Or are you a former Filipino citizen who is now a naturalized citizen in a foreign country and who desires to retire in the Philippines without re-acquiring your Philippine citizenship? In short, you simply want to avoid the possible complication of having a dual citizenship but still you are looking forward to spending more time in the Philippines or even the rest of your life in the Philippines. Perhaps, the SRRV or the Special Resident Retiree’s Visa is the right one for you! The Special Resident Retiree’s Visa (SRRV) is a special non-immigrant visa that entitles the holder to reside in the Philippines indefinitely with multiple entry and exit privileges. It is separate and distinct from the existing visa categories defined by the Philippine Immigration Act of 1940, as amended, and allied laws. This visa is for foreign nationals who would like to make the Philippines their second home or investment destination. SRRV is still issued by the Bureau of Immigration, but this one is being implemented through the Philippine Retirement Authority or PRA. You might wonder why the PRA? And what is the PRA? PRA or the Philippine Retirement Authority is a government-owned-and-controlled corporation attached to the Department of Tourism. It was created way back in 1985 through Executive Order No. 1037 issued by the late President Marcos. Its is mandated to attract foreign nationals and former Filipino citizens to make Philippines as their retirement destination. It was subsequently attached to the Board of Investments and now, it is attached to the Department of Tourism. So please take note: PRA is the only agency that accepts and processes SRRV applications. Although there are accredited marketers whom you may approach to help you in your application. The list of these accredited marketers is found in the official website of the PRA. 1. The SRRV Courtesy is for: former Filipinos, who are 50 years old & above; and foreign nationals, who are 50 years old & above, and who are retired officers of International Organizations recognized by the Department of Foreign Affairs (DFA). These include those foreign nationals who have served in the Philippines as diplomats, ambassadors, officers or staff of the international Organizations recognized by the DFA, such as the United Nations and the Asian Development Bank. This type of SRR Visa requires a visa deposit of US$1,500.00. The SRRV Expanded Courtesy is for foreign nationals, 50 years old & above, who are retired Armed Force officers of foreign countries with existing military ties and/or agreement with the Philippine Government.

    Thanks for your explanation of SRRV eligibility requirements. I got mine over ten years ago and went in-out of PI in Sep 2022. Following are some points for others to ponder:
    1- PI government banned the PI entry of foreigners in March 2020, including SRRV holders. Entry was allowed beginning about Feb 2022, but with conditions, such as PRA permission, covid vaccinations, covid testing 1-3 days before arrival, etc.
    2- New entry rule for SRRV is providing a copy of passport entry stamp made by airport's Immigration Officer. 3- New exit rule for SRRV is to apply for a PRA's Travel Pass to show the airport's Immigration Officer. 4- Cost of SRRV application totals under US $1,500 to PRA, health clinic for exam, and police for record check. Added cost paid to police if your name is similar to somebody else. 5- Cost to transfer visa from old passport to new passport requires 30 calendar working days and a fee may be levied. Otherwise, carry two passports. 6- Annual cost for SRRV membership, evidenced by dated membership card. $10 yearly for those with US $20,000 deposited at approved banks. Higher annual cost for others. Airline agents and Immigration officers asked for both visa and membership card.
    7- PRA office, Makati, is opened M-F, but Friday is by appointment only. PRA's cashier closes earlier, 3pm.
    8- No way to communicate with other SRRV holders through PRA web site.
    9- When in PI, airlines want to see your passport to check if you must pay a travel tax if you will be in PI more than 12 months when you want to fly out. Online buy? PI airlines rejected my credit card issued by US bank.
    10- PI bank was slow to provide me an annual report of interest earned on my US $20,000 deposit, so that I was not able to report it accurately (in lieu of my estimate) to US tax authority. Note: interest earning paid to PI gov. is not reported to me.

    (I'm your new subscriber!) Atty., can you explain regarding property? Years ago, if you owned a lot and built a house before in the Philippines while you were still single and a Philippine citizen. That said property was intended for the aging parents for their residence. Now that you are living in US as a US citizen, married, and have one child. Now both parents passed away, can you "rebuild" or "reconstruct" the house without a problem? What are the requirements?

    • @YourLawyer
      @YourLawyer  Рік тому +3

      Yes, you can. Being a former natural-born Filipino citizen, you are still allowed to own a residential land in the Philippines. In fact, you did not lose ownership of that house and lot when you acquired a foreign citizenship. This is recognized by BP 185. As to the reconstruction, you need to observe the requirement of permit from the office building official of the locality.

I paid a separate fee to PNP police, who had a desk at the SRRV office. But, when the police confused my name with someone with a similar name in their records, I had to go to PNP headquarters in the city of Manila, sign an affidavit that he was not me, swear an oath on telling the truth etc, pay a fee, etc. Police fees totaled several hundreds of pesos. Then there was the wait of several weeks for the return of my passport. Note that was 2007 and Manila-Makati.

