Citizen Administration and they told me I can have a senior card. From my understanding it will include non Filipino citizens.

    pano po Attorney if I am not a natural Filipino,i.e., my citizenship was acquired by naturalization; and I am not allowed to reacquire Filipino citizenship if ever I choose to give up the former.     Attorney may tanong po ako .Kapag pinili ko bang mag permanent residence sa Pilipinas with visa ano po ba ang mga requirements? Kailangan po bang mag renew ng visa every year? Marami pong salamat sa lahat ng inpormasyong pinagkakaloob nyo sa lahat.

      You'll apply only once for permanent residence. However, every year (around Jan to March) you'll have to go to an Immigration office and pay a fee of ~P500.

      If you are a former Filipino (now a naturalized citizen of a foreign country) who still owns a piece of land in the Philippines which you acquired prior to your naturalization, you have the legal capacity to sell it.

      @@nanettecuauhtli5866 Yes, if you sell a real property in the Philippines, that will be subject to Philippine taxes, ie, capital gains tax and documentary stamp tax. In fact, you cannot transfer the proceeds of the sale to the other country through the banks unless you can present proof that you have paid the taxes in the Philippines. Under the tax treaty of the US and the Philippines, the tax is payable in the Philippines, but US tax law requires that the income from the sale should be declared in the US. If the US citizen desires to avail of the tax privilege under the tax treaty, he/she has to provide the proof to the US government that taxes were paid in the Philippines.

      True. Im thinking of doing dual citizen, kaya lang my kids are both US citizen, and if they want to stay in US, i will probably stay there too. And we already have properties here in US, and later on ayaw namen ibenta because were still want to live here in US, siguro vacation na lang ako sa atin sa Pinas.

    Hello sir, my name is Manigandan Rangaraj, I am Indian I married Filipino girl on 2019 at Bacolod city. Already I renewal my residence visa second time last year. I check with immigration while renewal my visa for permanent resident, but immigration officer said Indian can not get permanent resident.

      Hi. The Immigration Officer is correct. Indian nationals (along with some others like China, Pakistan, etc) cannot get permanent residence (13A visa) by being the spouse of a Filipina. What you are eligible for is the TRV - temporary residence visa. Info at the Bureau of Immigration website.

    I read all the comments so far and did not find one that fits our situation. I am an American. My wife is a citizen of the Philippines who has just taken her oath of allegiance in the USA. Our plan is for her to become a dual citizen. When I retire and move to the Philippines using a SRRV visa, I will be collecting multiple retirements. I will probably have the retirements set up to guarantee her a lifelong income from those accounts. Now, my question is: if her source of income is from a retirement account in the US, does it get taxed in the Philippines if she is a dual citizen?

      the answer is No. PH wont tax you if your source of income is from US. Same as a legal resident working in US. The only way PH will tax you if you have a source of income or properties in PH.

      USA and Philippines has tax treaty. im dual citizen. you dont have to pay taxes. the consulate told us and show the paper in regards with taxation. IRS however can tax you if you have income outside US.. if you are a Filipino with only working visa or a work contract abroad then there is a chance you have to pay taxes in PH.

      You wife as a former filipino citizen can also apply for srrv visa as principal applicant and you as her dependent spouse is way much cheaper in terms of dollar deposit than you as a principal.

      Check the website of the Philippine Embassy in Canada and inquire about their outreach program. The Philippines Embassy will go to places to give services like dual citizenship, civil registry and passport application.

    Thank you so much for the information Atty! Ang question ko ay pag meron kanang 11has na lupa sa Pilipinas before ka maging U.S. Citizen at later on nag dual Citizenship uli. Ang allowed lang na property ay 5has sa dual Citizen. Anong mangyayari sa remaining 6has? tnx

      The 5-hectare limit is for agricultural lands po. If it comes to the knowledge of the DAR, they would probably send you a notice of CARP coverage.

      I think if you owned it prior to becoming a citizen of another country, it is still yours. Or if you inherited property from Filipino parents.

    Im a dual citizen, my question is if I stay in the Philippines for good, as what you just said i have to pay my income both in and out of the philippines. Does thAT MEAN i i will be paying both in the philippines AND the USA? I know as a US citizen I have to pay my income tax even if i stay in another planet. So, does thAt mean double Taxation? or i only have to pay tax once.if i pay my tax in the Phlippines, the US will not tax me anymore. Please enlighten me. Thank you..

    Mas ok mag dual kaysa permanent USAresident, no problem kung magtagal sa Pilipinas. Kung permanent resident ka, kailangan mo ng reentry permit na puedeng alisin sa iyo kung mag overstay ka sa Pilipinas. Kadalasan, ang bigay nila na reentry permit for two years kung saan maraming tanong pag balik mo sa US. Kung minsan, may marinig ka pang di mabuti sa customs ng US.

      Okay lang na Green Card Holder. Para Philippine Passport pa rin ang gagamitin pag uuwi sa Pilipinas. Para pag ayaw ng babalik sa US, okay na rin.

      Permanent resident visa for former Filipinos lasts for a lifetime, subject to the renewal of ACR-I Card (Alien Certificate of Registration- Immigration Card). SRR Visa is considered by some as more advantageous as it does not require an annual reporting to the Bureau of Immigration and no ACR-I Card too.

      Hello po. Nasa inyo po kung nais nyo pong maging dual citizen at kung beneficial po ba ito sa inyo. It depends po kasi sa individual circumstances at plan ng bawat isa. Kung nais nyo pong mag for good na sa Pilipinas, may option po kayong mag dual citizen o mag permanent resident lang. Kung nais nyo lang pong bumisita paminsan-minsan sa Pilipinas, may Balikbayan privilege naman po ang former natural born Philippine citizens for a visa-free entry at 1-year stay sa Pilipinas. Ingat po kayo.

      If they are not yet 21 (and haven't chosen Japanese citizenship/ renounced PH citizenship), then they are still dual PH/ JP citizens. They won't need exit clearance. (note: when your kids turn 21, they will have to choose between PH or JP citizenship since JP doesn't allow dual citizenship for adults.)

      Not all resident aliens are considered as permanent residents (on 13G visas). Some aliens/ foreigners are on 9A visas (tourist visa/ perpetual tourist). If you're a former Filipino, you can apply for 13G visa.

Were you born before or after 1973? I know it's a lot of questions but there are different conditions, so diff rules apply.