    Salamat interesting, rather confusing, when a Filipino comes to the UK and wants to be a British citizen it is very straight forward, even to extend a visa for 5 years, very straight forward, we would never try to bond people for money in different stages, that would be considered as RACIST. when a Filipino in the UK wants to buy a FREEHOLD property etc etc we would never say sorry has to be 60/40% and the British/English person will own 60% and you a foreigner can only own 40$% despite you paying 100% Hu hard luck Talaga , this is a the Filipino protectionism short sighted law you currently have, that once again in 97% of Western countries is against the law and classed as RACIST towards a foreign person, when will the Filipino Government come into this CENTURY?..ingat

      @@YourLawyer It is in it's pure form Racist, these excuses that governments hide behind "legislation" etc etc thus making the constitution overtly RACIST and is not fit for purpose in 2023, all this is a staling tactic and were the same excuses the South African government apartheid system hid behind the exact same rhetoric, when a foreigner cannot buy legally land or property and business in there own name solely, that is counted as institutionalised racial segregation, it does not take a genius to have to come to that conclusion, I was a senior lecturer in China and Korea for many years, with master BA degrees from the London University...Racism comes in many forms and is just not a coloured allegation, it is a broad church of diverse events. the conclusion you have to come to is this, sometimes as humans when the evidence is so damming and overwhelming you have to put your hands up and say GUILTY as charged, or state/play the get out of jail card (well sorry you feel that way sir, BUT there you go our country, and a shoulder shake/nudge) with a he he or a ha ha ....Jesus wept, I rest my case.if your a lawyer you know what this means.. i requiem meam doleat.

    Why does the Philippines require a $1500 deposit on SRRV Courtesy Extended visa? Just like the standard SRRV needing to deposit $20k. Those deposits have always bugged me. The major benefit you get with an SRRV is multiple entry/exit and longer stay. 2 six month extensions cost me about $300+ per year up to 3 years. I go to Thailand for a small vacation and come back and extend another 3 years. With SRRV, initial costs, including deposit, is about $3k+. Am I missing something here towards the SRRV visa benefits and why they are better options?

    • @YourLawyer
      @YourLawyer  Рік тому +6

      There is no need to sugarcoat the SRRV. It was designed primarily to attract foreign investments and to strengthen the dollar reserves of the country. This intention was expressly stated in the Executive Order that created the Philippine Retirement System. While the system allows foreign nationals to retire indefinitely in the Philippines, it has to achieve its main purpose by requiring a minimum investment in the Philippines and that is in the form of a visa deposit, which in some cases can be converted to investments in Condominium, Long Term Lease or Golf Club. To make the retirement program more attractive, the PRA has designed some additional benefits to SRRV as I have discussed in the video. Stay safe. 😊

    • @YourLawyer

      That is correct. It is important for the government to ensure that the retirees who are coming to the Philippines have the financial capacity to sustain their needs and not to be a burden to the Philippine government. Also, one reason why the Philippine government is promoting the Philippines as a retirement destination is to help the country’s economy through the dollar inflow.

      I find the IRONY of countries like Philippines that do NOTHING for their people, that have NO practical social safety net in place and that let's a majority of its subjects languish in poverty... "prove financial stability". There is NO "burden" on the PH government if a foreigner goes broke or gets hurt...NONE (so that's a cop-out excuse).
      They want people they can charge fees to...and to help prop up their artificial economy. It's typical government overreach.
      I've supported a Filipina for a decade... and the paid for EVERYTHING she needed (she was in abject poverty and an orphan). And the government pretends like it OWNS HER, yet did NOTHING for her, EVER!... not even allowing her freedom to travel (unless I PAY through the nose)
      ....I hate government... ALL of em 🎯

    Be carefull guys you can get the visas but the process will suck and dry up your pockets. After you get the visa its not like other countries, since everytime you exit the Philippines you need to pay exit fees, annual fees, security fees, etc. Which is the 1950's law. Which will add to your expenses and regret it. Also the foreign countries should have a reciprocal agreement to levy the same charges for exit purposes for Filipinos who have working and permanent visas, in Europe and the USA, which would be fair to all.

      Hi. Hindi nyo po kailangan ng deposit. Dual citizenship is allowed by Belgium, so pwede po kayo mag apply maging dual citizen (PH/ Belgium). As dual citizen, you can live forever in PH. Kung ayaw nyo po maging dual, pwede po kayo mag apply ng 13G visa para maging permanent resident ng Pinas. Pwede rin kayo mag retire sa Pinas non, pero may annual reporting sa Bureau of Immigration kc considered as foreigner pa rin kayo. Pag 13G, hindi po pwede kumuha ng senior citizen ID at di pwde sa senior benefits sa Pinss. Pag dual citizen, pwede kumuha ng senior ID at pwede sa benefits.

I have married a beautiful lady, last year, have brought land with her, the value of over 4M. If I apply for the srrv, do I still need a deposit of money into a bank account in trust, or does the money that I have spent in buying the land count for this?
    Regards. John
